The price of disrespect

Gov. Greg Abbott on Tuesday endorsed the Republican challenger to Galveston state Rep. Wayne Faircloth, a move that is expected to deepen simmering divisions within the state Republican party.

In a new video, Abbott called Mayes Middleton a “principled conservative — a conservative who will be a tireless advocate for his constituents.”

“In the next legislative session, we have an opportunity to continue to pass reforms that make Texas even better,” Abbott said. “To do this, we need leaders who will work with me to advance a conservative agenda that will benefit every Texans our great state. That is why I am endorsing Mayes Middleton for state representative.”

Middleton is an oil and gas businessman and rancher from Chambers County and is a board member of the conservative Texas Public Policy Foundation.

Abbott’s endorsement of Middleton is his second of a GOP primary challenger to a Republican incumbent running for reelection to the Texas House. In November, he endorsed Houston businesswoman Susanna Dokupil, who is challenging state Rep. Sarah Davis, R-West University Place.

Like Campos, you may be wondering what’s up with that. Faircloth has no reputation as a Joe Straus/Sarah Davis “moderate”, and he hasn’t gone all maverick-y on bathroom bills or toll roads or whatever else. He’s basically a standard-issue Republican, more “conservative” than average by the Mark Jones method, at least in the last session. What does Greg Abbott have against him?

If that’s what you’re thinking, you’re not cynical enough.

Abbott started the week by endorsing Mayes Middleton, a conservative who until last year served on the board of the Texas Public Policy Foundation, over state Rep. Wayne Faircloth, R-Galveston, who irked the governor’s circle by supporting a ban on “pay for play” gubernatorial appointments of big political donors.

So there you have it. Don’t get between Greg Abbott and his sugar daddies. Greg Abbott will cut you.

There is trouble with the trees

More to the point, there is trouble with the idea that municipal tree ordinances are somehow a bad thing, but that’s where we are, and it’s got some folks worried.

More than 40,000 trees were lost to [Hurricane] Ike, according to the nonprofit Galveston Island Tree Conservancy. A replanting campaign that began in 2010 has made significant progress: Volunteers have spent more than 17,000 hours planting more than 16,000 trees, including 250 live oaks and 60 palm trees on Broadway.

Now this effort faces a new threat – not from nature, but from politicians in the state Capitol. Gov. Greg Abbott wants the Legislature to strip cities of the authority to regulate – and essentially protect – trees on private property. It’s one of 21 items the Republican governor has placed on the agenda for a special session that begins July 18.

This action would weaken tree-protection ordinances in more than 50 Texas cities.

Local leaders across the state oppose the idea, but the issue has particular resonance in Galveston because of Ike’s devastating effect on its tree canopy.

In the storm’s aftermath, trees became precious jewels. Homeowners agonized for months, hoping in vain that their treasured oak or magnolia would somehow recover, before accepting the inevitable. Every dead tree that was felled and hauled away left the island a little barer, its people a little more sorrowful.

“Everyone was just so devastated by the loss,” said Jackie Cole, president of the nonprofit Galveston Island Tree Conservancy.

To bolster the recovery effort, the City Council passed a tree-protection ordinance in 2015. The measure requires property owners to seek a permit before removing trees considered significant based on their size or other factors. Trees that are unhealthy, that pose a hazard or that meet certain other criteria may be removed without penalty; others may be cut down only if the owner replaces them with trees of a specified size or pays into a local tree fund.

See here for some background. I would point out that for all of Abbott’s tree-hatred, his little vendetta will still require the consent of the Legislature. I hope the people of Galveston have been directing their concerns to Sen. Larry Taylor and Reps. Wayne Faircloth and Greg Bonnen. If local control still means anything, it needs to mean something to them.

By the way, story author Mike Snyder has a sidebar piece about the effort to defend local tree ordinances, which is being led by Defend Texas Trees. Turns out that most of the municipal tree ordinances in the state aren’t about what homeowners can and cannot do but about what developers can and cannot do, with restrictions and incentives in place to preserve mature trees. In other words, Abbott’s intended ordinance isn’t just an attack on trees, it’s a boon for developers. I know, I’m as shocked as you are.

A former Democratic state legislator is trying to recapture the Texas House District 23 seat from the first Republican to hold the office since Reconstruction.

In one of the few competitive legislative contests, Democrat Lloyd Criss, who represented Galveston County in the Texas House from 1979 to 1991, is challenging first-term Republican Rep. Wayne Faircloth.

