More on the Denton experience with marijuana decriminalization

A long story from the Dallas Observer.

Nick Stevens stood before the Denton City Council looking equally frustrated and determined. The activist had helped to lead the grassroots charge to decriminalize marijuana in the North Texas college town. Now he was there to defend Proposition B, which more than 71% of the city’s voters had supported in a high-turnout November vote.

Stevens and other activists with the group Decriminalize Denton had fought hard to pass one of the state’s first ordinances to decriminalize low-level marijuana offenses, but they received bad news the day after the election. Denton officials announced in a Nov. 9 memo that the city “does not have the authority to implement” some of Prop B’s provisions.

Facing council members during the Feb. 21 meeting, Stevens emphasized that even if they didn’t personally like the ordinance, they should still respect the will of Denton voters.

“That’s what being a representative is all about,” Stevens said. “It’s about listening to your constituents.”

Decriminalize Denton blasted the ordeal over Prop B as an “attack on democracy” in a press release. Advocates point to other Texas cities such as Austin that have implemented near-identical measures. Voters in San Marcos, Elgin, Harker Heights and Killeen similarly approved decriminalization during the midterm elections. But others have argued that the merits of the ordinance aside, the city of Denton’s hands are tied.

Prop B would mean, in part, that police could no longer issue citations or execute arrests for misdemeanor quantities of marijuana, except under certain limited circumstances. It would also bar law enforcement from using the “smell test,” meaning the scent of weed couldn’t serve as an excuse for search or seizure.

City Manager Sara Hensley explained during the Feb. 21 work session that Denton doesn’t have the authority to implement the parts of Prop B that run afoul of state law. She noted in her presentation that from Nov. 1 to Jan. 17, local officers made 52 citations and/or arrests related to pot or paraphernalia. (Prop B advocates have asked to see the demographic makeup of this, as did the Observer, but the police department didn’t respond to the request.)

Hensley argued that the Texas Code of Criminal Procedure, which mandates that police enforce state law, essentially supersedes the proposition. Denton’s police chief further vowed that the department would continue to make minor marijuana offenses a low priority.

To Deb Armintor of Decriminalize Denton, though, hearing the number of arrests and citations was “infuriating.”

“This is what they call ‘low priority’?” Armintor, a former Denton City Council member, told the Observer. “This is business as usual.”

Another local marijuana advocate spoke at the February meeting. Eva Grecco described how she went out day after day to gather enough signatures to place Prop B on the ballot. Many seniors can’t afford to spend thousands of dollars on medications each month, she said, and marijuana is a viable alternative.

“‘The times, they are a’changing.’ I am a mother. I am a grandmother. I am a great-grandmother,” Grecco said. “I myself do not smoke marijuana, but I fought very hard for this Proposition B to pass.

Grecco also tried to appeal to the council by noting that some members are themselves parents: “The more you fight the will of the people, these are the things your children will remember in the future.

“I’m just really angry — angry that all this time has gone by and certain members of this council and city manager have refused to listen or comply with the will of the people,” she continued. “Whether you like it or not, your personal choices do not matter. We do not vote for any of you for your personal choices.”

Grecco, Stevens, Armintor and the rest of Decriminalize Denton aren’t alone in their vexation. Some of the city’s voters have reported experiencing déjà vu. The battle over Prop B in uber-conservative Texas isn’t the first time that their voices have been muted following a landslide vote.

”The progressive group Ground Game Texas partnered with advocates in Denton and other cities to help lead the decriminalization campaign. Mike Siegel, the group’s co-founder and general counsel, agrees that Prop B is enforceable. City councils in Texas often adopt ordinances that may face legal challenges, he said, but they can press on until a judge tells them otherwise.

“You can see how the city manager is disrespecting the people as policymakers, even though the Texas Constitution and the city charter of Denton guarantees the people the policy-making rule,” he said. “Because the city manager is treating the people’s vote as something less than our regular city council vote, and that’s not how it should be under the law.”

The way Siegel sees it, voters should have been advised of legal risks prior to hitting the ballot box, but afterward? “Once they voted, that should be respected like any other ordinance in the city code.”

Denton City Council member Jesse Davis said the council has known for a long time that much of the measure is incompatible with state law. Davis told the Observer that parts of the ordinance, like the budgetary provisions, can’t be enacted by referendum. “Otherwise, you’d have people voting on referendums like: The tax rate is zero, the city budget only goes to fix the streets in my neighborhood,” he said.

City council members can’t simply ignore that Texas law exists and they can’t tell the police which rules to enforce, Davis said. But members are ready to focus on what they can do moving forward instead of what they can’t.

The democratic process isn’t just polls and referenda and headcounts; it includes representative democracy, Davis said. Each city council member was elected by the people, and each took an oath to uphold the laws of the U.S. and state constitutions.

Davis said a number of his constituents have contacted him about Prop B.

“I had to have some frank conversations with them about where we fall in the hierarchy of legislation,” he said. “And I’m very frustrated by some folks out there in the community who know better, or should know better, [who are] misleading people about our role in the scheme of laws and statutes in the state of Texas.”

Davis will face a recall on May 6, the same day he’s up for reelection, after detractors circulated a petition that partly claims he’d ignored “the will of over 32,000 Dentonites” when it comes to the ordinance. He contests that assertion as “factually inaccurate” and said he’s confident that voters will cast their ballot based on his record.

See here for the background. The story mentions that this isn’t the first time that Denton activists passed a ballot referendum that ran into resistance. This is a reference to the Denton fracking ban of 2014, which was challenged in court before it was implemented and subsequently nullified by the Legislature. This case is a little different in that the ordinance was implemented but not fully, with the argument being over how much of it can be done. There isn’t litigation yet (at least not in Denton) but there is a request for an AG opinion, and I have to believe that the Lege will weigh in, given their utter hostility to local control.

Anyway. I believe both sides here are arguing in good faith. I get everyone’s frustration. Ultimately, this is a state problem, both in terms of how marijuana is handled legally and in how much ability cities have to govern themselves. The solution has to be at the state level as well. I just don’t see any other way forward, given where we are. It will not be easy. There is no easy way. I wish there were.

AG argues for separating that San Antonio criminal justice reform proposition into multiple questions

Not a surprise, but an aggressive position to take.

Attorney General Ken Paxton’s office is urging the Texas Supreme Court to side with opponents of a proposed charter amendment that seeks to decriminalize marijuana and abortion, as well as enact a host of other police reforms.

Solicitor General Judd Stone submitted a letter to the court Wednesday calling the proposal a “grab-bag of provisions” that “flagrantly violates” a state law prohibiting multi-subject charter amendments.

Stone urged the court to grant a petition filed by the anti-abortion group Texas Alliance for Life Inc. (TAL) requesting that the city reject the proposed ballot language, and instead require a vote on each provision individually.

“While the substance of this proposed charter amendment conflicts with multiple substantive provisions of state law, this mandamus proceeding concerns a procedural problem: the charter amendment plainly violates Texas law’s longstanding prohibition on municipal charter amendments that ‘contain more than one subject,’” Stone wrote.

City Attorney Andy Segovia told reporters last week he believed most of the charter amendments’ provisions were at odds with state law and therefore unenforceable by the city even if they’re approved by voters.

Stone’s letter agreed with that assessment and accused San Antonio officials of “abuse[ing] their discretion by certifying and including this charter amendment on the ballot.”

In a written response to TAL’s petition Tuesday, Segovia defended his decision to place the amendment on the ballot as written because city officials “plausibly read the proposed charter amendment language to encompass only ‘one subject’ as required by statute.”

Segovia added that opponents should challenge the validity of the amendment after the election, not before.

Stone’s letter disagreed, and asked the Texas Supreme Court to take swift action against the proposal in its entirety. He suggesting the court has long favored stopping such charter amendments before they’re voted on, something that’s still possible if it can prevent San Antonio from including it on the ballot this week.

“When there is an opportunity to correct a ballot before the election, waiting to address the issue through a post-election contest and, potentially another election, is not an adequate remedy,” Stone wrote. “Because respondents can correct the ballot now, [TAL’s] mandamus is appropriate.”

See here for the background. I still think, based on past history, that SCOTx would prefer to not get involved at this time, but I’m somewhat less confident of that now. Both sides of this argument are defensible, so it really is a question of whether SCOTx wants to step in now or just wait for the inevitable lawsuit later. For sure, if this passes it will be a quick matter before they have to rule on a temporary restraining order one way or the other about enforcement. Breaking it up into its components means there will be multiple lawsuits instead of one. I don’t know what they’ll do, but as I said before, we’ll surely find out quickly. San Antonio City Council approved it for the ballot as is, which was also as expected. Now we wait to see what if anything SCOTx does. The Current has more.

San Antonio marijuana decriminalization referendum already facing a legal challenge

Don’t think this one will work, but after that who knows.

Opponents of the so-called Justice Charter have filed an emergency petition asking the Texas Supreme Court to require separate votes for each of its provisions, including decriminalizing marijuana and abortion and banning police chokeholds and no-knock warrants.

Progressive groups last month submitted roughly 38,000 petition signatures to get the proposed charter amendment included on the May municipal election ballot, a move San Antonio City Attorney Andy Segovia signed off on last week.

On Friday the anti-abortion group Texas Alliance for Life Inc. (TAL) filed a petition requesting that the city reject the proposed ballot language, which it says violates a state law prohibiting multi-subject charter amendments, and require each issue to be listed and voted on separately.

“Respondents have no discretion to force voters to approve or reject, all or nothing, charter provisions dealing with issues as varied as theft, graffiti, or prohibiting cooperation with state agencies regulating abortion providers,” wrote attorney Eric Opiela, a former executive director of the Republican Party of Texas.

City Council is expected to order that the ballot proposition appear on the May 6 ballot Thursday, a formality they don’t get to exercise judgment over. The deadline for setting the May ballot is Friday.

“Once Friday’s deadline passes, it is impossible for Respondent, San Antonio City Council to add additional measures to the May 6, 2023, ballot, preventing the separation of the proposed charter amendments into their separate subjects as required by law,” Opiela wrote.

“The tens of thousands of residents who signed this petition understood that each of these police reforms are part of a comprehensive approach to public safety, and we expect to vote on them in the same way they were presented — as one unified package,” Act 4 SA Executive Director Ananda Tomas said in a statement Sunday night.

Segovia said the city would defer to the amendment’s authors.

“We have until noon on Tuesday to respond to the Texas Supreme Court. Our position remains that the Council will put the petition on the ballot as one Justice Policy proposal because that was the way it was presented to those who signed the petition,” Segovia said in an email Sunday.

See here for the previous entry. I Am Not A Lawyer, but I don’t know offhand of any successful recent efforts to split up a ballot proposition like this. These are all criminal justice reform measures, and if the law is usually interpreted broadly then I don’t think there’s a leg to stand on. I also think that SCOTx would prefer to wait until the voters have their say, as then they have a chance to duck the question. If they’re going to act I’d expect it to happen before SA City Council votes to put the measure on the ballot on Thursday. So we’ll know soon enough. TPR has more.

Marijuana decriminalization and other police reform proposals get closer to the ballot in San Antonio

This will be the most interesting election on the May ballot.

A proposed City Charter amendment that seeks to ban police from using no-knock warrants and chokeholds, as well as expand the city’s cite-and-release policy for low-level, nonviolent crimes, has enough certified signatures supporting it to appear on the ballot in San Antonio’s May municipal election.

However, City Attorney Andy Segovia told reporters Wednesday the most of the provisions are inconsistent with state law and could not be enforced if even if they’re approved by voters.

Segovia said that if the amendment is approved, the city would not be able to make any other changes to its charter until the November 2025 election, thanks to a state law restricting the frequency of charter amendments. Mayor Ron Nirenberg had been assembling a charter review committee to explore other potential changes in the coming year.

As written the proposal, called the Justice Charter by its proponents, would ostensibly eliminate police enforcement of certain levels of marijuana possession, eliminate police enforcement of abortion-related crimes. It would also ostensibly ban the use of chokeholds by police, ban the use of no-knock warrants, create additional requirements to obtain a search warrant, and remove the officers’ discretion in whether to issue a citation or arrest for some low-level crimes.

With the exception of one provision calling for the creation of a city justice director, Segovia said the proposal’s elements “are all inconsistent with state law.”

“Therefore, even if the public does adopt the charter amendments, the charter amendments as written will not be enforceable,” he said.

Mike Siegel — co-founder of progressive group Ground Game Texas, which backed the proposal — told the Express-News that the Texas Constitution grants municipalities the right to so-called “home-rule” authority.

Ground Game Texas championed a similar proposal approved by Austin voters last May that decriminalized weed in that city. Months later, Texas Attorney General Ken Paxton has yet to sue to stop it.

“We know that Ken Paxton loves to sue Austin, loves to make an example of Austin elected officials and has not done so,” Siegel told the daily. “And to me, that’s the strongest indication that the state attorney general himself has determined that cities do have this discretion, that it is firmly grounded in the home-rule authority that’s guaranteed by the Texas Constitution, and this is something that cities can decide for themselves.”

Well, sure, but the Republicans in the Lege, as well as the state courts, have not been shy about limiting cities’ authority in various matters, so I don’t know how confident I’d be in that position. For sure, if this passes, it will be litigated, and there is the possibility of a pre-emptive bill being passed against this even before then. Again, I want to stress, the goals that Act4SA and Ground Game Texas are advocating are good and laudable and I support them. I just don’t think this is going to work, and I have zero reason to believe that the Republicans will just let this slide if it passes. Restraint and tolerance for any kind of dissent are not in their playbook. I hope I’m wrong, and I’m confident we’ll find out if this does pass. San Antonio will vote on marijuana decriminalization

We’ll see how it goes.

Progressive groups celebrated on the steps of City Hall Tuesday afternoon before delivering the boxes of signed petitions needed to get a measure in front of voters that would decriminalize both cannabis possession and abortion.

Ananda Tomas, executive director of police reform group ACT 4 SA, told reporters that her group and its allies collected 38,200 signatures in favor of the San Antonio Justice Charter. That’s well above the roughly 20,000 required to put it on the ballot for May’s citywide election.

