“Fort Worth is the new Austin”

Hadn’t thought of it that way.

Who speaks for Fort Worth in the nation’s capital?

For more than 25 years the go-to member of the Texas delegation for Tarrant County has been U.S. Rep. Kay Granger, R-Fort Worth.

From securing funds for the Panther Island project to ensuring Pentagon funding for the F-35 fighter jet made by Lockheed Martin to saving the USS Fort Worth (she is the ship’s sponsor) from Navy cost-cutters, Granger has made her mark.

But will that still be the case?

There are now seven members of Congress who represent portions of Tarrant County after the most recent once-a-decade redistricting that realigned congressional and legislative districts in the 2022 elections.

There are two ways that the new lines divide Tarrant, and the most apparent is that the county is cut up so that there isn’t a singular voice for the region.

“Fort Worth is the new Austin,” said David Wasserman, the U.S. House expert for the Cook Political Report, a nonpartisan analytical outlet. “It’s now been sliced up into a pinwheel.”

Austin, the 11th-largest city in the U.S., had been cut into six districts for nearly 20 years until the 2021 map created a concentrated “anchor” district that packed together Democrats and made Republican districts safer.

Tarrant County’s divisions carve up the county in such a way that Fort Worth, the 13th-largest city in the country, is also now the largest without an anchor congressional district.

In the second way the district divisions divide the region, there’s a twist highlighted by U.S. Rep. Marc Veasey, D-Fort Worth, who says the lines are drawn in such a way that four of the seven lawmakers who represent Tarrant County also represent Dallas County.

“That’s significant. There’s always been that rivalry between Fort Worth and Dallas,” said Veasey, whose district is almost evenly split between the two counties.

He and U.S. Rep. Beth Van Duyne, R-Irving, have represented both areas but as of the latest redistricting, there are two more: U.S. Reps. Jake Ellzey, R-Midlothian, and newly elected Jasmine Crockett, D-Dallas.

It makes for a complex political landscape.

“The districts in Dallas-Fort Worth are more sawed apart than most districts in the country,” said Michael Li, a Texan who is a redistricting expert at the Brennan Center for Justice at the New York University School of Law.

Ginger noted this story in the April 14 Dispatches from Dallas. The re-creation of a single anchor district for Austin and Travis County was something I noticed during the 2021 redistricting process. It was clearly done in part because a whole lot of Republican Congressmen found themselves in far-too-competitive races thanks to the blueing of the I-35 corridor. I also suspect that after 20 years the Republicans were finally willing to concede that they could not kill off Rep. Lloyd Doggett and so they may as well quit trying. If you can’t crack ’em, may as well pack ’em.

I did not notice how Fort Worth and Tarrant County had been slotted to fill that role of being sliced into many pieces to disperse Democratic voters. It makes total sense, I’m a little miffed that I hadn’t picked up on it before. It should be noted that in the 2020 election, under the old map, all of the Republican districts that include a piece of Tarrant County except for CD12 were at least modestly competitive, and CD12 had trended Dem over the decade just like all the others had. The new map is far less competitive, though perhaps things may get a bit tighter in the Presidential year 2024. I still believe CD24 will be on the national radar sooner or later; beyond that we’ll have to see.

Honestly, the main difference between Tarrant County with this map and Travis County with the previous two maps is that all of the Congressfolk who now represent Tarrant and Fort Worth seem to be happy to do so, and the local leadership is happy with them. That was very much not the case with Austin and Travis County, which were treated like dog poop on the shoes of most of the delegation. Which is to say, the Republican members of the delegation. Perhaps if Fort Worth and Tarrant County start electing Democrats to those local positions, this will change. Enjoy it while you can, y’all.

Runoff results: Around the state

After the primary, I rounded up the Democratic runoffs we’d have in May. I’m going to use that post to round up the results from last night, as best as I can tell as of when I gave up the ghost and went to bed. I started filling this in around 10 PM.

Statewide Dem

Lite Guv – Mike Collier vs Michelle Beckley.
AG – Rochelle Garza vs Joe Jaworski.
Comptroller – Janet Dudding vs Angel Vega.
Land Commissioner – Sandragrace Martinez vs Jay Kleberg.

Garza and Dudding were both up 61-39 as of 9:30 PM, with Garza being declared the winner. Collier (54.8 – 45.2) and Kleberg (52.2 – 47.8) were leading but it was too soon to say with them. Kleberg was up 62-38 in Harris County, and Collier was up 60-40, so that bodes well for them.

Congressional Dem

CD01 – JJ Jefferson vs Victor Dunn.
CD15 – Ruben Ramirez vs Michelle Vallejo.
CD21 – Claudia Zapata vs Ricardo Villarreal.
CD24 – Jan McDowell vs Derrik Gay.
CD28 – Rep. Henry Cuellar vs Jessica Cisneros.
CD30 – Jasmine Crockett vs Jane Hope Hamilton.

Jefferson (75%), Zapata (62%), and Crockett (75%) all had huge leads and were on their way to victory. Henry Cuellar (52.75 – 47.25) had a smaller lead but looked to be in pretty good shape. The other two races were ridiculously close – Ramirez was up by 78 votes, McDowell up by 20 votes. You’ll want to check them again today, and don’t be surprised if they wind up in recount territory.

SBOE Dem

SBOE1 – Melissa Ortega vs Laura Marquez.
SBOE2 – Victor Perez vs Pete Garcia.

Ortega (58%) and Perez (56%) looked to be in good shape.

State Senate Dem

SD27 – Morgan LaMantia vs Sara Stapleton-Barrera. LaMantia was at 57% and appeared to be in good shape.

State House Dems

HD22 – Joseph Trahan vs Christian Hayes.
HD37 – Ruben Cortez vs Luis Villarreal
HD70 – Cassandra Hernandez vs Mihaela Plesa.
HD76 – Suleman Lalani vs Vanesia Johnson.
HD100 – Sandra Crenshaw vs Venton Jones.
HD114 – Alexandra Guio vs John Bryant.

Lalani (64%), Jones (70%), and Bryant (62%) looked to be headed to victory. Lalani would be the first Muslim to serve in the Lege. Jones is openly gay and HIV positive and was the subject of a bizarre homophobic rant by his opponent, so his win is especially sweet. Bryant, who is 75 and served in Congress 30 years ago, wins one for the old white guys.

As of 10 PM, the other races were too close to call, with Hayes (50.86%), Villarreal (52.44%), and Plesa (52.91%) holding the advantage.

Republicans

Ken Paxton easily beat George P. Bush, which launched multiple (likely written in advance) eulogies to the “Bush dynasty” in Texas. Good riddance, if P is what that had fallen to. Dawn Buckingham (Land Commissioner) and Wayne Christian (RR Commissioner) were also cruising to victory.

UPDATE: All of the Dem statewide candidates that were leading when I signed off won. Michelle Vallejo (50.1%) edged ahead in CD15, while Jan McDowell (51.15%) increased her lead. It got super tight towards the end, but yes, Henry Cuellar (50.2%) once again came out ahead. All of the state office candidates that were leading last night were still ahead this morning.

April 2022 campaign finance reports: Congress

The primaries are over, and while we do still have some runoffs plus now a weird special election in CD34, we do have a smaller set of races and candidates to review. Given how many I had to cram into the previous posts, I’m sure you can feel my relief at that. I’ve taken out the people who are no longer running after the primaries, and I’ve removed some districts that aren’t particularly interesting for the general election; CD30 will be the next to go once that runoff is settled. Still a long list, but it will be shorter for Q3.

It’s weird to see the two nominees in CD03 having less than $10K on hand at this point in the cycle, but there are some extenuating circumstances. Keith Self was supposed to be in a runoff, one he just barely squeaked into, but then Rep. Van Taylor self-immolated, resetting everything in the race. I’m sure Self will post much bigger numbers for July. I would hope that Sandeep Srivastava is able to capitalize a bit as well – this district isn’t really competitive on paper, especially not in a tough year for Dems, but Collin County overall has been moving rapidly in a blue direction, and a good showing by Srivastava could put him in strong shape for 2024, which may be a much better year to run there. I’d love to see him at $250-300K raised in the Q3 report.

Also remarkable for his modest total is Rep. Troy Nehls, who really stands out in a “one of these things is not like the others” when compared to Reps. Chip Roy, Tony Gonzales, and Beth Van Duyne. I don’t know if this reflects a lack of interest in fundraising on his part, a lack of interest in him by the donor class, a lack of urgency given that his opponent hasn’t raised anything, or some combination. CD22 is another district that I expect to be competitive in a couple of cycles, so if Nehls proves to be a lackluster fundraiser that could be an issue down the line.

We’ve talked about the CD34 special election and the financial edge that the Republicans should have in it. The filing deadline for that was in April, so the candidates in that election, other than Mayra Flores who is the GOP candidate for November, is on this list. Flores also has less money than I would have thought, but as with Keith Self I expect that to grow between now and the next report. There will be some interim reports available before the election on June 14, I’ll check in on that in a few weeks.

A roundup of runoffs

I was going to just do a basic recap of all the primary races that will require runoffs, and then this happened, and I had to do some redesign.

Rep. Van Taylor

U.S. Rep. Van Taylor, R-Plano, has decided to end his reelection campaign after he was forced into a primary runoff amid 11th-hour allegations of infidelity.

Taylor made the stunning announcement Wednesday, hours after he finished his five-way primary with 49% of the vote, just missing the cutoff for winning the primary outright. The runner-up was former Collin County Judge Keith Self, who is now likely to become the next congressman for the 3rd District.

“About a year ago, I made a horrible mistake that has caused deep hurt and pain among those I love most in this world,” Taylor wrote in an email to supporters. “I had an affair, it was wrong, and it was the greatest failure of my life. I want to apologize for the pain I have caused with my indiscretion, most of all to my wife Anne and our three daughters.”

The day before the primary, the conservative outlet Breitbart News posted a story that Taylor had had a monthslong affair with a Plano woman, Tania Joya, who he had paid $5,000 to keep quiet. The publication reported that she provided it a phone screen shot purporting to be communications with Taylor and a bank record showing that she deposited $5,000 into her account. The Texas Tribune has not been able to independently verify the report.

Taylor has until March 16 to remove his name from the runoff ballot, which he plans to do, according to a spokesperson. After he does that, Self is automatically the Republican nominee for the district. There is a Democratic nominee for the seat, Sandeep Srivastava, but they face long odds after the district was redrawn last year to favor Republicans.

Holy shit. There’s a link to that article in the Trib story, which I refuse to include. It’s one of the less important aspects of this story, but the timing is curious. Why not publish this earlier, if that’s what you’re going to do, and not take the chance that he could win without a runoff? It gets a whole lot more complicated for the Republicans if he withdraws after winning the primary, and he came quite close to doing just that. I don’t understand any of this.

Statewide Dem

Lite Guv – Mike Collier vs Michelle Beckley.

AG – Rochelle Garza vs Joe Jaworski. As of Wednesday afternoon Jaworski had less than a 2K vote lead over Lee Merritt. When I first looked at this, it was a 3K lead, with all of the remaining ballots in Harris County, where Jaworski started the day with a 6K vote lead over Merritt. That had shrunk to a bit less than 5K votes by the afternoon, which almost made my logic that Jaworski would easily hold his lead look idiotic, but the gap appears to have been too large for Merritt to overcome. But who knows, there may be a bunch of late-fixed mail ballots out there, so let’s put a pin in this one.

