Filing period preview: Congress

So even though we still have the 2019 runoffs to settle, the 2020 election is officially upon us. I say this because the filing period for 2020 candidates began on Saturday the 9th, closing on December 9. I expect there will be a tracker of filed candidates on the TDP webpage, but until such time as we have something like that, my guidebook for this is the Patrick Svitek spreadsheet of declared and rumored candidates. I’m going to do a series of posts on who has announced their candidacies for what this week, and I’ll be using that as the springboard.

I begin with Congressional candidates. We’ve sort of been tracking this all along via the quarterly finance reports, since you can’t be a candidate (or at least, you can’t be taken seriously as a candidate) unless you’re filing finance reports. My roundup of Q3 filing reports is here, and I’ll supplement that in this post.

The first thing I noticed after I clicked over to the spreadsheet to begin my research was that there’s a new Democratic candidate in CD02. And sure enough, there was a Chron story to go with it.

Travis Olsen

Former Homeland Security Department employee Travis Olsen this week joined the race for Texas’ 2nd Congressional District, becoming the second Democrat to vie for the seat held by U.S. Rep. Dan Crenshaw, R-Houston.

Olsen, who filed his candidacy with the Federal Election Commission Tuesday and launched his campaign Thursday, said he would seek to “provide an alternative” for residents “looking to move past partisanship and polarized politics,” contending that Crenshaw has not sought common ground with Democrats during his first term.

“We need leaders in Congress who are going to put country above party,” Olsen said in an interview. “And what we have seen is that Rep. Crenshaw will just follow the party line, follow the president, in his choices.”

To take on Crenshaw, Olsen first would have to win a Democratic primary next year that already includes Elisa Cardnell, a Navy veteran who filed her candidacy in February.

In response to Olsen’s campaign launch, Cardnell said in a statement that the race “has been, since day one, about how we put country over party and defeat Dan Crenshaw in 2020.”

“We’ve been making the case now for six months; if we want to hold Dan Crenshaw accountable for voting against lower prescription drug costs and against reauthorizing the national flood insurance program, it’s going to take a female veteran who can make him come to the table and talk about the issues, not just his past service,” Cardnell said.

Here’s Olsen’s website. He’ll need to start raising money ASAP, Crenshaw has bags and bags of it, and Cardnell has taken in $177K so far. From my perspective, this means another set of interviews to do for the primary. You’ll note as we go on there’s more where that came from.

Among Democratic incumbents, only Rep. Lizzie Fletcher in CD07 has no primary opponent. I won’t be surprised if some character wades in, but she won’t have much to worry about. Not in March, anyway; she will have a well-funded Republican opponent in November. Reps. Al Green in CD09 and Sylvia Garcia in CD29 each have one primary opponent. Melissa Wilson-Williams has reported $31K raised, though it all appears to be her own contributions. Someone named Nile Irsan says he’s running in CD29, but he has no web presence or finance reports as yet.

The primary for a Democratic seat with the most action is in CD18, where four announced candidates face Rep. Sheila Jackson Lee: Marc Flores (Q3 finance report), Bimal Patel (Q3 finance report), Stevens Orozco (Q3 finance report), and Jerry Ford (Q3 finance report). Flores and Patel have been in the race for awhile and have raised a few bucks; Orozco has only taken in $3K, while Ford has loaned himself $50K. Jackson had a token challenger in 2018 and took 85% of the vote. She had more serious challengers in 2010, including then-Council Member, now State Rep. Jarvis Johnson, but still won with 67%. It’s hard for me to believe she’ll face much adversity this time around.

The main event races are CDs 10 and 22, and there’s no change in status for them. It won’t surprise me if some stragglers file for them, but the contenders are as they have been all along – Mike Siegel, Shannon Hutcheson, and Pritesh Gandhi in CD10; Sri Kulkarni, Nyanza Moore, and Derrick Reed in CD22. The newest candidates are in CD08, the Kevin Brady district mostly in Montgomery County. Jacob Osborne established a campaign committee in May and has a campaign finance account, but no money raised or web presence as far as I can tell. Laura Jones is a more recent entrant and the Chair for the San Jacinto County Democrats, but has not filed any finance reports yet. Democrat Steven David got 25% in CD08 in 2018 so this is not exactly a prime pickup opportunity, but it’s always nice to see qualified candidates take a shot.

Elsewhere in the state, most of what we know I’ve covered in the finance report posts. I’m still hoping for a more serious contender in the admittedly fringey CD17, and we have things to sort out in CDs 03, 06, 25, and 31. We may yet see some new entrants here and there but for the most part the big picture is fairly clear. I’ll take a look at legislative offices next.

The evolving CD31 candidate landscape

We have a lot of Democratic candidates raising 2018-type money in the big, targeted Republican-held Congressional districts. Some have clear frontrunners, at least based on money raised – Wendy Davis in CD21, Sri Kulkarni in CD22, Gina Ortiz Jones in CD23 – while CDs 10 and 24 have multiple candidates raising competitive amounts of money. And then there’s CD31, the district that MJ Hegar put on the map last year, where no one has yet raised much money or established themselves as a force to be reckoned with. With candidates still coming and going, let’s check in and see who’s who and what’s what.

Tammy Young

Round Rock City Council Member Tammy Young announced her bid for U.S. Rep. John Carter’s seat Wednesday, joining a crowded field of candidates hoping to unseat the Round Rock Republican.

Young moved to Round Rock after leading a nonprofit in New Mexico for children with Attention Deficit Hyperactivity Disorder. In Round Rock, she taught special education and later worked as a real estate broker. She was elected to the City Council in May 2017.

Democrats have been eyeing the district, which encompasses most of Williamson and Bell counties, after Carter defeated Democrat MJ Hegar by 2.9 points last year.

Young has hired major Democratic consultants, including AKPD, an ad firm that worked for U.S. Rep. Colin Allred, D-Dallas, in 2018 and is now Democratic presidential candidate Pete Buttigieg’s ad maker; AMHC, which did mailing for former President Barack Obama’s 2008 and 2012 campaigns; GQR for polling and 4Degrees for digital.

Young, 50, said she was a teenage mother and a survivor of domestic violence. She has two children with ADHD, which led her to write a book for parents titled “Slow Down, So I Can Tell You I Love You.”

“I know what it’s like to struggle and to have to find solutions to what seem like impossible challenges,” Young said.

On the City Council, Young worked to pass a $15 minimum wage for all city employees and worked with the city’s Chamber of Commerce to invest in workforce skills training.

“Through that experience on council, I’ve learned that it’s possible to work in a bipartisan way,” she said. “I know that this can be replicated in Congress.”

Computer engineer Donna Imam raised more than $60,000 between July and August and has $53,000 in cash on hand. Christine Eady Mann, a family practice physician who ran for the seat last year, announced in August that she would run again. She raised $53,000 between July and September, according to Federal Election Commission filings.

Omar Kadir, a former candidate for Williamson County treasurer; singer Eric Hanke and Dan Janjigian, an actor and ex-Olympic bobsledder, are among the other Democrats in the race.

Here’s Tammy Young’s webpage; she has a pretty compelling life story. Other candidates in the race include Dan Jangigian, Eric Hanke, Donna Imam, and 2018 returnee Christine Eady Mann, who was runnerup to MJ Hegar in the primary that year. Murray Holcomb has apparently dropped out, as have a couple others mentioned in this August AusChron story that I linked to in my Q3 finance report roundup. We’re less than a week out from the beginning of the filing period, so we should be getting clarity real soon. At this point what we need is for one or more of these candidates to demonstrate the ability to raise the kind of money that will enable them to run the kind of race that will be needed for CD31 to be competitive again. Hegar, with a big assist from Beto, moved the ball a long way in 2018. CD31 was on paper one of the less likely to flip districts in 2018 – Hillary Clinton lost it by 12 points in 2016. Hegar made it close enough that it’s already on the DCCC target lists for 2020. What we need at this point is for one (or more!) of these candidates to show that they can take that next step. I hope the Q4 finance reports will provide some evidence of that.

You really have to plan for every election

Whether or not they actually happen.

Judge Michael Keasler

For months, Democrats Mark Watson and Mike Snipes have been running 2020 campaigns for Texas Court of Criminal Appeals Place 6. They’ve raised money, filed official paperwork, gathered signatures, traveled to far corners of the state, devoured East Texas delicacies, created Facebook pages, won endorsements, launched websites and given interviews with journalists.

There’s just one problem: There is probably not going to be an election.

The current occupant of that seat, Republican Judge Michael Keasler, is 77, and according to the state’s mandatory retirement law for judges, he must finish his decades of service on the state’s highest criminal court by the end of next year at the latest. State law permits him to finish four years of the six-year term he was elected to in 2016.

According to the Texas Constitution, Keasler’s seat will become vacant at the end of next December, and Gov. Greg Abbott is empowered to fill judicial vacancies. But the little-known and rarely relevant law seems to have led to some confusion: Would Keasler’s seat be filled in 2021 by the governor, or in 2020 by the voters?

If the Democrats were confused, they certainly weren’t the only ones.

In August, when an official from the state Democratic Party emailed state elections administrators to ask whether there would be a race, a lawyer for the secretary of state’s office reported that there would.

“I figured it out,” wrote Christina Adkins in an Aug. 15 email obtained by The Texas Tribune. “Judge Keasler is subject to mandatory retirement so his position is on the ballot in 2020.”

The race was included on the state’s list of offices up for election in 2020, posted earlier this year, and remained there as recently as Wednesday morning. Later that day, a Texas Tribune journalist emailed the agency to ask whether the seat would be up in 2020. As of Thursday, it was no longer listed on the state’s website.

A spokesman for the agency said Friday that “there is no vacancy until December 31, 2020, and the office is not already on the ballot.”

The story includes a before-and-after screenshot from the SOS website, which one day did list CCA6 as a 2020 race and then the next day did not. At this point, I’d have to say that barring anything unexpected this race will next be on the 2022 ballot as currently scheduled. At least Watson and Snipes will be ready to hit the ground running when that time comes around.

Roland Gutierrez running in SD19

Most of the action in Texas in 2020 is in the Congressional and State Rep races, but there’s one big State Senate pickup opportunity, and we need to close the deal on it.

State Rep. Roland Gutierrez, D-San Antonio, is set to announce Saturday that he is running again for Senate District 19 after coming up short in a special election last year that ended in a Republican upset.

Gutierrez’s campaign said he will make the announcement at 2 p.m. at an event in San Antonio.

After the 2018 debacle, conditions are expected to be much more favorable for Democrats in November 2020, and they are confident they can knock off Sen. Pete Flores, R-Pleasanton. But first there will be a contested Democratic primary: San Antonio lawyer Xochil Peña Rodriguez is already running. She is the daughter of former U.S. Rep. Ciro Rodriguez, D-San Antonio.

For now, SD-19 is the only Texas Senate race expected to be competitive in the general election next year. Still, it has high stakes: If Democrats flip the seat, Lt. Gov. Dan Patrick could lose the 19-member supermajority that is required to bring bills to the Senate floor without Democratic support.

That story was from Friday; Rep. Gutierrez subsequently did formally announce his candidacy. He’ll have to give up his State Rep seat to do this, but he will likely be the strongest candidate against Pete Flores. I feel like residual bad blood following the 2018 special election, in which later entrant Pete Gallego finished ahead of Gutierrez but then lost the runoff, was a part of why Dems failed to hold this seat. Having Presidential year turnout in a district that was basically 55-45 Dem in 2016 will certainly help, but having unity would be nice as well. Whoever wins the primary needs to have the support of everyone else going into November. No screwups this time, please.

2019 election results: State

Nine out of ten Constitutional amendments are on their way to passing.

Amendments to the state constitution that would make it harder to enact a state income tax, stabilize funding for state parks and allow retired law enforcement animals to be adopted by their handlers received wide support from voters Tuesday.

Supporters of one of the most contentious issues on the ballot — Proposition 4 — proclaimed victory within hours of the polls closing, with about three fourths of voters supporting the proposal in early voting returns.