If passed, the charter also would codify the ban the San Antonio Police Department’s current leadership has placed on police chokeholds and no-knock warrants.

“I’ve been frustrated working within the system and working in City Hall to try to get things like this done,” District 2 City Councilman Jalen McKee-Rodriguez told charter supporters. “I think this is a demonstration that when the people will it, it will happen.”

Although the petition garnered support from McKee-Rodriguez and an array of progressive groups from around the state, it’s likely to face stiff resistance from others. Danny Diaz, head of San Antonio’s powerful police union, said his organization will work to defeat the measure, which he said ties officers’ hands.

The City Clerk’s office has 20 business days, until Feb. 8, to verify the signatures.

“We’re ready,” City Clerk Debbie Racca-Sittre said inside City Hall as she and a colleague sealed and time stamped four boxes filled with more than 5,000 pages of petition signatures.

City Council will call for the election, which will include council district seats and other local elections, during its Feb. 16 meeting.

Voters will likely see just one item on the May 6 ballot to make the batch of changes to the City’s Charter — but city officials could split them up into separate votes, Tomas said. “The intent is for it to be one single proposition. I think that that’s still going to be a conversation with City Council.”

The charter changes would essentially direct the police department not to spend resources pursuing most abortion and low-level marijuana possession cases.

A provision in the Texas Constitution states that “no charter or any ordinance passed under said charter shall contain any provision inconsistent with the Constitution of the State, or of the general laws enacted by the Legislature of this State.”

Whether the charter rules, if approved, violate that provision may ultimately be left up to legal challenges — but “this is entirely legal,” Mike Siegel, political director and co-founder of Ground Game Texas, told the San Antonio Report.

“Every day, police departments decide what they’re going to enforce and what they’re not going to enforce, and this represents the people of San Antonio saying: these are not our priorities for our scarce public dollars,” Siegel said. “The roots of the Texas Constitution are in local self control [and] self determination. So that’s why we have charter cities that have this authority to adopt their own charters and decide their own laws.”

It will be up to opponents of the charter changes to decide whether they want to challenge it, he said.

I would expect this to pass, as similar referenda has done in other cities. Whether it will get a similarly chilly reception from City Council or Commissioners Court remains to be seen. Unlike some other counties, the Bexar County District Attorney is on board with the idea, as noted in this Texas Public Radio story, so they have that going for them. On the other hand, the Lege is out there as well, with a giant hammer to wield against cities and counties that do things the Republicans don’t like. Sometimes I don’t necessarily mind Houston being a bit behind the activism curve. If six months or a year from now this ordinance is in place and being complied with, I’ll be delighted and looking to our city to follow suit. If not, I’ll be disappointed but not surprised. Stay tuned.

Election 2022 miscellania: Marijuana, Austin Mayor, CRT

Three items of interest for you. First up, several local initiatives to decriminalize marijuana were successful on Tuesday.

By the end of Election Day, five Texas cities have voted to decriminalize low-level marijuana possession.

After Austin voters overwhelmingly approved the proposition to decriminalize carrying small amounts of marijuana in May, Ground Game Texas — the progressive group behind that effort — successfully worked with local organizations and pushed for similar measures to appear on the ballots of Denton, San Marcos, Killeen, Elgin and Harker Heights for the midterms cycle.

Voters in these cities have now shown strong support for the proposals at the polls.

The campaign saw the highest level of support in San Marcos — home to Texas State University — with nearly 82% of the votes. Denton, which has several university campuses, saw more than 70% of the votes backing the proposition.

In Killeen, known for its proximity to military base Fort Hood, close to 70% of voters approved the proposition. Elgin, just outside of Austin, saw almost 75% of votes in support of the reform. And on the low end, more than 60% of voters in Harker Heights in Bell County casted ballots in favor of decriminalizing marijuana.

“These meaningful reforms will keep people out of jail and save scarce public resources for more important public safety needs,” said Mike Siegel, political director of Ground Game Texas and a former Democrat congressional candidate. “We’re extremely happy with our results.”

Like Austin’s ordinance, the successful propositions establish city ordinances that end low-level enforcement, including citations and arrests for possessing less than four ounces of marijuana and related drug paraphernalia, in most cases. They also largely ban using city funds and staff to test substances for THC, the cannabis plant’s chemical that gets users high.

Ultimately, Ground Game Texas hoped to use the campaign to boost turnout, especially among young voters.

“We wanted to use workers, wages and weed to engage new voters,” Siegel said.

Looking ahead, Ground Game Texas will continue working with on-the-ground groups to place progressive measures on local ballots. They aim to put the measure along with several other propositions, including abortion decriminalization, in front of San Antonio voters in May 2023. And similar efforts are likely to pop up in other big cities like Dallas, Fort Worth and Houston in the 2024 elections, Siegel added.

“We’re hoping that we can prove not only that these issues are popular, but they also boosted turnout in the communities that are on the ballot,” he said. “And in the days following this election, we’re going to be having lots of conversations with folks about the next cycle.”

See here for some background. As noted there, I’m not sure what the practical effect of this will be, and I worry about legislative backlash just because that’s the world we live in now. I’ll be very interested to see if there is any evidence that this drove turnout, because Lord knows we could have used more of it if it did. And while I’m glad to see that there’s interest in bringing this to Houston, please remember that we already have several charter amendments on the ballot next year, which means either this would have to happen then or you’ll need to wait until at least 2025, since there’s a mandatory two-year wait after a successful charter amendment election. Hope y’all are already engaging with folks here about this, Ground Game Texas, so there are no unpleasant surprises for anyone.

Item two: There will be a runoff for Mayor of Austin between two familiar faces.

Austin’s next mayor was not decided Tuesday, as a tight race between Celia Israel and Kirk Watson will continue into a runoff in December.

To win the race outright, a candidate would have had to earn more than half of all votes as of Tuesday. Israel took 40% and Watson 35% of the vote, according to final but unofficial results. They were separated by more than 15,000 votes.

Jennifer Virden, the only other candidate who conducted a significant campaign, earned 18%.

Three other candidates received limited support. Phil Brual received 2%, and Gary Spellman and Anthony Bradshaw each received 1%.

In total, 304,000 votes were recorded.

Heading into the day, political insiders who analyzed the election said they expected the race to go to a runoff, as voters seemed split between Watson, the former Austin mayor and state senator, and Israel, a sitting state representative. Although Watson outraised Israel $1.3 million to $409,000, it was Israel who enjoyed momentum heading into Tuesday with recent endorsements from the American-Statesman and the Austin Chronicle.

I don’t have a dog in this fight. I like both of them and wish the eventual winner all the best.

Ground Game Texas

This is good, too.

Some of Democrats’ biggest regrets about the 2020 election in Texas had to do with organizing. It was not consistent throughout the cycle — and usually isn’t in any cycle. It was supplanted by TV ads at the end. And it was hampered by the coronavirus pandemic.

Now, with the backing of the state’s most prominent Democrats, two former congressional candidates are trying to turn those regrets into action.

The candidates, Julie Oliver and Mike Siegel, are launching a new nonprofit called Ground Game Texas that will focus on year-round organizing on progressive issues, aiming to fill what they see as a statewide void for their party. The group starts off with a $1 million investment from Register2Vote, a national nonprofit that the two already help lead.

“There’s no off years and there’s no off cycles, and folks need to stay engaged year-round,” Siegel said in an interview, adding there is “kind of a tendency among Democratic activists” to get involved only in presidential-election years or high-profile down-ballot contests like the 2018 U.S. Senate race. “The Republican Party doesn’t do that. They never stop.”

Ground Game Texas will organize Texans around issues rather than candidates, with a focus on what Siegel and Oliver are calling “workers, wages and weed” — issues like raising the minimum wage and legalizing marijuana that poll well but are not reflected by Republican policymakers in the state. A February University of Texas/Texas Tribune Poll found that 60% of registered voters in Texas support legalizing some amount of marijuana for any use. A similar number in April expressed support for increasing the federal minimum wage.

The group expects to throw its weight behind local ballot initiatives, which often involve a lot of ground work such as collecting signatures for petitions to put the issues on a ballot. Siegel said he has already had conversations about proposals in 10 cities — places like Mission, Bedford and Elgin. The leading ideas there, he said, are decriminalizing marijuana and creating funding for climate jobs.

Ground Game Texas is launching with the support of three of the best-known Texas Democrats: Julián Castro, Wendy Davis and Beto O’Rourke, who said in a statement that the new group “is going to meet Texans where they are at to listen to them about the issues that matter most.” And it starts with an advisory board that includes Davis; rising-star state Reps. James Talarico of Round Rock and Jasmine Crockett of Dallas; and longtime party stalwarts such as former Agriculture Commissioner Jim Hightower and Texas AFL-CIO president Rick Levy.

The advisory board additionally features Democrats who ran in nationally targeted districts last year and suffered some of the toughest losses, like Candace Valenzuela, who narrowly lost to now-U.S. Rep. Beth Van Duyne, R-Irving.

Both Oliver and Siegel have firsthand experience with the challenges Democrats faced last election cycle. They both performed surprisingly well when they ran against Republican incumbents in 2018 — Oliver against U.S. Rep. Roger Williams of Austin and Siegel against Rep. Michael McCaul of Austin. In 2020, both ran again, only to lose by larger margins.

In 2020, both gained the backing of the Democratic Congressional Campaign Committee, which named them to its Red to Blue program for promising challengers. But they remain skeptical of the committee’s priorities.

“[The DCCC] doesn’t really invest in this sort of infrastructure building that Mike and I did in our campaigns,” Oliver said. “That strategy is so different between the DC strategy and the Texas strategy. … The DC strategy doesn’t really work here in Texas, so we want to do year-round organizing.”

The DCCC announced Monday that it was including Texas in an initial seven-figure investment nationally in on-the-ground organizing, calling it the “earliest ever organizing investment of this scale and scope in DCCC’s history.” The committee said it would target areas in Texas such as Dallas, Houston and the Rio Grande Valley, where Democrats notably underperformed last year.

As I’m sure you can guess, I approve of the issues they are focusing on. I very much think there’s ground to be gained by pushing real marijuana reform, and by “reform” I mean decriminalization, if not legalization. People across the board want it, and the single biggest impediment to it is Dan Patrick. I’m more skeptical of raising the minimum wage as a winning issue – note that the polling question is about whether one supports raising the federal minimum wage, not whether one supports raising the minimum wage in Texas – but am happy to push the idea. I trust that the focus on local ballot initiatives is a starting point, because that’s not going to get very far and any success they have is certain to wind up in court, if not in legislative pushback.

Putting emphasis on organizing when three’s not an actual election going on is a good and long-needed idea as well. Lots of people complain that no one talks to them about issues and what’s important to them outside of a “please vote for me” context, so this addresses that gap. We may find out that a lot of these people prefer being left alone most of the time, but there’s no way to know until you try. The bigger point here is that by having this kind of campaign infrastructure be year-round, you’re not having to rebuild from scratch every other year.

We’ve certainly seen various initiatives, promising various kinds of new engagement, come and go over the years. I’m sure that no matter what happens in 2022, in two years’ time I’ll be reading about yet another new effort to organize and engage and register. That’s fine, and it doesn’t mean that what came (and possibly went) before now was wasted or useless. We’ve had to try a lot of things, and to see what works and what doesn’t, we’ve learned from past experiences, and we have made a lot of progress even if the statewide breakthrough hasn’t happened yet. It would be much more concerning to me if we weren’t seeing new efforts like this, spearheaded in part by new additions to the political team, popping up and making news. We all have options for how we want to get involved now. Find the one that works best for you and get into it.

I’m not going to spend too much time on this since all these races are over and we know what happened, but a few observations:

– I don’t know what Hank Gilbert has planned for that $233K he has left over, but I hope he intends to do something with it. We’re going to need some dough in a lot of races next year.

– I’d like to see an autopsy done on how all this money was spent. It was a weird year, and a lot of money that would have been spent on field wound up going to other uses, so maybe it will be hard to draw meaningful conclusions, but still. I have no doubt that some candidates spent their money better than others, and that some candidates had much higher overhead costs than others. We should get a better picture of what happened here.

– I say that because I think the 2020s are much more likely to have multiple competitive races throughout the decade, in a way that we didn’t in the 2010s. If so, we’re going to see a much higher baseline of campaign contributions overall than what we were used to. So again, let’s have some confidence that our candidates and their campaigns are spending it well.

– MJ Hegar got off to a slower start than Beto did in raising money for her Senate campaign, but almost $30 million is real money, enough to run a credible statewide race. We’re going to need that kind of money for at least a couple of our statewide candidates next year.

– The 2022 Congressional campaign is going to be much more compressed than the last few have been, since we won’t know until this fall what the districts look like, and that’s without taking any litigation into account. Who even knows when we’ll begin to see potential candidates make themselves known?

That’s about all I have. I’ll check the Q1 2021 reports to see who’s raised what for the May 1 CD06 special, and we’ll see what if anything is interesting after that.

These totals are just off the charts. Remember how in the 2018 cycle I was freaking out as one candidate after another topped $100K? Here we have nine challengers to incumbent Republicans that have topped one million, with the tenth-place challenger still exceeding $500K. For that matter, nine out of those ten outraised their opponents in the quarter, though several still trail in total raised and/or cash on hand. I’ve run out of synonyms for “unprecedented”. All this is without accounting for DCCC and other PAC money being spent. Who could have imagined this even as recently as 2016?

The one question mark is with the incumbent Dems, as both Rep. Lizzie Fletcher and Rep. Colin Allred were outraised for the quarter. Both took in over $1.2 million apiece, so it’s not like they slacked, and they both maintain a cash on hand lead while having spent more. I don’t know what to make of that, but I’m not terribly worried about it. Republican money has to go somewhere.

MJ Hegar raised $13.5 million this quarter, and there’s some late PAC money coming in on her behalf. I wish she had been able to raise more earlier, and I wish some of the excess millions that are going to (very good!) Senate candidates in much smaller and less expensive states had come to her instead, but she’s got what she needs to compete, and she’s got a competitive race at the top of the ticket helping her, too. We don’t have a Senate race in 2022, and someone will get to run against Ted Cruz in 2024. All I can say is I hope some folks are thinking about that now, and taking some initial steps to build on what Beto and MJ have done before them.