Comptroller – Janet Dudding vs Angel Vega.

Land Commissioner – Sandragrace Martinez vs Jay Kleberg.

Congressional Dem

CD01 – JJ Jefferson vs Victor Dunn.

CD15 – Ruben Ramirez vs Michelle Vallejo, who has a 300-vote lead over John Rigney.

CD21 – Claudia Zapata vs Ricardo Villarreal.

CD24 – Jan McDowell vs Derrik Gay, who rebounded after my initial bout of pessimism to finish in second place.

CD28 – Rep. Henry Cuellar vs Jessica Cisneros. Cisneros had a big early lead that was mostly a function of the order in which the counties reported their results. Cisneros crushed it in Bexar County, then watched as Starr, Webb, and Zapata erased her lead. In the end, if what I’m seeing is the actual final tally, it was Cuellar who missed winning outright by nine (!) votes. This one could change to a Cuellar win as the overseas and provisional votes are tallied, and then of course there may be a recount. Hold onto your hats.

CD30 – Jasmine Crockett vs Jane Hope Hamilton.

CD38 – Diana Martinez Alexander vs. Duncan Klussman. This is the only Congressional runoff in Harris County for Dems.

SBOE Dem

SBOE1 – Melissa Ortega vs Laura Marquez. The third-place finisher had big charter school backing, so this race can go back to being one you don’t need to know about.

SBOE2 – Victor Perez vs Pete Garcia.

SBOE4 – Coretta Mallet-Fontenot vs Staci Childs. This is in Harris County, it’s the seat Lawrence Allen vacated in his unsuccessful run for HD26. I’ll put this one on my to do list for runoff interviews.

SBOE11 – Luis Sifuentes vs James Whitfield. Double-timer DC Caldwell finished third, while also losing in the Republican primary for this same seat to incumbent Pat Hardy. Let us never speak of this again.

State Senate Dem

SD27 – Morgan LaMantia vs Sara Stapleton-Barrera.

State House Dems

HD22 – Joseph Trahan vs Christian Hayes.

HD37 – Ruben Cortez vs Luis Villarreal

HD70 – Cassandra Hernandez vs Mihaela Plesa. This one was an almost even split among three candidates, with third place finisher Lorenzo Sanchez 29 votes behind Plesa and 102 votes behind Hernandez. Another overseas/provisional vote count to watch and another recount possibility.

HD76 – Suleman Lalani vs Vanesia Johnson. This is the new Dem-likely seat in Fort Bend.

HD100 – Sandra Crenshaw vs Venton Jones.

HD114 – Alexandra Guio vs John Bryant. Bryant was a Dem Congressman in the 90’s, in the old CD05. After winning a squeaker against Pete Sessions in 1994, Bryant tried his luck in the primary for Senate in 1996, eventually losing in a runoff to Victor Morales. Bryant just turned 75 (why anyone would want to get back into the Lege at that age boggles my mind, but maybe that’s just me), while Guio is quite a bit younger. Should be an interesting matchup. This was a five-way race with everyone getting between 17 and 25 percent, so endorsements from the ousted candidates may make a difference.

HD147 – Jolanda Jones vs Danielle Bess.

Harris County Dems

185th Criminal District Court – Andrea Beall vs Judge Jason Luong.

208th Criminal District Court – Beverly Armstrong vs Kim McTorry. Judge Greg Glass finished third.

312th Family District Court – Teresa Waldrop vs Judge Chip Wells.

County Civil Court at Law #4 – Manpreet Monica Singh vs Treasea Treviño. David Patronella was in second place after early voting, but fell behind as the Tuesday votes came in.

Commissioners Court, Precinct 4 – Lesley Briones vs Ben Chou.

Justice of the Peace, Precinct 1, Place 2 – Sonia Lopez vs Steve Duble.

Republicans

Not really interested in a complete rundown, but it’s Paxton versus P Bush for AG, Dawn Buckingham versus Tim Westley for Land Commissioner, and Wayne Christian versus Sarah Stogner for Railroad Commissioner. At least that last one will be interesting.

As noted yesterday, it will be Alexandra Mealer versus Vidal Martinez for the nomination for County Judge. I have no feelings about this.

2022 primary results: Legislative races

You might start with the Daily Kos rundown of races of interest, which includes all of the Congressional races worth watching.

One of those got an early resolution, as former Austin City Council member Greg Casar declared victory before 9 PM. He had a ridiculous early lead, and was at just under 60% when I wrote this. He was one of the candidates backed by national progressives, and they may go two for two, as Jessica Cisneros was just over 50%, up by about five points in her three-way race with Rep. Henry Cuellar. This one may go to a runoff, and it’s one we’ll all be sick of by the end of March if that happens. Whatever the case, she built on her 2020 campaign, likely with a bit of an assist from the FBI, and if she wins she earned it.

Other open Congressional seat races: Rep. Lloyd Doggett waltzed to an easy and crushing win in CD37. Rep. Vicente Gonzalez, who moved from CD15 to CD34 to succeed Rep. Filemon Vela, was headed to victory there. In CD15, Ruben Ramirez led a more tightly packed field; it’s not clear who might accompany him to a runoff. State Rep. Jasmine Crockett was at around 55% in CD30 early on, and could win without a runoff. I generally like her, but stories like this one about a cryptocurrency super PAC supporting her really makes me scratch my head.

In the two seats that are currently targets for the DCCC, John Lira was in a fairly solid lead in CD23, while it appears that sigh Jan McDowell will be in a runoff in CD24. Derrik Gay, the best fundraiser and the candidate the DCCC has been backing, was in a tight race for second place. Lord help me. Claudia Zapata was in first place and headed for the runoff in CD21, Sandeep Srivastava was winning in CD03, and here in Harris County Duncan Klussman and Diana Martinez Alexander were basically tied in CD38, with a runoff in their future.

On the Republican side: Dan Crenshaw easily won against a couple of no-names in CD02, while Van Taylor was above 50% in his four-way race in CD03. Monica De La Cruz and Mayra Flores were above 50% in CDs 15 and 34, respectively, while Wesley Hunt was winning in the district that Republicans drew for him, CD38. Morgan Luttrell was above 50% in CD08. None of the incumbents who had challengers had any reason to sweat.

In the State Senate, Sen. John Whitmire had a 62-38 lead in early voting over Molly Cook in SD15. Cook lost the race, but I’d say she beat the spread, and if there’s another opportunity in 2024 she’s put herself in good position to take advantage of it. Morgan LaMantia and Sar Stapleton Barrera are one and two, neck and neck, for SD27; that will be a spirited runoff. Titus Benton was leading Miguel Gonzalez 51-49 with about half the vote counted in SD17.

House races of interest in Harris County: Harold Dutton had a 55-45 lead on Candis Houston early on. Alma Allen was headed to victory against two opponents in HD131. Jolanda Jones at about 45% in HD147, with a close race between Danielle Bess and Reagan Flowers for the other runoff spot. Chase West had a four-vote lead over Cam Campbell in HD132 in early voting.

Elsewhere in the state:

HD22 (open) – Joe Trahan was just short of a majority and will face Christian Hayes in the runoff.
HD26 (R held) – Daniel Lee defeated Lawrence Allen.
HD37 (open) – Ruben Cortez and Luis Villarreal in the runoff.
HD38 (open) – Erin Gamez won.
HD50 (open) – James Talarico, who moved over from HD52, won easily.
HD51 (open) – Lulu Flores won.
HD70 (open, new seat, R held, D pickup opportunity) – Too close to call among three candidates.
HD75 – Rep. Mary Gonzalez easily defeated her challenger.
HD76 (open, new D seat) – Suleman Lalani and Vanesia Johnson in the runoff.
HD79 (two Ds paired) – Rep. Claudia Ordaz Perez was leading Rep. Art Fierro.
HD92 (open, new seat, R held, D pickup opportunity) – Salman Bhojani won.
HD100 (open) – Sandra Crenshaw and Venton Jones headed for the runoff.
HD114 (open) – Too close to call among at least three candidates.
HD124 (open) – Josey Garcia won.
HD125 – Rep. Ray Lopez defeated his challenger.

On the R side, the main thing I will note is that former City Council members Greg Travis and Bert Keller will not be in the runoff for HD133.

Note that a lot of this is based on incomplete voting, so there may be some changes as of the morning. I’ll do some followup tomorrow.

Some of these races have a lot of candidates, and in some of those cases I limited myself to people who raised a noticeable amount of money. Most but not all races have both Republicans and Democrats listed – the incumbent is listed first followed by other candidates from that party, if any. In the case of open seats like CDs 15 and 34, I listed the Democrats first since those are Democratic seats.

The two races that the DCCC has focused on as potential pickups are CDs 23 and 24. Leading candidates John Lira and Derrik Gay had raised respectable amounts so far, but if you look at the October reports you can see they didn’t add all that much to their totals. They spent more than they took in over the past three months, not terribly surprising given that they’re in contested races (Lira’s opponent didn’t report anything), but it means they’ll be starting way in the hole. If they don’t pick it up considerably in this quarter it won’t much matter anyway.

I’m a little surprised that State Rep. Jasmine Crockett hasn’t raised more in CD30, as she is the candidate endorsed by outgoing Rep. Eddie Bernice Johnson, but she was only an official candidate in that race for five weeks, so in that context she did pretty well. In the likely event of a runoff, we’ll see what her April report says. On the Republican side, I expected more from Keith Self, who was Collin County Judge and whose candidacy was fueled by the grievance of Rep. Van Taylor voting for the January 6 commission. I guess his buddy Ken Paxton is in no position to lend him a hand right now. Rebecca Viagran is the one San Antonio candidate in a district with two Austin heavyweights duking it out. You’d think that might be a good path to getting into a runoff, but her fundraising doesn’t reflect that.

Donna Imam had been running in CD31 as of the October report, but switched to the new CD37 when her old district became less hospitable. I expect she’ll join a long list of candidates who got their heads handed to them by Rep. Lloyd Doggett, but you don’t know till you try. All of the Dems in CD38 were late filers in the race, so they had less than three weeks to collect cash. If this were 2012, the eventual winner of that primary would struggle to raise more than about $50K over the entire year. This is not a race that Dems have any expectation of winning, but I’ll be interested to see if the nominee here can do better than their long-longshot counterparts from a decade ago. My theory is that after two exciting cycles and a fair amount of engagement and organization, there should be a higher base level of support for candidates like these. We’ll see how dumb that theory turns out to be.

I did not comment on the absurd fundraising total of Rep. Dan Crenshaw last time. I will do so this time: That’s a lot of money. Whatever else you might say about the guy, he’s a fundraising machine. Spends a lot of it, too – I don’t look at the report details, so I can’t say where it’s going. But anyone who can rake it in like that, you have to think he’s got his eye on a statewide run, maybe in 2024 if Ted Cruz makes good his threat to run for President again. He does have three primary opponents, who combined to raise less than $50K. He also occasionally says things that make the most rabid of Trump minions howl with rage, so the possibility exists that he could underperform against that collection of no-names. I would not expect it to amount to anything, but it might provide a bit of fodder for the pundits.

On primarying the quorum breakers

Working Families Party, a political party and relative newcomer to Texas politics that backs Democrats aligned with their platform, aims to spend in the ballpark of half a million dollars this cycle, WFP Texas Co-director Pedro Lira told the Signal.

Much of that money will go to door-to-door canvassing.

