Rerun candidate running again

Oh good grief.

Orlando Sanchez, the former Harris County treasurer, City Council member and mayoral candidate, is running for city controller, his second consecutive run for the office.

Sanchez received 47.8 percent of the vote in 2019, losing to incumbent Chris Brown, who now faces term limits.

Sanchez, a Republican and fiscal conservative, served as Harris County treasurer from 2006 to 2018. He held an at-large council seat from 1995 to 2001, and made two runs for mayor, in 2001 and 2003. He qualified for runoffs in both — nearly becoming the city’s first Latino mayor — but ultimately lost to former Mayors Lee Brown and Bill White.

“I feel that my time serving this community as both treasurer and on City Council has made me uniquely qualified to oversee the controller’s office,” Sanchez said. “I have both public and private sector experience, running successful businesses, and holding public offices. I look forward to taking my service and experience and using it to improve the efficiency of the office to better serve Houstonians.”

He joins an increasingly crowded field of candidates vying to become the next controller. Former Harris County Clerk Chris Hollins announced last week he was dropping his mayoral campaign to pursue the controller’s office.

Mayor Pro Tem Dave Martin, a longtime accountant who chairs City Council’s budget committee, and At-Large Councilmember Michael Kubosh, a former bail bondsman, are running as well. Shannan Nobles, who works in the controller’s office, also is vying the seat.

Well, I can say with confidence that I will not be voting for Orlando Sanchez. I’m sure Dave Martin and Michael Kubosh are delighted to see him enter. Until further notice, I think this race is Chris Hollins’ to lose. And that’s all I have to say about Orlando Sanchez.

Hollins moves to the Controller’s race

I have some thoughts.

Chris Hollins, the former Harris County clerk, said Thursday he is dropping his campaign for mayor and will seek the controller’s office instead, roughly one week after Rep. Sheila Jackson Lee announced she would enter the race.

Hollins had postponed a fundraiser scheduled for the day after news broke of Jackson Lee’s entry, and his campaign stopped sending fundraising emails and updates to supporters. That fueled speculation he would bow out. On Thursday, he made it official.

“You may know that we’re facing some real financial challenges in this city. It’s been projected that the next budget that we will have to pass, in the first term of the new mayor and the new controller, will be one where we have a $200 million-or-more structural deficit,” Hollins said of pursuing the controller’s office. “It’s going to take real smarts, real ability, real commitment to thread that needle, and that’s not even talking about having to pay our firefighters.”

Hollins, who also serves on the Metro board, sought out young and progressive voters, regularly criticizing the state’s Republican leadership and one of the mayoral race’s front-runners, state Sen. John Whitmire, a moderate Democrat.

He had raised $1.67 million for his campaign as of Dec. 31, slightly more than competitors Amanda Edwards, a former City Council member, and attorney Lee Kaplan. His campaign consultant, Grant Martin, was part of winning campaigns for Mayors Sylvester Turner and Annise Parker.

Like many of the mayoral contenders, though, Hollins has relatively low name recognition with city voters. His campaign needed to separate him from that pack to make a runoff, a task made much taller by Jackson Lee’s entry. The congresswoman’s base of voters includes many of the folks Hollins was hoping to attract.

Jackson Lee made her entry official earlier Thursday morning, designating a campaign treasurer for her mayoral run in the city secretary’s office.

The controller’s race has three other declared candidates; Mayor Pro Tem Dave Martin, a longtime accountant who represents District E on City Council and chairs the council’s budget committee; At-Large Councilmember Michael Kubosh, a former bail bondsman; and Shannan Nobles, who works in the controller’s office now.

Nobles, who filed a treasurer form in January, announced her candidacy Thursday.

“With over 20 years of public service experience and a background in finance, I am excited to bring my expertise to the table to help shape Houston’s future,” Nobles said in a release Thursday morning. “As Chief Deputy City Controller, I have worked tirelessly to safeguard the city’s assets and bring financial literacy to our communities.”

Hollins starts with a steep financial advantage in that race, thanks to the $1 million he had amassed for his mayoral bid as of Dec. 31. Controller races are much less expensive than mayoral contests.

Martin had $162,000 on hand as of December, with Kubosh further behind at $54,000. Nobles has not had to file a campaign finance report yet.

My thoughts:

– As I said when SJL stepped into the Mayor’s race, the field was awfully big and full of credible candidates, and that at some point it might be difficult for one or more of the current candidates to stay in the race. I said the same thing in 2015 and was wrong then, but this time I was right. Good to know I’m no worse than a coin flip on these matters.

– I also suggested that the Controller’s race would be a potentially enticing option for whoever might consider it as an alternative. I specifically had Chris Hollins and Amanda Edwards in mind when I wrote that, in part because they’d be prominent Democrats in a field that at the time only contained Republicans, and in part because they’d already raised more money than Controller candidates normally dream about. I’m on a roll here, I should buy a lottery ticket.

– On the subject of Hollins’ fundraising, Campos wonders if “he will give back the dough folks gave him to run for mayor”. My guess is that if someone asks for their contribution back he will do so, but he’s not going to go ask everyone who gave to him about it. I suspect his bottom line will not change much at all.

– Could other current candidates switch from the Mayor’s race to the Controller’s? Eh maybe, but I kind of doubt it. I feel like it’s a great decision for the first person, and much murkier for the second. But who knows?

– As for Shannan Nobles, I got an email announcement of her candidacy, which she also posted on Facebook, yesterday. The email arrived a couple of hours after the text I received from the Hollins campaign announcing his switch. I’m going to guess she’s not too happy about the way events transpired.

– If he gets elected Controller, Hollins would be well positioned to run for Mayor again at the next good opportunity. Normally that would be in eight years, which is to say the year 2031, which I swear is a real year and not a made-up date from an Arthur C. Clarke novel. The thing is, as I have noted before, both John Whitmire and Sheila Jackson Lee will be in their eighties in the year 2031. That doesn’t mean they couldn’t still be serving as Mayor at that time, but as I have wondered on more than one occasion, they might not want to still be Mayor at that time. It’s a hard job, and one might like to enjoy a retirement while one can. This is a longwinded way of saying that he would be as well-situated to run in 2027 as he would be in 2031, if the circumstances are there.

– I will once again remind everyone that nothing is set in stone until the filing deadline, all polls should be taken with large amounts of salt, and no one knows how these races will play out. There are just too damn many variables.

– Because my brain hates me, it occurred to me while writing this that Hollins’ departure makes a Tony Buzbee candidacy slightly more likely, on the grounds that at least some Hollins-for-Mayor supporters will migrate over to SJL’s camp now. As penance for bringing this up, I will say three Hail Marys and go sit quietly in a corner for an hour to contemplate my life choices.

It’s late January, so you know what that means: It’s campaign finance report time again. The reports of the greatest interest will be for the city of Houston, but I’ll be checking in on HISD, HCC, and Harris County as well. The July 2022 reports are here, the January 2022 reports are here, and the July 2021 reports are here.

I have collected all of the reports for the people listed above, and you can find them in this Google Drive folder. I decided not to link to all of them individually just because it was more work than I felt like doing. Omitting that means I don’t have a complete listing, with full names and the office they are seeking, of all the candidates. I’ll be sure to at least mention everyone of interest later in the post.

I’ve grouped everyone in the table above as follows: First are the Mayoral candidates, then the candidates for district Council offices, listed in alphabetical order by office – Amy Peck is District A, Tarsha Jackson is District B, and so on. The open offices are Districts E, H, and I. There are so far two challengers to incumbent Council members, and I have indented their names to indicate them – Daphne Scarbrough (yeah, the same person who was a leading opponent of light rail on Richmond Avenue, here to scourge us again) is running against CM Abbie Kamin in C, and Ivan Sanchez, who was a Democratic candidate for CD07 in 2018, is running against CM Ed Pollard in District J. Martina Lemond Dixon is running in E, Mario Castillo and Janette Garza Lindner (2021 candidate for HISD district I) are running in H (my district), and Joaquin Martinez is running in I. The one person that did not have a report filed as of Friday was District D incumbent Carolyn Evans-Shabazz.

The next group is for the At Large seats, of which #s 1, 2, and 3 are open. Nick Hellyar, who ran for At Large #4 in 2019, is running for #2, as are Marina Coryat and Danielle Bess (former candidate for HD147 in 2022), and Twila Carter and Dannell Cooper are running for #3. No one has yet filed a finance report saying they plan to run for At Large #1. You can be sure that will change, and that all of these fields will be much larger by the time the filing deadline rolls around. Indeed, they may already be larger, as there are two candidates who didn’t specify an office in their reports; I’ll get to them in a minute. As above, a candidate opposing an incumbent is indented. Yes, that’s our old buddy Roy Morales running against CM Letitia Plummer in At Large #4.

Next we have the two term-limited Council members who are now running for City Controller, and following them are two candidates who did not specify an office on their report, Leah Wolfthal and Fred Flickinger. I met Leah Wolfthal at the January CEC meeting for HCDP precinct chairs, and I thought she told me she is running in At Large #2. Her website just says “for At Large City Council”, so better not to make any assumptions. I’ve put her in this group for that reason.