I don’t have a whole lot to say otherwise, because these numbers speak for themselves. I mean, remember when we were a little worried about the ability of candidates like Lulu Seikaly and Julie Oliver and Donna Imam to raise enough money? Seems like a long time ago now.

Let me end with a thought about the future. Will what we saw in 2018 and 2020 carry forward? 2022 is the first post-redistricting election, so with new districts and the likelihood of some open seats, there should be plenty of action. We did see a fair amount of cash being raised in 2012, after all. If there are many more Dem incumbents, it’s for sure there will be more money flowing in. We’ll have to see how many competitive races there are beyond that. What I do know is that we have definitively proven that this can be done, that quality candidates can be found and they will be supported. We had the power, and we figured out how to use it. Hard to believe that will go away.

The overlooked Congressional race

There are ten Congressional races involving Republican-held seats that are seen as competitive. Nine of them have gotten a fair amount of attention. The tenth is CD06, and the Texas Signal steps in to fill the gap.

Stephen Daniel

The race in the Texas sixth congressional district between challenger attorney Stephen Daniel and incumbent Rep. Ron Wright has been chugging along, under the radar from other clashes in the state. However, many pundits have looked at the district, which includes parts of Arlington, as well as Waxahachie and Corsicana, and have proclaimed it’s a sleeper for flipping, something Daniel himself sees in the final weeks of the campaign.

In 2018, Jana Lynne Sanchez ran for the seat. It was the first time in years a serious Democratic challenger had entered into the race. In the documentary film Surge, which recently premiered in Texas at the Dallas International Film Festival and is airing on Showtime, filmmakers chronicle the battle Sanchez endured to raise money and to get people interested in a race many deemed out of reach.

Sanchez came within seven points of Wright. Two years later, several polls are showing an even tighter race between Daniel and Wright, a combative Texas conservative and the former Chief of Staff to Rep. Joe Barton, who retired from the seat after explicit photos appeared on social media. Wright was recently hospitalized after complications from lung cancer treatment.

Wright has said that women who have abortions have committed murder and should be jailed. As a former columnist for the Fort Worth Star-Telegram, he said that “white males are the only species without some form of federal protection.” Like most Republicans in Congress, he supports dismantling the Affordable Care Act. Texas currently leads the nation in the number of uninsured, and since the COVID-19 pandemic, more than 650,000 Texans have lost their health insurance.

Access to healthcare prompted Daniel to enter into the race against Wright. In an interview with the Texas Signal, he spoke about his background growing up in a small town and being the first person in his family to go to college. “There’s a lot of people who flat out can’t afford healthcare,” said Daniel.

Like every campaign, Daniel and his team had to adjust to the pandemic era. He misses the in-person experience of block walking, where he could personally connect with voters. He particularly enjoyed campaigning alongside statehouse candidates. There are five competitive races in the sixth congressional district. Now, that campaigning has moved to Zoom and other virtual settings.

Daniel is optimistic. “The path to turning Texas blue goes through Texas sixth [district],” he said. Nearly seventy percent of the voting bloc in the district is in Arlington and Tarrant county. He sees firsthand how voters in the district are changing. The DCCC recently added the race to their Texas target list.

There was one poll of this race, done by the DCCC back in June, that had Wright up by four points, 45-41. The DCCC Executive Director mentioned CD06 as a race to watch a couple of weeks ago, for whatever that means. Daniel has been a modest but decent fundraiser who would need some help to get a boost. (I have not heard anything about his Q3 report as yet.) I should note that Beto lost CD06 by a 51.2 to 48.0 margin, which made it closer than the more-touted CDs 03 (51.3 to 47.9) and 25 (52.1 to 47.0), with that pattern holding true for other races as well. I don’t know exactly why CD06 has gotten less attention than the other races – Daniel was unopposed in the primary, so there hasn’t been much to report on – but that’s the way it is sometimes. However you want to look at it, this is a race to keep an eye on.

On a side note, seven of the ten Democratic candidates in those competitive races are women. Daniel, along with Mike Siegel in CD10, is vying to join Rep. Lloyd Doggett as the white Democratic Congressmen from Texas. I believe the last time there were as many as three white male Democratic members of Congress from Texas was 2009-10, when then-Reps. Chet Edwards and Gene Green were still serving. Nick Lampson had been there in the prior session, in that election where Tom DeLay withdrew and the Republicans ran Shelley Sekula Gibbs as a write-in, but he lost to Pete Olson in 2008. Edwards was wiped out in 2010, and Green retired prior to the 2018 election.

Endorsement watch: Menefee and more

The Chron endorses Christian Menefee for Harris County Attorney.

Christian Menefee was still celebrating his victory in the Democratic primary over longtime incumbent Harris County Attorney Vince Ryan when the coronavirus pandemic changed everything. Lockdowns and social distancing left the 32-year-old civil litigation attorney with a lot of time on his hands.

He used those spare hours well. During the last several months, Menefee told the editorial board, he has researched the inner workings of the department he hopes to run. He studied the office’s organizational charts. He talked to more than 30 current employees. He reached out to the Dallas County district attorney and the Travis County attorney.

That helped give him a solid understanding of the office he seeks and what improvements need to be made, Menefee said.

“You can’t just come in with ideas,” said Menefee, a Houston native who is a litigator with Kirkland & Ellis. “You need to come in with stuff that you know is going to work.”

That kind of energy, attention to detail and determination to make the county attorney office as effective as possible earn Menefee our endorsement. We also recommended him in the primary, noting his commitment to expanding the office’s environmental law section, which currently has four full-time lawyers.

In addition to the bread-and-butter work of representing elected officials, local entities and county employees, Menefee said he wants the office to bring more impact litigation to “hold polluters accountable.”

Menefee also wants the office to be a strong advocate for local control — no small feat, given the control officials in Austin have sought in recent years, including Texas Attorney General Ken Paxton’s recent challenges to the county on vote-by-mail applications and eviction policies.

If you listen to the interview I did with Menefee for the primary, you will definitely hear all of these themes from him. He’s got a lot of potential, and I expect big things.

Next, the Chron heads a bit north to endorse Hank Gilbert in CD01 over the hottest of messes that is Louie Gohmert.

Ever since voters in Texas’ 1st Congressional District sent U.S. Rep. Louie Gohmert to Congress in 2004 by a landslide, it’s been an open question as to how extreme, how divisive and how — there’s no other way to put it — how batty their congressman can get before he’s recalled.

If his electoral successes are any guide, Gohmert is in no danger of being held accountable for his antics, which include most recently refusing to wear a mask unless he got COVID-19 — which he promptly did. His positive diagnosis drew a worried rebuke from his own daughter on Twitter: “My father ignored medical expertise and now he has Covid,” she wrote.

Still, as congressman, Gohmert has never polled less than 68 percent. Time and again, despite a mountain of cringe-worthy examples, Gohmert has emerged stronger after Election Day.

This year, his opponent swears it will be different. “He’s never had a real challenger,” says Democrat Hank Gilbert, 60, a former rancher, high school ag teacher and two-time candidate for Texas agriculture commissioner.

We hope he’s right. The district deserves better than what it’s had these past 16 years. Heck, Congress deserves better.

Here’s my interview with Hank, who is a mensch through and through. No question, Congress and the country would be a much better place with Hank subbing in for Gohmert, but that’s on the voters, and this is a tough district. If you know someone who lives in that district, make sure they know about Hank.

Finally, the Chron endorses incumbent Rep. Mike McCaul for re-election, and while the have good things to say about Mike Siegel, they argue that “trading an accomplished and pragmatic congressman would not serve the district well”. Whatevs.

CD10 poll: McCaul 45, Siegel 43

A new internal poll from the Democratic nominee for Texas’ 10th Congressional District, Mike Siegel, showed the race against Rep. Michael McCaul within just two points.

The poll found a narrowing lead for McCaul, who defeated Siegel by four points in 2018. McCaul holds a 45-43 lead over Siegel with just over two weeks remaining before early voting begins, according to the poll.

The poll was conducted Sept. 21-24 by GBAO Strategies, a progressive polling firm in Washington. The results are based on live phone calls to 400 likely voters with a margin of error of 4.9%.

GBAO Strategies conducted a poll for the Siegel campaign in August which showed McCaul leading by seven points, according to a release. That poll was not made public by the campaign.

I’ve not been able to find any poll data for this, which is not unusual for an internal poll whose topline results were released. The Texas Signal reported that the poll also included a Presidential number, and it has Biden tied with Trump in the district, 47-47. Beto topped Ted Cruz by a tenth of a point in CD10 in 2018, so this is consistent with Trump having a small lead in the state. At this point I’ve seen at least one poll result from most of the targeted districts – I’d love to see one from CD02 but have not as yet – and they have tended to tell a consistent story about the state as a whole. The rest is up to us.

DCCC expands the field in Texas again

This is as wide as it goes.

The Democratic Congressional Campaign Committee is adding three more districts to its Texas target list, expanding an already ambitious battlefield in the state.

The new targets of the House Democratic campaign arm are Republican Reps. Van Taylor of Plano, Roger Williams of Austin and Ron Wright of Arlington. The DCCC is now targeting 10 districts across Texas, or nearly half the GOP-held seats in the state’s congressional delegation.

“Democrats are on offense across Texas, campaigning on access to quality, affordable health care and protections for those with pre-existing conditions,” DCCC spokesperson Avery Jaffe said in a statement. “That consistent message and our 16-month long investment in Texas have put fast-changing districts like these ones in play and Democratic candidates in strong position to deliver in November.”

Taylor, Williams and Wright all won their races in 2018 by margins ranging from 8 to 10 percentage points. However, Beto O’Rourke, that year’s Democratic nominee for U.S. Senate, came closer in each district, giving some Democrats hope that they could come into play this fall with the right candidates and environment.

Taylor is being challenged by Plano lawyer Lulu Seikaly, Wright by Waxahachie attorney Stephen Daniel and Williams by Julie Oliver, who was the 2018 nominee against him and lost by 9 points.

The DCCC’s interest in the races has not been a secret. The committee polled in at least two of them earlier this summer, finding single-digit leads for the Republican incumbents — and dramatic swings in the presidential race in favor of the Democratic nominee, Joe Biden.

Still, the Democrats face an uphill battle. Taylor and Williams have large cash-on-hand advantages, and Taylor has demonstrated significant self-funding capacity. And while Wright is a weak fundraiser, he has the support of the deep-pocketed Club for Growth, which backed him in 2018 and endorsed him for reelection last week, calling him the “right candidate to represent the district and beat his radical liberal challenger, Stephen Daniel.”

As noted before, if Joe Biden really is in position to win Texas or come very close to it, then Dems really are in position to win a bunch of Congressional seats here as well. It’s certainly possible that Biden runs a couple of points ahead of most or all of these Dem challengers, much as Beto did in 2018, with the result that Biden carries several more than are won by the Congressional candidate. The best way to minimize that, and thus maximize the number of seats Dems win, is to boost all of the viable Democratic candidates. It’s true that some of the Dem challengers aren’t in great fundraising shape, but overall the Dems are carrying the day, so maybe the DCCC can afford to spend a bit less on the Wendy Davises and Gina Ortiz Joneses and more on the Lulu Seikalyes. Just a thought. I actually don’t know what this announcement means in real terms – it may mean little more than the DCCC telling its donors who are looking for new places to park their money that these are approved by them – but it should have some positive effect. We’ll certainly know more when the next finance reports are in. In the meantime, let us all pause for a moment and marvel at the realization that the DCCC is playing offense in ten Congressional districts in Texas. Who had that on their 2020 Bingo card?

Abandon ship!

During Troy Nehls’ recent bid for the Republican nomination in one of Texas’ battleground congressional districts, the Fort Bend County sheriff prominently displayed his support for President Trump across his campaign website.

“In Congress, I will stand with President Trump to defeat the socialist Democrats, build the wall, drain the swamp, and deliver on pro-economy and pro-America policies,” Nehls said under the top section of his issues page, titled “Standing with President Trump.”

Within two days of Nehls’ lopsided runoff victory, that section had been removed, along with a paragraph from Nehls’ bio page that stated he “supports President Trump” and wants to “deliver President Trump’s agenda.” Fresh language now focuses on his record as sheriff during Hurricane Harvey and managing the agency’s budget.

Nehls’ abrupt shift in tone captures the challenge facing Republican candidates in suburban battleground districts up and down the ballot, including Nehls’ district and two neighboring ones, where polling suggests Trump’s coronavirus response has alienated voters and, for now, created strong headwinds for his party’s congressional hopefuls.

In those contested districts, which even Republicans acknowledge Trump may lose, GOP candidates are navigating the choppy political waters by emphasizing their personal backgrounds and portraying their Democratic foes as too extreme. Most have dropped the enthusiastic pro-Trump rhetoric they employed during the primaries.

It is not uncommon for candidates to tailor their messages to the far ends of their party bases during the primaries before tacking back toward the center for the general election.

Still, it remains a unique challenge for Republicans in competitive races to distance themselves from the president and his lagging poll numbers without angering their supporters, said Jim Henson, director of the Texas Politics Project at the University of Texas at Austin.

“I think how you do that is still not quite clear, but I also think the ground is really shifting,” Henson said. “(Trump’s) overall favorable-unfavorable numbers are going down, he’s losing ground among independents, and we see glimmers — but just glimmers — of doubt among some Republicans in some suburban areas.”

Hilarious. The story also notes the Republican challenger in CD07, who was endorsed by Trump in the primary but would prefer that you not talk about that, and the CD10 race where Democratic challenger Mike Siegel is working to tie Trump to longtime incumbent Mike McCaul. We’ve seen this movie before, though in years past it had always been Democrats attempting this tightrope act, either by emphasizing their close personal friendship with Dubya Bush or their many points of disagreement with Barack Obama. It worked better in the former case than the latter, as anyone who remembers 2010 can attest.