The only item on the ballot that looked as though it might not pass was Proposition 1, which would permit elected municipal court judges to serve multiple municipalities at the same times. With votes still being counted late Tuesday, returns indicated that it had received just over one-third of the vote.

The other propositions were poised to pass easily. Proposition 5 would stabilize funding for state parks and received overwhelming support. The proposition allows money accumulated from existing sales tax on sporting goods to be used for the Texas Parks and Wildlife Department and the Texas Historical Commission. Current law allows the Legislature to allocate that money however they see fit.

Proposition 10, which had the highest level of support, amends the state constitution to allow retired service animals, such as dogs or horses, to be adopted by their handlers or other qualified caretakers. These animals are currently classified as surplus property or salvage and can be “auctioned, donated or destroyed.”

Prop 4 is terrible, but that usually doesn’t stop us. I just hope it’s not as bad as I fear it may be.

Meanwhile, in Fort Bend:

Eliz Markowitz

A Democrat and a Republican were leading in unofficial returns Tuesday night in a nationally targeted special election for a historically Republican Texas House seat.

Democrat Eliz Markowitz — the only Democrat in the race — was in first place, while Republican Gary Gates was in second, according to unofficial returns. The race will head to a runoff if no candidate gets over 50%.

Gates was one of three serious GOP candidates out of six total. The two other viable Republicans in the race, Tricia Krenek and Anna Allred, were third and fourth, respectively. Allred appeared to concede at about 10:30 p.m., saying she was “disappointed with the results” but “pleased with our campaign.”

The race for House District 28 — where former state Rep. John Zerwas, R-Richmond, stepped down at the end of September — was one of three contests Tuesday to fill state House seats. The two others happened in solidly Democratic districts where runoffs were also looking likely, based on the early vote and initial Election Day results.

In House District 100, where former Rep. Eric Johnson, D-Dallas, vacated his seat earlier this year after becoming Dallas mayor, Democrat Lorraine Birabil had a wide lead over three Democratic rivals but had not clinched more than half the vote. James Armstrong III, Daniel Davis Clayton and Sandra Crenshaw were in a close race for second place and a spot in an expected runoff.

Here are the results from Fort Bend County for HD28, and Dallas County for HD100. The SOS election night results webpage is bizarre and not up to date, so skip it for now.

Markowitz got 39.1% of the vote, with Gates getting 28.5%, Tricia Krenek 18.1%, and Anna Allred 9.3%. While I expect Republicans to unite for the runoff, I can’t help but feel that Gates was their third best choice in this race. His main asset is that he’s loaded and willing to spend on himself, which I figure helped him in this race. How much he’ll excite voters as that kind of candidate in December is the question. I feel very certain he won’t have a clear path to the GOP nomination in the March primary. Here’s the Chron story on this race.

I’m saving the HD148 race for last, because of the delay in Harris County results (see here for why that happened.) As of 5 AM, we still didn’t have full results. The best I can tell you at this time is this:

There’s still a lot of votes out as of this post, so things can change quite a bit. My initial speculation that some people may vote for Adrian Garcia based on the belief that he’s the County Commissioner appears to have had some validity. Beyond that, we’re just going to need to wait and see what the final tally says. Note that the total Republican vote is 34% – Ryan McConnico got 32% against Jessica Farrar a year ago. Put a pin in this one, we’ll come back to it. Oh, and as with the Republicans in HD28, I don’t think Anna Eastman (assuming nothing weird happens between now and the final count) will have a clear path in March, either.

There’s a lot here – so much that it’s taken me this long to post, and so much that I thought about splitting this into two separate posts – but let’s start with the Senate candidates. MJ Hegar has been in the race the longest, and she has raised the most, matching her performance from the previous quarter. All the other candidates (save for the low-profile no-hope types, and hey isn’t it nice to finally see Sema Hernandez file a finance report?) entered during Q3 and their finance reports can be graded on a curve as a result. That said, time keeps on ticking, ticking, ticking, and John Cornyn keeps on raising piles of money, so everyone needs to kick it up a notch or two. It was nice that every candidate at the Texas Signal candidate forum was asked about their path to victory, but raising money is a key part of that, even if it is a tacky subject to bring up. We’re going to need to see a lot more in the January reports.

Incumbents Lizzie Fletcher and Colin Allred are doing what they need to do. Their potential Republican opponents are raising a bunch of money, but they’re staying ahead of them, which they need to keep doing. Jessica Cisneros has done well in her challenge to Henry Cuellar, who is made of money, and she is getting some national press for her efforts. I still don’t know how much either money or national attention will mean in this race, but I do know that if she does win, it will be a very big deal and will make a lot of Dem incumbents look over their shoulders.

There are a number of new names on this report. Hank Gilbert is not going to win in CD01 because it’s a 70%+ Trump district, but Hank is a mensch and Louie Gohmert is a death eater from a hell dimension, so the least I can do is note that Hank is taking on the thankless task of challenging Gohmert. We noted last time that Lorie Burch has ended her campaign in CD03, and now several others have stepped in. Sean McCaffity, who is off to a strong fundraising start, and Tanner Do have reports for this quarter, and they will have company next time. Chris Suprun, whom you may remember as one of the wannabe faithless electors from 2016, has entered the race. He had also run in the CD27 special election last year, and had a brush with the voter ID law before that. Plano attorney Lulu Seikaly is also in the race, and I apologize to her for making her follow that.

Elsewhere in new candidates, Heidi Sloan has entered the race in CD25. Julie Oliver, the nominee from 2018, is well ahead of her fundraising pace from that year, so we’ll see how that goes. There are now a bunch of candidates in CD31, though I can tell you now that that article from August is out of date. I’ll have more on that in a separate post. Among the newcomers here are Dan Jangigian, Eric Hanke, and Donna Imam. Jangigian may have the most interesting resume of any Congressional candidate in recent memory – he’s a onetime Olympic bobsledder, and acted in the legendary bad movie The Room. He was subsequently portrayed in the movie The Disaster Artist, the movie about the guy who made The Room, by Zac Efron. And now he’s running for Congress. What have you done with your life?

A more familiar candidate making her first appearance here is Wendy Davis, who took in nearly a million bucks for CD21. That’s one of several top target races where there’s a clear frontrunner, at least as far as fundraising goes, which is a change from 2018 when most of the hotter primaries had the money more widely dispersed. Gina Ortiz Jones did even better, topping $1.6 million already. Rosey Abubara, who I thought might give her a challenge, has not filed a report. Candace Valenzuela and Crystal Fletcher have raised a few bucks in CD24, but Kim Olson is well ahead of them both, while Sri Kulkarni is lapping the field in CD22. The exception is in CD10, where all three candidates are doing well, but 2018 nominee Mike Siegel is a step behind Pritesh Gandhi and Shannon Hutcheson.

Rounding up the rest, Elisa Cardnell stepped it up in CD02, but faces a steep challenge as Dan Crenshaw is one of the biggest fundraisers in Congress now. Stephen Daniel is doing all right in CD06. I know their totals don’t look like that much compared to some of these other folks, but remember how much time we spent in 2018 talking about how rare it was for any Democratic challenger to raise as much as $100K for an entire cycle? We’ve come a long way. And I’m still hoping for either Rick Kennedy to start doing more in CD17 or for someone else to jump in, even if that race is a big longshot. The Quorum Report made my heart flutter with a teaser about a poll testing former CD17 Rep. Chet Edwards against carpetbagger Pete Sessions. I don’t know if this is a real thing or just someone’s idea of a cool thought experiment, but I’d be all in on another run by Edwards. We’ll see if there’s anything to it.

Beto ends his Presidential campaign

It was fun while it lasted.

Beto O’Rourke

Beto O’Rourke is dropping out of the presidential race.

The former El Paso congressman announced the decision Friday evening, ahead of a major Democratic gathering here in Iowa.

“Though it is difficult to accept, it is clear to me now that this campaign does not have the means to move forward successfully,” O’Rourke wrote on Medium. “My service to the country will not be as a candidate or as the nominee. Acknowledging this now is in the best interests of those in the campaign; it is in the best interests of this party as we seek to unify around a nominee; and it is in the best interests of the country.”

O’Rourke’s decision ends a White House bid that began with much anticipation in mid-March, months after his near-miss loss to U.S. Sen. Ted Cruz. O’Rourke’s campaign launch coincided with a splashy article on the cover of Vanity Fair, and he reported raising $6.1 million in the first 24 hours of his bid — at the time, the largest announced first-day haul of any 2020 Democratic contender. Soon after, he showed double-digit support in multiple national polls.

But O’Rourke never lived up to the high hopes, and after the initial fanfare of his entrance, he sunk into the low single digits in polls and saw his fundraising come back down to Earth.

He was facing the possibility of missing the cut for the next debate, which is Nov. 20 in Georgia. As of Friday evening, he had gained only two out of four qualifying polls, and the deadline is Nov. 13. A poll of likely Iowa caucus participants released Friday showed he had 1 percent support in the critical early state.

After O’Rourke’s announcement — “a decision we made so recently and so reluctantly,” he said at an event in Des Moines on Friday evening — a person close to him reiterated that his future will not include running for U.S. Senate next year in Texas. Some supporters have been encouraging him to challenge the state’s senior senator, John Cornyn, but he has long said he is not interested. A massive Democratic field has already assembled to take on Cornyn, but so far no candidate has been able to match the excitement O’Rourke created in his 2018 bid.

We all owe Beto a debt of gratitude for his 2018 Senate campaign, which has done more to inject life in the Democratic Party in Texas than anything I can think of. He had his moments during the Presidential race, especially after the mass shooting in El Paso, but that field was too deep and too talented for him to gain traction. He’s not running for Senate next year – you know how I feel about that – but maybe Governor in 2022 is on the menu, especially if Julian Castro is busy in Washington DC at the time. Take some time off and spend it with your family, Beto. Then do everything you can to help Democrats get elected next year. Daily Kos, Slate, Texas Monthly, and the Texas Signal have more.

The Democratic Senate candidate forum

This was a good event.

Six of the Democrats hoping to defeat U.S. Sen. John Cornyn next year will square off in the first big candidate’s forum in Houston tonight in what promises to be one of the hottest political races in Texas.

Former Congressman Chris Bell, Houston City Council member Amanda Edward, combat veteran MJ Hegar, 2018 U.S. Senate candidate Sema Hernandez, civil rights activist Cristina Tzintzún Ramirez and Texas State Sen. Royce West are all scheduled to attend the forum sponsored by The Texas Signal, a self-described progressive media company. A total of 11 Democrats have filed statements of candidacy with the U.S. Federal Elections Commission to run for the Senate in 2020.

The Signal, which organized the event, which I attended, has its own report. Basically, each candidate was on stage for 20 to 30 minutes, answering questions posed to them by moderators Kevin Nix and Royce Brooks. Questions ranged from issues (health care, gun violence, immigration, voting rights, etc) to impeachment (everyone was on board with the inquiry, and letting it come to completion before committing to further action) to their roadmap to victory.

As I said, I attended this event, and I thought it was a useful introduction to the candidates, especially for people who didn’t know them as anything more than a name. There’s video of each of the conversations with the candidates on the Texas Signal Facebook page, which I’ll link to here. Check them out, you’re going to have to decide on someone to take on Big John Cornyn in four months’ time.

Warren’s interest in boosting Texas Dems

I heartily approve of this.

As Elizabeth Warren climbs the polls — threatening Joe Biden’s lead in the Democratic primary — her campaign is turning its attention to Texas, a state she called home for a decade and a place her campaign has deemed the “future of our party.”

Warren announced this week she’s soon to dispatch staff to Texas, and her campaign manager says her commitment to the state includes pouring money into down-ballot races here, part of a broader national strategy to help candidates in other races.

“We’re targeting our resources to invest in places that will be critical to keeping the House, taking back the U.S. Senate, and regaining ground in key state legislatures in 2020,” Roger Lau, Warren’s campaign manager, wrote in a strategy memo this week. And he vowed that the campaign is “continuing to build the future of our party by investing in states like Texas.”

The memo comes as Warren rises in the polls, surpassing Biden to take the front-runner spot in several, including a Quinnipiac University poll released this week that showed Warren with a lead of 2 percentage points over the former vice president.