Everyone after that is not running for anything, from Mayor Turner to the four CMs to Controller Chris Brown. Former CM Mike Laster, who termed out in 2019, still has a decent amount of cash on hand. I assume the four people in this grouping who remain with over $100K on hand have some plan, perhaps vague and unformed but still existent, to do something with it. What that may be is not known to me, and possibly to them, at this time.

The Chron picks a few highlights from the Mayoral portion of the reports. The one thing I will add to that is that I must have missed Lee Kaplan’s July 2022 report, because I was surprised by his cash on hand total. Kaplan raised about $850K in the last period, which combined with a small amount of spending gives him the cash on hand total he has now. I have included Kaplan’s July 2022 finance report in that Google Drive folder as well.

There are candidates now who have not yet filed a finance report, and there are people who will be candidates that have not yet formally announced their candidacies. The July finance reports will tell us a much more complete story, though even then there will be room for more, as the filing deadline is not until August. This is what we know now. If you have anything to add, by all means please do so.

The first two candidates for City Controller

Two term-limited Council members are the first to toss their hats into the ring.

CM Dave Martin

Houston City Council members Dave Martin and Michael Kubosh on Tuesday confirmed their plans to run for city controller in November.

As the city’s independently elected financial officer, the controller certifies the availability of funds for the budget and all spending. It also processes payments, manages the city’s $4.5 billion investment portfolio, audits city departments, conducts the sale of municipal bonds and produces an annual report of the city’s finances.

Having served the maximum two terms, current Controller Chris Brown will step down at the end of this year.

District E Councilmember and Mayor Pro Tem Martin and at-Large Councilmember Kubosh previously had indicated their interest in the city controller position. They have not been able to announce their campaigns until now due to Texas’s resign-to-run law, which bars city council members from running for another office more than a year and 30 days before their term ends.

CM Michael Kubosh

Martin, who has been on council since 2012, cited his decades of experience in finance and accounting in the private and public sectors. Having worked for “Big Four” accounting firms earlier in his career and currently leading the Budget and Fiscal Affairs Committee at City Council, he said he is equipped to help Houston optimize its finances.

“I know more about city finance and general accounting and finance than any candidate that’s going to pop up in this race,” Martin said. “I’ll put my credentials up against anyone’s.”

Kubosh, who has served as the at-large position No. 3 council member since 2014, touted his experience running in city-wide elections. Calling himself an outsider and a political activist, he highlighted his successful effort to advocate for the removal of red-light cameras in Houston prior to his time in office. He said he would not shy away from confrontations if elected.

“I have a cross-section of voters throughout the city. (Martin) hasn’t run citywide. He’s only run in District E,” Kubosh said. “And I am very aggressive. I’ll speak up for the people.”

I’ve heard talk about CM Martin as a Controller candidate for some time now. CM Kubosh had been mentioned as a possible Mayoral candidate in the past but that had died down. For what it’s worth, as of the July finance reports, Martin had $151K on hand to $60K for Kubosh. The January reports will be out soon and we’ll see what they look like. There’s plenty of time to raise more money, though the Controller’s race usually doesn’t attract the big bucks.

I say these are the first two candidates for Controller because there’s just no way that they’re the only two. Given the demographics and politics of Houston, it would be mind-boggling in the extreme for there not to be at least one candidate of color in the race. In 2015 the field included MJ Khan, Jew Don Boney, Carroll Robinson, and Dwight Jefferson. Khan also ran in 2009; he and Pam Holm lost to Ronald Green. Just a stray, idle thought, but maybe this would be a good opportunity for a Latino candidate. Anyway, this is the time of the cycle where we start seeing a bunch of candidate announcements. I’m sure there will be plenty more soon enough.

A too-early look at who’s running for Houston city offices in 2023

Because it’s never not election season.

With the midterm elections behind us, city election season is now heating up. Next November, Houston will elect a new mayor, a new controller and 16 City Council members.

The campaigns actually got underway long before the midterm elections were over. State Sen. John Whitmire, the longest serving member of the Texas Senate, announced his plans to run for mayor way back in November 2021. Chris Hollins, the former Harris County clerk, announced in February, and former City Councilmember Amanda Edwards launched her campaign in March.

Those announcements, and the millions of dollars the mayoral candidates collectively have raised for their bids so far, have set Houston off on its earliest start to campaign season to date.

As the candidates start making more public appearances and vying for voters’ attention, here’s your early primer on city elections, and who is running so far:

Mayor Sylvester Turner is serving out his second and final term, which means Houston will elect a new mayor in 2023. Voters also will decide 16 spots on City Council — 11 members representing geographic districts, and five members elected citywide in at-large seats — to round out the City Hall horseshoe.

City Controller Chris Brown also is term-limited, meaning the city will have a new controller as well. The controller is the city’s independently elected financial watchdog.

Six council members face term limits, meaning their seats will be open. Ten council members are eligible for re-election and presumably running.

They have a list of the Council members who are not term-limited, as well as a list of people who claim they are running for something at this time. We’ll get some idea of who is serious and who is just a name when the January finance reports come out. From past experience, nothing is truly set in stone until the filing deadline, and we’re a long way away from that.

One more name that is out there as a potential Mayoral candidate is former Metro chair Gilbert Garcia. Don’t be surprised to hear of other names, though at this point it’s not very likely there will be any more high-profile names.

The incumbent Council members who are term limited include Dave Martin (District E), Karla Cisneros (H), Robert Gallegos (I), Mike Knox (At Large #1), David Robinson (AL #2), and Michael Kubosh (AL #3). I expect there to be a lot of At Large candidates, assuming At Large seats are still a thing next November.

There are also races for HISD and HCC boards of trustees. In HISD, Kathy Blueford-Daniels (District II), Dani Hernandez (III), Patricia Allen (IV), and Judith Cruz (VIII) are up for re-election. In HCC, the candidates whose terms are up are Reagan Flowers (Distrct 4), Robert Glaser (5), and Pretta VanDible Stallworth (9). Glaser is under accusation of sexual harassment, and as such I have to think there’s a decent chance he’ll choose not to run again. That is 100% fact-free speculation on my part, so take it for what it’s worth.

This is the situation as it stands now. As I said, we’ll know more when we see the January finance reports. If you know of someone not listed in the Chron story who’s running for something next year, please let us know in the comments.

Houston City Council approves its new map

Now we wait for the lawsuit(s).

City Council on Wednesday approved new boundaries for the city’s 11 districts for the 2023 elections, featuring modest adjustments affecting parts of downtown, Braeburn, Greater Inwood and a few areas in southeast Houston.

The new boundaries aim to balance district populations based on the latest census data.

By law, the most populous district should not have more than 10 percent more residents than the smallest district. Based on the 2020 census, Districts C and G need to give up some neighborhoods. Districts H, I and J, on the other hand, have lost too many constituents and need to expand. Overall, fewer than 3 percent of the Houston’s 2.3 million residents will change districts.

The redistricting plan had gone through several iterations based on months of internal discussions and public feedback. On Wednesday, four council members also offered amendments to the proposal, three of which were successful.

Despite the majority support for the new maps, council had to vote twice to approve them after it was revealed late Wednesday that the city secretary called out the wrong agenda item before the council voted during the morning session.

The council reconvened at 6 p.m. for a public hearing on a proposed bond election. Following the hearing, which drew no speakers, the council confirmed the new maps by a 14-2 vote, with District I Councilmember Robert Gallegos and District E Councilmember Dave Martin dissenting.

City Demographer Jerry Wood said throughout the design process he had to juggle competing interests from council members and the public and was unable to accommodate some requests.

“If you go into this thinking that you’re going to make everybody happy, you’re going to be sorry for thinking that,” Wood said. “If you go into this thinking that you’re going to make as few people unhappy as possible, then you might have some success.”

See here for some background. The map I’ve embedded is from the early part of the process and doesn’t include any of the changes made at that Council meeting, so go here for the latest details. CM Gallegos has some issues with the process and with an amendment that affected District I; the story did not say why CM Martin voted no. Overall, this was pretty painless, certainly easier than it was in 2011 when we had to add two new districts. That doesn’t mean there won’t be legal issues:

Much of the discussion around redistricting has centered on the lack of Hispanic representation at City Hall.

While about 45 percent of Houston residents are Hispanic, Gallegos of District I is the only Hispanic council member out of the 16, even though the city previously created two other Hispanic-opportunity districts, H and J.

The League of United Latin American Citizens (LULAC), one of the largest Hispanic civil rights organizations in the country, has promised to sue the city over what its advocates characterize as a gross underrepresentation of Latinos on the council.

The goal of the lawsuit is to replace the city’s five at-large seats, which represent voters citywide, with single-member seats, which cover a certain geographical area, to improve minority representation.

The city has hired a law firm in anticipation of the legal challenge.

“We are asking for equity and fairness, and we just don’t have that with the current districts,” said Sergio Lira, a Houston-based leader with the organization. “That’s why we are filing the lawsuit to push for changes.”

Some are worried that Kamin’s amendment could have an adverse effect on Hispanic votes.

The areas set to move to District H instead of Freedmen’s Town, have high percentages of Hispanic constituents, but are experiencing gentrification and are expected to see a decline in Hispanic populations in the following years, according to Wood.

Gallegos said that he did not originally agree with LULAC’s demand to abolish Houston’s at-large seats, but in light of these new developments, he plans to work closely with the organization to advance its cause.