The main advantage the Republicans running now have is that the districts they’re in are (for the most part, CD07 being an exception) still Republican, at least as of 2018. Those Democrats of yore had been running in districts that were often 60% or more red, and they depended heavily on folks who were willing to split the ticket for them – until they didn’t, of course, which is what happened en masse in 2010. The challenge today is holding onto the folks who had been fairly reliable Republican voters before 2016. Donald Trump (and to a lesser extent his acolytes like Dan Patrick) are the reason these voters are turning away, which is why the strategy of pretending that Trump doesn’t exist is so compelling. The problem with that is that Donald Trump is the Republican Party these days, and the Republican Party is Donald Trump. That presents a bit of a conundrum for the likes of Troy Nehls, himself a longtime Republican officeholder. He may yet win – maybe the district won’t have shifted enough, or maybe enough people will vote for him because they liked him as Sheriff regardless of other factors, or whatever. But I’m pretty sure this isn’t the campaign he thought he’d be running when he first entered the race.

First things first, any worries about fundraising capacity in these brutally awful times have been assuaged. The totals speak for themselves, but let’s go into some detail anyway. Basically, the candidate in nearly every race of interest is ahead of their 2018 pace, often by a lot. Let me put this in another table to quantify:

With the exception of CD31, where no one has come close to MJ Hegar (who as the US Senate nominee may help boost turnout in this district anyway), and CD06, where Stephen Daniel is a pinch behind Jana Sanchez in fundraising (but also a pinch ahead in cash on hand), each nominee is substantially better off this time around. Todd Litton, Joe Kopser, and the original version of Gina Ortiz Jones were all strong fundraisers, and they’ve all been blown out of the water this year. Mike Siegel, Sri Kulkarni, and Julie Oliver have all greatly outpaced themselves. I will maintain that we might have won CD24 in 2018 if we’d had a candidate who could raise money; that’s very much not a problem this year. Lulu Seikaly is well ahead of Lori Burch, who was herself quite a pleasant surprise in CD03.

There are still things to address. Seikaly, Siegel, and Valenzuela all needed to spend a bunch of money in the extended runoffs, and thus need to build up cash with less time to do it. Given their records so far, I’m not too worried about it. Both Jana Sanchez and 2018 Julie Oliver had May runoffs to win, so their modest cash on hand totals were understandable, but Stephen Daniel and 2020 Julie Oliver were both March winners, so I don’t understand why they’ve been spending as much as they have at this point. I hope that isn’t a problem. Donna Imam is not going to approach Hegar’s fundraising prowess, but she alone among the crowd in CD31 seemed to have some capacity for the task, so maybe she’ll at least make up some ground.

The big difference is that there isn’t a juggernaut Senate campaign, which was a boost to downballot candidates in 2018, this time around. On the other hand, we do have a Presidential campaign, which is already airing ads, and we have the DNC airing ads, and we have the DCCC, which has added CD02 to its already-long target list (though they may have dropped CD31 by now). Point being, there will be plenty of other money invested that will help with these races, directly or indirectly.

So overall, a pretty rosy picture, and the financial resources to support the notion that a whole lot of seats are actually in play. Remember how I spent much of the 2018 cycle talking about how there never used to be any Congressional money raised in Texas, outside of CD23? The world is in flames, but that one small part of the Before Times, I don’t miss.

Last but not least, a brief shoutout to Hank Gilbert, playing the part of Dayna Steele in this cycle – a great candidate and a swell human being in an absolute no-hope district against a terrible incumbent who is raising a surprising amount of money. If doing good and being good were all it took, Hank would be in the top tier of next year’s freshman class. Maybe someday we’ll live in that world. Godspeed, Hank.

Dems could possibly win a lot of Congressional races in Texas

It started with this:

You might think wow, that’s a really optimistic take, but after the Tuesday primary runoff, we also got this:

I’d quibble with the categorization of those 2018 contests as “not serious” – all of the candidates raised a decent amount of money that year, and prognosticators had CD10 on their radar by the end of the cycle – but I take his point. And in the replies to that tweet, we got this:

A second Blue Wave in the suburbs?

Well-educated suburban districts, particularly ones that also were diverse, were a major part of the Democrats’ victory in the House in 2018. Democrats captured many formerly Republican districts where Donald Trump performed significantly worse in 2016 than Mitt Romney had in 2012. Democratic victories in and around places like Northern Virginia, Philadelphia, Pittsburgh, Detroit, the Twin Cities, Atlanta, Orange County, CA, parts of New Jersey, and elsewhere came in seats that meet this broad definition.

And then there’s Texas. Democrats picked up two districts there, one in the Dallas/Ft. Worth Metroplex (TX-32) and another in suburban Houston (TX-7). But Democrats put scares into several other Republican incumbents, and the closeness of presidential polling in Texas could lead to unexpected opportunities for Democrats there this November.

Trump has generally led polls of Texas, but many have been close and Biden has on occasion led, like in a Fox News poll released last week that gave him a nominal lead of a single point.

Tellingly, of 18 Texas polls in the RealClearPolitics database matching Biden against Trump dating back to early last year, Trump has never led by more than seven points — in a state he won by nine in 2016. It seems reasonable to assume that Trump is going to do worse in Texas than four years ago, particularly if his currently gloomy numbers in national surveys and state-level polls elsewhere do not improve.

In an average of the most recent polls, Trump leads by two points in Texas. In 2018, Sen. Ted Cruz (R-TX) won reelection over then-Rep. Beto O’Rourke (D, TX-16) by 2.6 points. If Trump were to win Texas by a similar margin this November, the congressional district-level results probably would look a lot like the Cruz-O’Rourke race. Those results are shown in Map 1, courtesy of my colleague J. Miles Coleman.

Cruz carried 18 districts to O’Rourke’s 16. That includes the 11 districts the Democrats already held in Texas going into the 2018 election, as well as the two additional ones where they beat GOP incumbents (TX-7 and TX-32) and three additional districts that Republicans still hold. Those are TX-23, an open swing seat stretching from San Antonio to El Paso; Rep. Michael McCaul’s (R, TX-10) Austin-to-Houston seat; and TX-24, another open seat in the Dallas-Ft. Worth area.

TX-23 is competitive primarily because it’s two-thirds Hispanic, and it already leans to the Democrats in our ratings. TX-10 and TX-24 better fit the suburban mold: Both have significantly higher levels of four-year college attainment than the national average (particularly TX-24), and Republican incumbents in both seats nearly lost to unheralded Democratic challengers in 2018.

Cruz won the remaining districts, but several of them were close: TX-2, TX-3, TX-6, TX-21, TX-22, TX-25, and TX-31 all voted for Cruz by margins ranging from 0.1 points (TX-21) to 5.1 (TX-25). These districts all have at least average and often significantly higher-than-average levels of four-year college attainment, and they all are racially diverse.

In other words, these districts share some characteristics of those that have moved toward the Democrats recently, even though they remain right of center.

This is all a long preamble to an alarming possibility for Republicans: If Biden were to actually carry Texas, he might carry many or even all of these districts in the process. In a time when ticket-splitting is less common than in previous eras of American politics (though hardly extinct), that could exert some real pressure on Republicans in these districts.

Ted Cruz carried 20 districts to Beto’s 16, a minor quibble. Remember this post in which Mike Hailey of Capitol Inside predicted Dems would flip eight Congressional seats? Not so out there any more.

Look at it this way: Since the start of June, Trump has had exactly one poll, out of eight total, in which he has led Joe Biden by more than two points. The four-point lead he had in that poll is smaller than the five-point lead Biden had in a subsequent poll. In those eight polls, Trump has led in three, Biden has led in three, and the other two were tied. The average of those eight polls is Biden 45.9, Trump 45.6, another data point to suggest that Biden has gotten stronger as we have progressed.

Insert all the usual caveats here: Polls are snapshots in time. It’s still more than 100 days to Election Day. Things can change a lot. No Texas Democrat has won a statewide race since 1994, a losing streak to rival Rice football versus UT. (As it happens, the last time Rice beat UT in football was…1994. Coincidence? I think not.) The polls all said Hillary was gonna win in 2016 and we know how that went, smartass. Fill in your own rationalization as well.

The point here is simply this: If Joe Biden actually wins Texas, it could be really, really ugly for Republicans downballot. Even if Biden falls short, it’s likely going to leave a mark on them as well.

2020 primary runoff results: Congress

I’m going to bullet point these just for simplicity. There will be news stories to look at later.

CD03 Dem: Lulu Seikaly cruised to an easy win here. She was just over 60% at around 10 PM, with some Election Day precincts in.

CD10 Dem: Looking good for Mike Siegel, who is leading in Harris and Travis counties, where most of the votes are.

CD24 Dem: This was surprisingly not close, as Candace Valenzuela led early thanks to a big lead in Dallas County, but as of 10 PM she was also leading in Tarrant and Denton. A really hard-fought battle, with Valenzuela gaining a ton of momentum and stepping up her fundraising as the election neared. This is one of those where you might wonder if things would have been different with the runoff in May as originally scheduled.

CD31 Dem: Donna Imam takes it in both Williamson and Bell counties for the win.

On the Republican side, Ronny Jackson in CD13, Pete Sessions (yeah, that guy again) in CD17, Troy Nehls in CD22 (say goodbye to another $8 million, Kathaleen Wall) are all winners. I’m not prepared to all CD23 between Raul Reyes (endorsed by Ted Cruz) and Tony Gonzales (endorsed by Donald Trump). There were other runoffs, but all involving candidates with no hope to win in November, so I’m not too worried about them. The Texas Tribune has a good result tracker for both parties if you want to be a completist.

UPDATE: Tony Gonzales has slipped ahead of Raul Reyes in CD23, but the contest has not been called yet, and Reyes has not conceded.

The progressives and the runoffs

Judging from March, the ideological left wing of the Democratic Party in Texas should be inconsolable.

After months of high hopes, the faction ran into a centrist buzz saw in the March 3 primary. Joe Biden practically locked up the Democratic presidential nomination, and progressive candidates experienced electoral drubbings.

Among the fallen: presidential candidates Bernie Sanders and Elizabeth Warren, congressional candidate Jessica Cisneros, U.S. Senate hopeful Cristina Tzintzún Ramirez, and Audia Jones, a candidate for Harris County District attorney endorsed by Sanders.

But rather than licking their political wounds, leading progressive candidates still in the fight say they’re invigorated — and eager to use the coronavirus pandemic, fights over voting by mail and calls for police reform to score some late victories in the July runoffs.

“Every time we have a progressive run, we get a little bit closer,” said Sara Stapleton-Barrera, who is in a runoff against state Sen. Eddie Lucio Jr., D-Brownsville. “I feel like we’re slowly winning the war, but we have to get through some of these battles first.”

Perhaps the most energy is coming from Austin, where two runoffs have the attention of progressives. José Garza is competing in the nationally watched Democratic primary runoff for Travis County district attorney. Mike Siegel is vying for his party’s nomination in the 10th Congressional District’s Democratic primary runoff.

Garza’s race is where the focus on police reform is arguably the clearest. Even before the death of George Floyd at the hands of Minneapolis police prompted protests nationwide, Garza was challenging incumbent Margaret Moore from the left, arguing she was too harsh in her prosecution of nonviolent offenders. He earned the most votes in March and has promised to bring all police shootings and more police misconduct cases before a grand jury. He has also pledged not to accept campaign contributions from police unions.

Moore, meanwhile, has accused him of being inexperienced with the local criminal justice system and running a campaign focused on national issues instead of local ones.

In the 10th Congressional District, Siegel is running on a platform that includes supporting “Medicare for All” and the Green New Deal. Siegel will face Dr. Pritesh Gandhi, who has cited his medical experience while pitching Medicare Extra, a proposal that does not go as far as Medicare for All and leaves some private insurance in place.

“I think this is the exact moment in history when progressives are in a place to lead, and it’s because the times have caught up the policies we’re fighting for,” Siegel said. “This is the time to run as a progressive. I feel really good not just about my chances, but the movement overall.”

Another runoff that has drawn the attention of some national progressives is the one for the 24th Congressional District, where Kim Olson and Candace Valenzuela are competing to replace retiring U.S. Rep. Kenny Marchant, R-Coppell. The seat is a national Democratic target.

Valenzuela has endorsements like the Congressional Progressive Caucus and Warren, but the runoff has not as sharply split along ideological lines as much as it has on issues of experience and racial identity. Valenzuela, a former Carrollton-Farmers Branch school board member, and her allies are hammering Olson over her time as human resources director for the Dallas Independent School District. Valenzuela and her supporters are also touting that she would be the first Afro-Latina to serve in Congress. Olson is white.

But the divide might be clearest in South Texas, where the winner of the state Senate runoff between Lucio and Barrera will be the overwhelming favorite to win the seat in November.

I’ve said repeatedly that beating Eddie Lucio in SD27 will do more for progressives than beating Henry Cuellar in CD28 ever could have done, because of the relative sizes of the two legislative bodies and the outsized influence Lucio has in the 12-member (for now) Dem Senate caucus. Lucio is terrible, and I’m delighted that that particular race has finally gotten the attention it needs. I think one reason why maybe it didn’t get as much attention earlier is because Sara Stapleton Barrera isn’t necessarily “the” progressive candidate in that race. If Ruben Cortez had finished second, people would be rallying behind him now. This race is much more about Eddie Lucio, and I’d say it’s only now that we’re down to one candidate against him that the race has been viewed through that lens.

As for CD10, I mostly shrug my shoulders. I think Medicare For All is a fine goal to work towards, but Medicare For Those Who Want To Buy Into It is much more easily achieved in the short term, with far less disruption to the existing system and far less resistance from people whose employer-based (possibly collectively-bargained) plan is just fine for them. If we’re lucky enough to have a Democratic Senate in 2021, I think what can get passed by that Senate is what we’re going to get. Will having more pro-Medicare For All members of Congress affect that outcome? Maybe. It’s hard to say. I like Mike Siegel and would vote to give him a second chance to topple Mike McCaul if I lived in CD10, but I think either Siegel or Pritesh Gandhi will be a fine addition to Congress and a major upgrade over the incumbent. Same in CD24, with Kim Olson and Candace Valenzuela, each a good candidate with different strengths and appeals but no major differences on policy.

The race that definitely has the potential to have a big effect is the Travis County DA race, where the ideological lines are clear and the ability for the upstart to make a difference if they win is great, though not unbound. Please feel free to set a good example for the rest of us, Travis County.