Faircloth, 63, won the seat in 2014 by defeating Criss’ daughter, former Galveston County District Judge Susan Criss.

Although the district was redrawn to favor the GOP by combining the predominantly Democratic areas of Galveston County with overwhelmingly Republican Chambers County, Republicans have struggled in the district. Faircloth fell short in his first attempt to win the district in 2012, losing to then-Rep. Craig Eiland, a Democrat.

The seat came open in 2014 after Eiland decided to retire from a post he had held for two decades.

The district includes Democratic-leaning Galveston, the Bolivar Peninsula, Texas City, La Marque and the unincorporated community of San Leon before stretching across Galveston Bay to take in more conservative Chambers County.

[Sean Skipworth, who teaches government at the College of the Mainland,] said that Faircloth won during a mid-term election with low turnout, which usually favors Republicans. Incumbents are most vulnerable during their first reelection campaign, he said, and having presidential candidate Donald Trump at the top of the ticket could hurt Republicans farther down the ballot like Faircloth. The 75-year-old Criss also has high name recognition in Galveston County, which has 80 percent of the district’s population.

“If I was Faircloth, I would be a little nervous,” Skipworth said.

True, but Eiland was the only Democrat to receive a majority of the vote in HD23 in 2012. The district, like Galveston County itself, had been trending the wrong way for some time, and I suspect Eiland’s decision to retire rather than run in 2014 was predicated as much by an inking about which way the wind was blowing as anything else. That said, Susan Criss did about as well as one could expect in that environment, and it’s hardly outrageous to think that a guy like Faircloth, who represents a relatively balanced district, could get swept out in the Year of the Trump. It’s just that if that does happen, he’d immediately be the favorite to win it back in 2018, at least until we get a feel for where there will be a more permanent effect from this election. Bottom line, if the statewide polls are accurate, this seat could well be in play. Holding it after this year, that’s the challenge.

Possibly the only State Rep race endorsements we’ll get, depending on how much the Chron cares about the less-competitive races.

House District 23: Lloyd Criss

We endorse Lloyd Criss, a Democrat whom Texas Monthly rated as an outstanding freshman legislator back in 1979, the first of his six terms in office. Now the legislative expert wants to jump back into the game to fight for public education and a better funding mechanism for community colleges. Criss, 75, also says that he will hold the line on windstorm insurance. [Rep. Wayne] Faircloth did not meet for an endorsement interview.

House District 134: Sarah Davis

Davis, 40, told the editorial board that Texas is a deep-red state, and she insists on pushing an agenda that exists within the realm of the politically possible.

There’s a list of do-or-die issues that Houston needs to pass through the Legislature this upcoming session, such as pension reform and saving the Houston Independent School District from a broken funding system. Davis has the policy chops, seniority and close relationship with Speaker Joe Straus to push those changes through.

Our decision to endorse Davis is difficult. Democratic challenger, Ben Rose, has the makings of an excellent representative.

House District 144: Mary Ann Perez

This is an easy one. Mary Ann Perez, 54, lost her first reelection race two years ago after running a lackluster campaign against perennial candidate Gilbert Peña. Voters should put the former Houston Community College trustee back in her seat representing this heavily Hispanic district that stretches from Pasadena across the Houston Ship Channel to Baytown.

I expect Perez to win her seat back from the unserious and under-funded incumbent Rep. Gilbert Pena. HD144 was Democratic by about five points in 2012, and I expect it to be bluer this year. Rep. Davis will probably win, and Lloyd Criss (father of 2014 candidate Susan Criss) will probably lose, though the Trump effect makes both of those outcomes at least somewhat uncertain.

Side note: How close does Trump’s margin have to be for people to not call Texas some variation of “deep red” after this election? My guess is that this election will be seen as an outlier unless Trump manages to climb into double-digit territory, though I believe at least some doubt will creep into the narrative if Clinton comes within, say, six points. As such, I doubt the adjectives will change even in the event of a really close spread. I think it will require another atypical result in 2018 for people to stop defaulting to “[intensity modifier] red” as the state’s political description. What do you think?

An early look ahead to the legislative races

The Trib takes a look at the legislative races that could end with a seat changing parties.

• HD-23. Freshman state Rep. Wayne Faircloth, R-Dickinson, against former state Rep. Lloyd Criss, R-La Marque.