“At the end of the day, when you can really connect with people face to face, that’s really what motivates people to get out to vote,” Lira said. “We’re trying to build a real base of working class people. You can’t do that without involving those people.”

In partnership with CWA and Texas Organizing Project, WFP is also bankrolling “Texans for Better Dems,” a new political action committee that will primary Democrats in the state legislature who returned from Washington D.C. to restore quorum, a move that caused a rift in the state party and led to the creation of the Texas Progressive Caucus.

“We were incredibly proud of the Democrats who fled the state to deny Republicans quorum. It’s exactly the kind of leadership that we need from our elected officials,” Lira said. “We were also just as disappointed to see some of those Democrats come back. And it’s because those Democrats gave Republicans quorum that bills like the abortion ban and the anti-voting legislation were able to pass.”

Lira said the PAC was created specifically to primary those Democrats.

This was a thing I wondered about, and had seen some speculation about a few months ago when the quorum was freshly broken and tempers were high. I tried to keep an eye on it during the filing process, but there was a lot to keep up on, and if any WFP-backed candidates were out there, they didn’t make their presence known in a way that was visible to me. Now that we’re well past the filing deadline, let’s revisit this.

The first question is who the potential targets would be. I did a little digging into who among the Dems were here during the quorum break in Special Session #1, and who came back during Special Session #2 to bring the attendance count to the required level – this was in response to a private question I was asked. Long story short, I trawled through the daily journals on the Texas Legislature Online site, and found enough record votes to mostly fill in the picture.

For the first special session, I identified the following Dems who were present in Austin: Ryan Guillen, Tracy King, Eddie Morales, John Turner, Abel Herrero, Terry Canales, and Leo Pacheco. (There’s one I can’t identify; I suspect it was Harold Dutton, but he shows up in the next session, so it doesn’t really matter.) Guillen is now a Republican, Pacheco has since resigned, and Turner is not running for re-election. According to the SOS Qualified Candidates page, none of the others have primary opponents.

For the second special session, we can add these legislators, who were either there from the beginning or who showed up while the quorum was still not established: Dutton, Art Fierro, Mary Gonzalez, Bobby Guerra, Oscar Longoria, Eddie Lucio Jr, Joe Moody, James Talarico, Garnet Coleman, Armando Walle, and Ana Hernandez. Lucio and Coleman are not running. Talarico is running in a different district, HD50, which is open now that Celia Israel is running for Mayor of Austin. Fierro was paired with Claudia Ordaz Perez in redistricting. Of the rest, only Dutton and Gonzalez have primary opponents, and Dutton was a target well before the quorum break issue. Gonzalez, who has had primary challengers in the past as well for other reasons, faces someone named Rene Rodriguez, about whom I could find nothing. If the goal was to primary these Democrats, it sure doesn’t look like that goal was achieved.

Now, the WFP may well be playing a longer game. As we know, there wasn’t much time between the passage of the new maps and the start of filing season. Maybe they decided it was better to wait until 2024, or maybe they decided to focus more on races like CD35 (they have endorsed Greg Casar) and CD30. Maybe they’ll back Ordaz Perez and David Alcorta, the other candidate in HD50. Who knows? If they intended to make a bigger splash than that, I’d say they came up short. We’ll see what happens after this election.

The filings I’m still looking for

Today is Filing Deadline Day. By the end of today, we’ll know who is and isn’t running for what. While we wait for that, let’s review the filings that have not yet happened, to see what mysteries may remain.

Congress: Most of the potentially competitive districts have Democratic candidates in them. The ones that remain are CDs 22, 26, 31, and 38, though I have been told there is a candidate lined up for that latter slot. Of the rest, CD22 would be the biggest miss if no one files. I have to think someone will, but we’ll know soon enough.

For open seats, CD15 has five candidates so far, none of whom are familiar to me. CD30 has six candidates, with State Rep. Jasmine Crockett receiving the endorsement of outgoing Rep. Eddie Bernice Johnson. CD34 has six, with current CD15 Rep. Vicente Gonzalez the presumed favorite. CD35 has three serious contenders – Austin City Council member Greg Casar, former San Antonio City Council Member Rebecca Viagran, and State Rep. Eddie Rodrigues – and one person you’ve not heard of. CD37 has Rep. Lloyd Doggett and former CD31 candidate Donna Imam, in addition to a couple of low-profile hopefuls, but it will not have former CD25 candidate Julie Oliver, who has said she will not run.

Democratic incumbents who have primary challengers include Rep. Lizzie Fletcher in CD07 (I’m still waiting to see if Centrell Reed makes some kind of announcement); Rep. Veronica Escobar in CD16 (I don’t get the sense her challenger is a serious one); and Rep. Henry Cuellar in CD28, who gets a rematch with Jessica Cisneros, who came close to beating him last year. The Svitek spreadsheet lists some dude as a potential challenger in CD18 against Rep. Sheila Jackson Lee, but so far no filing. Reps. Al Green, Joaquin Castro, Sylvia Garcia, Colin Allred, and Marc Veasey do not appear to have any challengers as of this morning.

Statewide: Pretty much everyone who has said they are a candidate has filed. Frequent candidate Michael Cooper and someone named Innocencio Barrientez have filed for Governor, making it a four-candidate field. Two Harris County district court judges, Julia Maldonado and Robert Johnson, have filed for slots on the Supreme Court and CCA, respectively. The Svitek spreadsheet lists potential but not yet filed contenders for two other Supreme Court positions but has no listings for CCA. The one potential candidate who has not yet taken action is Carla Brailey, who may or may not file for Lt. Governor.

SBOE: As this is a post-redistricting year, all SBOE seats are on the ballot, as are all State Senate seats. Dems have four reasonable challenge opportunities: Michelle Palmer is running again in SBOE6, Jonathan Cocks switched from the Land Commissioner race to file in SBOE8, Alex Cornwallis is in SBOE12, and then there’s whatever is happening in SBOE11. The good news is that DC Caldwell has company in the primary, if he is actually allowed to run in it, as Luis Sifuentes is also running. I would advise voting for Sifuentes.

There are two open Democratic seats, plus one that I’m not sure about. Ruben Cortez in SBOE2 and Lawrence Allen in SBOE4 are running for HDs 37 and 26, respectively. There are two candidates in 2 and three candidates in 4, so far. Georgina Perez is the incumbent in SBOE1 but as yet has not filed. If she has announced that she’s not running, I have not seen it. There is a candidate named Melissa Ortega in the race.

In SBOE5, the district that was flipped by Rebecca Bell-Metereau in 2020 and was subsequently made more Democratic in redistricting, we have the one primary challenge to an incumbent so far, as a candidate named Juan Juarez has filed against Bell-Metereau. I’m old enough to remember Marisa Perez coming out of nowhere to oust Michael Soto in 2012, so anything can happen here. The aforementioned Perez (now Marisa Perez-Diaz) and Aicha Davis are unopposed so far.

Senate: Nothing much here that you don’t already know. Every incumbent except Eddie Lucio has filed for re-election, and none of them have primary opponents so far. Lucio’s SD27 has the three challengers we knew about, Sara Stapleton-Barrera, State Rep. Alex Dominguez, and Morgan LaMantia. A candidate named Misty Bishop had filed for SD07, was rejected, and has since re-filed for SD04; I’m going to guess that residency issues were at play. There are Dem challengers in SD09 (Gwenn Burud, who has run for this office before) and SD17 (Miguel Gonzalez), but no one yet for SDs 07 or 08.

House: Here’s the list of potentially competitive districts, for some value of the word “competitive”. Now here’s a list of districts on that list that do not yet have a filed candidate:

I’m told there’s someone lined up for HD133. We’ll see about the rest.

All of the open seats have at least one candidate in them so far except for HD22, the seat now held by Joe Deshotel. There’s a name listed on the Svitek spreadsheet, so I assume that will be sorted by the end of the day.

Reps. Ron Reynolds (HD27), Ana-Maria Ramos (HD102), and Carl Sherman (HD109) are incumbents who have not yet filed. No one else has filed yet in those districts as well. Svitek has a note saying that Rep. Ramos has confirmed she will file; there are no notes for the other two. There is the possibility of a last-minute retirement, with a possibly preferred successor coming in at the same time.

Here is a complete list of Democratic House incumbents who face a primary challenge: Rep. Richard Raymond (HD42) and Rep. Alma Allen (HD131). Both have faced and turned away such opponents in the past. If there was supposed to be a wave of primary opponents to incumbents who came back early from Washington, they have not shown up yet.

Rep. James Talarico has moved from HD52 to the open HD50 after HD52 was made into a lean-Republican district. Rep. Claudia Ordaz-Perez, the incumbent in HD76, will run in HD79 against Rep. Art Fierro after HD76 was relocated from El Paso to Fort Bend.

Harris County: Again, nothing new here. Erica Davis has not yet filed for County Judge. County Clerk Teneshia Hudpseth is the only non-judicial incumbent without a primary opponent so far.

Far as I can tell, all of the county judicial slots have at least one filing in them, except for a couple of Justice of the Peace positions. George Risner, the JP in Precinct 2, Place 2 (all JP Place 2 slots are on the ballot this year) has not yet filed, amid rumors that he is mulling a challenge to Commissioner Adrian Garcia. Incumbent Angela Rodriguez in JP precinct 6 has not yet filed. No Dem challengers yet in precincts 4 or 8.

Other judicial races: Sorry, I don’t have the bandwidth for this right now. I’ll review it after today.

A brief filing update

Just a few observations as we head out of the holiday season and into what I expect will be the busier part of the filing period. I’m using the Patrick Svitek spreadsheet, the SOS candidate filing resource, and the candidate filing info at the harrisvotes.com site for my notes.

– There’s now a fourth candidate listed for Attorney General on the Dem side, someone named Mike Fields, who along with Joe Jaworski has officially filed as of today. I can’t find anything to clarify this person’s identity – there’s no address listed on the SOS page, and Google mostly returned info about the former County Court judge who is now serving as a retired judge and who last ran for office as a Republican. I seriously doubt this is the Mike Fields who is running for AG as a Dem. I know nothing more than that.

– No Dems yet for Comptroller or Ag Commissioner, though I saw a brief mention somewhere (which I now can’t find) of a prospective Dem for the former. I feel reasonably confident there will be candidates for these offices, though how viable they are remains to be seen.

– Nothing terribly interesting on the Congressional front yet. A couple of Dems have filed for the open and tough-to-hold CD15; I don’t know anything about them. State Rep. Jasmine Crockett, in her first term in the Lege, will run for CD30, the seat being vacated by the retiring Rep. Eddie Bernice Johnson, who has endorsed Crockett for the primary. That race will surely draw a crowd, but having EBJ in her corner will surely help. No incumbents have yet drawn any primary challenges, though Reps. Vicente Gonzalez (now running in CD34) and Lloyd Doggett (now running in CD37) will have company for their new spots. I am not aware of any Dem yet for the new CD38, which should be Republican at least in the short term but which stands as the biggest prize available for Harris County Democrats.

Michelle Palmer has re-upped for SBOE6, which will be a tougher race this time around. I’m working on a post about the electoral trends for the new SBOE map.

– Sara Stapleton-Barrera and Morgan LaMantia have filed for the open SD27 Senate seat; Rep. Alex Dominguez has not yet filed. Nothing else of interest there.

– For the State House, I’m going to focus on area districts:

HD26 – Former SBOE member Lawrence Allen Jr, who ran in the 2020 primary for this seat, has filed.