As for whether this is another step in a long march towards more liberal candidates and officeholders, I’d say yes, and that we’ve already been on that march for a long time. Ideological sorting is a thing that has been happening for a few decades now. You can see the effect just in recent years – the Democratic waves of 2006 and 2008 included a lot of candidates whose politics included “fiscal responsibility”, support from the NRA, opposition to same-sex marriage, immigration restrictionism, and a host of other views that were very much not shared with the class of 2018. The Democratic Party is a big tent, which means there will always be room for vicious family fights over various issues. Having some number of Never Trumpers inside that tent will just make it all more exciting. It’s fine, and I’d rather be dynamic than stagnant. And every primary and primary runoff, the main emotion many of us will feel will be “thank prime that’s over, now let’s please get on to the general election”. Same as it ever was.

Three runoff stories

Just a sample from three high-profile and highly-contested Democratic primary runoff races.

TX-SEN: MJ Hegar versus Royce West

MJ Hegar

No two issues have impacted the Texas primary runoffs like the coronavirus pandemic and the protests surrounding George Floyd’s death, but as early voting begins Monday, the latter is looming especially large at the top of the ticket.

In the Democratic runoff to challenge U.S. Sen. John Cornyn, R-Texas, state Sen. Royce West of Dallas is hoping to harness the energy of the moment to pull past MJ Hegar on her seemingly well-paved road to the nomination. The former Air Force helicopter pilot has the backing of the Democratic Senatorial Campaign Committee, but West is increasingly seeking to train his party’s attention on the opportunity his candidacy represents, especially now.

“Democrats have got to decide whether they want to continue to be a victim of history or make history,” West said in an interview. With his election as Texas’ first Black senator, he added, Democrats can go the latter route.

Sen. Royce West

West said the “stars have aligned” for him in the runoff, playing to his profile as not only a Black man but also a seasoned legislator who has focused on criminal justice reform, authoring a 2015 state law that aimed to expand the use of body cameras by police in Texas, for example. And he has taken heart in recent primaries elsewhere, most notably in Kentucky, in which candidates of color have ridden the momentum of growing calls for racial justice.

To be sure, Hegar, who is white, has also increased her focus on issues of race and policing, and on Monday, she is holding a virtual news conference with the family of Javier Ambler, a Black man who died last year in the custody of Williamson County sheriff’s deputes. West and then Hegar called for the resignation of the sheriff, Robert Chody, after the circumstances of Ambler’s death came to light earlier this month.

Asked in an interview how she stacks up against West when it comes to meeting the moment, Hegar reiterated her tight focus on the general election.

“I think that you know me well enough to know that I’m running against John Cornyn,” she said, reciting her contrasts with Cornyn. She did argue her November-focused bid means she is already running a “coordinated campaign that is lifting up” down-ballot candidates, including candidates of color.

It should be noted that since this story was written, Amy McGrath has pulled ahead of Charles Booker in that Kentucky Senate primary. You can make whatever you want of the parallels, but the state of that race has changed since original publication. I’m mostly interested at this point in the candidates’ finance reports. Hegar has consistently been the better fundraiser – and I continue to be a little perplexed how a 26-year incumbent like Royce West has had such a hard time raising money (*) – though she’s not exactly performing at Beto levels. Still, with a Presidential race at the top of the ticket, just having enough to get her name out there is probably enough. Hegar is closer to achieving that level of resources than West is, and there’s more promise of national money for her at this time.

(*) – Yes, I’m aware of the claims made that the DSCC has pressured donors to avoid West. This story notes that the person who made those claims has not provided the names of any such donors, so color me a bit skeptical. Certainly not out of the question that this could have happened, but right now the evidence is thin.

CD24: Kim Olson versus Candace Valenzuela

Democratic voters in North Texas’ 24th Congressional District next month will select the candidate — retired Air Force Col. Kim Olson or former school board member Candace Valenzuela — they want to challenge Republican Beth Van Duyne in one of the fall’s most highly anticipated congressional contests.

The decision between Olson and Valenzuela is punishing for many Democrats who see both women as capable of beating Van Duyne, the former Irving mayor endorsed by President Donald Trump. The ultimate goal, Democrats sandwiched between Dallas and Fort Worth have said all year, is flipping the seat that has been occupied by Rep. Kenny Marchant for eight terms.

Marchant is one of several Texas Republicans retiring from Congress this year as the state becomes more competitive for Democrats. Marchant easily won his seat 16 years ago but beat his Democratic opponent in 2018 by just three percentage points. Local and national Democrats see the seat as theirs for the taking and a key component of keeping their majority in the U.S. House.

“We all feel like we’ve been in a holding pattern and we’re waiting for the choice to be made,” said Angie Hetisimer, a Tarrant County precinct chair and member of Indivisible Grapevine, which works to help elect progressive candidates. “I think for me and most of the people I talk to, we just want 24 to flip. Luckily we have two fantastic candidates.”

Given there is little light between Olson and Valenzuela on policy — both fluctuate between moderate and progressive on different questions but would be reliable votes for the Democratic agenda in Washington — the election is largely framed as a decision between Olson’s extensive résumé and Valenzuela’s biography. Olson was one of America’s first female fighter pilots. If elected, Valenzuela would be the first Afro-Latina member of Congress.

Olson was the first prominent candidate in this race and has been the bigger fundraiser, but Valenzuela has also done well in that department and has run a strong campaign. This is a top target for the DCCC, and in my view is the second-most flippable seat in Texas, following only CD23. If we can’t win this one, especially against a xenophobe like Van Duyne, it’s a big miss. I’m fine with either candidate, I just hope everyone involved is able to move on and keep their eye on the prize after July 14.

CD10: Mike Siegel versus Pritesh Gandhi

Democrats in one of Texas’ most expansive battleground congressional districts are choosing between a civil rights attorney embracing the party’s most liberal proposals and a doctor who argues those policies are too radical.

Mike Siegel, the 2018 nominee in Texas’ 10th Congressional District, finished first in this year’s March Democratic primary — about 11 percentage points ahead of Pritesh Gandhi, a primary care physician making his first run for office. Siegel came about 6 points short of winning the primary outright, pitting him against Gandhi in a runoff.

The winner will face U.S. Rep. Michael McCaul, R-Austin, who has represented the district since 2005. His political territory stretches from Austin to the Houston suburbs, covering all of five counties and parts of four others.

Beyond the ideological skirmish, the primary is also serving as a case study in whether the coronavirus pandemic will boost political candidates who work in the medical field. The virus has supercharged the public’s interest in health care and led to national TV appearances for Gandhi, but also stripped him of valuable campaign time as he works a grueling schedule that includes swabbing patients for COVID-19 and caring for those who exhibit symptoms.

It also has reinforced Gandhi’s pitch for sending more people to Congress who work in the health care field.

“People, I think, understand the importance of having a diversity of professional experience in Washington. And if that wasn’t clear before, it’s increasingly clear now,” Gandhi said. “I think that people, when they get to the voting booth, are going to want a leader who has experience and a track record in science and in health.”

Siegel was the 2018 candidate and he ran a good campaign, though he fell a bit short in a district that Beto carried by a whisker. Gandhi has been the stronger fundraiser – indeed, both Gandhi and third-place finisher Candace Hutchison outraised Siegel through April – but as with CD24, I expect whoever the nominee is to do just fine in this department. I know more people who are supporting Siegel in this one, and I do tend to lean towards giving a competent candidate who did a good job the first time around another shot at it, but as with the other races here I’m fine with either choice. I’m ready to get to the November part of this campaign.

Early voting for primary runoffs starts tomorrow

Remember the runoffs? It’s time we settle who our nominees are.

Who can vote in the runoffs?

Texas has open primaries, meaning you don’t have to be a registered member of either party to cast a ballot in a primary runoff. You can check your voter registration status here. But you can only vote in one party’s primary, and which one might depend on how you voted in the first round of the primaries in March. People who voted in the March 3 primary are only able to vote in that same party’s runoff election, as they have affiliated themselves with that given party for that calendar year. Those who did not participate in the March primary are able to vote in either primary runoff election.

What’s different this year?

The primaries were originally scheduled for May, but Abbott delayed them until July because of the coronavirus. Abbott also doubled the length of the early voting period for the July primary runoff elections in a move to aimed at easing crowds at the polls during the pandemic. Early voting runs from Monday through July 10.

“It is necessary to increase the number of days in which polling locations will be open during the early voting period, such that election officials can implement appropriate social distancing and safe hygiene practices,” Abbott wrote in a May proclamation.

They had endorsed Royce West for Senate in March, and they reran that endorsement on Saturday. (UPDATE: They reran their endorsement of Michael Moore for Commissioners Court, Precinct 3, this morning.)

Also on the ballot for this election: the special election in SD14 to succeed Kirk Watson. I have interviews with the two candidates of interest, Rep. Eddie Rodriguez, and former Travis County Judge Sarah Eckhardt. Please give them a listen if you live in this district. I expect this will go to a runoff, which I hope will not need to endure a delay like the May elections did.

All the elections for July 14 are important, but just as important is that this will serve in many ways as a dry run for November, both in terms of handling a higher volume of mail ballots and also in terms of making the in person voting process as safe as it can be in this pandemic. I was on a conference call a week or so ago with a national group, the Voter Protection Corps, which presented a report for policymakers with concrete steps to protect in-person voting and meet the equal access to voting requirements enshrined in federal law and the U.S. Constitution. Harris County Clerk Chris Hollins was one of the presenters in that call. You can see a summary of the call with highlights from the report here. I will be voting in person for this election, but however you do it please take the steps you need to in order to be safe.

Runoff reminder: Congress

Previously, we looked at the two statewide runoffs in the Democratic primary. Today we’re going to look at four Congressional primary runoffs. There are more than four total runoffs in Congressional primaries, but these are in the districts that are at least somewhat competitive, including a couple that are high on the national target list. As a reminder, here’s a look at the April campaign finance reports for Congress.

CD03

CD03 is held by freshman Rep. Van Taylor, who won by a 54-44 margin in 2018; Beto O’Rourke got 47.9% in the district. It’s not a first-tier opportunity, but the primary features two candidates who are way ahead of the 2018 fundraising pace, Sean McCaffity and Lulu Seikaly, who was a later entrant into the race. Seikaly has gotten more press that I could find of the two of them. Here’s a profile/interview with her on the Shondaland website. She recently picked up the endorsement of Rep. Marc Veasey after having been endorsed by the DMN for the primary. As for McCaffity, I found this profile of him from February. I don’t have a whole lot of insight to add to this race. Both candidates look good to me, either could break through and generate some national attention if they keep up the good fundraising or someone does a poll in the district. CD03 is entirely within Collin County, so if the suburbs do wind up abandoning Trump in a big way – in other words, even more than in 2018 – this race could be a sleeper.

CD10

CD10 of course has been on the radar all cycle, since Mike Siegel lost to longtime Rep. Mike McCaul by a bit more than four points, in a district that Beto carried by a hair. Siegel faces Dr. Pritesh Gandhi, who has been a strong fundraiser so far. As a working doctor who’s treating COVID-19 patients when he’s not on the campaign trail, Gandhi has also been featured in numerous new stories, getting both local and national coverage for his dual role. Siegel has made his way into some of that coverage, and was the subject of a nice recent profile. He also picked up a couple of endorsements, from Rep. Veronica Escobar and State Rep. Erin Zwiener.

CD24

This may be the spiciest runoff of the four, for a seat that Beto won with 51.5% of the vote in 2018. Precisely because this is such an clear-cut target – it’s been on the DCCC’s radar from day one – there’s been some fighting over who the DCCC should be backing in this race, Kim Olson and Candace Valenzuela. Olson is the 2018 nominee for Ag Commissioner (she got 46.4%, losing by five points) and is one of six Dem challengers so far to have raised over a million bucks as of April. Olson has a military background that’s a big part of her biography, but the circumstances surrounding her exit from the Air Force have some people worried that could be a drag on her campaign. Meanwhile, Valenzuela has also been a strong fundraiser and has picked up some notable endorsements including EMILY’s List, which is a fascinating decision on their part given that there were multiple pro-choice female candidates in the primary, including, you know, Kim Olson. Some of Valenzuela’s allies will be running ads against Olson over the issues with Olson’s military record. There’s a nice profile of Valenzuela here if you want to know more about her. As with these other races, I don’t have a strong preference. I feel like this race is there for the Dems to win, we just have to not screw it up.

CD31

Finally, there’s CD31, which started out the cycle high on the target list but has been slipping down since. While there have been a ton of candidates cycling through this race, none have caught fire the way MJ Hegar did in 2018, and none have distinguished themselves in fundraising. The two who survived the first round, Christine Eady Mann and Donna Imam, were the top fundraisers, but neither is close to the top tier among Dem challengers, and only Imam has a decent amount of cash on hand. Eady Mann, who lost in the 2018 primary runoff to Hegar, is also a medical doctor and has also been featured in some stories for her candidacy and career in a time of COVID. I couldn’t find any recent stories about Imam. I don’t see this race as being all that competitive anymore, but the trend in Williamson County will keep it reasonably close regardless. A surprise is still possible, but I’m going to want to see the winner of this runoff start to rake in some bucks before I’ll buy into it.

I included losing candidates from primary runoffs in 2018 as well, as they were still in the race at that time. I did not include the high-dollar races in CDs 07 and 32 – Lizzie Fletcher and Laura Moser had each raised over $1M by this point, with Colin Allred and Lillian Salerno combining for close to $1.4M – because I wanted to focus only on challengers. Reps. Fletcher and Allred are doing quite well in this department now, they’re just in a different category. It’s clear there’s a lot more money now than there was in 2018, which I attribute mostly to the national Democratic focus on many of these races. Only CDs 03, 06, and 25 are not official targets, but any of them could get bumped up if the environment gets more favorable or the nominees step it up another level. Both CD03 candidates and the 2020 version of Julie Oliver are well ahead of the 2018 pace, while Stephen Daniel was a later entrant in CD06 and may catch up in the next report.