It’s also the latest example of national Democrats paying serious attention to a state they long saw as a Republican stronghold beyond their reach. The party picked Houston to host a presidential debate earlier this month. The Democratic Congressional Campaign Committee has opened an office with senior staff in Austin and has operatives working in the half-dozen GOP-held congressional districts they’re targeting for the 2020 election. And the National Democratic Redistricting Committee, a Washington entity headed by former Obama administration Attorney General Eric Holder, has said it plans to spend hundreds of thousands of dollars in hopes of seizing the nine seats that Democrats need to take back the Texas House.

Warren’s campaign manager summed up the effort: “If we want to make big, structural change, we need to make sure Democrats control the U.S. House and Senate and win important gubernatorial and state legislative races across the country.”

That was from a couple of weeks ago; I forgot I had it in my drafts. We don’t know what the shape of this effort will be, but so far Team Warren is saying all the things I’d want a Democratic frontrunner to say. She has already endorsed in the CD28 primary, which is either bold or meddling, depending on one’s perspective. This is a different type and level of commitment, and it won’t be clear what it means till some time next year. I’ve said before that putting real resources in Texas is a must-have for me in a Presidential candidate. This is a good example of what I’m talking about. Well done.

Jackson to challenge Ellis in Precinct 1

Former Harris County criminal court judge Maria T. Jackson will challenge incumbent Rodney Ellis for Harris County Precinct 1 commissioner, her campaign announced Monday.

Jackson, the county’s longest serving felony judge until her resignation last month, plans to hold a campaign kickoff on Tuesday. She said she was unavailable for comment Monday.

Jackson, a Democrat, served as presiding judge of the 339th State District Court in Harris County between 2008 and 2019. Previously, she was a Houston municipal court judge. She unsuccessfully ran for the Texas Court of Criminal Appeals in 2018.

Jackson earned a bachelor’s degree from the University of Texas and graduated from the Texas A&M School of Law. She faces a well-funded opponent in Ellis in the March Democratic primary. Ellis, a former state senator, was first elected Precinct 1 commissioner in 2016.

On his most recent campaign finance report filing in July, Ellis listed a war chest of $3.8 million, more than any other elected official in Harris County. Jackson listed $13,812 cash on hand for her judge campaign account, which she can transfer to her campaign for commissioner.

University of Houston political science Professor Brandon Rottinghaus said the fundraising deficit is one of several significant challenges Jackson would have to overcome to have a chance of victory. Rottinghaus said Ellis is widely known to the public and popular among Democratic voters. He also said judges often struggle to transition to legislative or executive elected positions.

“Judges tend not to be visible, politically,” Rottinghaus said. “They aren’t used to talking about core political issues and using that to build coalitions.”

See here for the background, and here for my 2016 judicial Q&A with Jackson. Ellis formally announced his re-election campaign on the same day, not that there was any doubt about his intentions. I tend to agree with Prof. Rottinghaus on this, especially when the other candidate is as well known as Commissioner Ellis is. I support Ellis, I voted for him as a precinct chair in 2016, and I’m happy with what he’s done. Guess I need to add this race to my list for primary interviews.

The Senate race will be the top statewide contest in 2020, but beyond that it’s the judicials and the one Railroad Commissioner slot on the ballot. Candidate Chrysta Castañeda has thrown her hat into the ring for that job.

The 2020 race for a seat on the Texas Railroad Commission is beginning to seriously take shape as prominent Dallas attorney Chrysta Castañeda enters the Democratic primary to challenge Republican incumbent Ryan Sitton.

“The Railroad Commission’s number one job is to protect our natural resources and prevent the waste of oil and gas, but in its current configuration, it has abandoned that duty,” Castañeda said in a statement Wednesday afternoon announcing her candidacy.

The Railroad Commission is usually one of the lower-profile statewide races on the ballot, but in election cycles like 2020, the candidates play an important role for their parties because they top the non-federal statewide ticket. The contest for Sitton’s seat, one of three on the commission, will appear on the ballot after the races for president, U.S. Senate and U.S. House.

Castañeda has decades of oil and gas experience, first as a software engineer for companies and then as a lawyer for operators and others in the industry. In 2016, she won a $146 million verdict for the late Dallas oil tycoon T. Boone Pickens in a high-profile drilling rights dispute.

Castañeda is centering her campaign on the issue of flaring, or the burning of natural gas that companies do not move to market. The practice, which emits harmful pollutants into the air, has become increasingly rampant; Oil and gas producers say it’s because of a shortage of pipelines, while environmentalists say it’s due to economics with natural gas being far cheaper than oil. They also blame the Railroad Commission, which has approved a historic number of flaring permits, and extensions to flaring permits.

In her announcement video, Castañeda says the state “might as well be burning cash” and charged Sitton with refusing to enforce laws to curtail the waste.

“Texans deserve someone who will enforce the law and work for all of us,” she said. “Let’s stop wasting energy.”

No one can say she doesn’t have experience, though I’m sure some folks will be more impressed by it than others. I learned from this story that there is another candidate already in, Kelly Stone, who is clearly from a more progressive background. That should make for an interesting primary, with at least some possibility that either or both candidates could raise some money for the purpose of running a real campaign in the primary. (It’s not just for Senate hopefuls!) The story also notes that 2016 candidate Cody Garrett is thinking about running again. You may say to yourself “I don’t remember seeing Cody Garrett on the November 2016 ballot”. That’s because he wasn’t – he lost to perennial candidate Grady Yarbrough in the primary. I would not put it past Yarbrough to clutter up the 2020 ballot as well, but whether or not he does it’s important that we get a real campaign, with people being aware of their choices. Every race matters.

Ogg continues to have problems with the bail settlement

I don’t like this.

District Attorney Kim Ogg is rallying police officers across Harris County to show up in federal court en masse to oppose to a landmark bail reform agreement at a final hearing set for this month.

She emailed about 100 police chiefs to invite them to attend an Oct. 28 court proceeding before Chief U.S. District Judge Lee Rosenthal to lend support on an issue she says “endangers the public.”

In addition to recruiting top brass to the hearing, Ogg also requested that her lieutenants be present to support her concerns about portions of the settlement that allowed most defendants arrested on minor offenses to await trial at home without posting up-front cash bail, according to her spokesman, Dane Schiller.

Ogg expressed misgivings about the proposed consent decree approved last summer by Commissioners Court after months of intensive meetings between county leaders, judges and the lawyers for the plaintiffs in the 2016 class action.

Ogg, who is not a defendant in the lawsuit, is among a number of parties, including many from the bail bond industry, who submitted concerns about the settlement in court during the summer.

“The district attorney has always supported bail reform, so that nobody is held just because they are poor, but she also says public safety should always be considered,” Schiller said.

The county public defender, who has been friends with Ogg since law school, said he suspects Ogg’s approach will be perceived as overkill by Rosenthal, the region’s highest ranking lifetime appointee to the federal bench.

“A courtroom full of police officers is not going to intimidate her,” said Harris County Public Defender Alex Bunin. “She might be insulted that they would do that to her.”

“It’s over the top, and this kind of bravado backfires every time,” Bunin added. He said the majority of the concerns Ogg raised were resolved by a judicial rule passed in January.

See here and here for the background. I agree with Alex Bunin here, this is not going to help and will serve as fuel for Ogg’s primary opponents. The fears being expressed are overblown, and frankly it’s fine by me if the county has to experience a little inconvenience to accommodate a non-violent offender who need assistance getting back to court. As I’ve said before, I’d much rather pay for an Uber for that guy than pay to feed, clothe, and house him for some number of weeks or months. Maybe – stay with me here – we could arrest fewer of these non-violent mostly drug offenders in the first place, which would go a long way towards reducing inconvenience for everyone. In the meantime, the bail agreement is in place and it is going to be the law. Let’s all do what we can to make it work.

John B. Love III

Meet the ninth Democratic candidate in the Senate primary.

John B. Love III, a Midland city councilman, is the latest Democrat to jump into the crowded race to challenge U.S. Sen. John Cornyn, saying in his announcement that gridlock in Washington is “taking a toll on Texas families.”

“In August, a mass shooting came to Midland,” Love said in his announcement, citing the mass shooting in which a gunman killed seven people and injured two dozen more in Midland and Odessa. “Tomorrow it will come to someone else’s town. We can fix these tough problems if we work together.”

Love, a three-term councilman who serves as Midland’s mayor pro tem, is pitching himself as the small-town cure for the problems in D.C.

“I grew up in West Texas where neighbors talked to each other,” Love said in his announcement. “I’m a proud Democrat, but in a small city you have to talk to your Republican neighbors. We’ve gotten a lot done in Midland and I’m ready to bring the same approach to Washington.”

Love is one of nine Democrats who have so far filed paperwork to run in the primary, in which gun violence has already become a top issue.

Love said he’s a “proud gun owner who supports a ban on assault weapons.”

“I’m for comprehensive background checks and closing the gun show loophole,” Love said. “But more importantly, we need real action, real votes and leadership to reduce gun violence.”

I did not find a Senate campaign page for him, but this local news story about his announcement has an image that appears to be what he’ll be using. Love is the ninth candidate, and the fourth African-American in the field, along with Amanda Edwards, Royce West, and Michael Cooper. If he draws a non-trivial level of support, that could affect Edwards and West’s chances of making it to the runoff. At first glance, he looks like an interesting candidate, and in a cycle that doesn’t already have a bunch of interesting candidates, I bet he could make an impression. If he ends up in the conversation for a statewide race in 2022, I would not consider that a bad outcome. We’ll know soon enough how far behind he is in fundraising, and then we’ll get to see how much ground he can make up. The Midland Reporter-Telegram has more.

Barohich not running again in SBOE6

Another open seat.

Texas State Board of Education chairwoman Donna Bahorich, who represents part of Harris County, announced Friday she will not seek reelection in 2020 as the District 6 representative.

“I have 8 years of service on the board,” Bahorich said. “I feel like I’ve given it quite a bit of work.”

In a statement, Bahorich said her tenure has been “exceptionally challenging and gratifying.” One of 10 Republicans on board, Bahorich was first elected in 2012. She has served as chairwoman since 2015, after being appointed to the role by Gov. Greg Abbott.

Prior to her election, Bahorich served as a district director for then-state Sen. Dan Patrick. Before that, she worked in telecommunications.

Bahorich wasn’t as bad as she could have been, all things considered, but this is a definite upgrade opportunity for 2020. SBOE6 shifted significantly Democratic from 2016 to 2018, after a modest but decent shift from 2012 to 2016. Beto got 51.5%, and Mike Collier took a plurailty with 49.5%. SBOE5 with Ken Mercer is actually a brighter opportunity, but this one is right behind it. Two Dems are already in – Michelle Palmer and Debra Kerner – so it’s a matter of who the GOP puts forward.

Couple things to add here. I have no idea if Bahorich is stepping down for the reasons she states or if the Democratic movement in the district pushed her in that direction. The SBOE is an unpaid, low-glamour-but-high-friction post, and it’s not hard for me to believe that two terms is enough for any rational person. It’s also not hard for me to believe that Bahorich decided she had better things to do than sweat out an election she wouldn’t have much control over, given the partisan tides, the lack of funds in these races, and the futility of campaigning for this low-profile position with so many voters in it. This is the kind of race where overall GOTV efforts are key, and while the lack of straight ticket voting is a new challenge to overcome, SBOE races are fairly near the top of the ticket – after the three federal races (President, Senate, Congress) and the statewides, which this year is just Railroad Commissioner and the Supreme Court/CCA. It’s before all of those county and district court races, so there should be no fatigue factor. After the 2018 sweep, Bahorich is the only non-statewide elected Republican who will be on my ballot. Or at least she would have been, but whatever the case I’m hopeful about changing that. With any luck, that just got a little easier.

Gina Ortiz Jones is doing big fundraising numbers again

Gina Ortiz Jones, the leading Democratic candidate to replace U.S. Rep. Will Hurd, R-Helotes, raised over $1 million in the third quarter, her campaign announced Tuesday morning.