“After what happened this morning, I agree that we need all single-member districts to make sure that we have the representation we need,” he said.

See here for some background. I don’t have anything to add to what I wrote then. I think the plaintiffs would have a decent chance of prevailing if they file, but it’s not a slam dunk. An alternate possible outcome would be to agree to move City Council elections to even-numbered years, as the natural boost in turnout would create a more diverse electorate and thus could raise the chances of Latino candidates in citywide races. That was one of the things that happened in Austin, in addition to the switch to districts from At Large; their elections had been in May of odd years, for maximal non-turnout. Greg Wythe wrote on this topic some years ago at his sadly defunct blog, and it’s stuck with me ever since. There are good reasons to keep city elections in the odd years – Lord knows, we have enough to vote on in the even years, and putting them in the even years would very likely make them more overtly partisan – I’m just saying it’s a possible option. We’ll see what happens.

July 2022 campaign finance reports: City of Houston

We’re still more than a year out from the 2023 election, but we are now up to three serious conteners for Mayor, plus two others in the wild, so the finance reports are beginning to generate some real interest. The January 2022 reports are here, the July 2021 reports are here.

As a reminder, no links to individual reports here because the city’s system generates PDF downloads, and I don’t have the time to rename and upload and share them. Next year, when there are candidates, I’ll do that. Not this time.

All of the current officeholders submitted reports in a timely fashion this period. The only oddity was with the report for CM Letitia Plummer, which did not list an amount raised on either the summary or section totals pages. She clearly did raise some money, as a perusal of the rest of the report shows, but didn’t include a total for it anywhere. I didn’t feel like tallying it up myself, so I left the mystery in place. The only non-officeholders of interest to file reports are the two 2023 Mayoral candidates listed at the bottom, who made a decent splash with their unprecedented totals for this point in the cycle. While he did not file a city of Houston report yet, and while there is some uncertainty about how much he can move from his state account, Sen. John Whitmire had $9.7 million on hand as of July 15. Even if he can only transfer, say, 25% of that, it’s a lot of cash to start out with.

We must once again talk about the finance report for Ed Pollard, who I will say again must be planning something for his future because there is absolutely no need for this level of fundraising for his re-election campaign in District J. I had speculated that maybe he was aiming for a Mayoral campaign, but at this point that seems less likely – I can’t rule it out, but there’s already a big field of well-financed players, and Pollard would be the least known and tied for least-funded among them. Maybe next time, or maybe something in 2024? Or maybe he just really likes fundraising? Who knows.

Other than that, honestly kind of a boring set of reports. Things should start to get more interesting with the January 2023 reports – if nothing else, I’d expect to see a few new names. I’ll skip the HISD and HCC reports this cycle so look for those next January as well. I’ll round up a few state reports of interest for next time. Let me know what you think.

January 2022 campaign finance reports: City of Houston

January finance reports are always worth a look, if only as a ritual to start the new year. We’re a year out from election season truly beginning for Houston, but as we now have two brand name contenders for Mayor already, we should check in and see how our current electeds are doing in the fundraising department. I last looked at these reports in July of 2021. Let’s see what folks have been up to since then.

As a reminder, no links to individual reports here because the city’s system generates PDF downloads, and I don’t have the time to rename and upload and share them. Next year, when there are candidates, I’ll do that. Not this time.

Mayor Turner is the biggest recipient of campaign cash, which is usually how it is. He won’t be on the 2023 ballot, but we will have at least two charter referenda in our future, and I’m sure he’ll want to be able to have some influence over them. As was the case with Mayor Parker and term limits in 2015, he might want to add one or two more to that list, on policy matters that have been discussed but not yet addressed. I’m thinking of the stupid revenue cap, and a second try at an equal rights ordinance, this time for the charter. I have no special insight on these matters, just a long memory and a searchable archive, both of which I endeavor to use for good and not evil.

The fact that we have two high-profile Mayoral candidates in place (well, as much as one can be at this early hour) doesn’t mean that there aren’t other potential Mayorals out there. Last time I noted CM Ed Pollard’s prodigious fundraising, in which he amassed an amount that far outstripped his possible need for re-election in his district, and noted that he has been on some people’s lips as a possible candidate for Mayor. His January finance report does nothing to turn that speculation down, though also as noted before he may have his eye on some other prizes as well.

On the other end of that spectrum is the one person I had felt most confident about as a 2023 Mayoral candidate, and that’s City Controller Chris Brown, who seemed a natural fit for the Mayoral candidate role and who has demonstrated fundraising prowess in the past. Not these past six months, though, and his cash on hand total is looking awfully paltry. Does that mean anything? It’s too early to say. But now that John Whitmire and Chris Hollins are out there doing Mayoral candidate things, the time to decide whether or not one wants to join them in that is not far off. Michael Kubosh, who is currently doing Michael Kubosh things, falls in between the two of them in fundraising action. He’ll be facing the same decision as well.

A person who turned it up several notches after a sedate second half of 2021 is CM Sallie Alcorn, who was a top fundraiser for her initial election and now seems to be preparing for her second race. Note that in recent years, the old “blackout” period for fundraising was eliminated, so incumbents can get a head start on building up their treasuries. Fewer of them have need to do that now, as about half of them are term-limited. Some of those term-limited folks will be leaving with a decent amount of cash in their kitties – I’m thinking Dave Martin, Robert Gallegos, and David Robinson. It’s not clear to me what if any office they might use those funds for in the future – maybe one of them has an eye on Controller – but they have them if they want them.

Not much else of note. Greg Travis is now filing state reports, so he’s been swapped out for Mary Nan Huffman, who still has a few bucks in her account. I did not find a report for Tiffany Thomas. I’ll do HISD and HCC next to finish this off. Let me know what you think.

July 2021 campaign finance reports: City of Houston

PREVIOUSLY: Congress, Harris County

As we know, this is not an election year for city of Houston offices. That usually makes for a pretty dull summary of finance reports, since it’s just incumbents and about half of them are term-limited and thus not really motivated to do much. But I had last checked on these in January 2020, which was the conclusion of the 2019 election cycle, and I didn’t want to wait till next year for a first look. And you never know what you might find.

Sorry, no links to individual reports this time – the city of Houston’s reporting system spits out downloaded PDFs, which I have to rename and upload to Google Drive to be able to provide links for them, and it ain’t worth the effort at this point. I’ll do that in 2023, when things heat up.

One of these things is not like the others. I’ve been asking folks who they think will run for Mayor in 2023, partly to see how my own speculations have turned out. One name that has come up a lot is that of Ed Pollard, the first-term Council member in District J. Let’s just say his July report does nothing to temper that kind of talk. To put it mildly, one does not need $300K to run for re-election in a low-turnout district like J, and that’s more than two years out from the actual election. Pollard may have his eye on something else, of course – he ran for HD137 in 2016, and who knows what opportunities the next round of redistricting may present – but if one is being mentioned when the question of “who is thinking about running for Mayor” comes up, this is the kind of finance report that supports such talk.

Other names that come up when I bring up the question include Michael Kubosh, Chris Brown, and Amanda Edwards. Neither of the first two has raised all that much, though they both have the capability. Kubosh has knocked $60K off his loan total, which may have contributed to his lower cash-on-hand total. As for Edwards, she’s the opposite of Pollard at this point.

The one person who has been openly talked about as a candidate – by someone other than me, anyway – is Sen. John Whitmire, who has enough cash in his treasury to not sweat the small stuff. He recently announced his intent to run for re-election in 2022, which is completely unsurprising and not in conflict with any 2023 speculation. Mayor Turner ran for and won re-election in HD139 in 2014 before officially beginning his Mayoral campaign in 2015.

Beyond that, not a whole lot to report. Mayor Turner has some money on hand if he wants to influence a charter amendment or two. CM Tiffany Thomas did not have a report that I could find – sometimes, the system is a little wonky that way. The only other number of note was for term-limited CM David Robinson, who has added over $100K to his cash on hand since last January. Maybe that’s a sign that he has his eye on another race, and maybe that just means that some people are good at fundraising. I’ll leave that to you. Next up, HISD and HCC. Budget amendments and a fight over police reform

That’s your City Council agenda for today.

City council members have authored more than four dozen amendments to Mayor Sylvester Turner’s proposed budget to trim spending, create new sources of revenue and expand police accountability measures.

Council members will take up the proposals Wednesday when they consider the mayor’s $5.1 billion budget plan, which is coming forward at an especially fraught moment. The city’s usual budget challenges have been aggravated by the economic crisis tied to COVID-19, while activists are gaining traction around the country in their calls to defund or scale back police departments after the death of Houston native George Floyd.

Many of the 50 budget amendments are a direct response to those topics, including one from Councilwoman Amy Peck that would establish a group to audit all city departments and programs, then recommend whether they should be continued with certain changes, folded into another program or dissolved altogether.

The process would in some ways parallel the zero-based budgeting process used for Turner’s spending plan, which required department heads to analyze every function and justify each dollar spent rather than adding to existing budgets. Peck said Turner’s administration never showed council members the detailed results of zero-based budgeting — and her so-called sunset review commission has a broader scope.

“With the sunset review, it’s looking at every line item, but it goes past that,” she said. “It involves citizens and stakeholders and really gets into whether (the program is) serving the constituents, whether there are ways to consolidate, if there are technology advances to make. There could be some program within a department that’s just not needed anymore.”