We eventually got used to the big numbers from 2018, which I repeatedly noted were completely unprecedented for Democratic Congressional challengers in Texas, and so there’s less of an “ooh, ahh” factor when we look at this year’s numbers, but let’s not totally lose our ability to be wowed. Joe Kopser raised a ton of money in 2018, and Wendy Davis has left him in the dust, taking in three times as much at this point. Sri Kulkarni has nearly matched his entire total from 2018, while Gina Ortiz Jones is doing to herself what Wendy Davis is doing to Joe Kopser. Throw in Sima Ladjevardian and both Kim Olson and Candace Valenzuela, and wow. We do need to appreciate where we are now, because there was a long time when anything like this would have been unthinkable. Hell, you can count on one hand the number of statewide candidates from 2004 to 2016 who raised as much as these Congressional candidates have done so far.

There’s also a lot more spending, as four candidates have already dropped a million bucks, with Ladjevardian and Pritesh Gandhi not far behind. Those two plus Sri Kulkarni and Kim Olson were in competitive primaries, with Olson and Gandhi in the runoffs, while Wendy Davis and Gina Ortiz Jones had much less formidable opposition. I have to assume the latter two did most of their spending with an eye towards November.

I will admit that some of the cash on hand totals from this year’s report had me nervous, but doing this comparison mostly alleviates those concerns. I am of course still worried about the environment for raising money now, but there’s only so much one can worry about it, and as we saw in the previous post there was no noticeable slowdown for the month of March. We’ll see what the July numbers look like.

If there is a cause for concern, it’s in CD31, which has been a soft spot in the lineup from the beginning. Christine Eady Mann and Donna Imam seem to have finally hit a stride in fundraising after the entire field, including several who dropped out along the way, got off to a slow start, though Mann continues a pattern from 2018 of spending every dollar she takes in. Neither has matched MJ Hegar’s pace from 2018, and I seriously doubt they’ll do any better going forward. That’s a high hurdle to clear – Hegar eventually raised over $5 million – but I’m more hopeful now that whoever emerges in that race can at least be competitive.

The next finance reports of interest will be the 30-day reports for state candidates, and then the June reports for county candidates. You know I’ll be on them when they come out. As always, let me know what you think.

Hey, remember politics? You know, races and finance reports and stuff like that? Yeah, it’s still happening, weird as that may seem right now. As we are well into April, the Q1 Congressional finance reports for 2020 are in, and thankfully for me the number of candidates whose reports I need to review is much smaller. Let’s have a look. Some real separation in the Senate race, as MJ Hegar approaches five million total raised. She is in a much stronger position for the runoff than Royce West, though there’s still time for him to raise a few bucks. Hegar has a long way to go to be on par with John Cornyn, but she’s at least putting herself into “reasonably viable for a statewide candidate” range. For what it’s worth, Cristina Tzintzún Ramirez and Amanda Edwards did eventually top a million dollars raised, and in the end they both spent nearly all of it. I still don’t know why Tzintzún Ramirez was unable to do better in this department, but that’s water under the bridge now.

As was the case in 2018, everyone in all of the interesting races is raising a ton of money. The two incumbents are doing what they should be doing. Six challenger candidates have now topped a million dollars raised, with Wendy Davis and Gina Ortiz Jones both over three million. Pritesh Gandhi and Kim Olson still have to make it through the July runoff, by which time their runoff opponents – Mike Siegel and Candace Valenzuela – may have also topped that mark. Of course, right now is kind of a lousy time to be raising money, so hold that thought for a minute. We’re at a point where it’s basically routine for everyone to pile up big money-raised numbers, so let me note that the thing that stands out here is the amount that some of these candidates have spent. It’s more than a little mind-boggling that four candidates so far have spent over a million bucks, and some people, even the big moneybags, have left themselves a bit bereft in the cash-on-hand department. I’m glad to see both CD31 candidates finally start to get on the board, but that’s quite the hole Christine Eady Mann left herself in cash-wise. I’m going to do a separate post with a direct comparison to April 2018 later, but let’s put a pin in that. We don’t know what the fundraising environment is going to be like over the next few months. Dems benefited from a lot of Congressional cash in 2018. We had every reason to believe the same thing would happen this year as of the last report, but that was in the Before Times. Now, who knows?

We can take a little peek at how the fundraising environment may be. Everyone had to report their totals as of February 22 as well, thanks to the March primary. So here’s a look at how the Raised totals varied from January to April:

Donna Imam did not have a February 22 total when I went looking for these numbers, so I omitted her from this table. Honestly, it doesn’t look like there was much of a slowdown in March, which is what I had been afraid of. Hell, Wendy Davis raised nearly a million bucks just in the last five weeks of the period. With the primaries over, the federal contribution limits get reset, so I think Davis and at least a couple other candidates who emerged victorious reaped a benefit from becoming the official nominee. Certainly Sima Ladjevardian and Gina Ortiz Jones took in a decent haul in the latter half of the filing period. Julie Oliver and Stephen Daniel did not get such a boost, however. I don’t have much more to say about this, I was just curious about how this went. We’ll see what the next quarter brings. As always, let me know what you think.

Does getting to 40% make you likely to win the runoff?

I was talking with some fellow political nerds last week, and one of the topics was the forthcoming runoffs. As is usually the case, this year we have some runoffs between candidates who finished fairly close together in round one, and some in which one candidate has a clear lead based on the initial election. The consensus we had was that candidates in the latter category, especially those who topped 40% on Super Tuesday, are basically locks to win in May. The only counter-example we could think of off the tops of our heads was Borris Miles beating Al Edwards, who had been at 48%, in the 2006 runoff for HD146.

So, later on I spent a few minutes on the Secretary of State election archive pages, looking through past Democratic primary results and tracking those where the leader had more than forty percent to see who went on to win in the runoff. Here’s what I found:

In each of the cited races, the leading candidate had at least 40% of the primary vote. Races that have asterisks indicate that the runnerup also had at least 40%. As you can see, up until 2018, having forty percent or more in the primary was indeed a pretty good indicator of success in overtime. The last cycle provided quite a few counterexamples, however, including one incumbent (Rene Oliveira, who had been busted for a DWI earlier) who went down. So maybe 40% isn’t such a magical number, or maybe it’s harder now than it was before 2012. Or maybe this is just a really small sample and we should be careful about drawing broad conclusions from it.

Fortunately, we have quite a few races this year to add to this sample:

2020 primary results: Senate and Congress

In the US Senate primary, MJ Heger is clearly headed to the runoff. It’s less clear who’s in second place, in part because the statewide results are so out of date on both the Trib and SOS pages. As of this draft, these pages show Royce West trailing Cristina Tzintzún Ramirez by three points, with 64,041 votes cast for him. However, as of the same time, the Dallas County election results show West with 58,873 votes, just in Dallas. Suffice it to say, the statewide results are not up to date. My guess is that West finishes second, but check back later.

For Congress:

– Sima Ladjevardian was close to 50% in CD02 after early voting, but slipped back a bit from there and will be in the runoff with Elisa Cardnell.

– Mike Siegel was leading in CD10 as far as I could tell, but it’s not clear who he’ll face in the runoff.

– Sri Kulkarni appears to be over 50% in CD22. I very much hope that race ended last night.

– Wendy Davis (CD21) and Gina Ortiz Jones (CD23) were winning easily, and Julie Oliver (CD25) was also headed to victory. Kim Olson and Candace Valenzuela were basically tied in CD24 and will face off in May, as will Sean McCaffity and Lulu Seikaly in CD03. Christine Eady Mann and Donna Imam made the cut in CD31. Elizabeth Hernandez appeared to be leading Laura Jones in CD08.

– Henry Cuellar seems to have held on in CD28, and on the Republican side Kay Granger was doing the same in CD12. So Republicans will still have at least one female member of Congress from Texas.

– Sheila Jackson Lee and Al Green won easily against their challengers.

– Pete Sessions will be in the runoff in CD17, and Troy Nehls gets to face Kathaleen Wall and her millions of dollars in CD22. I pity everyone who will have to suffer through the TV commercials.

One more of these to go.

UPDATE: The Chron says it’s Mike Siegel and Pritesh Gandhi in the CD10 runoff, with Shannon Hutcheson finishing third. That’s a rare failure for a female candidate in any Dem primary from this year.

Endorsement watch: The rest of Congress

I think we are finally getting to the end of the Chron’s primary endorsements. We had the Senate and Tax Assessor, there are these four Congressional endorsements, all of which ran on Saturday, and I think the only races left may be the HCDE primaries. We’ll see, I’m probably forgetting something. Anyway, let’s go through these:

Rep. Sheila Jackson Lee for CD18.

Rep. Sheila Jackson Lee

Jackson Lee, one of the most senior Democrats in Congress, is consistently ranked as one of the most effective lawmakers. In 2019, according to GovTrack.us, she cosponsored 772 bills and resolutions and introduced another 38.

Last month, the president signed into law a bill authored by Jackson Lee and U.S. Sen. John Cornyn, a Republican, commissioning a federal study for a 51-mile Emancipation Trail between Galveston and Houston — a rare bipartisan effort in this politically polarized atmosphere. She has also taken up the late John Conyers’ effort to create a commission to study reparations, an effort applauded by this editorial board.

That record earns Jackson Lee our endorsement in the Democratic primary for Houston’s 18th Congressional District.

It is worth noting that Jackson Lee faces six challengers in the primary, a sign that many in her district are hungry for change.

Jackson Lee would do well to listen to her opponents’ concerns and the issues for which they are advocating.

I question the logic behind the claim having multiple opponents in this primary is “a sign that many in her district are hungry for change”. Maybe if she loses the primary or is forced into a runoff, that would be such a sign. John Cornyn had seven challengers in the 2014 Republican primary, which he wound up winning with 59% of the vote. Anyone with the right paperwork and a check for the filing fee can run for office. I don’t know what the number of candidates has to do with the electorate’s desire for change. And in the brief recitation (that I have omitted from this excerpt) of her opponents’ concerns and issues, I didn’t see anything that Jackson Lee would have been opposed or even indifferent to. Maybe be a little more specific here? Just a thought.

With hopes of flipping a seat held by a high-profile Republican, the question of “electability” will be a top priority for Democratic voters in the March 3 primary for House District 2.

That would make Houston lawyer, political activist and former Beto O’Rourke adviser Sima Ladjevardian the logical choice.

A late entry in the race, filing just hours before the Dec. 9 deadline, Ladjevardian still reported the most money raised and cash on hand at the end of the year. She also has the best potential for raising the cash needed for the Nov. 3 election face-off with incumbent Dan Crenshaw, who is unopposed in the Republican primary.

National pollsters and analysts put the race in the “likely Republican” category, but Crenshaw’s 53 percent vote in 2018 suggests he is not invulnerable.

The other Democratic challengers are Elisa Cardnell, a Navy veteran, a single mom and high school math and physics teacher, and Travis Olsen, who resigned his job with the Department of Homeland Security last year in protest of the administration’s family separation policy and other immigration issues.

Plenty of primary endorsements come down to this sort of practical assessment – these candidates are all roughly equivalent in terms of their positions and their experiences, so which one do we think will have the best shot at winning? I feel like it’s relatively uncommon for the Chron to state it this baldly, but there it is. Sima (*) has indeed been a brisk fundraiser, which is no doubt the reason why the DCCC added CD02 as a target. It’s easy to understand the rationale for all this, but it has to be a little frustrating for the candidates, not just for someone like Elisa Cardnell, who has been in this race for almost a year and hasn’t done too badly in fundraising herself while also making the “electability” argument based on her status as a Navy veteran, but also for Sima, whose own qualities get de-emphasized due to her ability to bring in money. It’s important to remember that the main reason for this rationale, whether you agree with it or not, and whether you agree with this particular conclusion to it or not, is that all three candidates are well-qualified and appealing, and we have to find a distinction somewhere.

(*) I recognize that it is often patronizing to refer to candidates, especially female candidates, by their first names. In this case, the candidate is doing that branding herself, on her domain name and campaign materials. I’m sure that’s in large part because “Ladjevardian” is much longer and more intimidating to pronounce and spell than “Sima” is – for sure, “Sima” fits quite nicely on a yard sign or T-shirt – and in part because there’s a well-documented penalty that candidates who have “funny” or “foreign-looking” surnames suffer. All this is a much more involved discussion for another time, I just wanted to acknowledge it.

Laura Jones and Elizabeth Hernandez see themselves as “regular people” who decided to do more than just complain about things. They each independently decided it was time to run for Congress.

For now, that means the two Democrats are trying to get their message out to voters in a solidly Republican House District 8 that sprawls across all or part of nine counties. They have little financial resources and almost no name recognition.

The winner of the March 3 Democratic primary will advance to the November election, almost certainly to face 12-term incumbent Kevin Brady, the top-ranking Republican on the powerful Ways and Means Committee. Brady was re-elected in 2018 with 73 percent of the vote.

Brady reported having more than $1 million in his campaign account at the end of 2019. Jones reported a little less than $2,000 and Hernandez had $0.

Jones, 42, said she has also made a point of meeting with mayors and other elected officials across the district, including many Republicans, to talk about these “regular people” problems.

It is that work and her experience in county politics that makes Jones the best choice in this Democratic primary.

It’s easy to look at a race like this and say it’s pointless, it’s hopeless, let’s put our energy and resources into races we can win. I get that, and I agree that a Democratic win in CD08 would be a monumental upset. But I’d also argue that running these races, with quality candidates, is important in their own fundamental way. For one, we can’t ever abandon any part of the state or subset of the population, not if we truly believe that our values and beliefs are beneficial to all. For another, things do change over time – see, for example, the former Republican stronghold known as Fort Bend County – and it’s so much better to have been a presence all along. At its most practical level, we Democrats need to give all our compatriots a reason to vote. We’re lucky to have people like Laura Jones and Elizabeth Hernandez doing that work in places where the challenges are greater and the rewards are not as apparent.

Democratic voters in Texas’s 10th Congressional District have a difficult choice to make, as the three candidates in the primary race — Shannon Hutcheson, Pritesh Gandhi and Mike Siegel — all offer compelling reasons why they should be selected to take on seven-term U.S. Rep. Mike McCaul.