The figure represents a massive haul that her campaign described as the “largest off-year quarterly fundraising total the district has ever seen.”

“I’m honored by the groundswell of support we’ve received and together we’re building a grassroots campaign to stand up to the corporate special interests and bring commonsense priorities like quality, affordable health care and lower prescription drug costs to Washington, D.C.,” Jones said in a statement.

Jones’ campaign expects to report having about $1.4 million cash on hand — a hefty stockpile for a race that is at the top of national Democrats’ priority list this cycle in Texas.

The GOP primary for the seat is still forming, but national Republicans like Tony Gonzales, a retired Navy cryptologist from San Antonio. He entered the race a few days after Hurd’s announcement and raised over $100,000 in his first month, according to his campaign.

The candidates are not required to report their third-quarter fundraising to the Federal Election Commission until Oct. 15.

Ortiz Jones was a big fundraiser in 2018, but so was Will Hurd. This time around, she’ll be the one with the head start. Yes, this presumes she’ll win her contested primary. If that doesn’t happen, then whoever does will have some big shoes to fill. We’ll see how everyone else is doing later this month.

Michele Leal, candidate for State Representative for House District 148, raised over $100,000 in the first 24 days of her candidacy.

“Michele’s strong fundraising is a result of her hard work and her strong relationships with people who care about the future of Houston and Texas,” said State Representative Christina Morales. “We need leaders like Michele in the State House – who will stand up for everyday Texans and advocate for our diverse communities.”

Leal – a former legislative staffer in the state House and Senate, and a proven community advocate and activist, announced her candidacy on September 3rd, to complete the term of her former employer, retired State Representative Jessica Farrar.

“We have the opportunity to bring real change to Austin, which is only possible when we stand together,” said Leal. “I am committed to earning the support of Houstonians across our entire district, and we will have the resources we need to share our vision for a better Texas.”

I haven’t received any other fundraising press releases from HD148 candidates, so I thought I’d run this one as a measure of what is possible. They, like the city candidates running in this November’s election, have 30 day reports due this week. I’m very interested to see who raised the kind of money to quickly and effectively get their name out there in this short period of time. So far, at least one person has.

PPP: Competitive Congressional districts are competitive

Some nice data points for you.

A handful of Republican-held House seats in the Texas suburbs represent fertile ground for competitive races in 2020, according to recent Democratic polling.

The surveys in six GOP districts, shared first with CQ Roll Call, are a sign that Democratic outside groups are willing to spend resources in the Lone Star State, where party leaders believe they can make gains next year. The polls were commissioned by House Majority Forward, the nonprofit arm of House Majority PAC, a super PAC tied to the chamber’s Democratic leadership.

Three of the districts surveyed have GOP incumbents running for reelection, including Reps. Michael McCaul in the 10th District, Chip Roy in the 21st and John Carter in the 31st. Polls were also conducted in three open-seat races in the 22nd, 23rd and 24th districts. Republicans won all six seats in 2018, all by margins of 5 points or less.

The surveys, conducted by Public Policy Polling, tested a generic Democrat against a generic Republican in each of the districts.

Respondents backed a generic Republican candidate over a Democratic one in four of the six races. In the 10th, 21st and 22nd districts, 49 percent supported a GOP candidate, compared to 46, 44 and 45 percent respectively for a Democrat. Fifty-one percent backed a Republican in the 31st District, compared to 44 percent for a Democrat.

A generic Democratic candidate garnered more support in two districts. Fifty-three percent backed a Democrat in the 23rd District, where GOP incumbent Will Hurd is retiring, to 41 percent for a Republican. In the 24th District, where GOP Rep. Kenny Marchant is retiring, 47 percent of respondents supported a Democrat while 46 supported a generic Republican.

The polls surveyed between 523 and 656 likely voters in each of the congressional districts and had margins of error between plus or minus 3.8 and 4.2 percentage points. They were conducted Sept. 19-21 via landline telephone interviews using IVR technology, also known as automated phone polling.

I get that not that many people will know who a particular member of Congress is, but I don’t understand why you’d do a “generic R versus generic D” matchup in CD21, where freshman Chip Roy is running for re-election and he will most likely face off against Wendy Davis, who is as well known as a potential candidate is going to be. In CD10 and CD31, I’d do “Rep. Mike McCaul vs generic Dem” and “Rep. John Carter vs generic Dem” for similar reasons, though perhaps there’s a chance that CD10 will be open next year, too. The “generic Dem” approach is most appropriate in CD31, where I have no idea yet if there’s a candidate who can raise the kind of money needed to make that a real race. I hope the Q3 finance reports give me some good news there.

In CD23, where Gina Ortiz Jones is raising gobs of money, I’d love to have seen a “generic R vs generic D” question followed by a “generic R vs Gina Ortiz Jones” question, just to see if there’s any difference. I’ve said that Will Hurd was an overperformer for the Republicans in CD23, but I don’t think he was twelve points above the baseline. As for the rest, it’s still very early and on both sides candidate quality is going to matter, but the fact that these races are almost certainly going to be very competitive is nothing new. I made this point multiple times in 2018, but the shift in the Congressional districts is a microcosm of the shift in the state, and we’ve seen what that polling looks like so far. Where the numbers go from here is the big question.

Julián Castro will not be running for Senate, either

Julián Castro said Saturday at the Texas Tribune Festival that he would not seek the Democratic nomination to challenge U.S. Sen. John Cornyn, R-Texas, in 2020 even if he were to drop out of the presidential race.

“No, I’m not going go run for the Senate, that’s never what I intended to do,” Castro said in an interview with MSNBC’s Katy Tur in the penultimate event at the Paramount Theatre, preceding the closing keynote address by U.S. House Speaker Nancy Pelosi, D-Calif.

While Castro is guaranteed a spot on the next Democratic stage in Ohio in October, his chances of qualifying for the November debate are dicey. Castro is at 1.7% in the RealClearPolitics polling average. The raised threshold requires that a candidate earn 3% support in at least four early state or national polls that meet the Democratic National Committee’s methodological requirements — up from 2% for the September and October debates — or at least 5% in two early state polls. The early states are Iowa, New Hampshire, Nevada and South Carolina.

Tur noted that Castro had sent out a note to funders saying if he doesn’t qualify for the November debate, he would drop out of the race.

“If that happens would you consider running against John Cornyn?’ Tur asked Castro.

In explaining why he would not do that, Castro, a former mayor of San Antonio and secretary of Housing and Urban Development, said, “People ask me, `Why are you running for president?’ My experience is actually as an executive. I actually have some of the most relevant experience in running for president. When you’re a president, you’re a chief executive. I was a chef executive of a federal agency with a $48 billion budget. I’m running for what’s relevant to my experience.”

Castro as a Senate candidate has been discussed before, though not nearly as often as “why won’t Beto run for Senate again?” has been discussed. You know how I feel about that, so I’ll just say again that I have always assumed “Castro for Governor 2022” is the backup plan, assuming 1) Castro isn’t in someone’s cabinet, and 2) he actually wants to run for Governor. It is an executive position, he could get an awful lot done, and it would put him in good position to run for President again in 2028, following (God willing) two terms of one of his current opponents in the primary. Not that beating Greg Abbott would be easy, but that would be the time to try. The Current has more.

Rodney Ellis may have an opponent in 2020

Keep your eye on this:

Here’s a Chron story about Judge Jackson’s resignation, which does not mention the challenge-to-Rodney-Ellis possibility, since at this point that’s mostly informed gossip. It does mean, as the story notes, that Greg Abbott will get to appoint a replacement, which if past patterns hold will be a Republican that had been booted out by voters in either 2016 or 2018. Which in turn means there will be at least one judicial slot available in 2020 for a Democrat who doesn’t want to have to primary someone. I’m sure that will draw some interest.

As far as the rumored challenge to Commissioner Rodney Ellis goes, no one gets or deserves a free pass, and a real challenge is better for democracy than the usual no-name crank filing against an otherwise unbothered incumbent for the office. If we’re going to have an election, let’s have one between real, qualified, purposeful candidates. I supported Ellis in that weird precinct chair election in 2016, I’ll happily support him in 2020, and I fully expect he’ll cruise to an easy win in March, if indeed Jackson runs against him.

Jackson will have several obstacles to winning a primary against Ellis (if, again, that is what she intends to do). Ellis is popular, has a strong base, has been a prime mover of policies widely supported by Democrats while on Commissioners Court, especially while he’s been in the Dem majority post-2018, and has a lot of money in his campaign treasury. Jackson, by contrast, has $13,812 on hand, and will now have to raise money in large quantities in a short time frame. Her one contribution from this cycle came from the Texans for Fairness PAC, which supported a lot of local Dems in 2018, and whose co-founder is Amir Mireskandari, of that weird poker club situation that I haven’t said anything about in part because I have no idea what to make of it. It’s not hard to see how that could be a loud sideshow in a Jackson-Ellis primary battle, which again, as of this time isn’t a thing. But it could be, and so we ought to be aware of what might come with it. Stay tuned.

Mary Jennings “MJ” Hegar stepped away from her last movie deal as it became, as she says, “too blockbuster-y.”

The decorated war veteran now has a deal with Netflix for the movie that has long been in the works, but very well could drop in the middle of her bid to unseat U.S. Sen. John Cornyn next year. It’s a potential boon for a candidate who’s built a career writing, speaking and now making movies about her story — of getting shot down and wounded in Afghanistan, suing the Pentagon and lobbying Congress to scrap restrictions on women in combat.

That story has also fueled her political campaigns. It was told in a three-minute video that went viral as she launched her last campaign, drawing national attention to her race against U.S. Rep. John Carter in a Republican stronghold north of Austin.

Cornyn has deemed her “Hollywood Hegar,” in part because of the praise she has drawn from celebrities like Kristen Bell and Patton Oswalt. But Hegar says she’s trying to accomplish something real with the exposure: She’s long pushed for equality in the Armed Forces and believes it’s important for stories like hers — of women in combat — to be told.

“What I’m trying to accomplish is change — culture change,” Hegar said. “And you do that through books and movies and TV in American culture.”

Hegar — one of nearly a dozen Democrats vying to take on Cornyn in 2020 — earned more than $150,000 over the last year and a half working toward that goal, according to recently filed personal finance disclosures. The disclosures, which Senate candidates are required to file and covers a period from the beginning of 2018 until mid-August, show earnings of $42,500 from the Netflix deal, more than $27,000 in book royalties and $99,000 from a slew of public speaking gigs across the country.

Most of that money was made while she was also running her surprisingly successful campaign against Carter, who she came within three percentage points of beating. Hegar — whose husband works at Dell and helps take care of their two kids in Round Rock — says it’s how she makes enough money to help her family get by as she makes her run at Cornyn.

“The political system the way it is now, you have to be independently wealthy, or have the kind of job like a lawyer, just to be able to run for office,” Hegar said. “So we end up with a lot of people in office who haven’t faced the challenges that our legislators are charged with finding solutions to.”

“I have an accidental opportunity to run for office,” Hegar said. “The dramatic nature of my story means that the place that I can make the biggest impact is, you know, in a public facing role. Even if that’s contrary to my personality type — I’m actually quite introverted.”

I’ve thought about this, and I’ve decided I basically agree with her assessment. She’s been afforded an opportunity, and it’s one I think most of us would take if we were in the same position. She does still have to help support her family while she’s running for office, and frankly this is a much less ethically tangled way of doing it than the various forms of consulting that many others engage in, mostly incumbents. Everyone agrees that our system of financing campaigns is terrible, but the point here is that just being able to run for office is something many regular people can’t afford to do. A larger share of such people than we’re used to seeing ran for office and got themselves elected in 2018, and some of them went through quite a bit of financial struggle to do so. I don’t have any easy answers for this, but it’s very much worth talking about and making visible. If Hegar’s situation can help a little with that, so much the better.

Will this movie ultimately work against her? It’s entirely possible. Cornyn will certainly use it – he already has been – but the other Dems in her primary are likely to take some shots as well. And even though many people would make the same decision she made to take Netflix’s offer, that doesn’t mean all of them will support her decision. It could go either way for her, and I’m sure she’s aware of that. I’m fine with it, and within reasonable bounds I’m fine with anyone criticizing it or not being fine with it. We’ll know soon enough if it made any difference.