Other cost-cutting amendments include Councilwoman Sallie Alcorn’s proposal to study where Houston and Harris County can join forces instead of providing duplicate services, and a program suggested by Peck and Councilman Robert Gallegos that would allow city workers to voluntarily take unpaid time off. Councilman Greg Travis also proposed letting private firms compete with city departments for certain contracts, or studying whether it would save money to do so.

The mayor has expressed opposition, meanwhile, to a sweeping police reform amendment introduced by Councilwoman Letitia Plummer that would eliminate nearly 200 vacant positions in the Houston Police Department. The funds saved by getting rid of the positions and a cadet class would go toward beefing up de-escalation training and the police oversight board, among other proposals sought by those pushing for police department reform around the country.

Turner repeatedly said during last year’s mayoral campaign that he wants to grow the police department by several hundred officers, and he rejected the idea of reducing the police department’s budget during an appearance on CNN last week.

With a budget of over $900 million that is devoted almost entirely to personnel, HPD is by far the city’s largest department and would have little room to cut spending without diminishing the police force. The police union previously negotiated a 3 percent pay bump from July 1 through the end of the year, accounting for much of the department’s proposed budget increase.

On Monday, five black Houston council members released a series of proposed HPD reforms that include many of the measures contained in Plummer’s plan, but without the spending cuts. The letter included every black member of council — Martha Castex-Tatum, Jerry Davis, Carolyn Evans-Shabazz, Edward Pollard and Tiffany Thomas — except Plummer.

In a statement, Plummer said, “After reading my colleagues’ open letter, it appears we all want the same things. I look forward to having their support for my amendments on Wednesday.”

Here it must be noted that the police union was a big supporter of Mayor Turner, and they were the instigators of the lawsuit that killed the firefighter pay parity referendum. He campaigned on hiring more police, and that’s where he is. That said, nine votes on Council can pass a budget amendment, and in addition to those six black Council members there are five other Democrats – Abbie Kamin, Robert Gallegos, Karla Cisneros, David Robinson, and Sallie Alcorn – who should be open to persuasion on this matter. Maybe some of the Republican Council members might be willing to trim some budget as well – CM Dave Martin received no money from the HPOU PAC in 2019, for instance. Point being, there’s plenty of room to get at least the group of five amendments passed, if not the Plummer amendment. There’s a rally this morning at City Hall to build support for that. There won’t be any better opportunities anytime soon.

There won’t be furloughs after all

A slightly confusing bit of good news.

Houston will not need to furlough roughly 3,000 city employees nor cancel its police cadet classes in the upcoming budget year, Mayor Pro Tem Dave Martin announced during a city council budget committee meeting Tuesday.

Instead, the city will use federal coronavirus relief funds to help bridge its projected $169 million shortfall in the fiscal year that begins July 1.

“No employee in the (City of Houston) will be furloughed,” Martin said.

The administration has updated Mayor Sylvester Turner’s initial budget proposal, eliminating many of the most dire consequences attributed to the revenue gap. The revised budget plan eliminates furloughs and adds back five cadet classes for police, Martin said.

It also adds another fire department cadet class, giving that department four classes. The new proposal also adds $15 million back into the city’s rainy day fund as hurricane season gets underway; Turner’s original spending plan would have exhausted that fund entirely.

The changes comes as the city has weighed how it can spend $404 million in federal funds it received through the CARES Act, part of a stimulus package approved by Congress.

The administration plans to use roughly $19 million of those funds to cover expenses for redeploying city employees from their normal duties to address the coronavirus pandemic, freeing some budgetary space. It is not clear if the city plans to use additional federal funds to cover the remaining costs of the budget revisions.

See here, here, and here for some background. I’ve said all along that the city could avoid all of the issues for this year if it could use that federal money for previously budgeted items. Apparently, they have decided that they can, or at least that there’s enough of the money available to fill other needs to make the math work. I can’t tell from this story what may have changed to go from apocalyptic warnings about layoffs and furloughs to this – maybe the city got clarity from the feds, maybe they came to this conclusion on their own, maybe there was enough wiggle room to allow for budget items to get moved around, who knows? This is the outcome that should have been from the beginning. Remember, a large part of budgeting is determined by the calendar – if these federal dollars had been allocated earlier, there wouldn’t have been so many “previously budgeted items” to worry about. I’m a little worried that someone is going to come along and try to stop the city from doing this, maybe by lawsuit or some other decree, but until then, I’m glad they worked this out. There are plenty of things to worry about going forward, like sales tax revenues, but buying a year’s time before that reckoning allows for another CARES Act or other positive development to occur. Sometimes kicking the can down the road is all you need to do.

CM Plummer tests positive for COVID-19

Houston City Councilmember Letitia Plummer has tested positive for COVID-19, becoming the first elected official in the city to have a confirmed infection of the disease caused by the new coronavirus.

Plummer, a first-term council member and dentist, has been quarantining at home since Thursday and received her results Monday, she said. She briefly went to the emergency room on Saturday to receive fluids, but otherwise has been at home.

Her staff members will be tested for the virus Tuesday, she said. Her dental office staff have all tested negative, as have her three sons.

Mayor Pro Tem Dave Martin said the administration is working to ensure any council member or staff member who wants to get tested can do so Tuesday at City Hall, though they are still are working through the details. Mayor Sylvester Turner is scheduled to unveil his proposed budget Tuesday.

“We have to be careful. This is a great wake-up call for a lot of people,” Martin said. “We think this is over? No. For us, it’s just beginning.”

The council has continued to meet in person at City Hall each week, though members generally are spread out around the dais and at the press tables in front of the audience seats. Most wear masks, but they frequently are in close proximity to one another.

First things first, I wish CM Plummer all the best for a speedy recovery, and I am glad that no one in her family or office appear to have been infected. I hope that’s true for all of her colleagues and other contacts as well. This is a shock, but it’s not really a surprise. Sooner or later, this was going to happen to someone in local elected office – as we have already discussed, it has happened elsewhere, in some cases with fatal results. We all hope and pray for a better outcome here.

But look, it’s not great that Council has continued to meet in person like this, even with masks. Go back and read this link I posted in th weekend roundup. Even sufficiently distanced, and even with masks, having people in an enclosed space for a long period of time is a high-risk scenario for coronavirus. City Council, and every other elected body, needs to give very serious thought to transitioning their meetings online, like now. If the Lege isn’t working on a contingency plan for this as well, even with their next meeting not scheduled until January, they’re needlessly risking the lives of their members, their staff, their security and other support personnel, and everyone else who crowds into the Capitol every two years. If SCOTUS can handle its business over the phone, these folks can do so as well. The alternative is an outbreak that prevents a quorum or upends the elected balance of power, and that’s without considering how many of these people are in high-risk categories. Let’s not be stupid about this. Hold the meetings online, and don’t delay. I don’t want to hear any excuses.

We’re done with the 2019 Houston election cycle, but there are still things we can learn from the January 2020 campaign finance reports that city of Houston candidates and officeholders have to file. Nominally, this period covers from the 8 day report before the November election (which would be October 27) to the end of the year, but for most of these folks it actually covers the 8 day runoff report to the end of the year, so basically just the month of December. In either case, this is the time when candidates don’t raise much but do spend down their accounts, as part of their GOTV efforts. For those who can run for re-election in 2023, they will have plenty of time to build their treasuries back up.

Mayor Turner will not be running for re-election again, but it’s not hard to imagine some uses for his existing (and future) campaign cash, such as the HERO 2.0 effort or the next round of city bonds. He can also use it to support other candidates – I’m sure he’ll contribute to legislative candidates, if nothing else – or PACs. That’s what former Mayor Parker has done with what remains of her campaign account. Nearly all of the $38,750 she spent this cycle went to the LGBTQ Victory fund, plus a couple of smaller contributionss to Sri Kulkarni, Eliz Markowitz, and one or two other campaigns. Tony Buzbee has restaurant bills to pay, and those endless emails Bill King spams out have to cost something.

Others who have campaign accounts of interest: As we know, Jerry Davis has transferred his city account to his State Rep campaign account. I’ve been assuming Mike Laster is going to run for something for years now. The change to four-year Council terms may have frozen him out of the 2018 election, when he might have run for County Clerk. I could see him challenging a Democratic incumbent in 2022 for one of the countywide offices, maybe County Clerk, maybe County Judge, who knows. It’s always a little uncomfortable to talk about primary challenges, but that’s what happens when there are no more Republicans to knock out.

Other hypothetical political futures: Dave Martin could make a run for HD129 in 2022 or 2024, or he could try to win (or win back) Commissioners Court Precinct 3 in 2024. If Sen. Carol Alvarado takes my advice and runs for Mayor in 2023, then maybe State Rep. Christina Morales will run to succeed her in SD06. If that happens, Robert Gallegos would be in a strong position to succeed Morales in HD145. Michael Kubosh wasn’t on my list of potential Mayoral candidates in 2023, but maybe that was a failure of imagination on my part. As for Orlando Sanchez, well, we know he’s going to run for something again, right?

You may be wondering, as I was, what’s in Amanda Edwards’ finance report. Her activity is from July 1, since she wasn’t in a city race and thus had no 30-day or 8-day report to file. Her single biggest expenditure was $27K to Houston Civic Events for an event expense, and there were multiple expenditures categorized as “Loan Repayment/Reimbusement” to various people. Perhaps she has transferred the balance of her account to her Senate campaign by this time, I didn’t check.