Hutcheson, a lawyer who has represented Planned Parenthood, impressed us with her passion for education and bringing affordable health care to Texas families. Gandhi, a doctor and Fulbright scholar, protested the treatment of migrant children at the border and founded Doctors Against Gun Violence.

All promise solutions to issues such as climate change, gun control and health care, but in this race, we give the edge to Siegel.

His efforts in 2018, a race he lost by 4 percentage points to the powerful incumbent, convinced Democrats that the district was within grasp. He formed that challenge on a grassroots appeal that built upon his record of service as a teacher and assistant city attorney in Austin, where he led the charge in the suit against Texas’s anti-immigrant SB 4 law. During his campaign, he succeeded in protecting the voting rights of students at the historically black Prairie View A&M University.

“As Democrats, the way we’re going to win in Texas is by establishing this reputation that we will fight for the people here,” he told the Editorial Board.

Interestingly, this is in some ways a reverse of the endorsement in CD02, in that Siegel has raised the least money of the three candidates. Siegel did run before, and that’s valuable experience to have, and unlike in 2018 this race has been on the radar from the beginning, so the considerations are a little different. I’m just noting this in part because the distinction one has to find among otherwise equally attractive candidates doesn’t have to be about money. Other things can serve as a tie-breaker, too.

Trib overview of the CD10 primary

I have three things to say about this.

Mike Siegel

When Mike Siegel made a long-shot bid to unseat U.S. Rep. Michael McCaul, R-Austin, two years ago, few were watching — until he surprised political observers and came within 5 points of flipping the longtime Republican seat. Now the seat is up for election again, and national Democrats are paying attention.

Siegel’s 2018 result means the 10th Congressional District, which stretches from metro Austin to the northwest outskirts of Houston, is finally considered in play after a 2003 redistricting left it deeply gerrymandered and solidly red. Many more eyes are now on the race, including the Democratic Congressional Campaign Committee’s. But for Siegel, that has translated to tougher competition.

A former lawyer for the city of Austin, Siegel is vying for the Democratic nomination along with two newcomers: labor and employment lawyer Shannon Hutcheson and physician Pritesh Gandhi, both also from Austin.

A primary runoff is likely in TX-10, but with two weeks to go until Super Tuesday, it’s still uncertain who will make the cut. Siegel and his supporters put the district “on the map” last cycle after “the state and national party had left [it] for dead,” Siegel told The Intercept in June.

“People across this district remember me for showing up when for decades Democrats hadn’t really shown up, in some of these rural communities in particular,” Siegel told The Texas Tribune. “They appreciate that we brought this race so close without a lot of outside support.”

Siegel faced even more primary opponents in 2018 but won the nomination relatively easily. He garnered more than double the votes of each of his opponents in the first round of voting and went on to win the runoff by nearly 40 percentage points.

But Siegel holds views that might raise questions about whether he’s the right candidate to flip a traditionally red district. Because he is the most progressive candidate and the only one who supports “Medicare for All” and the Green New Deal, his bid could be seen as a riskier choice to challenge McCaul in the historically Republican district.

Hutcheson and Gandhi have taken more moderate positions, and each is getting some national support. Hutcheson has been endorsed by EMILY’s List, the influential group that works to elect Democratic women who support abortion rights. Gandhi, meanwhile, has the backing of 314 Action, which backs scientists running for office.

Fundraising in the primary has been competitive, especially between Gandhi and Hutcheson. In the fourth quarter, Gandhi and Hutcheson raised $257,000 and $216,000, respectively, while Siegel has trailed behind with $96,000. This was the first quarter Gandhi out-raised his opponents.

1. I feel like we all need to aim for a higher level of precision when we use the word “gerrymandering”. A district that heavily favors one party is not necessarily “gerrymandered”. The old, pre-2003 CD10, which was a nice, compact, entirely-within-Travis-County district, was a safe Democratic seat and not at all “gerrymandered”. CD13, which hews almost entirely to state and county borders and is ridiculously Republican, is almost the exact opposite of “gerrymandered”. A funny-looking district isn’t necessarily “gerrymandered”, either. CD18 is an African-American opportunity district, and has been drawn the way it is to encompass many African-American neighborhoods. For sure, Texas is a longtime and notorious hotbed of gerrymandering, and we should expect more of it in 2021. But context matters, and it would be helpful to have a clear idea of why a particular district’s boundaries are offensive or illogical or just plain nakedly partisan, if only to pick the right battles.

The current CD10 was certainly drawn with ill intent, partly to defenestrate Lloyd Doggett (oops) and partly to deprive the city of Austin of representation. The irony here is that, at least based on the 2018 election, the end result was to conjure up a fairly competitive district, which was not at all what the Republicans had in mind. A combination of booming growth in Travis County, and a one-two punch of demographic change and Trump-inspired suburban shifting in Harris County – compare CD10 2012 and CD10 2018 to see the effect – has worked to threaten what Tom DeLay once envisioned. None of that undoes the malice in the map, but it does show that the best-laid plans can (maybe) be undone by sufficiently rapid increases in population and diversity.

2. It’s important to remember, though, that as hard as CD10 swung towards Democrats in 2018, it was not at all clear it would be as competitive as it turned out to be following the 2016 election. Trump still carried CD10 by a 51.9 to 42.8 margin, and no other Democrat reached 40% in the district. As the 2018 cycle went on, and it became clear what the political environment was like, it made sense to put some resources into longer-shot districts like CD10. Mike Siegel did raise almost $500K in the 2018 cycle, which sounds like nothing now but was one of many record-breaking hauls at the time. He was also on the low end of the spectrum, raising less money than candidates like Julie Oliver and Jana Lynne Sanchez. The DCCC has to make choices about where it spends its money, and CD10 wasn’t at the top of the list in 2018. Maybe a million bucks or two dropped on that district might have helped, who knows. I don’t think it was outrageous the way priorities were made last cycle .

3. Siegel is doing better on fundraising this time around – as of the January 2020 report, he had almost matched his entire total from the 2018 cycle. It’s just that this time, he has opponents who are doing even better on that score. Several repeat candidates from 2018 are far outpacing their opponents in fundraising – Gina Ortiz Jones, Sri Kulkarni, Julie Oliver – but Mike Siegel is not in that class. He can very much win this primary, and whoever does get the nomination will justifiably have establishment support going forward. He happens to have drawn strong opponents this year. That’s the way it goes.

The interviews I didn’t do

As was the case with the 2019 Houston elections, there were too many candidates and too many races (and in this case, too little time as well) to do a full slate of interviews. I did what I could, and did a pretty good job of covering the races of interest in Harris County if I do say so myself, but if there had been more time I’d have done more. In some cases, I can point to previous interviews or other resources, so let’s have a review, and look ahead to what might be on tap for the runoffs.

US Senate: I’d have loved to interview some of these candidates, but it was unlikely I’d be able to get time on their calendars, especially after the filing deadline. The Texas Signal has done some Senate candidate forums, and you can see links to Facebook videos from one they did in Houston here. The Texas Trib also did a series of interviews with the five leading candidates, and they can be seen here, as well as a Q&A series here.

CD02: I interviewed Elisa Cardnell and Travis Olsen very early in the cycle, before the filing deadline and thus before Sima Ladjevardian entered the race. I’ve tried but have not succeeded at setting up a time to talk with her, and if there’s a runoff that she’s in that will be a top priority for me.

CD08: This is obviously not a district that anyone expects to be competitive, but I regret not having the time to speak to Laura Jones and Elizabeth Hernandez. They both look like super candidates, and it’s important to support efforts to build Democratic infrastructure in places like Montgomery County. That race is on my list for November.

CD09: Rep. Al Green is the one Democrat in Congress from the area that I’ve never had the chance to interview. Tried to chase him down once a few years ago but couldn’t make it happen. I don’t see this as a competitive race and there’s no need to do a November interview, but one of these days I’d like to talk with him, just to have done it.

CD10: I interviewed Mike Siegel for the 2018 runoff. This race is on my list for the May runoff, if there is one.

CD18: I interviewed Rep. Sheila Jackson Lee back in 2010. I would enjoy talking with her again, but I did not have it in me to do seven (!) interviews for this race. In the unlikely event of a runoff, I’ll definitely revisit this race.

CD22: I interviewed Sri Kulkarni for the 2018 runoff. My original thought was that if this goes to a runoff I’ll be there for it, but after the recent bizarre allegations between the two candidates who might make it into a runoff besides Sri Kulkarni, I’m not sure what I’ll do.

SD11: I interviewed Susan Criss when she ran for HD23 in 2014. I may or may not do this race for November, we’ll see.

SD13: I’ve interviewed Sen. Borris Miles twice, most recently in 2012, when he was running for re-election in HD146. Let’s just say I’d have to ask him some very different questions now, and leave it at that.

HD126: As it happens, I interviewed both candidates in 2018 – Natali Hurtado, and Undrai Fizer. I’ll probably do this one for November, we’ll see.

HD142: I have never interviewed Rep. Harold Dutton, I don’t think I’ve ever met him. I have interviewed Jerry Davis a couple of times, most recently in 2013. I will definitely want to do interviews in this race if there’s a runoff.

HD146: I have not interviewed Rep. Shawn Thierry, but I did run a judicial Q&A from her in 2010. I interviewed Ashton Woods for City Council last year.

HD147: I have interviewed Rep. Garnet Coleman multiple times, most recently in 2012. He’s always been a favorite person to talk to. In the unlikely event of a runoff, I’ll definitely revisit this race.

HD148: Had it not been for the special election in November, I’d have been all over this race. That said, thanks to the special election I’ve already done interviews with Rep.-elect Anna Eastman, Penny Shaw, and Adrian P. Garcia. I also interviewed Cynthia Reyes-Revilla for City Council. I might possibly revisit this in a runoff, but because I’ve done these interviews so recently it’s not clear to me I’d have anything new to ask these folks. We’ll see.

Sheriff: I’ve interviewed Sheriff Ed Gonzalez multiple times, including in 2016 when he first ran for Sheriff. I also interviewed Jerome Moore after he made it to the runoff with Gonzalez in 2016. I didn’t see this race as a particularly serious challenge to Gonzalez, so I put a higher priority on the DA and County Attorney races. If it turns out I was wrong and this one winds up in a runoff, I will of course revisit it.

HCDE: I also regret not doing interviews in the two At Large HCDE races, but there just wasn’t the time, and unlike with legislative offices there’s just so many questions about this position I can reasonably ask. I’ll probably do Position 7 if that race goes to a runoff, but we’ll see.

Yeah, I’ve done a lot of interviews over the years. Always room for more, though not always the time. I’ll be back to the task in March, and again later this year. Hope you find this useful.

In the Senate primary, there’s MJ Hegar and there’s everyone else. Her totals above understate her lead in the money race, because VoteVets will be spending on her candidacy as well. I would have thought Royce West would have raised more, and I thought Cristina Tzintzun Ramirez might have done better as well, but here we are. I do think the eventual nominee will be able to raise plenty of money, and will likely get some national help as well. For sure, we know Hegar is on the DSCC’s list; whether that transfers to someone else if she falls short remains to be seen.

I’ve expressed some skepticism about Jessica Cisneros in her primary against incumbent Henry Cuellar, but she’s proven she can raise money – in fact, she outraised him for this quarter, though obviously Cuellar still has a big cash on hand advantage. I can’t say I’ve ever been enthusiastic about her candidacy – she seemed awfully green at the beginning, and as someone who had moved back to Laredo to run this race she didn’t strike me as the kind of candidate that could give him a serious challenge. But man, Cuellar is a jackass, and I’m sure that’s helped her in the fundraising department. He’s also now got some national money coming in, which suggests at least a little case of the nerves. This is the marquee race that’s not in Harris County for me, though I will reiterate what I said before about taking out Cuellar versus taking out Eddie Lucio.

Sima Ladjevardian made a big splash in CD02, and around the same time as her announcement of her Q4 haul the DCCC put CD02 on its target list, adding it to the six other seats (CDs 10, 21, 22, 23, 24, and 31) that were already there. I assume the two are related, though Elisa Cardnell keeps chugging along.

Even though there was a long history of Democratic challengers to Republican Congressmen not raising any money, we all got used to the idea of our candidates breaking records and putting up very impressive totals in 2018. Look at the January 2019 summary that I linked to above, which adds it up for the cycle. Even candidates in completely non-competitive districts were topping $100K, even $200K or more. So maybe some of the totals you see here have you a bit jaded, like “oh, sure, we can raise money now, we’re good at that now”. If that’s what you’re thinking – and I don’t blame you, I feel that way too – I invite you to look back at the January 2018 summary, which is the point in time from that cycle that we’re in now. Look in particular at CDs 03, 10, 22, and 24, where candidates this time around have in some cases done better by an order of magnitude than their counterparts – who in some cases were themselves – did two years ago. Look at Julie Oliver in CD25 – she hadn’t even cracked $20K at this point in 2018. We are in such a different world now.

I could go down the list and look at all the race, but you can see the totals. There are no surprises here, in the sense that the candidates you’d expect to do well are indeed doing very well. Only CD31 is underperforming, at least relative to the other districts, but Christine Mann has stepped it up a bit and Donna Imam is willing to throw some of her own money in the pot. With the DCCC jumping into CD02, we’ve already expanded the field, and with the numbers so far it will be easy to expand it further. If this all still feels a little weird to you, I get it. Things were the way they were for a long time. They’re not that way any more, and I for one am glad to adjust to that.

Filing update: Focus on Harris County

One more look at who has and hasn’t yet filed for stuff as we head into the final weekend for filing. But first, this message:


That’s general advice, not specific to Harris County or to any person or race. With that in mind, let’s review the landscape in Harris County, with maybe a bit of Fort Bend thrown in as a bonus. Primary sources are the SOS candidate page and the Patrick Svitek spreadsheet.

Reps. Sylvia Garcia and Lizzie Fletcher do not have primary opponents, though the spreadsheet does list a possible opponent for Garcia. As previously discussed, Rep. Al Green has a primary opponent, and Rep. Sheila Jackson Lee has three so far, with at least one more to come. Elisa Cardnell and Travis Olsen have filed in CD02. Mike Siegel and Shannon Hutcheson have filed in CD10, and none of the three known contenders have filed yet in CD22. (Before you ask, no, I don’t know why some candidates seem to wait till the last minute to file.)