UT-Tyler: Trump still looks weak in Texas

Two months later, there may be a story line to watch.

Beto O’Rourke remains competitive against President Donald Trump in a Texas head-to-head matchup, according to a poll released Thursday by the Center for Opinion Research at the University of Texas at Tyler.

The poll, conducted over three days following last week’s debate in Houston, shows O’Rourke polling better against Trump in a head-to-head matchup than every other Democratic contender except former Vice President Joe Biden.

Both led Trump by 2 percentage points in hypothetical matchups. Four other candidates tested against Trump lagged behind the president, though Sen. Bernie Sanders of Vermont trailed by less than the 2.8-percentage-point margin of error.

O’Rourke’s campaign boasted that the results vindicate his stance on gun control. He has caught flak from members of both parties since forcefully demanding mandatory buybacks of assault weapons in the Houston debate.

His gun confiscation proposal drew support from 49% of Texans in the UT-Tyler poll, while other plans drew broader support. Nearly 85% supported universal background checks for gun purchases. A “red flag” law that would let law enforcement take guns from someone deemed dangerous drew support from 65%.

Far more Texans — 59% — support an assault weapons sales ban that would let owners keep guns they already own. Gun rights advocates view confiscation as unconstitutional.

Trump continues to poll underwater in Texas, showing a 40% job approval rating among all respondents. Approval is much higher among Republicans and much lower among Democrats.

Trump’s approval numbers were 40.3% approve, 54.5% disapprove in July, and 39.6% approve, 52.3% disapprove in September. The “will vote for” number he gets, in each matchup, is a close approximation of his approval number. A thing that I noticed that I want to point out, though it’s far too soon to draw any conclusions about it, is how Trump does with Dems and with Republicans.

“Neither/NS” is the sum of the “Neither/Other” and “Not Sure” responses. Trump gets nearly identical levels of support among Dems and Republicans against each potential opponent. The range of support for him is a bit wider among indies, but indies are also the smallest sample so those numbers may just be more volatile as a result. All Dems get roughly the same amount of support among Republicans. There’s more variance among indies, but by far the biggest variable is the level of support among Dems for each candidate. Beto as native son does best, followed by the two previous Presidential candidates – and thus the best known among them – Biden and Bernie, with Elizabeth Warren a notch behind. Farther down are Kamala Harris and Pete Buttigieg. They had Julian Castro in the July sample but not this one.

You can compare to the July data, where Trump did a bit better among Republicans and Dems but worse among indies, giving him roughly the same overall numbers. This will be worth watching for trends if UT-Tyler keeps pumping these out every other month, but beyond that it’s only two data points. My main argument here is that Trump seems to have a ceiling, and it’s lower than that of the Dems. Dem voters who haven’t made up their minds or who have a preference than isn’t the named candidate in the given question have the option of giving a non-committal answer. They’re not defecting to Trump, they’re just keeping their powder dry. Fewer Republicans are similarly ambivalent about Trump, and quite a few more are actively against him. That leaves him less room to grow, at least among the easier to get voters. If all of this is for real, then when the Dems have a nominee, or at least a much smaller number of choices, I’d expect to see the Dem candidates’ support get consolidated. That’s what is worth watching.

Now again, there’s the apparent correlation between the approval number and the “would vote for” number, so if the former goes up the latter may as well. And as noted before, this sample seems unusually Democratic, which may be skewing things. The good news is that there is just a lot more polling activity here this cycle, so there will be many chances to see if this poll is in the mainstream or an outlier. For now, the basics of it look better for the Dems than for Trump.

As for the gun control questions, they’re interesting and worth considering, but even with the baby steps Dan Patrick and Greg Abbott have taken in that direction, I don’t think it means much. Lots of things poll well in Texas but have zero traction because literally no elected Republicans in the Lege or statewide agree with that position. There are some tiny cracks in the ice now because of the 2018 elections, but it’s going to take a lot more Republicans losing elections for it to truly matter.

Bell officially begins his Senate campaign

Yeah, I know, I also thought that this had already happened. Just a reminder that these things occur in stages.

Democrat Chris Bell, the former Houston congressman and gubernatorial nominee, is formally announcing his U.S. Senate campaign.

Bell, who has been campaigning since early summer, is set to rev up his bid Wednesday with a video in which he calls the Republican incumbent, John Cornyn, a “water boy” for President Donald Trump and offers a sharpened pitch for why he is the best choice in the crowded primary.

“As the only candidate who’s been to Congress, I know how badly broken it is,” Bell says. “I’ve fought the same political insiders that keep John Cornyn in power, and I know how to take them down.”

Bell’s announcement comes toward the end of the third fundraising quarter, which should provide some new insight into the viability of the candidates, most of which began their campaigns over the past three months.

Bell was the first candidate to announce an intent to run after MJ Hegar’s entrance; in between then and now, Amanda Edwards and Royce West and Cristina Tzintzún Ramirez have followed. The polling we have, which I don’t take too seriously at this time, does not indicate a clear frontrunner, which among other things means everyone needs to get their name recognition up. That in turn takes money, so I too will eagerly await the next round of finance reports. That may well tell us more than anything else we’ve seen so far. The Chron has more.

Rep. Cesar Blanco to run for Sen. Jose Rodriguez’s seat

Looks like this has been settled quickly.

State Rep. César Blanco, D-El Paso, is running for the seat being vacated by state Sen. José Rodríguez.

In a video published Monday, Blanco alluded to the deadly mass shooting last month in El Paso, and said El Paso and West Texas “need a fighter.”

“Now more than ever, El Paso needs leaders willing to stand up to those that try to turn our community into a political punching bag by promoting dangerous rhetoric and hateful policies meant to tear us apart,” Blanco said.

Rodríguez, another El Paso Democrat, announced Friday he was not seeking reelection, and Blanco quickly emerged as a potential candidate for the seat. The Latino Victory Fund launched a draft campaign that night to convince him to run, and on Saturday morning, four lawmakers in the Senate district endorsed him, including three of his four colleagues from El Paso’s House delegation.

See here for the background. The four other legislators are Joe Moody, Mary González, Art Fierro, and Pancho Navárez. That doesn’t rule out the possibility of someone else running, but that’s a pretty significant show of strength. Any other State Rep who wanted to run would have to give up their seat to do so, as this is not a special election but the March primary. I’d guess Rep. Blanco will get some low-profile opponents, but this race is likely his to lose at this point. His HD76 will then also become open, but as with SD29 it’s a safe Dem seat, so the eventual primary winner there will take it in November.

State Sen. Jose Rodriguez to retire

Sad to see him go.

State Sen. José Rodríguez, an El Paso Democrat, announced Friday that he will not seek reelection to the upper chamber in 2020.

Rodriguez informed El Paso colleagues of his decision in a text late Thursday night that was obtained by The Texas Tribune. He made the announcement official at his district office.

“I started my tenure in the Senate with one of the worst budgets in the state’s modern history,” Rodríguez said in a written announcement on his retirement. “Fortunately, my last session was one where state leaders finally gave long overdue attention to our public schools.”

Rodríguez was first elected in 2010 to represent Senate District 29. The district, which hugs the Texas-Mexico border, is historically considered Democratic; it covers El Paso, Culberson, Hudspeth, Jeff Davis and Presidio counties.

The senator’s retirement announcement comes a day after the Senate Democratic Caucus announced that Rodríguez would step down as chair at the end of the year. State Sen. Carol Alvarado, D-Houston, will replace him at the post.

It’s unclear who will announce bids for Rodríguez’s seat. One potential candidate is state Rep. César Blanco, a fellow El Paso Democrat who serves as chair of the House Democratic Campaign Committee.

In case you’re wondering, Beto got 74% in SD29 in 2018, Lupe Valdez got 67%, and Paul Sadler got 61% against Ted Cruz in 2012. So yeah, safe Dem district. A State Rep. like César Blanco could certainly win it, or some other politician from within El Paso; Sen. Rodríguez had been the El Paso district attorney before he won the seat in 2010, following the retirement of Sen. Eliot Shapleigh. Sen. Rodríguez was a strong progressive and a good Senator, and whoever succeeds him will have big shoes to fill. I wish him all the best with whatever comes next.

Quinnipiac: Lots of Texans don’t intend to vote for Trump

More nice polling news.

President Trump’s job approval rating remains marginally underwater in Texas, with 45 percent of registered voters saying that they approve and 50 percent saying that they disapprove. Thinking ahead to 2020, 48 percent of Texas voters say that they would definitely not vote for Trump if he was the Republican nominee, while 35 percent say that they would definitely vote for him and 14 percent say that they would consider voting for him.

Most of this poll is about the Democratic primary, in which Joe Biden leads the field in Texas. The latest UT/Trib poll finds the same thing. I continue to be way more interested in the November 2020 matchups, so that’s what I’m going to focus on. Here are the important numbers from the poll:

In the June Quinnipiac poll, they polled specific matchups, with Biden leading Trump 48-44, and other Dems not doing quite as well. I’m not sure why they strayed from that path to this more generic question, but whatever. The numbers look pretty lousy for Trump regardless. Cornyn does a little better, which does not conform to my thesis that he will perform about as well as Trump, but there’s a lot more uncertainty in the Cornyn numbers. Trump’s approval numbers are better here than in that Univision poll, but still underwater, with 50% disapproval. His national approval numbers have been tanking, as are his national re-elect numbers, so this may be a reflection of all that. Approval numbers matter. No matter how you slice this, it ain’t great for Trump.

In somewhat related news:

U.S. Air Force veteran MJ Hegar, with a scant 11% of Texas Democrats supporting her, leads the Democratic candidates in the race for U.S. Senate, according to the latest University of Texas/Texas Tribune Poll. The bigger piece of news might be this: 66% of potential Democratic primary voters said either that they don’t know who they’ll support or that they haven’t thought about it enough to have an opinion.

Asked whether they’ve heard of the candidates, most of the respondents threw up their hands. State Sen. Royce West of Dallas, the most well-known of the candidates, was known to just 22% of voters, followed by Hegar, an unsuccessful 2018 congressional candidate from Round Rock, 21%; Chris Bell, a former U.S. representative and the party’s 2006 candidate for governor, 20%; Sema Hernandez, who ran against Beto O’Rourke in last year’s primary for U.S. Senate, 13%; Beaumont pastor Michael Cooper and political organizer Cristina Tzintzún Ramirez, 12% each; and Amanda Edwards, an at-large Houston city council member, 10%. Everyone else was known to fewer than 8% of Democratic voters.

Nevertheless, in a race held today, Hegar is the favorite, at 11%, with the other candidates mired in the low single digits behind her: West, 5%; Hernandez and Tzintzún Ramirez, 3% each; Bell, Cooper and Edwards, 2% each.

“[Hegar] is really well positioned,”said Daron Shaw, professor of government at UT-Austin and co-director of the poll. “She’s the frontrunner. I don’t know that it’s her race to lose, but she’s certainly got a leg up.”

Like I’ve said, don’t focus too much on these numbers yet. When one or more of the candidates starts spending money on a state campaign, we’ll begin to see how the race may shape up. Until then, it’s all up in the air. The DMN has more.

Univision News poll: Trump 42, Dem 47

Here’s a fun poll.

Days away from the third Democratic debate in Houston and over a year from the 2020 presidential election, an exclusive poll by Univision News found that 40% of registered voters in the state say they will vote for the Democrat who prevails in the party’s primary, while 33% say they will support president Trump. If undecided voters leaning one way or the other are included, the advantage would be 47% to 42% in favor of the Democrats.

The Latino vote could be decisive. A large majority of Hispanics (69%) surveyed in the state said they intend to vote for the Democratic candidate, compared with 19% who plan to support Trump (also including undecided voters who are leaning one way or another).

According to Census data, Hispanics represented 40% of the population of Texas last year and during the 2018 elections Hispanics constituted more than 24% of registered voters. The Univision national poll, conducted by Latino Decisions and North Star Opinion, measured the presidential preferences of Hispanics in this election cycle and included a specific module for Texas with the support of the Center for Mexican-American Studies at the University of Houston in which included a sample of all state voters.