Most of the unsuccessful candidates’ reports were not interesting to me, but I did want to include Raj Salhotra here because I feel reasonably confident that he’ll be on another ballot in the short-term future. The HISD and HCC Boards of Trustees are both places I could see him turn to.

Last but not least, the Keep Houston Strong PAC, whose treasurer is former Mayor Bill White, gave $10K to Move to the Future PAC. That’s all I know about that.

30 Day campaign finance reports: Incumbents and challengers for Council

Not a whole lot of interest here. There are multiple candidates who entered the race too late to have a July report who are showing up this time, but outside of Isabel Longoria in H none of them made much of an impression. That race continues to be the most interesting non-Mayoral challenge to an incumbent on the ballot. Karla Cisneros has plenty of resources available to her, but she’s in a fight.

Beyond that, as I said, not much to say. I wish Janaeya Carmouche had raised more money. Willie Davis and Marcel McClinton did raise a few bucks, but not nearly enough to make a difference in a citywide race. There’s just nothing else to say. I’ll have more reports tomorrow.

UPDATE: Because I’m an idiot, I overlooked the At Large #1 race initially. Raj Salhotra continues his fundraising superiority, while Mike Knox at least raised a few bucks, and no one else did anything of note. I see a lot of Raj signs in my neighborhood, but I think I’d feel better if I saw a TV ad or two from his campaign. Old-fashioned, I know, but it’s still the best way to reach a lot of voters.

Endorsement watch: E and F

The Chron endorses incumbent CM Dave Martin in District E.

It’s easy to find out the biggest problem in Houston City Council District E. Ask any of its residents and most likely they will tell you a flooding story. Water invaded so many homes in the Kingwood and Elm Grove neighborhoods after Harvey and Imelda that just the sight of dark clouds makes people nervous.

That’s why District E residents have come to depend on incumbent Councilman Dave Martin. Since first being elected in 2012, and has served one two-year and one four-year term. Martin has been working hard to make their homes less vulnerable to flooding.

During an endorsement interview, Martin told the editorial board that most of the flooding is due to runoff caused by excessive development in neighboring Montgomery County. The water cascades into District E whenever there’s a big rain.

Martin, 61, said he has asked the county for more water detention and retention facilities, including a berm between Elm Grove and Montgomery County. But the task has been difficult. “Let’s talk politics. You have a predominantly Democratic body in the city of Houston and a Republican body in Montgomery County,” Martin said.

He said the politics being played includes the developer responsible for much of the runoff problem. “It’s Perry Homes and everyone knows Perry Homes is one of the largest contributors to political campaigns in Texas,” Martin said. “I know what I’m up against.”

CM Martin, whom I’ve not had the opportunity to interview, is basically the best case scenario in a district like E. He cares about governing and doesn’t exist as a roadblock. I wouldn’t want a City Council full of members as conservative as Dave Martin, but I’m happy to have a Dave Martin in District E.

In District F, the Chron recommends Tiffany Thomas.

In a city known for its diversity, District F still stands out for its eclectic mix of white, black, Latino and Asian residents, a place where English may be a second or even third language spoken at home. But the ward, which spreads along the Westpark Tollway toward the city’s far western edges, is also known by many in the community as the “forgotten district” — under-resourced and left out of opportunities for economic development and revitalization efforts.

Tiffany Thomas, our choice for District F, wants to make greater Houston remember.

“The current system does not work for District F,” she told the editorial board. “We are forgotten when we look at investment, when we look at leadership, and when we look at our values at City Hall.”

Thomas, 38, grew up in the area, attending Alief schools. After graduating from Sam Houston State University, she moved back home and has been active in the community, working with nonprofit groups focused on education and health care. In 2013 she won a seat on the Alief ISD Board of Trustees, where she helped shepherd the 2015 bond referendum to create a Career Technology Center.

She points to the creation of the center as a high point of her service on the board as well as why she is running for council.

“Yes, we did $300 million for a CTE center, which is the best and brightest on this side of town for high-skill, high-wage jobs,” Thomas said. “The challenge is, there are no high-skill, high-wage jobs in the district.”

She hopes to use her position on the council, including through code enforcement and working with management districts, to hold absentee landlords accountable, revitalize neighborhoods and attract businesses.

Thomas and Giang “John” Nguyen were the two leading fundraisers as of July, but we’ll see how that goes now that the 30 day reports are coming in. The Chron had nice things to say about some of the other candidates, especially Nelson, but overall I agree that Thomas is the strongest candidate.

Revisiting City Council redistricting

This would be interesting.

At Wednesday’s council meeting, District E Councilmember Dave Martin said the city should consider redrawing city council district boundaries, particularly in his own district.

District E includes two far-flung suburbs, Kingwood and Clear Lake. Martin said it’s a “ridiculously arranged council district” where it is difficult to coordinate meetings.

“I’ve always felt that the folks in Clear Lake do indeed deserve their own representation there, because it is tough for someone to drive 60 miles on a weekend to get to a certain area,” Martin said.

Mayor Sylvester Turner agreed with Martin’s assessment of District E.

“I will tell you it is an interesting drawing,” Turner said. “Because you certainly cannot go from Kingwood to Clear Lake for a town hall meeting, two town hall meetings.”

Turner said he would support taking a look at the map after the 2020 census.

“I don’t know what the thinking was back then,” Turner said. “But it does seem to be not in the best interest of two areas that are so geographically separated. I think it’s worth taking a look at.”

There’s a copy of the map embedded in the story, and you can also see it here, with links to individual district maps here. It’s true that District E is this two-headed amalgam of far-apart suburbs, with a bit of connecting tissue in between, but any proposed solution to address that is complicated. The problem is that the Kingwood part of E abuts District B, and the Clear Lake part borders on Districts D and I. Any redesign of the current map that would split District E into separate parts has to take into account merging a bunch of white Republicans with a bunch of black and Latinx Democrats. Even before we take Voting Rights Act requirements into consideration, I can guarantee you that a substantial number of people would be unhappy with any alternative.

What you could do is reduce the size of individual districts to be roughly the size of the Kingwood and Clear Lake pieces, then redraw the map with however many districts there would be with such smaller population requirements. That would result in a map with anywhere from 15 to 21 districts, depending on how much you padded out the two halves of E. We can debate whether that’s a good idea or a bad idea, but we’d also probably need a charter amendment to make it happen.

Personally, I’d be willing to at least explore the idea, and maybe have someone draw a few sample maps, to give a picture of what this might look like. Honestly, I think we ought to consider the same for the Legislature, where individual districts have grown in population quite a lot in recent years. This is especially true for Senate districts, which used to be smaller than Congressional districts but are now larger and will get more so in 2021 when Texas is given additional seats in Congress. It’ll never happen of course, but that doesn’t mean we should never think about it.

July 2019 campaign finance reports: Incumbents and challengers for Council and Controller

Let me start by saying that I began this post before Amanda Edwards became a candidate for Senate. I’m going to keep the AL4 race in here, in part to include Edwards’ June report totals, and in part because I’m just stubborn that way. I did add in the candidates who have jumped into AL4, so this is as up to date as I am. Feel free to tell me who I’ve missed.

I know Tiko Reynolds-Hausman and Isabel Longoria entered their races in July, so they have no reports yet. That may be true for some others as well, but if so I’m not aware of them.

Let’s get the easy ones out of the way first. Greg Travis and Martha Castex-Tatum don’t have opponents. Chris Brown, Dave Martin, and Robert Gallegos may as well not have them, either. I know, there’s still a few months to go before the election, but none of the purported challengers appear to be doing much. Heck, only Sam Cleveland even has a website, though Ryan Lee and Rick Gonzales do at least have Facebook pages. So yeah, nothing to see here.

David Robinson and Michael Kubosh have opponents who have been a bit more active – Willie Davis is a repeat candidate, having run in 2015 against Robinson – but so far don’t appear to pose too much of a threat.

The threat to Karla Cisneros is greater, and potentially severe. I’ve already seen a couple of signs for her opponents in my neighborhood, and while Isabel Longoria hasn’t had a chance to post a finance report yet, Cynthia Reyes-Revilla’s totals are OK. Not terrifying if you’re the incumbent, but not nothing. Keep this one in your back pocket, and we’ll revisit when the 30 day reports are posted.

Had Amanda Edwards decided to stay in Houston and run for re-election, I’d have grouped her with the not-really-challenged incumbents. With AL4 now an open seat, and the field likely to expand further (*checks the Manning spreadsheet one last time to make sure no one else has entered the race*), it’s also open in the sense that there’s no clear frontrunner. Nick Hellyar and Letitia Plummer, who had started out in other races, have the early fundraising lead, but not enough to present a significant obstacle. Hellyar has picked up multiple endorsements from current and former elected officials, which ought to boost his coffers, but we’ll see what that means in practice. We really don’t know anything about this race right now.