HD28 – Eliz Markowitz still has an active campaign website and Facebook page, but I don’t see anything on either to indicate that she’s running again. One person who is running though he hasn’t filed yet is Nelvin Adriatico, who ran for Houston City Council District J in 2019.

HD76 – The spreadsheet lists four candidates so far. Two ran in 2020, Sarah DeMerchant (the 2020 nominee) and Suleman Lalani (who lost to DeMerchant in the primary runoff). Two are new, Vanesia Johnson and James Burnett. This new-to-Fort-Bend district went 61-38 for Joe Biden in 2020, so the primary winner will be heavily favored in November.

HD132 – Chase West has filed. He’s not from the traditional candidate mold, which should make for an interesting campaign. This district was made more Republican and is not the top local pickup opportunity, but it’s on the radar.

HD138 – Stephanie Morales has filed. This is the top local pickup opportunity – the Presidential numbers are closer in HD133, which does not yet have a candidate that I’m aware of, but it’s more Republican downballot.

HD142 – Jerry Davis is listed on the Svitek spreadsheet as a challenger to Rep. Harold Dutton. He hasn’t filed yet, and I don’t see any campaign presence on the web yet. That’s all I know.

HD147 – I am aware of a couple of candidates so far to fill the seat left vacant by Rep. Garnet Coleman’s retirement. Nam Subramaniam has filed. HCC Trustee Reagan Flowers sent out a press release over the weekend stating her intention to run. I would expect there to be more contenders for this open seat.

– For Harris County offices, there are already some people campaigning as challengers to incumbents. Carla Wyatt is running for Treasurer, Desiree Broadnax is running for District Clerk. On the Republican side, former District Clerk Chris Daniel has filed for his old office, and someone named Kyle Scott has filed for Treasurer. There are no Democratic challengers that I can see yet for County Clerk or County Judge, though there are a couple of Republicans for County Judge, Vidal Martinez and Alexandra Mealer. Finally, there’s a fourth name out there for County Commissioner in Precinct 4, Jeff Stauber, who last ran for Commissioner in Precinct 2 in 2018 and for Sheriff in 2016, falling short in the primary both times.

So that’s what I know at this time. Feel free to add what you know in the comments. I’ll post more updates as I get them.

More redistricting stuff

Just a roundup of some redistricting stories. We’ll start with the DMN.

The new map, part of a process of redrawing legislative boundaries every 10 years, makes significant changes in North Texas, where Democrats likely will gain a seat held by Republican Jeff Cason. The district would move to an area made up of mostly minority voters.

But the Republican proposal also adjusts the southern Denton County district represented by Democrat Michelle Beckley to make it more favorable for a GOP candidate. Beckley has opted to run for Congress in 2022 against Republican incumbent Beth Van Duyne in Congressional District 24.

Meanwhile, the North Dallas district represented by John Turner would move west and become a majority Hispanic district in Oak Cliff and Grand Prairie. Turner is retiring after his term ends, and had he stayed, he would have been paired with a Republican Morgan Meyer.

In North Texas, Republicans had the goal of protecting their incumbents who could be in trouble during the next decade. They made alterations that now have the Dallas County seats held by Republicans Angie Chen Button of Garland and Meyer, who lives in University Park. The new maps place them in areas won in 2020 by Donald Trump, but only at a 50% to 49% margin. Those districts will remain battlegrounds as Democrats try to make Dallas County a blue oasis.

Republicans bolstered their Tarrant County seats, except for the one held by Cason, which will become more Democratic. Cason also was one of only two Republicans who voted against House Speaker Dade Phelan in January. And they made the Collin County districts represented by GOP Reps. Matt Shaheen and Jeff Leach stronger for a Republican, but as with the case in Dallas County, the Collin County seats will remain targets for Democrats.

“Republicans did their best to cement their majority and, from a partisan gerrymandering standpoint, they played this very smart,” said David de la Fuente, a senior policy analysts for the center-left group called Third Way. “They didn’t go overly aggressive for new pickup opportunities for themselves because they know that a lot of this growth that’s happening in Texas is growth that could benefit the Democratic Party, so they tried to stop losses more than anything else.”

Rep. Jasmine Crockett, a Dallas Democrats who represents District 100, which includes parts of southern and eastern Dallas County, as well as West Dallas, is upset that her district is slated to incur a radical drop in its Black population. Under the new maps, the number of voting age Black residents District 100 will drop from 34.6% to 27%. The white voting age population would increase from 22% to nearly 37%. Crockett’s voting age Hispanic population drops from 41% to 29%.

“They have taken the voice away from African Americans in my district and that’s a clear violation of the Voting Rights Act,” Crockett said. “They are spitting on the legacy of HD 100. They went too far.”

Most of the Black population lost by Crockett will be moved to the nearby District 104 that is represented by Dallas Democrat Jessica González. Her new constituents would include residents from the historic Joppa neighborhood, a community built by freed slaves. District 104 has largely changed, González said. The district now extends to Mesquite and Garland.

While she would pick up Black population from districts represented by Crockett and Rose, González said the number of eligible voters with Hispanic surnames would drop from over 50% to about 48%. That could be a Voting Rights Act violation, analysts say.

Crockett and González were vocal participants of the quorum break by House Democrats to stall a controversial elections bill.

“I’m not too shocked that it ended up being me they targeted,” Crockett said. “I kind of wear it as a badge of honor…It is still a safe Democratic seat, but partisan gerrymandering is legal and when you slice and dice communities of interests, you end up with a problem.”

State Rep. Toni Rose, D-Dallas, would also have the Black population in her district sharply reduced, and she would lose Paul Quinn College. Rose’s district would see a drop in Black voting age population–from 34% to 26%. The Hispanic voting age population in the district would rise from 58% to 63%.

Black residents represented 25% of the growth in the Dallas/Fort Worth area, according to the U.S. Census Bureau.

Well, that answers my question about what Rep. Cason did to offend the redistricting gods. Gotta say, I was under the impression that doing what was done here to Rep. Crockett’s district was called “retrogression” and it was a no-no under the Voting Rights Act. It’s not clear to me if that slicing and dicing was done for strategic reasons or just out of spite. Wait for the lawsuits, I guess.

Here’s the Chronicle:

“The map gives Republicans a slight advantage,” said Ross Sherman of the advocacy group RepresentUs, which works with the Princeton Gerrymandering Project to grade redistricting proposals. “This seems to be a trend this cycle: another map producing safe seats and insulating politicians from their constituents.”

The Gerrymandering Project gave the proposed House map a “C” in fairness for its GOP advantages. It’s the highest grade a Texas map has received so far, after proposals for congressional and state Senate maps earned “F” grades.

Speaking in general about the maps, GOP strategist Brendan Steinhauser said the Republicans tried to “lock in the gains” they earned during the 2020 election, rather than “be too aggressive” and shift blue seats their way.

The House seats currently are divided almost equally between districts that favored Republican Donald Trump and Democrat Joe Biden in 2020. The current map includes 76 Trump-led districts and 74 Biden-led districts, but the new map shifts that support to 86 in favor of Trump and 64 in support of Biden.

Texas grew by roughly 4 million people over the past decade, a surge driven almost entirely by people of color, especially Latinos. Updating the political maps is required every 10 years, to account for such shifts.

Still, the proposed House map reduces the number of majority-minority districts by voting age population. Previously, 67 districts were majority-white; the new map proposes 72 districts that have mostly white voters.

Those numbers change dramatically when evaluating estimates for adult citizens. Using those figures, the House currently has 83 majority-white districts, compared with 89 under the new map. And while the current districts include 33 with Hispanic majorities and seven with Black majorities, those numbers would fall to 30 and four, respectively.

“These maps do nothing but preserve the status quo at the expense of Black and brown Texans,” said Anthony Gutierrez, the executive director of the good-government group Common Cause Texas.

Same observation about the reduction of majority-minority districts. I mean, I get that the Voting Rights Act may as well be written on toilet paper with this Supreme Court, but it’s still theoretically the law of the land. The Republicans may have had more challenges with the State House districts because of the law that requires districts to be entirely within counties where possible, which prevented them from putting pieces of urban counties in the same district with rural counties, which was not the case for the Congress or State Senate maps. Again, I figure the lawyers will have a lot to say about all this when the dust settles.

Speaking of Congress:

In a strongly-worded letter, U.S. Reps Sheila Jackson Lee and Al Green said they oppose the Republicans’ proposed redrawing of their districts and say they were not consulted before the map was released to the public.

The map “makes radical and unneeded changes to the two local congressional districts that include the majority of Black voters in Harris and Fort Bend counties,” the letter to the Texas Senate Redistricting committee states.

There are massive changes for Harris County in the congressional redistricting plan the Texas Senate released earlier this week. The county would still have nine members of Congress, but the district lines would be dramatically altered to improve the re-election chances of current Republicans and create a new congressional seat that appears to have been drafted to ensure another Republican would be elected to Congress.

The map would have a dramatic impact on the districts represented by Jackson Lee and Green, changing who represents 200,000 mostly Black residents.

Jackson Lee’s 18th Congressional District would not only lose the Third Ward, but also downtown Houston, the University of Houston and Texas Southern University — most of those areas would instead be shifted to the 29th Congressional District, represented by Democratic U.S. Rep. Sylvia Garcia.

And the Republican map would put Jackson Lee’s home in Riverside Terrace into Green’s 9th Congressional District, meaning she would not even be able to vote for herself unless she moved. It would also put Jackson Lee’s main district office for the 18th in Green’s district, forcing her to move it.

“No other member of the large Texas delegation is so severely impacted by the proposed map,” the letter notes, pointing out at Jackson Lee’s 18th Congressional District has roots that tie back to Barbara Jordan, who in 1972 became the first Black woman to represent Texas in Congress.

I said before that Reps. Green and Jackson Lee would easily win the new districts as drawn, but what was done to them is clearly an insult. For Sen. Huffman to claim that no one got in touch with her about the maps she was drawing is disingenuous, especially when she knows what effect those maps are going to have. You have the power, you have the responsibility. Spare me the whining.

Nonwhite residents accounted for about 95% of the population growth that gave Texas two additional seats in the U.S. House.

Despite that, the number of predominantly Hispanic congressional districts in Texas would fall from eight to seven, while majority Anglo districts would rise from 22 to 23, in the Republican-drawn map unveiled this week, said Gloria Leal with the League of United Latin American Citizens.

“Toss-up seats, which presented an opportunity for Hispanics to elect candidates of choice, were cut from 12 to one,” Leal said. “This blatant attempt to increase partisanship in districts not only results in the suppression of minority votes, but it eliminates the opportunity for Hispanics to elect a candidate of their choice in violation of the Voting Rights Act and the U.S. Constitution.”

State Sen. Joan Huffman, R-Houston and chairwoman of the committee, said the map was drawn in a “color-blind way,” without taking into account the race of residents.

“We did not consider race in drawing the maps at all,” Huffman said. “Once we drew the maps, we provided them to our legal counsel … and we are advised that they were legally compliant” with the Voting Rights Act.

Michael Li, with the Brennan Center for Justice at the New York University School of Law, testified that creating the map without regard to race is not enough to insulate it from legal challenges, particularly if lawmakers know about its adverse impact on nonwhite Texans.

Li said the proposed map raised several “red flags,” particularly in the Dallas-Fort Worth area, where Black and Hispanic populations increased sharply in the past decade, yet no new districts were created to give nonwhite voters an opportunity to elect preferred candidates. At the same time, SB 6 would move a significant Latino population from a district held by U.S. Rep. Mark Veasy, D-Fort Worth, and into an Anglo majority district that includes seven rural counties, he said.