• HD-43. State Rep. J.M. Lozano, R-Kingsville, will face Democratic challenger Marisa Yvette Garcia-Utley.

• HD-54. State Rep. Jimmie Don Aycock, R-Killeen, decided not to seek reelection in a district where Republicans have only a narrow advantage over Democrats in presidential election years like this one. Killeen Mayor Scott Cosper apparently won the Republican runoff, but his 43-vote margin over Austin Ruiz has prompted a recount. The winner will face Democrat Sandra Blankenship in November.

• HD-78. State Rep. Joe Moody, D-El Paso, will contend with Jeffrey Lane, a Republican in a district where Democrats have demonstrated a slight advantage.

• HD-102. Freshman Rep. Linda Koop, R-Dallas, will face Democrat Laura Irvin.

• HD-105. State Rep. Rodney Anderson, R-Grand Prairie, currently holds this swing district. He’ll battle Democrat Terry Meza in November.

• HD-107. State Rep. Ken Sheets, R-Dallas, has fended off a series of challenges in his narrowly Republican district; this time, the chief opponent is Democrat Victoria Neave.

• HD-113. Like Sheets in the district next door, state Rep. Cindy Burkett, R-Sunnyvale, has a district where the incumbent is always under attack. Her Democratic opponent this time is Rhetta Andrews Bowers.

• HD-117. State Rep. Rick Galindo, R-San Antonio, is one of two House Republicans defending a district where Democrats generally win statewide races. He’ll face the guy he beat, former Rep. Philip Cortez, a Democrat, in November.

• HD-118. The other of those Republicans is John Luhan, also of San Antonio, who won a special election earlier this year to replace Democrat Joe Farias, who retired. He’ll face Democrat Tomás Uresti — the loser of that special election — in a November rematch.

• HD-144. State Rep. Gilbert Peña, R-Pasadena, represents a district that has gone for Republicans in some years and Democrats in others. And it’s another rematch: He will face former Rep. Mary Ann Perez, the Democrat who lost in 2014 by 152 votes out of 11,878 cast.

Several incumbents got free passes in districts where an able opponent might have been dangerous. In HD-34, state Rep. Abel Herrero, D-Robstown, drew no Republican challenger. In HD-45, Republican Jason Isaac didn’t draw a Democratic opponent.

That’s a pretty comprehensive list. Because I like numbers, I went and dug up the 2012 district results so you can get some idea of how steep a hill these are to climb for the Democrats:

“Diff” is just the difference between the Romney and Obama totals. “Boost” is my way of quantifying how wide that gap really is. It’s the ratio of the Diff to the Obama total, which put another way is how big a turnout boost Democrats would need in 2016 over 2012 to match the Republican total. That doesn’t take into account any other factors, of course, it’s just intended as a bit of context. Note that for HDs 78 (where Obama won by more than ten points in 2012), 117, 118, and 144, Democrats already had a majority of the vote in 2012, so in theory all that is needed is to hold serve. Individual candidates matter as well, of course, though in 2012 there was literally only on State House race in which the winner was not from the party whose Presidential candidate carried the district, that being then-Rep. Craig Eiland in HD23. Point being, you can swim against the tide but it’s a lot more challenging to do so these days. I went and added a couple more races to the list that the Trib put together just for completeness and a sense of how big the difference is between the top tier and the next tier. I don’t have a point to make beyond this, I’m just noting all this for the record.

State moves to close La Marque ISD

I hadn’t realized this was in the works.

Texas Education Commissioner Michael Williams has ordered the closure of Galveston County’s La Marque ISD in July unless the school district successfully appeals.

Williams notified leaders of the 2,500-student district this week that he intended to take the rare step of revoking its accreditation after consecutive years of poor academic and financial performance.

The Texas Education Agency has not announced what would happen to the students, but most likely a neighboring school district or districts would be asked to take over, said spokeswoman Debbie Ratcliffe.

“It is my sincere desire that the agency, the district, and the community work together in a cooperative and productive manner to address the needs of the district’s students,” Commissioner Williams wrote in a Feb. 3 letter to La Marque Independent School District Superintendent Terri Watkins and school board president Nakisha Paul.

La Marque ISD received warning from the state last year that it was on probation. At the time, Paul said she was hopeful about the district’s future.

“I don’t think we’re in the same boat as North Forest. I refuse to think we’re in the same boat,” Paul told the Houston Chronicle in March 2014. “We are trying very hard to get it right. The community is still fighting for this district.”