And then there’s At Large #1. If you knew nothing about this election and I told you that Raj Salhotra was the incumbent and Mike Know was a challenger, you’d believe me based on their numbers. I can’t recall the last time an incumbent was so thoroughly outclassed in this regard. That’s great for Salhotra, whose biggest challenge isn’t Knox as much as it is Georgia Provost, who nudged past four better-funded candidates as well as ultra-perennial candidate Griff Griffin to make it into the runoff in 2015. She’s going to get her share of votes, especially if the voters don’t know the other candidates on the ballot. Salhotra is well on his way to having the resources to run a sufficient citywide campaign and introduce himself to the electorate. In what should be a prelude to another runoff, he just needs to finish in the top two. So far, so good.

I’ll break up the open seat races into two or three more posts. Did I mention there were a crap-ton of candidates this year? Let me know what you think.

Here’s the Mayor’s budget

A lot of people won’t like it, but this is what happens when you heap a big expense on top of an already tight fiscal situation.

Mayor Sylvester Turner on Tuesday proposed to close Houston’s $179 million budget gap for the upcoming fiscal year by tapping into the city’s reserves, eliminating more than 60 vacant positions and laying off more than 300 city employees.

Turner’s proposal would reduce the overall budget of city departments by about $36 million, a figure that includes layoffs of firefighters, fire cadets and municipal workers, all of whom have received pink slips.

The mayor’s budget also would draw $116 million from the city’s reserves, which Turner said the city can afford because it will end the 2019 fiscal year with a higher-than expected general fund balance. The next fiscal year begins July 1.

Laying out the final budget proposal of his first term, Turner framed the financial plan as conservative and said his administration “scrubbed every department” in search of places to trim costs. The budget also uses a conservative projection for the amount of new property tax revenue Houston may take in, Turner said.

Turner said a large chunk of the 2.2 percent increase in general fund spending is driven by the cost of Proposition B, the voter-approved charter amendment that grants firefighters the same pay as police of corresponding rank and seniority. The raises will cost $79 million during the next budget year, Turner said.

District E Councilman Dave Martin agreed with Turner’s fiscal assessment of the budget, contending that the city has faced a challenging situation with small revenue growth projections — about 2 percent in property taxes and 1 percent across all sources — amid large added costs such as Prop B.

“We’ve been working on this for nine months, accumulating a healthy fund balance, not filling slots that were available for employment,” said Martin, who chairs the council’s Budget and Fiscal Affairs Committee.

Under Turner’s proposal, public safety — which includes the fire and police departments, the municipal courts and emergency operations — would make up about 58 percent of the general fund budget, at a cost of $1.5 billion. The fire department’s budget would increase to $558 million, a 4.5 percent boost over how much the city estimates it will spend on the department this year.

The fire department was allocated $503 million in the current budget. Total projected spending, however, has grown to about $534 million with the city covering Prop B raises retroactive to Jan. 1. Turner said the adjusted paychecks would go out Friday.

Controller Chris Brown, the city’s elected budget watchdog, said he does not feel confident that Turner has accurately projected Prop B’s cost because the mayor has yet to supply his office with financial data backing up the $79 million estimate. Brown also wants to generate his own independent figure, which he said he cannot do without certain incentive pay data.

Turner told reporters Tuesday that the city attorney, Ron Lewis, had determined the city’s interpretation of Prop B would withstand legal challenges.

Still, Brown said the city has little breathing room if a judge rules the firefighters are owed more. He noted that the budget would dip the city’s target fund balance within striking distance of the minimum level allowed by city policy. The city’s reserves must make up at least 7.5 percent of the city’s general fund budget, and the 2020 budget target would leave the balance at $171 million — 7.9 percent, $9 million above the threshold.

“What if a judge says, ‘You know what, we think that this is $100 million,’ and we need to pay immediately this additional money?” Brown said. “Where is that money coming from?”

I see on Twitter that some firefighters have highlighted the above quote from Controller Brown, while in this article Marty Lancton again complains that Mayor Turner isn’t implementing Prop B exactly the way he wants it to be implemented. Well, someone has to talk about the cost of Prop B. As for Brown, he’s just doing his job. And the possibility that the cost of Prop B could go up on a judge’s order is a good point and more than a little disturbing.

From here, the budget goes through Council, where they can propose amendments and do whatever they’re going to do with it. I’ll be very interested to see if any of the ones that voted against the layoffs have anything constructive to suggest for how to avoid, or at least reduce them. The budget vote is scheduled for June 5, so mark your calendar.

Appeals court allows city to post video of pay parity hearing

Probably doesn’t matter much at this point, but there it is.

A Texas appeals court on Thursday ordered a state district judge to rescind his temporary restraining order requiring the city of Houston to remove video from its website that depicted a public city council committee hearing over a proposal to grant firefighters “pay parity” with police.

District Judge Kyle Carter should not have blocked the city from posting the video of the committee hearing because it is not clear the meeting constituted illegal electioneering, as the Houston firefighters union had alleged, the 14th Court of Appeals justices ruled.

That restraining order had expired last week anyway, said Cris Feldman, an attorney for the firefighters union, adding that the decision does not preclude a court from coming to the same conclusion that Carter did after further hearings in the case.

The section of state law banning local governments from using public funds to advocate for or against ballot measures was not intended to restrain public discussion of such issues, the justices wrote Thursday.

“It was not unreasonable or unexpected that statements tending to indicate support for, or opposition to, the charter amendment might be voiced at the meeting,” the nine-page opinion states. “Public funds were not being used for political advertising by making the meeting video publicly available, even though an incidental effect of posting the video on the city’s website may be to re-publish statements supporting or opposing the charter amendment.”

As noted, the TRO had expired on August 14, and the Chron posted their own copy of the video shortly after Judge Carter handed down his opinion, so this is all mostly academic. It may mean something after the election when the lawsuits over the wording of the referendum gets filed, but until then it’s mostly a warm-up exercise.

July 2018 finance reports: City of Houston

Every level of government requires finance reports in January and June, whether or not there is an active election cycle in that year. That includes the city of Houston, whose january report data we inspected here. Our next election is in 2019, and while this is still traditionally a little early for there to be much activity, there are the finance reports. Here’s what we’ve got:

As you may recall, there wasn’t much in the way of fundraising for anyone except Mayor Turner last time. I don’t know if it’s due to the time of year, the approach of the next election, or the overall political climate, but as you can see nearly all of our elected officials have been busy. The report for Martha Castex-Tatum, who was elected in May to succeed the late Larry Green, is in a shorter period than everyone else since she had to post 30-day and 8-day reports for her cycle; the others are all for the full January through June time frame.

Looking at these numbers, only Jack Christie has acted like the term-limited Member that he is. Brenda Stardig, Jerry Davis, Ellen Cohen, and Mike Laster have been more or less business as usual. I’ve speculated before about the possible future ambitions they may have, and I don’t have anything to add to that. I’m sure there’s a reason why the three non-Cohen members have been stockpiling the loot like this, but until they do something tangible it’s hard to say what that might be.

Which doesn’t mean we can’t speculate at all. I look at what Dwight Boykins and David Robinson are doing and I wonder a little. Both are on the ballot next year for their final terms (as always, modulo future rulings in the interminable term limits litigation), and while Robinson had to fend off four challengers and win in a runoff in 2015, Boykins cruised home unopposed. It could be that Robinson is merely gearing up for the next battle while Boykins is doing his best to keep potential opponents at bay. It could also be that they’re looking beyond their next term to a time when both the Mayor’s office and the Controller’s office will be open seats. I have no idea and no evidence – like I said, I’m just speculating. Dave Martin is also in that “one more term and has a lot of cash” group, but we don’t tend to elect Mayors who fit Martin’s political profile, though perhaps Controller might appeal to him.

Be all that as it may, this is the first time since we switched to four-year terms and no blackout period for fundraising that we’ve seen incumbents establish a clear financial advantage for themselves. No one on the outside has yet taken a concrete step (like designating a campaign treasurer and raising their own money) towards running for a Council seat, but do keep in mind there are several now-former candidates for Congress in town who likely have some cash remaining in their coffers (sorry, I’m only checking on still-active candidates). Surely it would not be a surprise if one or more of them decided to act more locally next year. Given that possibility, it’s hard to blame any of the members who are up for re-election next year to take precautions.

The remaining reports I included because they’re there. As we learned after the death of El Franco Lee, the remaining funds in Larry Green’s campaign account are to be distributed by his campaign treasurer, whose name is Kevin Riles. As we see from Lee’s July report, there’s no particular rush to do whatever that turns out to be. I don’t remember what Citizens to Keep Houston Strong was about, but Bill White is their treasurer. I’m sure we’ll see plenty more PACs and PAC activity as we move towards referenda for firefighters’ pay parity and the revenue cap.

Firefighters file suit over handling of pay parity proposal

I figured we’d have to wait till after the eventual vote on the firefighters’ pay parity proposal for there to be litigation over it, but no.

The union representing Houston firefighters sued Mayor Sylvester Turner and a City Council member on Monday, alleging the officials are improperly using public resources to oppose a “pay parity” ballot initiative.

The Houston Professional Fire Fighters Association accuses Mayor Turner and Council Member Dave Martin, who represents Kingwood, of campaigning against the ballot initiative, which would tie firefighter pay to that of Houston police officers of comparable rank and seniority.

The union argues it is a violation of the Texas Election Code and is asking for an injunction that would prohibit the officials from “continuing to post such political advertising on the City of Houston website.”

The mayor’s declined to comment Monday evening.