Li also questioned changes made to District 22 — centered on Fort Bend County, one of the most diverse suburban counties in America — where the voting age population would rise to 55% Anglo, up from the current 46%. Dismantling a district where rising numbers of Hispanic, Black and Asian voters were able to create voting coalitions “raises many red flags,” he said.

Have I mentioned that the lawyers are going to be busy? I don’t have much faith in the courts, but I believe in the lawyers.

Decision Desk:

Texas gained two Congressional districts through 2020 reapportionment. One district went into Austin, which the GOP previously divided between five Republican districts in 2010. All five ended up as marginal races by 2020. This new Democratic district releases pressure on the five seats allowing them to absorb Democratic voters from other parts of the state. The second new Congressional seat is roughly the successor to the old Seventh district in west Houston, with the new TX-07 traveling between Houston and her suburbs as a new, safe Democratic seat.

TX-03, TX-06, TX-07, TX-10, TX-21, TX-22, TX-23, TX-24, TX-25, TX31, and TX-32 were all potential competitive seats in 2020. TX-15, TX-28, and TX-34 became competitive because of newfound Republican strength among South Texas Hispanics. All but one of the districts are now uncompetitive. Republican Districts gain more Republican voters, and the few Democratic held seats become more Democratic. All of the former Republican suburban seats reach deep into the rural and exurban areas and drop Democratic suburbs. Former rural and exurban seats – TX-04, TX-05, TX-08, TX-13, and TX-36 – reach deeper into the suburbs to carve up Democratic areas. The result is  districts with obtuse borders where the Democrats gained the most voters, such as the north Dallas suburbs with the new TX-04.

In South Texas, past voting rights litigation prevents Republican map-makers from exploiting recent party gains. The resulting districts resemble the present lines and stretch northwards, but the most GOP-favoring Hispanic areas are now congregated in TX-15 which makes it a potential swing district. O’Rourke did win this seat by over 10%, so the district will not be competitive if the 2020 results end up as a one-off occurrence.

Texas mappers still found ways to cater to their protected incumbents. In TX-10, Senior Republican Michael McCaul gets a district that squiggles narrowly around Austin from his neighborhood west of the city to rural Texas. New TX-06 Republican Jake Ellzey’s district takes in more rural areas where he is better known and loses Arlington Republican voters who backed Susan Wright during the 2021 Special Election. TX-25 previously did not include Republican Roger Williams’ base in Weatherford, west of Fort Worth. Now it does.

Republicans also released their proposed Legislative and Board of Education district maps, which can be viewed here. Biden in 2020 and O’Rourke in 2018 won a majority or a near-majority of districts on the former maps for these bodies, so Republican mappers were even more desperate to gerrymander these lines. Both maps protect incumbents in a similar manner to the Congressional plan with the rural and exurban areas reaching into the suburbs. The legislative plans however go beyond incumbent protection and each attempt to carve up a marginally Democratic seat in the Dallas-Fort Worth Metroplex. 

The desire to protect incumbents may end up dooming State House Republicans in future years. County nesting requirements prevented the GOP from linking the Republican dominated rural areas to the suburbs. By giving former Biden-District Republicans seats Trump won, other, formerly safe Republican seats needed to take in Democratic voters. Even more districts than previously become marginal districts that could potentially swing heavily away from the GOP.

Voting rights litigation is a constant factor in Texas redistricting. For example, plaintiffs forced Texas Republicans to draw the new Dallas-based TX-33 into a Hispanic Democratic seat in 2010 (initial 2010 map here). This new Congressional gerrymander disadvantages minority communities across the state, especially since nearly all of Texas’s recent growth came from minority groups. The proposed TX-23 is only 60% Hispanic compared to the 80% or higher in other South Texas seats, limiting minority opportunity. TX-27 has several majority Hispanic counties, including the city of Corpus Christi, inside a seat where White voters historically pick the representative. TX-38 could be a second, overwhelmingly Hispanic seat in the Houston area. TX-18 was previously an African American district, but is here majority Hispanic, an example of regression. Fort Worth minority voters are distributed between four Districts and there could be a fourth minority seat in the region. A majority-minority coalition seat can be drawn in the suburbs north of Dallas. Expect this criticism and more to potentially be levied in future court cases.

I suspect he means that only CD15 is competitive, but CD23 is only Trump+7, which seems competitive enough to me. I also think that over time several others will become more competitive as well, if these districts are allowed to go into effect as is. I’m sure there will be changes, and then of course the lawsuits, though as we well know they will take years to resolve. What we eventually get here is what we’re going to have for awhile. The Current and the Trib have more.

Still no quorum, and no Dem legislators rounded up yet

And I’m still not sure what exactly will happen when and if a law enforcement officer stumbles across one of the wayward legislators.

The hunt for missing Democratic Texas House members escalated late Thursday and Friday, as the sergeant-at-arms and law enforcement visited some of the absentees’ homes with the aim of bringing them to the Capitol.

Earlier this week, Republican House Speaker Dade Phelan issued civil arrest warrants for 52 Democrats who have refused to report to the House for a month now, depriving the Republican majority of the 100-member quorum needed to vote on legislation during two special sessions.

The warrants allow law enforcement to order, and even escort, members back to the chamber. But given that they are not guilty of a crime, members are not at risk of going to jail.

The first step in the search came Wednesday, when the sergeant-at-arms stopped by the Democrats’ Capitol offices and left copies of the warrants with their staffs.

On Thursday and Friday, law enforcement visited the homes of at least a few Austin Democrats, with the aim of bringing them back to the chamber, but found none of them.

Rep. Jon Rosenthal, D-Houston, returned to Texas last week but has not disclosed his location. He said Friday that he was unaware of any widespread effort to “physically collect folks” and was for the most part going about his life.

“I’m certainly not running around wearing Jon Rosenthal campaign gear or anything like that,” he said. “But I feel comfortable being outside and doing the things that normal humans do.”

An engineer by training, Rosenthal said he was still having meetings with constituents by phone or Zoom, as he has throughout much of the pandemic.

“I wouldn’t engage in anything like this if it wasn’t such an important, fundamental core issue,” he said.

Also Friday, Derrick Johnson, president and CEO of the National Association for the Advancement of Colored People, urged the Justice Department in a letter to intervene in Texas and determine that Abbott and Republican lawmakers were engaging in a civil rights conspiracy and violating Democratic members’ constitutional rights by using the threat of a civil arrest to compel attendance. The process for restoring a quorum is outlined in rules of the House that were unanimously adopted by members, including the Democrats, in the spring.

Johnson said he’d spoken with Black lawmakers — Reps. Jasmine Crockett of Dallas, Joe Deshotel of Beaumont and Ron Reynolds of Missouri City — and all of them supported Justice Department intervention.

The NAACP intervention is spurred in part by some yahoos offering a bounty to police officers for catching the Dems, which is very much the sort of thing no one should be encouraging. Again, I have no idea how this all plays out. How much does law enforcement even care about this? And what is the plan if and when they find someone? I don’t think anyone knows. I think when a police officer happens to encounter one of the quorum busters, no one has a clear idea of what happens next. I mean, given that it’s not a criminal warrant and there’s no threat of arrest, what is to stop the legislator from just walking away? All of this is completely half-baked, and is headed for a farce. Whatever the Republicans think they’re going to get out of this, I doubt they will be satisfied.

You can’t arrest the quorum-busters, at least not yet

Good to know.

A state district judge in Travis County issued an order blocking the arrest of House Democrats who have broken quorum by leaving the state, paving the way for those who remain outside of Texas to return home without threat of apprehension.

State District Judge Brad Urrutia, a Democrat, granted the temporary restraining order late Sunday night restricting Gov. Greg Abbott and House Speaker Dade Phelan from “detaining, confining or otherwise restricting” the free movement of House Democrats within the state or issuing any warrants ordering their confinement.

The order expires in 14 days unless extended by Urrutia. The court will hear arguments on a temporary injunction on Aug. 20 where Abbott and Phelan must show why a temporary injunction should not be filed against them.

The petition for the restraining order appears to be preemptive in nature, as the House has not yet voted to renew a call of the House in the second special session which began Saturday.

“[T]he Speaker thinks he can wave his hand and have his political opponents rounded up and arrested. We’re watching a major political party backslide in real time from fair representation, the rule of law, and democracy itself,” said Dallas State Rep. Jasmine Crockett, one of the plaintiffs in the case.

Enrique Marquez, a Phelan spokesman, said Monday morning the speaker’s office had not yet been notified of the suit or restraining order. Abbott’s office did not immediately respond to a request for comment.

The lawsuit was filed on behalf of 19 House Democrats by attorneys Samuel E. Bassett, Jeremy Monthy and Megan Rue.

“No matter what the Governor or Speaker have said, it is a fundamental principle in this country that no one has the power to arrest their political opponents. That is why this action had to be filed,” Bassett said in a statement.

The plaintiffs are Reps. Gina Hinojosa, Alma Allen, Michelle Beckley, Jasmine Crockett, Joe Deshotel, Barbara Gervin-Hawkins, Vikki Goodwin, Celia Israel, Ray Lopez, Armando “Mando” Martinez, Trey Martinez Fischer, Ina Minjarez, Christina Morales, Mary Ann Perez, Ana-Maria Ramos, Richard Peña Raymond, Ron Reynolds, Eddie Rodriguez and Ramon Romero, Jr. All of the plaintiffs broke quorum and left the state in July.

It is the second lawsuit filed by House Democrats in an attempt to avoid arrest if they returned to Texas. The other was filed Friday by attorney Craig Washington in federal court in Austin on behalf of 22 House Democrats. It was riddled with problems, including subsequent statements by at least four of the plaintiffs that they had not authorized the suit on their behalf.

The lawsuit in federal court also named State Rep. James White, R-Hilister, as a defendant. White is not named as a defendant in the case in state court.

In his order, Urrutia said Abbott and Phelan erroneously interpreted Texas law and legislative rules to allow the apprehension of members of the House in response to a call for quorum. He barred the defendants from detaining or restraining the Democrats’ movement in any way and from issuing warrants or other documents ordering their apprehension. Urrutia also barred the defendants from ordering law enforcement to arrest the lawmakers.

A copy of this lawsuit is here, and of the judge’s order is here. As the story notes, this has nothing to do with that other lawsuit, filed in federal court, which did not seem to make much sense. This one at least I can understand, and it has bought the Dems some time. Whether they choose to remain out of the Capitol during this time or not remains to be seen, but at least now they have the option. KXAN, the Current, and the Chron have more.

UPDATE: Though more Dems did show up yesterday, the Lege still fell short of a quorum. Tune in again today at 4 PM to see the next episode.

Dissension in the ranks

Some of the Texas House Democrats who are still in Washington, D.C., did not hold back Monday as they watched more of their colleagues return to Austin and bring the chamber within single digits of a quorum.

“You all threw us under the bus today! Why?” Rep. Ana-Maria Ramos of Dallas said in a tweet addressed to three of her Democratic colleagues who came back to Austin.

The House had as many as 95 members on hand at one point Monday afternoon, five members short of quorum but the nearest the chamber has gotten to being able to start business since most Democrats fled last month over the Republican elections bill. It was the third day of the second special session, and the GOP-led House again issued a “call of the House,” procedural move to lock the doors of the chamber and prevent members from leaving without permission.