Last year, four of La Marque’s six schools failed to meet the state’s academic standards. The passing rate on state exams was 54 percent, 23 points below the state average.

The district overall earned the lowest academic rating in 2014, 2013 and 2011 (the state did not issue ratings in 2012).It earned a substandard financial rating for the 2011-12 year.

Enrollment has dropped by about 25 percent over five years. Most of the children are black or Hispanic and come from low-income families.

Doesn’t sound good. The main thing that concerns me about this is the lack of an announcement about what would become of the current students. At least with North Forest ISD there was an obvious place for them to go, and so far so good with that. I don’t know what the neighboring districts are or how good a fit they might be.

There’s also still a chance that La Marque ISD may get a reprieve. They are fighting to stay open, as you might imagine.

At the special town hall meeting Sunday, board president Nakisha Paul said La Marque inherited issues accumulated under years of former leadership, and that the district’s once-strong foundation was gone. The new board and superintendent had plans to rebuild La Marque, she said, and champion its legacy. Watkins, who was named superintendent 16 months ago, said the district needs more time.

“This is the start of the process, not the end of the process,” Watkins said. “Research shows that a steady, systemic turnaround is the best way forward.”

Already, the district has shown improvement, she said, and the board worked through the weekend to prepare an appeal updating their progress on major goals.

The district’s financial balance increased to $5.6 million as of January, up from just $47,000 in 2013, she said.

Programs have been added to help students assigned to disciplinary alternative education programs, including a partnership with the La Marque police and another with the Gulf Coast Center Mental Health Authority to provide counseling, behavioral support and family training.

The district has hired new principals, deans and an assistant for elementary and secondary campuses to realign administration and pursue higher graduation and attendance rates. It came into compliance on several special education issues and posted test score gains in multiple subjects.

Of interest is that they have the support of State Rep. Wayne Faircloth. Having political allies didn’t help North Forest, but Faircloth is a Republican, so it’s a little different. There are two other small ISDs on the chopping block as well. I’ll be very interested to see how this plays out.

Here’s a brief look at the July campaign finance reports for candidates in area State House races of interest.

Faircloth and Wallace are in a runoff to take on Rep. Craig Eiland, whose red-leaning district is a rare pickup opportunity for the GOP. Bear in mind that candidates who had a competitive primary had to make an 8 day report for it, so their reporting period began May 21. Candidates like Eiland that had no primary opponents last reported in January, so they had much more time to raise funds for this report. If you’re wondering why Eiland is listed twice, it’s because he has both a regular candidate/officeholder report and a specific purpose committee report.

HD26 was not drawn to be a competitive district, but it could become one after the DC court issues its long-awaited redistricting opinion. Vy Nguyen has been in this race from the beginning, however many maps ago that was, and I believe will do better than the district’s numbers predict. She’s smart and energetic and has a good future.

The new Fort Bend district that spreads southwest into Wharton and Jackson Counties doesn’t seem to have drawn much financial interest so far. Olivo is a former State Rep who was defeated in the 2010 primary by Rep. Ron Reynolds and should have some fundraising capability, but a brief look through some previous report suggests this was not a strong suit of hers.

Once again a marquee race for Harris County. I have to say, Davis’ totals are distinctly unimpressive, and her burn rate is potentially troublesome for her. Lot of money spent on consultants and printing. Mostly, I’m stunned by her relatively meager haul, less than half of what challenger Ann Johnson took in. Maybe I’m just used to the prodigious totals that her predecessors, Ellen Cohen and Martha Wong, used to rack up. Both of them eventually lost, so consider this Exhibit A for “Money Isn’t Everything”, but it’s still strange to see a targeted incumbent get doubled up by a challenger. I can’t wait to see what the 30 Day reports will look like in this one.

Like I said before, I don’t quite get what MJ Khan is doing. Maybe he’s just keeping his powder dry, I don’t know. I still don’t think state issues are a driving passion for him. We’ll see.

This may be the most competitive races in the state, with both parties getting their strongest candidate for November. One thing I’ve been meaning to comment on but haven’t gotten around to yet is Mary Ann Perez‘s amazing showing on Election Day in May. She collected 67% of the vote on E-Day, more than half of her final total, to vault past the 50% mark in her three-candidate race and avoid a runoff. Whatever she had going for a ground game, it worked. I suspect a good ground operation will be key in November as well.