Senator Bernie Sanders would win the state (48% against 42%). Similarly, former Vice President Joe Biden would win the state (47% to 43%), and the same would happen with Senator Warren (44% to 42%).

According to the national poll, President Trump’s management style continues to generate a strong rejection among Hispanics, with four out of five registered voters disapproving of the president’s performance. At the same time, according to the survey, Democrats have gained support from Latinos who were undecided.

In this latest poll, which comes on the eve of Thursday’s debate in Houston in which all the leading Democratic candidates will share the same stage for the first time, 62% of Latinos reported that they will support any Democrat who opposes the president.

This is the most favorable poll for Dems versus Trump in Texas so far – compare to the Quinnipiac June poll, the UT/Trib June poll, the UT-Tyler July poll, and the August Emerson poll. In part, this is because Trump’s approval numbers are terrible – 44% approve of the job he’s doing, 56% disapprove. There does seem to be a correlation between the two in the polls we’ve seen so far, which makes sense but may not be conclusive. Trump did outperform his approval numbers in 2016, but he wasn’t President then, he didn’t have a record to defend, and he had the good luck to run against someone whose own approval numbers were lousy. At least the first two of those will not be true this time.

The poll has three results for each question – there’s a national Latino result (1,043 Latino RVs), a Texas Latino result (641 Texas Latino RVs), and an overall Texas result (1,004 Texas RVs). You can see how the questions break out, in many different combinations of candidate and query, and you can see it in tabular form with the wording of the questions here. To save you some clicking and scrolling, here are the headline numbers:

All numbers are for Texas, with the first number being from the Latino subsample and the second number being overall. Not a whole lot of difference, and where there are differences it’s usually in the Undecideds. Note they also threw in a Senate question, though just a generic one. It probably wouldn’t make much difference if they asked about individual candidates, as the polls we’ve seen so far, one from August and one from this week suggest the Dem candidates aren’t sufficiently well known for there to be much difference between them. On that note, here’s the more recent poll of the Texas Senate primary:

Hegar polled at 12 percent, followed by three candidates with 10 percent: State Sen. Royce West; activist Cristina Tzintzún Ramirez; and Houston City Councilwoman Amanda Edwards. Chris Bell, a former congressman from Houston, had 9 percent in the poll.

The survey of 600 likely Democratic primary voters was conducted from Sept. 3-5 by Ragnar Research Partners of Austin and Washington. The margin of error is 3.9 percent.

I wouldn’t worry too much about Dem Senate primary polls for now. In the Univision poll, John Cornyn does about as well as Trump, with the slight differences on both sides again coming from an increase in the undecideds. Cornyn did basically as well as John McCain in the 2008 election, the main difference in the two races being the larger share of the vote going to the third-party candidate. His 12-point margin over Rick Noriega was identical to McCain’s 12-point margin over Barack Obama. This suggests that there won’t be that much difference between Cornyn and Trump when the 2020 votes are counted. That in turn suggests to me that the not-Trump voters from 2016 who voted more or less Republican otherwise but went much more Democratic in 2018 will likely repeat their more recent behavior in 2020. I don’t want to go too far out on the limb for this – polling data is still preliminary and scarce – but it’s something to keep an eye on. It’s long been my belief that the not-Trump voters will stay with the Dems in 2020, and after that who knows, and if so that makes the path for Dems easier to navigate. But as they say, there’s still a lot of time. Now we wait for the next poll.

Endorsement watch: Warren sticks her neck out

Democratic presidential candidate Elizabeth Warren is wading into one of Texas’ highest-profile intraparty fights, endorsing Jessica Cisneros, the primary challenger to U.S. Rep. Henry Cuellar, D-Laredo.

“The people of Texas’ 28th district are ready for systematic change and deserve a Democrat that will be on the side of working people; not the side of big money and obstructionist Republicans,” Warren, the U.S. senator from Massachusetts, said in a statement Monday morning. “I believe Jessica Cisneros is that fighter.”

Cisneros, a young immigration attorney from Laredo, has the backing of Justice Democrats, the progressive group famous for helping elect freshman U.S. Rep. Alexandria Ocasio-Cortez, D-N.Y., last year. Cuellar is among the more conservative Democrats in the House.

“Jessica knows our diversity is our strength and that when progressives are unapologetic about our values and who we’re in this battle for, we win,” Warren said. “It’s time Texans had a champion in Congress who does just that.”

See here for the background. This will certainly raise Cisneros’ profile, and I’d say it’s a good bet it will help her with fundraising, too. It’s a bit of a risk for Warren to take, partly because it may cost her some primary votes in a heavily Democratic part of the state, partly because she may have made a mortal enemy who can sabotage her agenda in the House if he survives and she wins, and partly because Henry Cuellar also has friends who are now motivated to work against her. It’s also very on brand for her, and if you’re looking for someone who walks the walk, Elizabeth Warren has the record to show she does that. This race just got more interesting. On an unrelated note but something that I’ve been looking for an excuse to include in a post, CD02 candidate Elisa Cardnell was recently endorsed by Rep. Marc Veasey, who among other things is the Regional Vice-Chair of the DCCC. CD02 is not currently on the DCCC target list, but in an ideal world the overall political climate, the Cardnell campaign fundraising prowess, and any available polling data would cause this race to be added in at some point. For now, it’s on the second tier, but the endorsement of an incumbent like Rep. Veasey is a boost for Team Cardnell, and suggests the national folks are keeping an eye on this one as well.

Lucio’s challengers

Will definitely want to keep an eye on this.

Sen. Eddie Lucio

This cycle, [Sen. Eddie] Lucio’s record will be dissected as two opponents—one a trial lawyer and daughter of a former Cameron County Democratic chair, and another a current State Board of Education member—take aim at this titan of Rio Grande Valley politics. Can they persuade the voters of Lucio’s district, which is 89 percent Hispanic with a 37 percent poverty rate, to reject the Texas Senate’s most conservative Democrat, or will the 73-year-old prevail again?

Lucio’s two primary challengers are Sara Stapleton-Barrera, a 35-year-old trial lawyer whose father chaired the Cameron County Dems in the ’90s, and Ruben Cortez, a sitting member of the State Board of Education who won re-election last year.

Stapleton-Barrera practices injury and constitutional law and criminal defense, but she’s politically inexperienced. Her campaign is founded on the idea the district needs new blood and on a promise to prioritize women and children. She’s been endorsed by the Cameron County Democratic Women, said Lucio’s not a “real Democrat,” and condemned his anti-equality views. “I’m 110 percent supportive of the LGBTQ community,” she told me over the phone. She’s also stressing the need for renewable energy and addressing climate change, an area where Lucio may be vulnerable: The senator voted to kill Denton’s fracking ban in 2015, and wrote a letter of support in March for one of three controversialliquefied natural gas plants proposed east of Brownsville. Stapleton-Barrera opposes the gas plants.

Seven months before writing the letter of support, Lucio accepted $5,000 from the company, Exelon, proposing the natural gas plant. Over the phone, Lucio told me he couldn’t remember who requested the letter and said his support for the gas plants depends on them operating in an environmentally “safe” way.

Stapleton-Barrera also hits Lucio for his tort reform record. “He’s taking money from the insurance companies and leaving people injured in a car wreck or by medical malpractice high and dry,” she said, adding that she wouldn’t take money from any PACs including TLR.

On abortion, Stapleton-Barrera is to Lucio’s left, but may not excite pro-choice advocates. In an email to me, she stole a line from the 1990s, saying abortion should be “legal, safe, and rare.” When pressed, she told me she would not support any further restrictions on abortion and would consider any measures loosening restrictions on a case-by-case basis. Her online platform doesn’t mention reproductive rights at all, and she told me she’s not making it a prominent part of her campaign because many in her district are anti-abortion.

Cortez has served on the state education board since 2013 and used his role to fight for Mexican-American studies; before that, he was on the Brownsville school board. In 2018 in Lucio’s senate district, Cortez got more votes than any other candidate, including Beto O’Rourke. (Lucio was not on the ballot.) Cortez, who currently represents an area larger than the state senate district, is attacking Lucio’s liberal bona fides. In a recently-posted bilingual announcement video, he slams Lucio for “consistently break[ing] his promise to carry forward the Democratic Party values” and accuses the senator of siding with “Trumpist Republicans” against Valley residents. According to the video, Cortez has endorsements from three local teachers’ unions and a letter carriers’ union.

But Cortez’s grasp of Lucio’s record appears a bit shaky. In the video and a separate post, he hits the senator for supporting a bill this year to allow more guns in schools, even linking the vote to the recent mass shooting in El Paso. Lucio, however, voted against that bill both in committee and on the floor. (Hinojosa, the McAllen-based state Senator, is the one who broke party ranks.) Cortez did not respond to multiple requests for an interview.

Money could be a problem for both challengers. In the first half of this year, Stapleton-Barrera raised around $4,000 and took about $20,000 in loans from her husband; as of July, Cortez had only about $1,000 on hand. Lucio couldn’t fundraise during the legislative session, but in the second half of last year he pulled in almost $350,000.

I’m a big non-fan of Sen. Lucio, so I’m happy to see him draw a couple of serious challengers, flawed though they may be. There’s a lot of attention being paid to the primary challenge in CD28, where national Democrats are funding a more progressive candidate against Congressman Henry Cuellar, whose record on many issues is as problematic as Lucio’s. I’m skeptical about that effort, in part because challenger Jessica Cisneros is flawed in her own ways, but it’s a worthwhile thing to try. Lucio is arguably a bigger impediment to progress than Cuellar, because he’s one of 31 Senators, giving him that much more influence in his chamber, whereas Cuellar is one 435 Congressfolk. The good news is that even if Lucio survives this race, every Senator will be up for election in 2022, so the next opportunity to have another go at him will be in short order.

Anyway. Stapleton-Barrera’s website is here. Cortez doesn’t appear to have any web presence, but his SBOE profile is here. Check them out, and I’ll keep an eye on this.

Try, try again

A lot of women ran for office as Democrats in 2018. A lot of them won, and a lot of them who didn’t win are trying again.

[Gina Ortiz Jones isn’t] the only woman who’s back for a second round.

In April, MJ Hegar, who got within three points of defeating U.S. Representative John Carter, an eight-term incumbent in a deep-red district north of Austin, announced she would challenge U.S. Senator John Cornyn. Julie Oliver, who lost Texas’ 25th Congressional District to three-term Republican Roger Williams, despite cutting a 21-point spread down to just under nine, is also running again. So is Kim Olson, the Democratic challenger who lost to Texas Agriculture Commissioner Sid Miller. This time she’s running to represent Texas’ 24th Congressional District, which spans the suburbs of Dallas and Fort Worth.

At least six Democratic women who lost their bids for the Texas Legislature in 2018 are running again in 2020, says Monica Gomez, the political director at Annie’s List, a political action committee that supports progressive women running for state and local office in Texas. Two more are coming back to run for different seats. “We haven’t seen this kind of rededication to running again in Texas since Annie’s List was founded in 2003,” Gomez says. She estimates that in the organization’s history, a total of 10 candidates have run again after a loss. “So eight in one cycle is a very large increase.”

The record-breaking number of first-time female candidates who ran for office in 2018 led to a record-breaking number of first-time female officeholders: 127 women now serve in Congress, the most ever and a 23-seat increase from 2017. Despite these gains, women remain grossly underrepresented in public office at every level. Women hold 24 percent of seats in the 116th U.S. Congress and 29 percent of statewide executive positions across the country. Texas sends 38 people to Congress; in 2019, only six of them are women. In the Texas Legislature, women hold 43 of 181 seats, or 24 percent—five points lower than the national average.

Why are women persistently underrepresented in politics? Over the past decade, a body of research has established that when women run, they win elections at the same rate as men. Melanie Wasserman, an economist at UCLA who studies occupational segregation by gender, wanted to learn more. So in 2018 she analyzed the political trajectories of more than 11,000 candidates over two decades in local California elections, focusing on how candidates responded after losing an election. She found that women were 56 percent less likely than men to run again after a loss, noting what she called a “gender gap in persistence.”