The 95 members who were present included at least four new Democrats: El Paso-area Reps. Art Fierro, Mary González and Joe Moody, as well as Rep. James Talarico of Round Rock. Moody is the former speaker pro tem, a title that House Speaker Dade Phelan, R-Beaumont, stripped from Moody in retaliation for the quorum break during the first special session.

Talarico was the most open about his return, announcing it on Twitter and issuing a statement explaining his decision, saying he was coming back to work on “real issues Texans face” after a productive time in Washington.

While the quorum-busting Democrats were able to maintain a largely united front during the first special session, which ended Friday, it was clear they reached a fork in the road when the second special session began a day later. A group of them released a statement saying that 26 House Democrats would be staying behind in Washington to keep up their fight to pass federal voting rights legislation in Congress.

Another House Democrat still in D.C., Rep. Gina Hinojosa of Austin, also scrutinized the Democrats who returned Monday afternoon on Twitter, calling out Fierro, González, Moody and Talarico as the House was waiting to see if it could still reach quorum for the day.

“Quorum is still not met,” Hinojosa tweeted. “Praying no other Democrats willingly go to Floor.”

I’d prefer not to throw any lighter fluid on this fire, so I’m going to keep this short and simple. Sticking together and not having people wander back to Austin was a key to not losing the political and PR battle in the first special session. With that behind us, members will once again have to make their own decisions about what to do, but only to a point because restoring the quorum or not needs to be a strategic decision, made with everyone’s buy-in. I don’t know what happened here, but this obviously ain’t a great look. There’s still no quorum, though the more Dems that make like these colleagues, and the more Republicans who come off the COVID quarantine list, that may not be the case for much longer. Pick a plan and stick with it, that’s all I’m asking, And iron this stuff out behind closed doors, none of us needs to see this.

Meet the new special session

Same as the old special session, at least at first.

It appears likely that not enough Democrats will show up for the Texas House to conduct business when a second special legislative session convenes Saturday.

Some of the more than 50 Democratic representatives who fled Texas to foil the first special session began trickling out of their Washington, D.C., hotel and heading home Friday. But 27 members have committed to staying in the nation’s capital. At the same time, Democrats were working to confirm that at least 50 members will pledge to not return to the House floor on Saturday even if they are back in Texas.

If that happens, the chamber would again be deprived of a quorum to conduct business for at least a few days. And it could set up a showdown over whether House Speaker Dade Phelan has the authority, and political will, to compel Democratic representatives in Texas to show up at the Capitol.

The ongoing absences would further delay any consideration of the 17-item agenda Gov. Greg Abbott has set for the 30-day special session, including a contentious voting bill, which Republicans have vowed to pass into law, that motivated Democrats to leave the state last month. Two-thirds of the 150 member chamber must be present to conduct business. One seat is currently vacant.

“If you’re looking for us to telegraph exactly what we’re going to do over the next couple days, we’re not going to do that at this time,” state Rep. Chris Turner, the Democratic caucus chair, said earlier in the day. “The governor would love us to do that, but we’re not going to.”

The House Democratic caucus would not confirm any details about its next move as of Friday evening after marking the last day of the first special session that was derailed after 57 members broke quorum.

The number of Democrats actually in Washington had appeared to dwindle to about 40 members over the last few days. But with 27 Democrats planning to stay behind, even some of the Democrats seen departing from their hotel in Washington on Friday indicated the House floor may not be their destination.

“If Congress is in session, we’re in session,” state Rep. Trey Martinez Fischer, D-San Antonio, said earlier in the day. “Our job is here, and we will have a significant number of members staying here and waiting day by day, engaging day by day, finishing the fight.”

Well, we’ll see. We ought to know early on what the head count is. In one of the earlier stories I saw, it was noted that the Republicans are also not quite at full strength, as some are on vacation or otherwise not available – Jake Ellzey is now in Congress, so right there they’re down one – and that means they need that many more Dems to show up to get to 100. We don’t know if Speaker Dade Phelan is going to follow through on the threat to use DPS to hunt down wayward Dems in the state and drag them to Austin. We may eventually get a quorum, but it won’t happen right away.

Later on Friday, this happened.

Twenty-two Texas House Democrats sued some of the state’s top Republican leaders in federal court in Austin late Friday, alleging that GOP officials’ efforts to bring them home for a special legislative session infringed on their constitutional rights to free speech and to petition the government for redress of grievances.

The lawsuit was filed on the final day of the first special session called by Gov. Greg Abbott — and on the eve of a second specially called legislative session — and names as defendants Abbott, House Speaker Dade Phelan and State Rep. James White.

It’s unclear why White was listed as a defendant. White said Friday night he was not aware he’d been sued or why he was named as a defendant. The lawsuit also did not use Phelan’s legal name, which is Matthew McDade Phelan.

Abbott and Phelan did not immediately have a statement on the lawsuit.

The Democrats’ attorney, Craig Anthony Washington, a former Democratic lawmaker, did not respond to a request for comment. Washington is practicing law under a probationally suspended license, according to the State Bar of Texas.

The lawsuit alleges that some Democrats are being targeted because of their race and skin color, but then provides no evidence.

It also claims the three Republican lawmakers acted together under the “color of law” to cause the harm alleged in the suit, but then points no specific harmful actions other than “public statements.” The lawsuit also says some individual plaintiffs experienced “retaliatory attacks, threats and attempts at coercion relating to the exercise of their First Amendment rights” but again does not provide specifics.

The plaintiffs listed in the case are state Reps. Senfronia Thompson, Trey Martinez Fischer, Gene Wu, Vikki Goodwin, Ron Reynolds, Eddie Rodriguez, Jon Rosenthal, Jasmine Crockett, Mary Ann Perez, Alma Allen, Christina Morales, Nicole Collier, Celia Israel, Ana-Maria Ramos, Barbara Gervin-Hawkins, Terry Meza, Donna Howard, Jarvis Johnson, Ray Lopez, Shawn Thierry, Elizabeth Campos and Gina Hinojosa.

The lawsuit alleges that the three Republican lawmakers have attempted “by public statements and otherwise, to attempt to deny, coerce, threaten, intimidate, and prevent” the Democrats and their constituents from voting in all elections, petitioning the government for redress of grievances, speaking publicly about their constitutional rights, exercising their right of association and their right to not being arrested without probable cause. The Democrats allege that in acting together, the defendants engaged in a conspiracy to deprive them of their constitutional rights.

Because of the defendant’s actions, the complaint alleges, the plaintiffs have been “deprived of liberty for substantial periods of time, suffered much anxiety and distress over separation from their families, and much discomfort and embarrassment.” They also have suffered damages to their reputations and have had to spend time traveling to Washington to lobby Congress to pass laws that would protect voting rights.

That sounds pretty unlikely to me, even without the issues noted for attorney Craig Washington. You can read a copy of the lawsuit and come to your own conclusions, but this seems like an extreme longshot. And as to why Rep. White was named as a defendant, my guess is it stemmed from his request for an AG opinion suggesting that the quorum-breaking Dems had “vacated” their seats. Even if you could count on Ken Paxton’s office to give an honest answer, that seems like a big escalation of the stakes.

And in other desperation moves, there’s this.

Texas Republican leaders said Friday they were extending “an additional month of funding” for the Legislature as a deadline to reinstate those dollars vetoed by Gov. Greg Abbott nears, which could cost some 2,100 state workers their salaries and benefits.

The announcement Friday by Abbott, Lt. Gov. Dan Patrick and House Speaker Dade Phelan comes a day ahead of the beginning of a second special session, where it’s still unknown whether enough state lawmakers in the lower chamber will convene in time to restore the funding long term.

Citing an emergency, the Legislative Budget Board requested the transfer of funds, according to a memo dated Aug. 6 from Abbott responding to the LBB’s proposal. Funds amounting to at least $12.6 million will be transferred from the Texas Department of Criminal Justice to the Senate, the House, and legislative agencies such as the LBB, the Legislative Council and the Legislative Reference Library.

Abbott referenced his veto in that memo, reiterating his position that “funding should not be provided for those who quit their jobs early and leave the state with unfinished business, exposing taxpayers to higher costs for additional legislative sessions.”

“However, in order to ensure the Legislature is fully resourced to do the work of the next special session,” he wrote, “I recognize that the partial restoration the Legislative Budget Board had proposed is necessary.”

The extension announced Friday means that those legislative employees and legislative agencies will have funding intact through Sept. 30 instead of Sept. 1, when the next two-year state budget takes effect.

I thought the LBB could only meet when the Lege was not in session, which is certainly was on Friday. If this is all it took, then why not act sooner? And why not free up more money? This has the feel of something half-baked, though I suppose if no one challenges it in court there’s nothing to stop it. And hey, even if someone does challenge it in court, the Supreme Court will just sit on it until the matter becomes moot anyway, so what difference does it make? We’re off to a roaring start here, that’s for sure.

The Texas Dem legislators and the push for federal voting rights legislation

We know this happened.

Vice President Kamala Harris on Wednesday pointed to Texas Republicans’ push for sweeping new voting restrictions as a key illustration of the need to restore federal oversight of elections.

While meeting at the White House with a group of Democratic members of the Texas Legislature, Harris pointed to the U.S. Supreme Court’s 2013 ruling to nullify the lynchpin of the landmark Voting Rights Act that kept states like Texas under “preclearance” of its voting laws to safeguard the rights of voters of color — a measure Democrats are hoping to bring back with new federal legislation.

“We have seen exactly what we feared when that case came down in 2013. Because that case was an opening of a door to allow states to do what otherwise we have protected against, which is states putting in place laws that are designed, in many cases quite intentionally, to make it difficult for people to vote,” Harris said. “And so this is what we’ve seen over and over again, and what’s happening right now in Texas is, of course, a very clear and current example of that.”

Harris’ remarks came at the start of a meeting with 16 Democratic members of the Texas Legislature. The vice president, who is leading the Biden administration’s voting rights efforts, invited the lawmakers to the White House after state representatives in May staged an 11th hour walkout of the state Capitol to break quorum and prevent a final vote on what is considered one of the most restrictive GOP-backed state voting bills following the 2020 election. On Wednesday, Harris called the Democrats “courageous leaders” and “American patriots.”

The bill Democrats defeated, Senate Bill 7, would have brought sweeping changes to Texas elections by restricting voting hours, narrowing local officials’ control of elections, further tightening the rules for voting by mail and bolstering access for partisan poll watchers, among several other provisions.

In a series of meetings with U.S. senators and congressional leaders, Democrats have been using the trip — and the national attention their quorum break garnered — to push for a pair of federal bills that could preempt portions of the Texas legislation they temporarily prevented from becoming law and restore expansive protections for voters of color. With Republicans in full control of the Legislature, Gov. Greg Abbott has vowed to call lawmakers back this summer for a special legislative session to pass the bill into law.

The far-reaching federal For the People Act would overhaul elections, requiring states like Texas to offer automatic and same-day voter registration. Under the law, Texas would also have to drop its tight eligibility requirements for voting by mail, among several other changes to state law. The more narrowly tailored John Lewis Voting Rights Advancement Act could place Texas back under federal oversight so its election laws could not go into effect before the federal government ensured they wouldn’t undermine the voting rights of people of color.

Under preclearance, various sets of political maps and voting restrictions were placed on hold with federal courts repeatedly finding Texas lawmakers intentionally discriminated against voters of color in drawing them up.