Judge Kyle Carter agreed with the Houston fire union’s argument that the city council’s July 26 budget committee meeting constituted an act of illegal electioneering against the proposal and that public resources, essentially, had been used to present and post a political advertisement. The Houston Professional Fire Fighters Association sued Mayor Sylvester Turner and Councilman Dave Martin, who chairs the budget committee, over the issue on Monday.

“There is a fair way to go about voicing your opposition and creating a campaign against a certain resolution and then there’s an unfair way,” Carter said in delivering his Tuesday morning decision. “Much of the hearing, I thought, was informative and served its purpose. However, there was a good portion of the hearing that … went beyond the pale.”

He did not elaborate on what comments he thought went too far.

Carter ordered attorneys for the city and the fire union to discuss what portions of the tape could be returned to the city website after the offending portions were redacted. The order, as issued, is valid through Aug. 14.

Buck Wood, an Austin-based public law attorney who helped pass Texas’ first open meetings and open records laws in 1973, said he had never heard of such a ruling in his 50 years of practice.

“Making your position known in a public forum is the essence of what the open meetings law is all about. Not only that, assuming it gets filmed by the city, it’s an open record and you can go get it under the public information act. That’s the whole idea,” Wood said. “The fact that they don’t like what the mayor and the council are saying doesn’t make any difference. That’s content censorship. I never heard of such a thing.”

Joe Larsen, a Houston lawyer with 25 years of experience in open meetings and open records law, agreed. Larsen said he can see such a committee discussion being problematic if its agenda was not posted properly or if the issue being discussed was irrelevant to the committee’s focus, but he said he cannot otherwise envision a way in which such a hearing could constitute electioneering.

“I don’t see how it could be,” he said. “What’s wrong about people taking a public position? How do you restrict your public officials on what they’re going to discuss? That can’t be the right result.”

“That is the equivalent of a 25 percent pay raise for firefighters which the city cannot afford,” Turner said. “The public has a right to listen to the public hearing and we will vigorously challenge the judge’s ruling.”

Not really sure what the practical effect of this ruling is. I mean, how much traffic do those committee hearing videos get? There was an earlier version of this story in which the Mayor referred to the proposal as “the equivalent of a 25 percent pay raise for firefighters which the city cannot afford”, a quote he repeated later on KUHF. The firefighters may have gotten this ruling – which the Mayor says he will appeal – but Turner get the opportunity to keep making his case against the firefighters in the news. Not sure that’s a great tradeoff for the firefighters.

No quorum for very special Council meeting

Close, but no cigar.

A handful of city council members who organized a rare special meeting to push for a Houston firefighters petition seeking pay “parity” with police to appear on the November ballot fell short of a quorum Friday and broke up without a vote.

The resolution they had put forward called on Mayor Sylvester Turner to let the council vote at its meeting next week to place the parity petition on the ballot.

Turner told one council member last Friday that he planned to have that discussion at the Aug. 8 council meeting, but word of that plan had not reached the full council Monday when members Greg Travis, Michael Kubosh, Brenda Stardig, Martha Castex-Tatum and Dwight Boykins signed a memo calling the special meeting.

No more than seven members reached the council chamber Friday morning, two short of the count necessary for a quorum, so Councilwoman Brenda Stardig called off the effort after 15 minutes.

Signatories Travis, Kubosh, Stardig and Boykins were present, though Boykins grew impatient and left. Council members Mike Knox, Steve Le and Dave Martin also were present. Castex-Tatum did not attend.

Martin had said he would skip the gathering, but the New Orleans native acknowledged he showed up in Cajun mode, spoiling for a fight.

If more Council meetings had that kind of entertainment, I’m sure more people would tune in to them. There will be a Budget Committee hearing, followed by a Council vote on August 8, and we’ll have this thing on the November ballot.

A very special Council meeting

Who knew there was such a thing?

In a rare maneuver that sidesteps Mayor Sylvester Turner’s authority, five city council members have called a special meeting this week, hoping to force the issue of Houston firefighters’ push for a referendum on pay “parity” with police.

The council members aim to secure their colleagues’ support for a resolution calling on Turner to place an item on the council’s July 24 agenda to schedule a November election on the petition, which seeks to grant firefighters the same pay as police officers of corresponding rank.

In Houston’s strong-mayor form of government, the mayor generally has sole authority to decide what appears on the agenda for the weekly council meetings.

The lone exception allows three council members to set the agenda of a special meeting. Such gatherings — including this one — typically are organized without the mayor’s approval, and often struggle to muster a quorum, as many of the 16 council members are loathe to invite the mayor’s wrath.

Council members Greg Travis, Michael Kubosh, Brenda Stardig, Martha Castex-Tatum and Dwight Boykins signed a Monday memo calling a special council meeting for Friday at 10 a.m.

Turner is on a trade mission in South America and will not be back in time to attend the meeting.

Kubosh said he signed the memo to help ensure the issue was discussed, noting that several elections have passed since the petition was submitted.

“They were successful last year at stalling it a whole year, so, yes, I think that’s possible,” Kubosh said, referring to the Turner administration.

[CM Dave] Martin [who chairs the Council’s budget committee] said he does not intend to attend Friday’s meeting and doubts the organizers will have the quorum necessary for a formal vote.

“If they don’t show up, they don’t show up,” Kubosh said. “But I’ll show up.”

It is unclear what the impact would be if the proposed resolution reaches a vote and passes.

City Attorney Ron Lewis declined to address whether that outcome could force the mayor to act, given that the city charter gives Turner control of the council agenda.

“As a practical matter,” Lewis said, “the item will go on an agenda that’s timely, and the mayor’s committed to that.”

Insert shrug emoji here. The petitions were certified in May, and one would think the vote would be in November. According to Mayor Turner’s chief of staff and confirmed by CM Martin, this was to be discussed at the budget committee hearing on July 26, with the item for placing it on the ballot to be on Council’s August 8 agenda. I don’t know what else there is to say.

Bike plan vote delayed

What’s another two weeks?

Houston’s long-term plan for improving bicycle routes around town will wait a couple more weeks after a handful of elected officials voiced various concerns.

City Council members Greg Travis, Michael Kubosh, Steve Le, Mike Knox and Dave Martin tagged the proposed Houston Bike Plan on Wednesday morning, delaying its approval for at least two weeks.

The plan, which doesn’t commit money but does guide future projects as the city proceeds with road work, lays out an ambitious plan for hundreds of miles of high-comfort bike lanes in Houston, meant to make bicycling safer and more appealing to residents.

Work on the plan began roughly 18 months ago and has been through various drafts with input from city and community officials.

Council ratifies Turner’s pension plan

On a 16-1 vote, Houston City Council has endorsed Mayor Sylvester Turner’s historic package of pension reforms. The vote clears the way for the City to move forward in partnership with the pension systems to seek legislative approval of the reforms.

“I am bubbling over on the inside,” said Mayor Turner. “I am thankful to everyone who has helped get us to this point. That includes City Council, the pension systems, our City employees and many others. This plan is historic, transformative and budget neutral. We are solving our pension problem permanent and we are doing it without needed a tax rate increase. There is no other plan out there offering the same benefits. The Houston solution can be the model for other cities with similar challenges.”

The police, fire and municipal pension systems all signed off on the package of reforms prior to today’s City Council vote, marking the first time that the City and all of the pension groups have been united.

The plan immediately reduces the City’s nearly $8 billion pension debt by over 30 percent and then sets a 30-year fixed payoff schedule for the remaining $5.3 billion of debt. This immediate reduction is accomplished through a combination of benefits changes that include scaling back cost-of-living adjustments, higher employee payroll contributions and phasing out of the Deferred Retirement Option Program, known as DROP, which allows employees to accept retirement benefits while continuing to work for the City. In return for the concessions, the City has agreed to issue $1 billion in Pension Obligation Bonds to make up for years of prior underfunding of the pension systems.

“It is a big deal that employees have agreed to these benefit changes,” said Turner. “I know this has not been easy, and I thank each of them for their patience, understanding and service. This plan will provide stable and sustainable retirements at an affordable cost to the taxpayers who foot the bill. Retirees won’t have to worry if the check will be there.”

Moving forward, predictions about the anticipated performance of pension system investments will be based on a more conservative seven percent assumed rate of return. If there are market changes that cause costs to exceed pre-agreed limits, there is a mechanism to force additional changes in benefits to bring everything back in line. A requirement that both sides share information will ensure compliance with the required 30-year payoff schedule.

State Senator Joan Huffman and State Representative Dan Flynn are expected to carry the Houston pension legislation. Bill filing for the 2017 legislative session begins mid-November 2016.

Turner secured the political chip of a prompt and lopsided endorsement by using an impassioned speech to persuade Councilman Michael Kubosh to remove his “tag,” a parliamentary maneuver that would have delayed the vote. Kubosh had said he initially tagged the measure at the request state Sen. Paul Bettencourt, a Houston Republican who has called for a delay until more information was available on the reform plan.

“Either you all are going to represent the people of the city of Houston or – I’m going to borrow your term Councilmember Kubosh – are you going to represent political interests? I stand with the people of the city of Houston,” Turner said. “I was voted (in) to represent their interests, not some party affiliation or some political interest or somebody who wants to be mayor.”