In the Lege, the big news is that Penny Shaw has filed in HD148, so the voters there will get their third contested race in a four month time period. At least with only two candidates so far there can’t be a runoff, but there’s still time. Ann Johnson and Lanny Bose have filed in HD134, Ruby Powers has not yet. Over in Fort Bend, Ron Reynolds does not have an opponent in HD27, at least not yet. No other activity to note.

Audia Jones, Carvana Cloud, and Todd Overstreet have filed for District Attorney; incumbent Kim Ogg has not yet filed. Christian Menefee and Vince Ryan have filed for County Attorney, Harry Zamora has entered the race for Sheriff along with incumbent Ed Gonzalez, and Jack Terence, last seen as a gadfly Mayoral candidate in the late 90s and early 2000s, has filed for Tax Assessor; Ann Harris Bennett has not yet filed. Andrea Duhon has switched over to HCDE Position 7, At Large, which puts her in the same race as David Brown, who has not yet filed. Erica Davis has already filed for Position 5, At Large.

In the Commissioners Court races, Rodney Ellis and Maria Jackson are in for Precinct 1; Michael Moore, Kristi Thibaut, Diana Alexander and now someone named Zaher Eisa are in for Precinct 3, with at least one other person still to come. I will note that Precinct 1 Constable Alan Rosen has not yet filed for re-election, but three other candidates, two of whom filed within the first week of the period, are in for that position. Rosen’s name has been bandied about as a possible Commissioners Court challenger to Steve Radack, and if he is planning to jump to that race it makes sense that he’d take his time, since he’d have to resign immediately afterward. I have no inside scoop here, just a bit of idle speculation. There are no Dems as yet for either Constable or JP in Precincts 5 or 8.

This brings us to the District Courts, and there’s some interesting action happening here. There are a couple of open seats thanks to retirements and Maria Jackson running for Commissioners Court. Herb Ritchie is retiring in the 337th; two contenders have filed. One person has filed in Jackson’s 339th. Someone other than George Powell has filed in the 351st, and someone other than Randy Roll has filed in the 179th. I’m not sure if they are running again or not. Steve Kirkland has a primary opponent in the 334th, because of course he does, and so does Julia Maldonado in the new 507th. Alexandra Smoots-Thomas does not yet have a primary opponent.

Fort Bend County went blue in 2018 as we know, but Dems did not have a full slate of candidates to take advantage of that. They don’t appear to have that problem this year, as there are multiple candidates for Sheriff (where longtime incumbent Troy Nehls is retiring and appears poised to finally announce his long-anticipated candidacy for CD22, joining an insanely large field), County Attorney, and Tax Assessor (HCC Trustee Neeta Sane, who ran for Treasurer in 2006, is among the candidates). The Dems also have multiple candidates trying to win back the Commissioners Court seat in Precinct 1 that they lost in 2016 – one of the candidates is Jennifer Cantu, who ran for HD85 in 2018 – and they have candidates for all four Constable positions.

There are still incumbents and known challengers who have been raising money for their intended offices who have not yet filed. I expect nearly all of that to happen over the weekend, and then we’ll see about Monday. I’ll be keeping an eye on it all.

Second mobile voting locations lawsuit filed

Same claims, different plaintiffs.

The lawsuit was filed Tuesday in the U.S. District Court for the Western District of Texas in Austin. It is led by former Austin Assistant City Manager Terrell Blodgett, Texas Young Democrats (TYD) and Texas College Democrats.

“We are here to tear down an obstacle to the right to vote,” Mike Siegel, who is representing Blodgett, said during a press conference Tuesday.

Siegel, a civil rights attorney who is running for Congress against Republican incumbent Michael McCaul, said the law “suppresses the vote of young people, of seniors, of people with disabilities” and people without access to transportation.

Blodgett, who is 96, said he has almost never missed an election – that is until HB 1888 went into effect. Because of the law, the mobile polling site at Westminster, the senior living community he lives in, was forced to close. Blodgett said he has relied on that polling location and was unable to vote because he wasn’t feeling well and couldn’t use public transportation.

“I would have had to climb on this bus and go over from the house to the library and vote because we didn’t have the facility or the voting machines there at Westminster,” he said.

When asked, Blodgett said he thinks Republicans in the Legislature passed the law for political reasons.

“I think they did it to suppress the Democratic vote,” he said.

According to the lawsuit, many young voters were unable to vote in 2019 because they lacked access to transportation.

“For example, at three different college campuses in Austin where there are TYD constituents — Huston-Tillotson University, St. Edward’s University and Austin Community College — mobile voting locations that had been available and used by TYD voters in the 2018 elections were no longer available for use in the November 2019 election,” plaintiffs say in the lawsuit.

As I said before, I agree with the motivation for HB1888 and I agree with the goals of these lawsuits, but I have little to no faith that the federal judiciary, at least once you get past the district courts, will have any sympathy. And to be honest, in reading this story, I can see what the likely defense strategy will be. Mr. Blodgett doesn’t need to worry about where any voting location is, because he is eligible to vote by mail, and if he had requested a mail ballot he would not have had this problem. As for the college students, Travis County isn’t barred from having early voting locations on those campuses. They just have to keep them open throughout the early voting period. Which costs more, sure, but they could choose to budget the funds for it. Whether any of that is actually responsive to the complaints is beside the point, because I can totally see the Fifth Circuit and SCOTUS buying it. I’ll be delighted to be proven wrong. The Texas Signal has more.

Filing period preview: Congress

So even though we still have the 2019 runoffs to settle, the 2020 election is officially upon us. I say this because the filing period for 2020 candidates began on Saturday the 9th, closing on December 9. I expect there will be a tracker of filed candidates on the TDP webpage, but until such time as we have something like that, my guidebook for this is the Patrick Svitek spreadsheet of declared and rumored candidates. I’m going to do a series of posts on who has announced their candidacies for what this week, and I’ll be using that as the springboard.

I begin with Congressional candidates. We’ve sort of been tracking this all along via the quarterly finance reports, since you can’t be a candidate (or at least, you can’t be taken seriously as a candidate) unless you’re filing finance reports. My roundup of Q3 filing reports is here, and I’ll supplement that in this post.

The first thing I noticed after I clicked over to the spreadsheet to begin my research was that there’s a new Democratic candidate in CD02. And sure enough, there was a Chron story to go with it.

Travis Olsen

Former Homeland Security Department employee Travis Olsen this week joined the race for Texas’ 2nd Congressional District, becoming the second Democrat to vie for the seat held by U.S. Rep. Dan Crenshaw, R-Houston.

Olsen, who filed his candidacy with the Federal Election Commission Tuesday and launched his campaign Thursday, said he would seek to “provide an alternative” for residents “looking to move past partisanship and polarized politics,” contending that Crenshaw has not sought common ground with Democrats during his first term.

“We need leaders in Congress who are going to put country above party,” Olsen said in an interview. “And what we have seen is that Rep. Crenshaw will just follow the party line, follow the president, in his choices.”

To take on Crenshaw, Olsen first would have to win a Democratic primary next year that already includes Elisa Cardnell, a Navy veteran who filed her candidacy in February.

In response to Olsen’s campaign launch, Cardnell said in a statement that the race “has been, since day one, about how we put country over party and defeat Dan Crenshaw in 2020.”

“We’ve been making the case now for six months; if we want to hold Dan Crenshaw accountable for voting against lower prescription drug costs and against reauthorizing the national flood insurance program, it’s going to take a female veteran who can make him come to the table and talk about the issues, not just his past service,” Cardnell said.

Here’s Olsen’s website. He’ll need to start raising money ASAP, Crenshaw has bags and bags of it, and Cardnell has taken in $177K so far. From my perspective, this means another set of interviews to do for the primary. You’ll note as we go on there’s more where that came from.

Among Democratic incumbents, only Rep. Lizzie Fletcher in CD07 has no primary opponent. I won’t be surprised if some character wades in, but she won’t have much to worry about. Not in March, anyway; she will have a well-funded Republican opponent in November. Reps. Al Green in CD09 and Sylvia Garcia in CD29 each have one primary opponent. Melissa Wilson-Williams has reported $31K raised, though it all appears to be her own contributions. Someone named Nile Irsan says he’s running in CD29, but he has no web presence or finance reports as yet.

The primary for a Democratic seat with the most action is in CD18, where four announced candidates face Rep. Sheila Jackson Lee: Marc Flores (Q3 finance report), Bimal Patel (Q3 finance report), Stevens Orozco (Q3 finance report), and Jerry Ford (Q3 finance report). Flores and Patel have been in the race for awhile and have raised a few bucks; Orozco has only taken in $3K, while Ford has loaned himself $50K. Jackson had a token challenger in 2018 and took 85% of the vote. She had more serious challengers in 2010, including then-Council Member, now State Rep. Jarvis Johnson, but still won with 67%. It’s hard for me to believe she’ll face much adversity this time around.

The main event races are CDs 10 and 22, and there’s no change in status for them. It won’t surprise me if some stragglers file for them, but the contenders are as they have been all along – Mike Siegel, Shannon Hutcheson, and Pritesh Gandhi in CD10; Sri Kulkarni, Nyanza Moore, and Derrick Reed in CD22. The newest candidates are in CD08, the Kevin Brady district mostly in Montgomery County. Jacob Osborne established a campaign committee in May and has a campaign finance account, but no money raised or web presence as far as I can tell. Laura Jones is a more recent entrant and the Chair for the San Jacinto County Democrats, but has not filed any finance reports yet. Democrat Steven David got 25% in CD08 in 2018 so this is not exactly a prime pickup opportunity, but it’s always nice to see qualified candidates take a shot.

Elsewhere in the state, most of what we know I’ve covered in the finance report posts. I’m still hoping for a more serious contender in the admittedly fringey CD17, and we have things to sort out in CDs 03, 06, 25, and 31. We may yet see some new entrants here and there but for the most part the big picture is fairly clear. I’ll take a look at legislative offices next.

There’s a lot here – so much that it’s taken me this long to post, and so much that I thought about splitting this into two separate posts – but let’s start with the Senate candidates. MJ Hegar has been in the race the longest, and she has raised the most, matching her performance from the previous quarter. All the other candidates (save for the low-profile no-hope types, and hey isn’t it nice to finally see Sema Hernandez file a finance report?) entered during Q3 and their finance reports can be graded on a curve as a result. That said, time keeps on ticking, ticking, ticking, and John Cornyn keeps on raising piles of money, so everyone needs to kick it up a notch or two. It was nice that every candidate at the Texas Signal candidate forum was asked about their path to victory, but raising money is a key part of that, even if it is a tacky subject to bring up. We’re going to need to see a lot more in the January reports.

Incumbents Lizzie Fletcher and Colin Allred are doing what they need to do. Their potential Republican opponents are raising a bunch of money, but they’re staying ahead of them, which they need to keep doing. Jessica Cisneros has done well in her challenge to Henry Cuellar, who is made of money, and she is getting some national press for her efforts. I still don’t know how much either money or national attention will mean in this race, but I do know that if she does win, it will be a very big deal and will make a lot of Dem incumbents look over their shoulders.

There are a number of new names on this report. Hank Gilbert is not going to win in CD01 because it’s a 70%+ Trump district, but Hank is a mensch and Louie Gohmert is a death eater from a hell dimension, so the least I can do is note that Hank is taking on the thankless task of challenging Gohmert. We noted last time that Lorie Burch has ended her campaign in CD03, and now several others have stepped in. Sean McCaffity, who is off to a strong fundraising start, and Tanner Do have reports for this quarter, and they will have company next time. Chris Suprun, whom you may remember as one of the wannabe faithless electors from 2016, has entered the race. He had also run in the CD27 special election last year, and had a brush with the voter ID law before that. Plano attorney Lulu Seikaly is also in the race, and I apologize to her for making her follow that.

Elsewhere in new candidates, Heidi Sloan has entered the race in CD25. Julie Oliver, the nominee from 2018, is well ahead of her fundraising pace from that year, so we’ll see how that goes. There are now a bunch of candidates in CD31, though I can tell you now that that article from August is out of date. I’ll have more on that in a separate post. Among the newcomers here are Dan Jangigian, Eric Hanke, and Donna Imam. Jangigian may have the most interesting resume of any Congressional candidate in recent memory – he’s a onetime Olympic bobsledder, and acted in the legendary bad movie The Room. He was subsequently portrayed in the movie The Disaster Artist, the movie about the guy who made The Room, by Zac Efron. And now he’s running for Congress. What have you done with your life?

A more familiar candidate making her first appearance here is Wendy Davis, who took in nearly a million bucks for CD21. That’s one of several top target races where there’s a clear frontrunner, at least as far as fundraising goes, which is a change from 2018 when most of the hotter primaries had the money more widely dispersed. Gina Ortiz Jones did even better, topping $1.6 million already. Rosey Abubara, who I thought might give her a challenge, has not filed a report. Candace Valenzuela and Crystal Fletcher have raised a few bucks in CD24, but Kim Olson is well ahead of them both, while Sri Kulkarni is lapping the field in CD22. The exception is in CD10, where all three candidates are doing well, but 2018 nominee Mike Siegel is a step behind Pritesh Gandhi and Shannon Hutcheson.

Rounding up the rest, Elisa Cardnell stepped it up in CD02, but faces a steep challenge as Dan Crenshaw is one of the biggest fundraisers in Congress now. Stephen Daniel is doing all right in CD06. I know their totals don’t look like that much compared to some of these other folks, but remember how much time we spent in 2018 talking about how rare it was for any Democratic challenger to raise as much as $100K for an entire cycle? We’ve come a long way. And I’m still hoping for either Rick Kennedy to start doing more in CD17 or for someone else to jump in, even if that race is a big longshot. The Quorum Report made my heart flutter with a teaser about a poll testing former CD17 Rep. Chet Edwards against carpetbagger Pete Sessions. I don’t know if this is a real thing or just someone’s idea of a cool thought experiment, but I’d be all in on another run by Edwards. We’ll see if there’s anything to it.