“If I make the assumption that the candidates who drop out have similar chances of winning as those that run again, then the gender gap in persistence can explain quite a lot of the gender gap in officeholding,” Wasserman told the Observer. “It would increase female representation among officeholders at the local level by 17 percent.”

In other words, perhaps we should be paying more attention to the losers—the women who run, lose, and choose to run again.

As for the other legislative candidates, I’d say Eliz Markowitz (SBOE in 2018, HD28 in 2020) counts, and it looks like Natali Hurtado is doing it again in HD126. That leaves four more, going by Monica Gomez’s math, and I have no idea who they may be. Please leave a comment if you do know.

Not all of these candidates will make it to November, of course. All except Markowitz and Hurtado have at least one primary opponent as far as I can tell. McDowell and Olson are running for the same seat (with others in the mix as well), Leeder is unlikely to make it past Wendy Davis, and of course Hegar is in a pleasantly crowded field. I’ve been idly wondering if she might do what some had been crying for Beto to do and get back into the race she’d run last time, in CD31 where no other candidates of her stature have emerged yet. I doubt it – she’s still a strong contender for the Senate nom, and if anyone else has had the same thought as I have, I’ve not seen them express it – but anything is possible up till the filing deadline. DeMerchant will face off against Suleman Lalani and Rish Oberoi, while Cattanach has Shawn Terry. Point being, there are still more chapters of this story to be written. The next one will be out in December.

UPDATE: Forgot about Sema Hernandez for the federal races. Still don’t know who the other four repeat legislative candidates are.

UPDATE: I have been informed about a couple of “try again”-ers for this year. Brandy Chambers (HD112) and Celina Montoya (HD121) are both repeat candidates from 2018. Ann Johnson (HD134) ran in 2012 and is running again.

McCaul’s hustle

Turns out, running for re-election is hard work.

Rep. Mike McCaul

Rep. Michael McCaul does not have to be here, at Carl’s BBQ on the side of a highway, in a wood-paneled backroom, seated at a bare table in front of a stuffed, life-size buck whose antlers hold a sign saying, “NEVER moon a werewolf.”

He doesn’t have to drive east two and a half hours from his home in Austin to find brisket this good, but here is where his voters are. And after the last election, his worst in his 15-year political career, the Republican congressman decided he needs to campaign for them like never before.

McCaul could be forgiven for retiring. In the past four weeks, four of his fellow Texas Republican colleagues have done so — a political phenomenon nicknamed “Texodus” — including two members who represent suburban districts similar to McCaul’s. The Democrats flipped the House in 2018, suddenly making life miserable for GOP members now in the minority, and targeted half a dozen of the members of Congress in Texas, including him. To win, McCaul has to, for the first time, actually try; His once-safe district stretching from Austin to Houston is changing faster than he expected, threatening to throw him out.

But when faced with fight or flight, McCaul chose the former. He changed his campaign staff, including hiring Corry Bliss, who led the top Republican-affiliated super PAC for House races in 2018, as a general consultant. Last quarter, McCaul claimed a personal fundraising record. His team boasted the earliest field program of any incumbent Republican in America, one it says has already knocked on 10,000 doors. In the past week, McCaul met with local chamber of commerce officials, AARP constituents and local journalists. He toured car dealerships. He led a consortium on how to address human trafficking. And he hit three barbecue joints in three days.

“I decided if I’m going to do this again, I’m going to work it hard, maybe harder than I ever have,” McCaul told CNN.

In a 25-minute interview this week, McCaul blamed the Texas Republicans’ drubbing last cycle “in large part” to the top of the ticket. GOP Sen. Ted Cruz lost the big four metropolitan regions — “something no top-of-the-ticket Republican nominee had done since Barry Goldwater in 1964,” who faced native son and President Lyndon B. Johnson, according to a University of Houston study. McCaul noted that Cruz, who was “not as likeable” and unable to “fully” energize his party’s base voters, lost his district to then-Democratic Rep. Beto O’Rourke, who created a following McCaul called “Beto-mania.” (A source close to the Cruz operation responded that McCaul raised more than triple the amount of his Democratic opponent and still “almost lost.”)

In recent years, the populations of Latinos, African Americans and Asians in McCaul’s district have boomed. Between 2012 and 2017, Latinos grew from 26% to 29% of the population as over 60,000 moved there or were born, according to American Community Survey figures pointed out by Potter. The white population increased but more slowly than other races, and shrunk as a percentage of the district from 58% to 52%.

Rep. Marc Veasey, a Texas Democrat, said the population explosion could yield the state two or three more congressional seats after the next census. But he said that rapid demographic change was just one reason why these suburban seats have become competitive after so long, saying the voters “have really had enough of this President — and Republicans not pushing back against a lot of what they see as wrong for the country.”

Siegel, physician Dr. Pritesh Gandhi and Shannon Hutcheson, a lawyer whose clients include Planned Parenthood, are all vying to be the Democratic nominee to take on McCaul. Democrats are confident that the mix of Trump at the top of the ticket, fundamental demographic changes and a message centering on health care and protecting the Affordable Care Act will flip the seat.

The Democrats also don’t think McCaul is well-known even after winning eight terms in office and call his claims of a reinvigorated field campaign overblown. According to a copy of McCaul’s schedule of the past two weeks obtained by CNN, the congressman had one door-knocking event but canceled it. When CNN toured the block, which included a home hoisting a Trump flag out front, a couple potential voters said they didn’t recognize McCaul’s name, but they would vote for him so long that he was Republican.

I love both the faux-blockwalking story and the Ted Cruz shade. Who says politics is boring? The story is cool and all, but I’m going to boil this all down to a couple of tables:

Mike McCaul got slightly fewer votes in 2018 than he did in 2012, while Mike Siegel got nearly 50K more votes than Tawana Cadien did. All of the improvement in Siegel’s vote totals came from Harris and Travis counties. The small rural counties in between produced essentially the same totals and margins each year. If Dems can squeeze a bit more out of the two big counties (*), they can win this seat. As before, that’s going to be a combination of relentless voter registration and GOTV, which I can guarantee will involve actual blockwalking. The path forward is clear.

(*) For what it’s worth, Siegel improved slightly on Cadien’s performance in Bastrop County, reducing the margin there from 2,353 for McCaul in 2012 to 1,691. It’s worth expending some effort there, in part because every vote will matter and in part because I at least still have hope that Bastrop will start to go the way of Hays County, but the fat part of the target remains the two biggest counties.

The first six, down to Anna Nunez, I’ve discussed before. Let’s review the others.

– No, that’s not County Commissioner Adrian Garcia. According to Carlos Calbillo on Facebook, this Adrian Garcia is a “former Texas Senate intern, Aggie and campaign worker in the race that now-Commissioner Adrian Garcia ran for Congress against Gene Green. He is no relation to the Commissioner.” You can see a picture of him at the link above, and this appears to be his Facebook page. It’s certainly possible some people will think he’s the County Commissioner, but whether they’d be happy to vote for him or confused as to why he’d be running for another office is a question I can’t answer.

– Chris Carmona is a Republican who has run for office a couple of times – City Council against Melissa Noriega in 2011, County Attorney in 2016 (he lost in the primary), and for HD148 against Rep. Farrar in 2014 (he got 39.7%). Having more than one Republican in the race may split that vote enough to prevent either of them from making the runoff, though with this many Dems in there as well I wouldn’t count on that. He still has his 2016 campaign Facebook page; I assume he’ll repurpose it for this race.

Christopher Watt is an attorney (this is why I’m pretty sure I’ve got the right person). His Facebook page suggests he’s a Democrat. I didn’t find any campaign presence for him.

Alva Trevino is an attorney who serves on METRO’s Executive Leadership Team, having previously been METRO’s General Counsel. Her husband Joe Trevino ran for City Council in 2007, losing in the runoff to Jolanda Jones for At Large #5. She should be a serious contender, able to raise some money quickly, which everyone is going to need to do in this short campaign with a lot of background noise.

– Last but certainly not least is Anna Eastman, who I’d say starts out with the name recognition advantage after serving two terms as HISD Trustee. She announced her candidacy on Friday to a lot of acclaim.

So that’s eleven candidates, which needless to say is a lot, all running for an office that they’d need to run for again next year, beginning with the primary. I had originally thought that whoever won the special election would have a leg up in the primary, but now I’m not so sure. Mostly that’s because with this many candidates – and remember, the filing deadline is Wednesday, so there’s still time for more people to jump in – the potential for an unexpected result is non-trivial. As I’ve said many times, we’re going to have a super high turnout primary next March, which means the incumbent advantage for someone who would have literally just won, will be small. I’d still give the winner of this race the edge, but it would not shock me at all if we wind up electing someone else next year.

I’ll update again once the filing deadline passes. I’m going to do some interviews for this race, but we’ll see how many.

The felony judges who abused the bail system

Shame on them all.

Three sitting judges and eight former district judges in Harris County were publicly admonished by the State Commission on Judicial Conduct in response to complaints that for years they violated state law and judicial cannons by ordering hearing officers to deny no-cost bail to thousands of poor defendants.

But the actions this week came too late to affect most jurists’ behavior on the bench. Seven left their district seats last year either because they didn’t run or lost elections. One lost re-election back in 2016.

The misconduct probes of all 11 judges began in February 2018, when the Houston Chronicle obtained copies of memos and notes that showed that for a full decade most of Harris County’s felony court judges had provided different types of written or verbal instructions to the county’s hearing officers to routinely deny no-cash bail to all or most newly-arrested defendants.

The agency’s findings confirm most bans were in effect for years and largely went unnoticed and unchallenged until 2017 when Harris County judges and other officials were civilly sued in federal court for allegedly violating the rights of poor defendants by routinely failing to provide no-cost bail in many misdemeanor as well as felony cases.(The county is now in the process of settling that lawsuit).

In its August disciplinary orders, the commission concluded that through various actions all 11 Harris County district judges willfully violated judicial cannons and also “failed to comply with the law and failed to maintain competence in the law” by instructing hearing officers not to issue personal bonds even though under state law the hearing officers had the authority and duty to do so, the orders say. Under state laws and ethical cannons, the hearing officers are supposed to consider each defendant’s case and circumstances individually.

Let’s be clear here: These judges were found by the State Commission on Judicial Conduct not just to have violated rules of conduct that they are expected to follow, they actually broke the law by systematically denying personal recognizance bonds to poor defendants. This is serious stuff.

You may say “but these are FELONY defendants!” Sure, but it’s still the case that some number of them will never be convicted of a crime. Some of them will agree to a plea deal for a misdemeanor or lesser felony for which the sentence includes no jail time. Some, regardless of how their case gets adjudicated, represent little to no risk to public safety. How big a risk they are to public safety is completely unrelated to how much cash or collateral they can scrape up to buy their way out of jail. Again, Robert Durst got bailed out. There remains a bail lawsuit in Harris County over the practices in the felony courts, and there’s a similar lawsuit in Dallas that’s working its way towards a resolution. Standard practices are going to change, because they have to change.

The judges who were admonished included former longtime Harris County District Judge Michael McSpadden, who retired last year after many years presiding over the 209th District Court. The commission found McSpadden had, like many other longtime judges, issued blanket instructions to deny all personal recognizance or PR bond requests from Nov. 20, 2009 to Feb. 1, 2017. McSpadden had previously written a letter to the Houston Chronicle in March 2018 where he admitted that “it is true I have instructed the magistrates not to grant these bonds in our felony cases to all defendants, never specifying a certain race or gender.”

McSpadden told the Chronicle on Thursday that he stands behind his decision to deny PR bonds even if it violated the law.

“I have great respect for the work of the commission. But I still feel the same way. I, as the elected judge, would like to make the decision on free bonds for accused felons rather than turn those important duties over to the magistrates. And it would take one more day to do this,” he said.

The three active Harris County District Judges who were admonished were: Hazel Jones, of the 174th District Court, Herb Richie of the 337th District Court and George Powell of the 351st District Court.