The point of preclearance, and the reason for the urgency, is that in a world where preclearance has been restored, any new legislation that affects voting in any way will have to be reviewed before it can be implemented. In the world we’re in now, those bills go into effect until and unless they are put on hold by a federal court after a lawsuit has been filed. As we know from the past decade’s experience with voter ID and redistricting, there’s no reason to expect that to happen. The federal bills would re-establish preclearance in some updated fashion – remember, the Shelby decision was predicated on the fact that the formula used to determine which states needed to be under preclearance was outdated, and it said that Congress could fix that.

The key, though, is that this would only affect state laws passed afterwards. If SB7 had been passed, or if it passes before Congress can enact its bill, then preclearance doesn’t apply. That’s why the quorum break, which doomed SB7 for now, was so consequential, and why the Texas Dem legislators are good spokespeople for getting that ball rolling. I don’t know what will happen in terms of the Congressional calendar – really, the Senate’s calendar, as the House has already passed both of those bills and would be able to pass a revised version of either in short order – but at least the Dems had a receptive audience for their pitch.

Reps. Trey Martinez Fischer and Jasmine Crockett met with [Sen. Joe] Manchin’s staff on Tuesday. In comments to Texas Signal, Crockett maintained that the meeting with his Chief of Staff and another aide was quite substantial. According to Crockett, they started going through all the provisions of the For The People Act, also known as H.R. 1, they agreed with.

“I’m not really one for this term incremental change they continually try to sell me in the Texas House, but if this is what incremental looks like that will at least provide us cover now,” said Crockett. She also told the Texas Signal there were certain things that Manchin supported, like vote by mail options for those who are sick or have a conflict with work, that would be a lot more expansive than what we currently have in Texas now.

Crockett believes a big factor in Manchin’s movements towards supporting some version of a voting rights bill stems from his former role as West Virginia Secretary of State. She also believes she and Martinez Fischer were able to really convey the totality of the voter suppression efforts of SB 7 to him and his staff. “We were able to give them some of the details that they just weren’t privy to because they’ve not lived and breathed SB 7 all session,” said Crockett.

Some members of the Texas delegation did actually meet with Manchin in Washington. U.S. Reps. Sylvia Garcia, Al Green, and Henry Cuellar helped broker the last-minute meeting, which Garcia called “productive.” Senator Jose Menéndez posted on Twitter afterward, writing “Working together we’ll find a pathway forward to protect [voting rights] of all Americans and protect our democracy.”

The fact that Manchin was engaging in an earnest debate, was also for Crockett a step forward on voting rights legislation. That wouldn’t have happened if Texas House Democrats had not broken the quorum. “I really do feel like we were heard, and we were heard in a manner that we wouldn’t have been heard if we just sat there and pushed our buttons and said no and [SB 7] became law,” said Crockett.

There does appear to be some momentum now for the Manchin version of SB1, which received Stacy Abrams’ support as well. It’s when the Republicans filibuster it, and it becomes clear there isn’t any support on their side for the Manchin revision, that we’ll see whether the immovable object or the irresistible force wins.

Ground Game Texas

Some of Democrats’ biggest regrets about the 2020 election in Texas had to do with organizing. It was not consistent throughout the cycle — and usually isn’t in any cycle. It was supplanted by TV ads at the end. And it was hampered by the coronavirus pandemic.

Now, with the backing of the state’s most prominent Democrats, two former congressional candidates are trying to turn those regrets into action.

The candidates, Julie Oliver and Mike Siegel, are launching a new nonprofit called Ground Game Texas that will focus on year-round organizing on progressive issues, aiming to fill what they see as a statewide void for their party. The group starts off with a $1 million investment from Register2Vote, a national nonprofit that the two already help lead.

“There’s no off years and there’s no off cycles, and folks need to stay engaged year-round,” Siegel said in an interview, adding there is “kind of a tendency among Democratic activists” to get involved only in presidential-election years or high-profile down-ballot contests like the 2018 U.S. Senate race. “The Republican Party doesn’t do that. They never stop.”

Ground Game Texas will organize Texans around issues rather than candidates, with a focus on what Siegel and Oliver are calling “workers, wages and weed” — issues like raising the minimum wage and legalizing marijuana that poll well but are not reflected by Republican policymakers in the state. A February University of Texas/Texas Tribune Poll found that 60% of registered voters in Texas support legalizing some amount of marijuana for any use. A similar number in April expressed support for increasing the federal minimum wage.

The group expects to throw its weight behind local ballot initiatives, which often involve a lot of ground work such as collecting signatures for petitions to put the issues on a ballot. Siegel said he has already had conversations about proposals in 10 cities — places like Mission, Bedford and Elgin. The leading ideas there, he said, are decriminalizing marijuana and creating funding for climate jobs.

Ground Game Texas is launching with the support of three of the best-known Texas Democrats: Julián Castro, Wendy Davis and Beto O’Rourke, who said in a statement that the new group “is going to meet Texans where they are at to listen to them about the issues that matter most.” And it starts with an advisory board that includes Davis; rising-star state Reps. James Talarico of Round Rock and Jasmine Crockett of Dallas; and longtime party stalwarts such as former Agriculture Commissioner Jim Hightower and Texas AFL-CIO president Rick Levy.

The advisory board additionally features Democrats who ran in nationally targeted districts last year and suffered some of the toughest losses, like Candace Valenzuela, who narrowly lost to now-U.S. Rep. Beth Van Duyne, R-Irving.

Both Oliver and Siegel have firsthand experience with the challenges Democrats faced last election cycle. They both performed surprisingly well when they ran against Republican incumbents in 2018 — Oliver against U.S. Rep. Roger Williams of Austin and Siegel against Rep. Michael McCaul of Austin. In 2020, both ran again, only to lose by larger margins.

In 2020, both gained the backing of the Democratic Congressional Campaign Committee, which named them to its Red to Blue program for promising challengers. But they remain skeptical of the committee’s priorities.

“[The DCCC] doesn’t really invest in this sort of infrastructure building that Mike and I did in our campaigns,” Oliver said. “That strategy is so different between the DC strategy and the Texas strategy. … The DC strategy doesn’t really work here in Texas, so we want to do year-round organizing.”

The DCCC announced Monday that it was including Texas in an initial seven-figure investment nationally in on-the-ground organizing, calling it the “earliest ever organizing investment of this scale and scope in DCCC’s history.” The committee said it would target areas in Texas such as Dallas, Houston and the Rio Grande Valley, where Democrats notably underperformed last year.

As I’m sure you can guess, I approve of the issues they are focusing on. I very much think there’s ground to be gained by pushing real marijuana reform, and by “reform” I mean decriminalization, if not legalization. People across the board want it, and the single biggest impediment to it is Dan Patrick. I’m more skeptical of raising the minimum wage as a winning issue – note that the polling question is about whether one supports raising the federal minimum wage, not whether one supports raising the minimum wage in Texas – but am happy to push the idea. I trust that the focus on local ballot initiatives is a starting point, because that’s not going to get very far and any success they have is certain to wind up in court, if not in legislative pushback.

Putting emphasis on organizing when three’s not an actual election going on is a good and long-needed idea as well. Lots of people complain that no one talks to them about issues and what’s important to them outside of a “please vote for me” context, so this addresses that gap. We may find out that a lot of these people prefer being left alone most of the time, but there’s no way to know until you try. The bigger point here is that by having this kind of campaign infrastructure be year-round, you’re not having to rebuild from scratch every other year.

We’ve certainly seen various initiatives, promising various kinds of new engagement, come and go over the years. I’m sure that no matter what happens in 2022, in two years’ time I’ll be reading about yet another new effort to organize and engage and register. That’s fine, and it doesn’t mean that what came (and possibly went) before now was wasted or useless. We’ve had to try a lot of things, and to see what works and what doesn’t, we’ve learned from past experiences, and we have made a lot of progress even if the statewide breakthrough hasn’t happened yet. It would be much more concerning to me if we weren’t seeing new efforts like this, spearheaded in part by new additions to the political team, popping up and making news. We all have options for how we want to get involved now. Find the one that works best for you and get into it.

Better cut your police budget now while you still can

That’s one possible takeaway from this.

The Texas House on Friday passed a bill to financially penalize the state’s largest cities if they cut their police budgets. The measure was sent to the Senate after two days of heated debate and emotional speeches, with the bill authors calling to “back the blue” and the opposition decrying the bill as political propaganda.

House Bill 1900 comes after a year of civil rights advocates calling on cities to reduce what they spend on policing and to reform police behavior. Those calls were spurred by high-profile deaths at the hands of police like George Floyd’s in Minneapolis and Mike Ramos’ in Austin.

Among Texas’ largest cities, only Austin cut its law enforcement funding last year, though almost all of that decrease came from an accounting shift of money that still allows traditional police duties to remain funded, but potentially in different city departments. Still, the city’s response to some activists’ calls to “defund the police” prompted harsh and immediate backlash from Republican state leaders, who have pointed to fast-rising homicide rates throughout the state and country as a reason to maintain police funding levels.

Gov. Greg Abbott became laser-focused on Austin’s budget and “backing the blue,” making legislation to punish cities that decrease police funding one of his emergency items this year.

After initial passage Thursday, HB 1900 was finally approved on a 90-49 vote Friday and sent to the upper chamber. The Senate’s related bill, which would require an election before cities could decrease police funding, passed out of the upper chamber last month. It’s unclear how either chamber will react to their counterpart’s proposal.

HB 1900 was authored by Republican state Reps. Craig Goldman, Will Metcalf, Greg Bonnen and Angie Chen Button and Democrat Richard Peña Raymond. If a city with more than 250,000 residents was determined by the governor’s office to have cut police funding, the bill would allow the state to appropriate part of a city’s sales taxes and use that money to pay expenses for the Texas Department of Public Safety. Such cities would also be banned from increasing property taxes or utility rates, which could have been used to compensate for the reapportioned sales taxes.

The bill does allow cities to cut police department budgets if such a decrease is proportionally equal to an overall city budget decrease. Cities can also get approval to cut police budgets if expenses for one year were higher because of capital expenditures or disaster response. The bill would also let neighborhoods annexed in the last 30 years to vote to deannex themselves from a city that has decreased funding to its police department.

Several other Democrats offered amendments Thursday to add exceptions for when a city could cut police department funding. State Rep. Trey Martinez Fischer of San Antonio offered leniency so city council members wouldn’t opt against a necessary increase in police funding for fear they could not turn it back the next year. And state Rep. Jarvis Johnson of Houston filed multiple amendments, including one to not punish cities for cutting civilian positions within law enforcement agencies. He said the Houston Police Department has more than 1,200 civilian jobs, including janitors and other positions he listed off.

“At any given time that Houston Police Department decides we no longer need a car attendant, we no longer need a car attendant supervisor, we no longer need a truck driver, we no longer need a typist, that does not mean that the city of Houston has decided to defund the police,” he said.

The amendments failed, as the Democrats denounced what they called partisan rhetoric and a move for state control over large cities.

On Friday, state Rep. Gene Wu, a Houston Democrat, offered up amendments to first eliminate the 250,000 population cap which Democrats argued only punished larger, more liberal cities. When that failed, he attempted to set the population cap at 50,000, then 200,000. Both amendments failed. His argument that the 250,000 limit was an arbitrary number and goes against the legislative intent of public safety for all Texans could buttress potential legal challenges if the bill is signed into law.

“If we’re true to our word to say why we are doing this … then we should accept this amendment to apply to all 30 million Texans,” he said.