Michael McSpadden’s first duty as a judge was to follow the law. He did not do that. I don’t give a crap what his feelings were. He failed to do his job, and I am glad he is no longer on the bench.

I am not happy that three Democratic judges were also found to be doing this. All three are up for election next year, and there are no more Republican judges on the district or county courts for Democrats to aim for. But we can still perform upgrades, and these courts are at the front of the line for that. Democrats with a criminal justice background, an interest in becoming a judge, and a commitment to following the law, should look here first.

(Obligatory copy editing nitpick: A “cannon” is a big gun. A “canon” is a fundamental principle or general rule, and is the thing that these judges violated. Spelling counts, y’all.)

Our all-important metro areas

Another look at the trouble Republicans face in Texas now.

The key to Texas’ political future is whether it finally follows the geographic realignment that has transformed the politics of many other states over the past quarter century.

Across the country, Republicans since the 1980s have demonstrated increasing strength among voters who live in exurbs at the edge of the nation’s metropolitan centers or beyond them entirely in small-town and rural communities. Democrats, in turn, have extended their historic dominance of the nation’s urban cores into improved performance in inner suburbs, many of them well educated and racially diverse.

Both sides of this dynamic have accelerated under Trump, whose open appeals to voters uneasy about racial, cultural and economic change have swelled GOP margins outside the metropolitan areas while alienating many traditionally center-right suburban voters.

In Texas, only half of this equation has played out. In presidential elections since 2000, Republicans have consistently won more than two-thirds of the vote for the two parties in 199 mostly white nonmetropolitan counties across the state, according to a study by [Richard] Murray and Renee Cross, senior director of the University of Houston’s Hobby School of Public Affairs. (Trump in 2016 swelled that number to three-fourths.) The GOP has attracted dominant majorities from those areas in other races, from the Senate and US House to the governorship and state legislative contests. Democrats consistently amassed big majorities in 28 mostly Latino South Texas counties, but they have composed only a very small share of the statewide vote.

The key to the GOP’s dominance of the state is that through most of this century it has also commanded majorities in the 27 counties that make up the state’s four biggest metropolitan areas: Dallas/Fort Worth, Houston, San Antonio and Austin. Demographically similar places in states along the coasts and in the upper Midwest have moved consistently toward the Democrats since Bill Clinton’s era. But in Texas, Republicans still carried 53% to 59% of the vote in those metropolitan counties in the four presidential races from 2000 through 2012, Murray and Cross found.

In the Trump era, though, that metro strength has wavered for the GOP. In 2016, Hillary Clinton narrowly beat Trump across the 27 counties in Texas’ four major metropolitan areas. Then in 2018, Democrat O’Rourke carried over 54% of the vote in them in his narrow loss to Sen. Ted Cruz, Murray and Cross found. O’Rourke won each of the largest metro areas, the first time any Democrat on the top of the ticket had carried all four since native son Lyndon B. Johnson routed Barry Goldwater in the 1964 presidential race, according to Murray and Cross.

Looking just at the state’s five largest urban counties — Harris (Houston), Travis (Austin), Bexar (San Antonio), Tarrant (Fort Worth) and Dallas — the change is even more stark. In 2012, Obama won them by a combined 131,000 votes. By 2016, Clinton expanded the Democratic margin across those five counties to 562,000 votes. In 2018, O’Rourke won those counties by a combined 790,000 votes, about six times more than Obama did in 2012. Along the way, Democrats ousted Republican US House incumbents in suburban Houston and Dallas seats and made substantial gains in municipal and state house elections across most of the major metro areas.

“We have now turned every major metropolitan area blue,” says Glenn Smith, a longtime Democratic strategist in the state.

Yet that, of course, still wasn’t enough for O’Rourke to overcome Cruz’s huge advantages in smaller nonmetro communities. That outcome underscores the equation facing Texas Democrats in 2020 and beyond: They must reduce the GOP’s towering margins outside of the major metropolitan areas and/or expand their own advantage inside the metro centers.

Few in either party give Democrats much chance to record many gains outside of metro Texas, especially given Trump’s national strength with such voters. O’Rourke campaigned heavily in Texas’ smaller counties and made very limited inroads there, even relative to Clinton’s abysmal performance in 2016. Exit polls conducted for a consortium of media organizations including CNN found that O’Rourke carried just 26% of white voters without a college education, only a minuscule improvement from the 21% Clinton won in Texas in 2016.

O’Rourke’s very limited rural gains have convinced many Texas Democrats that while they can’t entirely abandon smaller parts of the state, their new votes are most likely to come from the metropolitan centers.

“It’s a matter of emphasis,” says Smith, a senior adviser to the liberal group Progress Texas. “You’ve got to do urban/ suburban areas first. You’ve got to maximize your advantage there.”

The stakes in the struggle for Texas’ big metro areas are rising because they are growing so fast. While the four major metro areas cast about 60% of the statewide votes in the 1996 presidential election, that rose to about 69% in 2016 and 2018, Murray and Cross found. Murray expects the number to cross 70% in 2020.

And the concentration of Texas’ population into its biggest metropolitan areas shows no signs of slackening. The Texas Demographic Center, the official state demographer, projects that 70% of the state’s population growth through 2050 will settle in just 10 large metropolitan counties. Those include the big five urban centers that O’Rourke carried as well as five adjacent suburban counties; those adjacent counties still leaned toward the GOP in 2018 but by a much smaller cumulative margin than in the past. Overall, O’Rourke won the 10 counties expected to account for the preponderance of the state’s future growth by a combined nearly 700,000 votes.

We’ve been talking about this literally since the ink was still wet on the 2018 election results. I touched on it again more recently, referring to a “100 to 150-county strategy” for the eventual Democratic nominee for Senate. None of this is rocket science. Run up the score in the big urban areas – winning Harris County by at least 300K total votes should be the (very reachable) target – via emphasizing voter registration, canvassing apartments, and voters who turned out in 2008 and/or 2012 but not 2016. Keep doing what we’ve been doing in the adjacent suburbs, those that are trending blue (Fort Bend, Williamson, Hays), those that are still getting there (Collin, Denton, Brazoria), and those that need to have the curve bent (Montgomery, Comal, Guadalupe). Plan and implement a real grassroots outreach in the Latino border/Valley counties. We all know the drill, and we learned plenty from the 2018 experience, we just need to build on it.

The less-intuitive piece I’d add on is a push in the midsize cities, where there was also some evidence of Democratic growth. Waco, Lubbock, College Station, Abilene, Amarillo, Killeen, San Angelo, Midland, Odessa, etc etc etc. There are some low-key legislative pickup opportunities in some of these places to begin with. My theory is that these places feature increasingly diverse populations with a decent number of college graduates, and overall have more in common with the big urban and suburban counties than they do with the small rural ones. Some of these places will offer better opportunities than others, but they are all worth investing in. Again, this is not complicated. We’ve seen the data, we will definitely have the resources, we just need to do the thing.

We’re up to three candidates running against Steve Radack

Former State Rep. Kristi Thibaut announced her entry into the race to take on longtime Commissioner Steve Radack this week. You can find her campaign Facebook page here. I had previously noted some chatter about her possible candidacy. This is one of those times when there was something to that chatter.

Also in that race, having announced a few days before Thibaut, is Michael Moore, the former Chief of Staff to Mayor Bill White. The presence of Moore and of Thibaut suggests that there’s some serious fundraising ahead, in part because Radack already has a bunch of money. I will be very interested to see what their January finance reports look like.

The first candidate in the race was Diana Alexander, and I would expect her to take a different path towards the nomination. She has a greater grassroots presence and more recent visibility from the 2018 election through the activism of Pantsuit Republic Houston and Indivisible Houston. There’s a CEC meeting for the Harris County Democratic Party coming up in September, and I’ll also be interested to see who has volunteers and supporters out for their preferred candidate at that event.

As I’ve said about the Congressional races, it’s already starting to get late for anyone else who might be looking at this race. Filing opens in less than 12 weeks, and as noted above if you want to hit the fundraising trail, you’ve already got some strong competition. Nobody else getting in would surprise me slightly more than the field expanding further, but not by much.

The psychological shift

I have three things to say about this.

[Democratic operative Jason] Stanford has a theory about how [Texas Democratic] angst started. He says it began with the 1996 U.S. Senate race in Texas. Democrats were recovering from losing two years earlier and were hoping to stem another round of losses.

As a result, he says, the primary was stacked with impressive candidates running to oust incumbent Republican Sen. Phil Gramm. The field included two incumbent congressmen, a county party chair and a teacher named Victor Morales, who eventually won the nomination.

The race was relatively close, but Morales lost.

“After we lost, that was two losses in a row and Democrats lost hope for generation,” Stanford says.

For years after, he says, it was hard to convince people to run for office as a Democrat in the state.

“We couldn’t get good people to run,” he says. “We would just try to fill the ballot instead of recruiting actually good candidates.”

That’s partially why the last time a Democrat won a statewide election of any kind was back in 1994.

Even though Democrats have still been shut out of statewide races, in the past few years, the party has been able to get at least one thing back: hope.

“The political changes are astronomical in Texas,” says Brandon Rottinghaus, a political science professor at the University of Houston.

After 2016, Democratic-leaning Texans who had been sitting out elections started to vote again.

“I think of it like a seat with four legs,” Rottinghaus says. “You’ve got white progressives, you’ve got young people, you’ve got people of color, and you’ve got low-income people. That forms the platform for the Democratic Party. And in all of those elements, you’ve got increases in voting.”

In the 2018 election, Texas had higher voter turnout among all those groups. Republicans had been winning statewide races by double-digit margins, but that year a Democratic Senate candidate lost by only 2.6 percentage points.

Rottinghaus says this trend bodes well for Democrats in 2020, but a win is not a sure thing.

“There’s no guarantee Texas will be blue or any statewide office will be won,” he says. “But the pieces are in place to be able to be competitive. And that’s what Democrats are looking for and why a lot of people are running for these positions.”

In the past several weeks, a slew of candidates has announced they want to run against Republican U.S. Sen. John Cornyn next year.

The field is up to nine candidates, including former Congressman Chris Bell, state Sen. Royce West, Houston City Council member Amanda Edwards and former congressional candidate MJ Hegar. Most recently, Cristina Tzintzun Ramirez, a well-known immigrant rights and political activist, said she’s joining the race, too.

“Good candidates are just showing up,” Stanford says. “It’s amazing. This is a huge sea change.”

1. The story calls it a “psychological shift”, and I’ve called it “changing the narrative”, but we both refer to the fact that now everyone believes that the state is competitive for Democrats. The previous belief that basically all of the elections, save for a couple of swing districts, were settled in the primaries, is no longer operative. This isn’t just wild-eyed optimism by Democrats or a scare story being used in fundraising emails by Republicans. Democrats actually did make Texas competitive in 2018, and despite some chest-thumping by Republicans about it all being about Beto, the objective evidence suggests we are in for more of the same this year. And everyone with skin in the game is acting accordingly. That’s how you get five experienced politicians, all of whom come with fundraising promise, lining up to take on John Cornyn.

2. The fundraising bit is important in ways that can’t be overstated. Only two Democrats since the 2002 debacle have raised sufficient money to truly compete statewide, Bill White in 2010 and Wendy Davis in 2014. Beto broke through on this in a big way in 2018, but he was the only one who did. Other statewide candidates, who ran against deeply flawed opponents and who came almost as close as Beto did to win, did not get that kind of support. Would Mike Collier, or Justin Nelson, or Kim Olson have done better if they had had $10 million or more to work with? We’ll never know, but I’m confident that the candidates on the 2022 statewide slate will not have it as tough as they did. And I hear a lot less now about how Texas is just an ATM for Democratic candidates everywhere else.

3. To an extent, the shift began right after the 2016 election, with the swarm of candidates who entered the Congressional races and raised a ton of money in them. That was part of the national wave, of course, so it was in its way a separate thing, but still. I spent all of that cycle talking about how unprecedented much of it was, in particular the fundraising. The point I’m making here is that this shift didn’t begin post-Beto, it’s been going on for two years now. The main difference is that it’s happening at a statewide level, and not just downballot.