Well, the real reason they’re doing this is because Greg Abbott was mad at Austin, but it’s not polite to bring that up. And not having a significant minimum population requirement means the law might have to apply to places that Republicans represent (*), and we can’t have that. So here we are. By the way, law enforcement agencies from the cities that this bill targets opposed it, and got the same result they got in opposing permitless carry. We have a strange definition of “backing the blue”, it seems.

Anyway. My suggestion in the title is not original to me, I got it from Grits for Breakfast post.

The Legislature gets to write the laws, but even they are not immune from the Law of Unintended Consequences. I don’t think legislators have considered the incentives they’re putting in place in HB 1900 punishing cities that “defund” police department (by which in Austin’s case they mean delaying cadet classes by one year). Going forward, cities that increase police spending can never again lower it. But they often need to do so. Now, cities will decline to spend more, knowing they won’t be allowed to spend less. Bill authors even rejected amendments so that overtime for one-off special events – like a Super Bowl weekend in Houston – would be counted against them the following year. If I’m right about the new incentives facing city councils under this legislation, the result will be to suppress police spending instead of bolster it. I predict that if HB 1900 becomes law, when we look back five years from now the growth rate in police budgets will have flattened, not rallied.

Indeed, the most delicious irony may well come if HB 1900 ends up itself defunding the police!

Note that this is the same logic that led to Harris County Commissioner’s Court proposing a property tax rate increase in 2019 as a way to hedge against the revenue cap law that the Lege passed that year, which would essentially prevent them from ever raising rates in the future regardless of situation or need. (This was only defeated because of an anti-majoritarian quirk in the law that allowed a minority of Commissioners to prevent the vote by breaking quorum.) I don’t actually think any city will take this action for the simple reason that it turns the heat on them in an uncomfortable way, but the incentive is there. I do think Grits is correct that the future effect will be to introduce extreme reluctance to approve any increase in police budgets, because it’s a one-way ratchet that can only have negative effects elsewhere. Indeed, it’s likely just a matter of time before city controllers and city managers start releasing five-year budget projections that warn of various consequences from this bill. Among other things – and I expect this is why the big city police departments opposed this – this will put downward pressure on wages and benefits for police officers, as well as a strong disincentive to approve overtime. Cities are going to do what they need to do. If you don’t like it, go yell at Greg Abbott.

(*) – Technically not true, though the large majority of State Reps from the cities this will apply to are Democrats. That may change in the near future, as places outside the big urban counties like Frisco, Grand Prairie, and McKinney become covered by HB1900. Maybe that will make their Republican representatives more receptive to the idea of modifying or repealing that law in the future, or maybe these cities will follow in the footsteps of places like Garland and Irving and just become Democratic cities themselves. The list on unintended consequences here could wind up being very long indeed.

2020 primary runoff results: SBOE, Senate, House

Again, bullet points. Get used to it.

SBOE6 Dem: Michelle Palmer had a 65-35 lead after early voting, and that was pretty much all there was to it.

SBOE5 GOP: It’s much more boring and sedate, but the Republican candidate who didn’t arrive in a clown car, Lani Popp, defeated performance artist and semi-professional troll Robert Morrow. This is the best pickup opportunity for Dems, but since no one pays attention to SBOE races – the district are ginormous and candidates never have any money – there would have been a chance Morrow could have won if he’d been the nominee. Having Popp carry the GOP banner lowers the Dem chances slightly, but as we know from other elections it’s never a good idea for a chaos agent to be a viable candidate in any race. Whatever happens in November, this was the better outcome.

SD14 special election: Sarah Eckhardt has been over fifty percent all night. This may change by the morning, but as I type this she appears to be headed for a victory without a runoff.

UPDATE: The final results from Travis County show Sarah Eckhardt winning with 51.1%, but I’d forgotten that Bastrop County is also in SD14, and Eckhardt is only at 31% there thanks to 38% of the vote going to Republican Don Zimmerman. It appears that is enough to keep her under 50%, which means a runoff with Rep. Eddie Rodriguez.

SD19 Dem: State Rep. Roland Gutierrez has bounced back from his second place finish in March to lead 53-47 as I write this. Seems likely he’ll hand on.

SD27 Dem: Alas, Sen. Eddie Lucio has also hung on, leading 54-46 in the later evening. I believe he said this would be his last term. We can only hope.

State House Dem Sarah DeMerchant will get her third shot at HD26 in Fort Bend County. In Harris County, Akilah Bacy crushed it in HD138, Rep. Harold Dutton eked it out in HD142, and going late into the night, Penny Shaw was leading Anna Eastman in HD148. Eastman had a sizable lead in mail ballots – her campaign worked that pretty hard – but Shaw equaled that in early votes, and had a small but growing lead on Election Day. Anna’s a friend and I’m sad for her, but Shaw appears to be the nominee. I suspect – and I’d have said this regardless of who won – there will be another hotly contested primary in HD148 in 2022. It’s a fact of life with redistricting, and there’s a high potential for the neighborhoods in and around HD148 to be swapped in and out of various districts, as was the case in 2011. (I personally was at various times that year drawn into HDs 134, 143, 146, 147, and 148, before finally landing in 145. I can hardly wait to see what happens next.)

In Dallas, Lorraine Birabil, who had won the special election in HD100 and was leading by enough early on for me to say she had won, was trailing Jasmine Crockett by about 90 votes late in the evening, with three vote centers yet to report. (Hat tip to Scott Braddock and his indefatigable Twitter feed.) Elsewhere, Liz Campos won in HD119, while Lorenzo Sanchez (HD67) had a small lead. Two Republican incumbents were ousted, Dan Flynn (HD02) and JD Sheffield (HD59). Jacey Jetton had a modest lead in HD26.

UPDATE: Birabil is still trailing Crockett in HD100, but it’s not quite final yet.

Runoff reminder: State House

There are seven Democratic primary runoffs for State House districts. Let’s have a look at what we’ve got.

HD26

Located in Fort Bend County, HD26 is an open seat now held by Rep. Rick Miller, who dropped out of his contested primary after some racist remarks he’d made were publicized. Sarah DeMerchant, the Dem candidate in 2016 (42.1% of the vote) and 2018 (47.6%) faces off against first-time candidate Dr. Suleman Lalani. Lalani led in March 31.7%, DeMerchant had 29.6%. I do not know if either of the other two candidates from March have endorsed in the runoff. HD26 is a prime target for Dems, one of the nine districts carried by Beto won by Republicans last time around. HD67

Moving up to Collin County, this is one of two near-misses for Dems from 2018, where Sarah Depew took 48.8%. (Sarah Hirsch, who got 49.7% in 2018, is back for another crack at HD66.) Four new candidates lined up for this race, with Tom Adair (32.9%) and Lorenzo Sanchez (27.0%) ending as the top two. Adair was endorsed by the DMN in March, and is quoted in this story from the Plano Against Police Brutality march in early June. Sanchez has been endorsed by Latino Victory Fund and also by former Senate candidate Cristina Tzintzun Ramirez. Both appear to have been quite active at recent protests and rallies, going by their respective Facebook pages.

HD100

This is an open Democratic seat, vacated by Eric Johnson, who is now the Mayor of Dallas. Lorraine Birabil won the special election to fill out the remainder of Johnson’s term, so she is the incumbent, though she has not participated in a legislative session yet. (There’s another race like this later, as you may know.) She led the field of six with 29.3%, followed by Jasmine Crockett at 25.9%. The Lone Star Project recently sent out an email touting Rep. Birabil’s accomplishments in her short time in office – she has called for a special session to address police violence and has vowed to file legislation on the topic. Crockett for her part has been representing protesters and co-filing lawsuits on behalf of people injured by rubber bullets. Rep. Birabil is an Annie’s List-endorsed candidate.

HD119

Also an open Democratic seat, now held by Rep. Roland Gutierrez, who as we know is running for SD19 and is in a primary runoff there. Elizabeth “Liz” Campos (whose website was offline when I drafted this) and Jennifer Ramos were the top two contenders, with 46.1% and 43.8% in March, respectively. Ramos was endorsed by the Express-News in March, and was also endorsed by Latino Victory Fund. I don’t have much else to tell you about this race.

HD138

Our last three races are all in Harris County. HD138 is the only one currently held by a Republican, and it is another Beto-carried top target, which fell short of flipping in 2018 by a handful of votes. Akilah Bacy led the way in the primary with 46.8%, followed by Jenifer Rene Pool with 29.2%. (Google still does not show a campaign webpage for Pool when I search for her.) Bacy was endorsed by the Chronicle in March, by 2018 candidate Adam Milasincic before that, and is on the Annie’s List slate. My interview with Akilah Bacy is here, and with Jenifer Pool is here.

HD142

Remember this one? Longtime Rep. Harold Dutton, forced into a runoff against still-serving-on-City-Council-in-District-B-because-we-can’t-get-a-damned-runoff-scheduled-there Jerry Davis? The race with the mystery candidate that other State Reps want investigated? That investigation is ongoing, I’ve not heard anything since then. Yeah, I don’t know what I can add to this.

HD148

Last but not least, the other district in which a special election winner is trying to be the official November candidate. Anna Eastman won the special election and runoff to fill out the remainder of Jessica Farrar’s term. She took 41.6% in the field of five in March. Penny Shaw, who was a 2018 candidate for County Commissioner in Precinct 4 and who finished sixth in the 13-candidate special election, took 22.1% in March. Eastman was endorsed by the Chron in both the special election and the primary. She has been touting vote by mail for the runoff, and along with Rep. Jarvis Johnson and Sen. John Whitmire has promised to introduce legislation making it easier for homeowners associations to change deed restrictions to easily allow old racist language to be removed. Shaw was endorsed by Farrar for the primary, and has the larger share of organizational endorsements. I interviewed both for the special election – my conversation with Rep. Eastman is here, and with Shaw is here. Both also participated in a forum held by the 2020 Democratic Candidates Debates group on Facebook, and you can see that here.

Note that in that HD47 primary, one (1) vote separates second and third place, according to the Travis County Clerk. I assume there will be a recount, and even before then late-arriving mail ballots could change this. In the event of an actual tie, there will be a coin flip to determine who goes to the runoff. I’m rooting so hard for that outcome, you guys.

In the HD67 primary, 63 votes separate Lorenzo Sanchez and Rocio Gosewehr Hernandez, or 0.3 percentage points. I would expect a recount there as well, but with a far lesser chance of affecting the outcome.

Lorraine Birabil was the winner of the special election in HD100 to fill out the unexpired term of Eric Johnson, who is now Mayor of Dallas. Anna Eastman was the winner of the special election in HD148 to succeed Jessica Farrar.

14th Court of Appeals, Place 7 – Tamika Craft versus Cheri Thomas

164th District Court – Cheryl Elliott Thornton versus Alex Smoots-Thomas
339th Criminal Court – Te’iva Bell versus Candance White

County Commissioner, Precinct 3 – Diana Martinez Alexander versus Michael Moore

Moore was leading most of the night, but Alexander caught and passed him as final results came in. I don’t care to go through the various Constable and JP races, but the good Jerry Garcia was leading problematic incumbent Chris Diaz going into the Precinct 2 Constable runoff.

Whatever turnout there will be in the runoffs will be driven primarily by the Dem Senate race and the Congressional races on both sides. Won’t be much, but it ought to be a bit more than usual, and surely more on the D side if there were no Senate runoff.