Turner’s comments plainly were directed at Bill King, who was runner-up in last year’s mayoral race and who joined Bettencourt at his news conference. The duo said the detailed reform proposals were public for too short a time and too vague to be properly vetted, particularly a key “corridor” provision that would force benefit cuts in the future if a market downturn led the city’s payments to increase above a specified threshold.

King and Bettencourt say the city should switch new hires to retirement savings plans similar to 401(k)s, but acknowledged a well-written “corridor” provision could offer the same benefits to the city.

Most council members, however, referenced the briefings they had received on the plan and echoed Turner’s point that no public speaker in the six weeks since the reform outline was first announced had appeared before City Council to criticize it.

“I want to make sure the public understands we have been briefed, and it wasn’t a 24-hour-ago briefing,” Councilwoman Brenda Stardig said.

Councilman Dave Martin, like Stardig, a conservative, offered even stronger comments.

“I did not vote for you. I did not support you. I’m supporting you 100 percent on this,” Martin told Turner. “I think it’s ridiculous for people to criticize this plan. It’s been transparent; it’s been thorough. We’ve been diligent. We don’t need any more information. Maybe the state does, but do your homework.”

Yeah. Just as a reminder, the Kinder Institute has analyzed the plan, so we are not operating in an information vacuum here. I’m sure if Sen. Bettencourt had called the Mayor’s office and asked for a briefing, he’d have gotten it. But it’s easier to preen than it is to prep, so here we are. My guess is we’ll see bills get pre-filed for this, probably in November, so we’ll know soon enough what that will look like. The next question is who will support it and who will try to kill it. The games have just begun.

The city cab app

Meet Arro.

Houston’s fractured taxi market is headed toward a rare bit of unity, with a push by the city toward how people hail cabs in the 21st century.

As the taxi and limo industry adjusts to new ways of doing business, under intense competition from firms like Uber, city officials plan to consolidate dispatching via a private smartphone app in an attempt to buoy travel options for visitors and residents.

Citing a need to better use the nearly 4,000 taxi and limo permits across roughly 9,000 drivers, city officials announced Monday that Arro, a company already combining dispatch in New York, Boston, San Francisco and Chicago, will develop a universal taxi app for Houston’s 146 taxi companies.

“We’re excited to bring the taxi industry, fully, into the digital age,” said Tina Paez, director of Houston’s Administration and Regulatory Affairs Department.

Cab and limo companies encouraged the city to develop something to even the playing field with Uber, which has dominated the ride market since arriving legally in Houston in November 2014.

“I think you will have people come to rely on faster cab service than they do now,” said Duane Kamins, owner of Lone Star Cab Company.

The app would mean all cabs could be hailed based on who’s closest, breaking the taxi reliance on downtown cab stands and airport trips that leads to bunching of vehicles and a lack of available rides in other neighborhoods. The app also provides an emergency scenario, should Uber – which opposes some of Houston’s regulations – bail right before thousands descend for the Super Bowl.

City Council is expected to discuss the app at its meeting next week.

Starting with consolidating taxi companies into a single online dispatch system, the app will eventually expand to include other features such as transit schedules, real-time traffic information and bike sharing information.

Council member Michael Kubosh, however, questioned at a Monday committee meeting why the city was entering into the app business – or even encouraging a vendor to jump in.

“If you want government intervention and you all are holding hands singing Kumbaya, I will vote for your government intervention,” Kubosh said.

No taxpayer money will be used to develop or advertise the app, though city staff will guide the process with Arro, and elected officials could devote time to promoting it.

I don’t see any problem with the city’s involvement, especially given the other features mentioned. Cabs remain a regulated utility, so there’s a pretty good argument to be made that the city should get make this kind of investment. The concerns CM Greg Travis raised about Arro’s app receiving mediocre user ratings are more worrisome, but let’s not get ahead of ourselves. It’s a good idea, and it brings independent cabbies into the fold as well. Let’s see what the beta version looks like and go from there.

What Council members think about the Uber threat

I was scrolling through Facebook and came upon this post from CM Michael Kubosh:

Council Member Michael Kubosh said that all public service drivers for buses, cabs, train, limos, shuttles and jitneys require the same CRIMINAL BACKGROUND CHECK and FINGERPRINTS. They must follow the rules. They came to Houston during the 2014 Rodeo operating illegally and the City Council changed the Ordinance to make room for their business model. NOW LOOK WHAT THEY ARE WANTING.

Which got me to wondering about other Council members and what they thought. Of the five Council members that voted against the original ordinance in 2014, four remain on Council: Kubosh, Jack Christie, Jerry Davis, and Mike Laster. I went looking, via Google, Facebook, and Twitter, to see who else has had something to say.

And the answer is, most of them have not said anything as yet. One who has is Brenda Stardig, who is the Chair of the Public Safety committee:

CM Dave Martin was quoted in one of the stories I blogged about after Uber issued its ultimatum:

“If you don’t want to follow the rules we all agreed to, have a good opportunity in another city,” District E Councilman David Martin said. “But we cannot be blackmailed when it comes to public safety.”

And that’s pretty much it for actual opinions. The only other Council member to say something was Greg Travis:

Comments on that post ran more in Uber’s favor than against, for what it’s worth. Also for what it’s worth. all four of these Council members – Kubosh, Martin, Stardig, and Travis – are Republicans; so is Jack Christie among the No votes from 2014, while Davis and Laster are Dems. I mention that mostly to note that if Uber is trying to make a free-market/deregulation argument, it’s not working on the kind of people you’d think it might work on. This discussion is just getting started, and Lord knows Uber is willing and able to dump a ton of resources into winning it, so this is hardly a final whip count. But clearly, Uber has some ground to make up to win this one.

More on the Uber ultimatum

Ride-hailing giant Uber threatened Wednesday to stop operating in Houston unless city leaders amend local regulations the company said are making it tough for them to recruit drivers.

The ultimatum, the latest skirmish in what has been a contentious relationship between Uber and the city since it started operating here two years ago, drew a strong rebuke from city leaders.

“This is just not how we do business in Houston,” said Mayor Sylvester Turner, who added the city “will not compromise on public safety.”

The Uber announcement, which officials viewed as a threat to meet the company’s demands or lose the service, was met with frustration by city leaders, some of whom have grown increasingly exasperated by the tumult.

“If you don’t want to follow the rules we all agreed to, have a good opportunity in another city,” District E Councilman David Martin said. “But we cannot be blackmailed when it comes to public safety.”

Uber and its supporters argue that part-time driving for the company helps people make money while keeping rates for riders cheap.

The company in its report said drivers take an average of four months to sign up with Uber and complete the city permitting process. Houston officials said the longest a driver has waited is two months, and that the average time to clear the regulations is 11 days. About 47 percent of drivers received a license within a week, officials said.

“What they are putting out is factually incorrect,” Turner said, adding that he thought the company’s motive is to put pressure on politicians to capitulate.

I didn’t expect Uber’s announcement to be greeted warmly, but I am a bit surprised that no one stepped forward to defend them, or at least to criticize the fingerprint policy, in the story. CM Martin’s comment is of particular interest, since Uber’s main allies on Prop 1 in Austin are a couple of conservative Republican Council members there. I’ve look around at other coverage but have not seen any other reactions from Council members. I will be very interested to see who, if anyone, is in Uber’s corner on this. It was one thing to advocate for allowing Uber to operate here. This is a whole ‘nother level, and unless a Council member comes under pressure from constituents, it’s rather a large stretch.

The Press brings up another aspect of this fight.

Notwithstanding the curious timing (voters in Austin will decide May 7 whether to keep similar regulations; early voting for the ballot measure started this week), it’s hard to know what to make of Uber’s claims. Officials with the City of Houston insist that, by pretty much any trackable measure, Uber has been a resounding success here. The city’s Administration and Regulatory Affairs department says that every month it sees an increase in drivers who want a license to drive for the company. And, according to city officials, judging by the company’s revenue in Houston (under the regulations passed in 2014, Uber pays 2 percent of gross bookings to the city), Uber is doing quite well.

It seems there’s either fundamental difference of interpretation or someone’s not telling the whole truth. We’d love to get to the bottom of this, but here’s the problem: Uber has sued to block the city from releasing pretty much any internal data that could show whether Houston’s regulations have been a success or unreasonable burden for rideshares.

Lara Cottingham, deputy assistant director of the city’s Administration and Regulatory Affairs department, insists that Uber has had an undeniably good run here since the city began enforcing its rules for licensing drivers for so-called transportation network companies (or TNCs) like Uber, limo services and taxi companies. “The number of drivers is increasing, their revenue is increasing, everything seems to be working out for them very, very well,” Cottingham told us. “But because Uber sued us to stop us from releasing [those numbers], I can’t tell you how successful they are.”

While Uber claims it takes drivers on average four months to get a city license, Cottingham says that’s just not the case. She says that according to a survey the city conducted this spring (which, of course, she can’t release because of Uber’s lawsuit), nearly half of all drivers got their license within a week of applying – almost all (about 84 percent) had al license within three weeks of applying, she claims. Whatever the case, Uber’s Meridia said in the letter to city leaders yesterday that demand in Houston “continues to grow approximately twice as fast as our ability to onboard qualified drivers.”

Cottingham says the city has streamlined the process as much as possible, but what Uber’s really asking for – axing the city’s additional background check provision – isn’t an option.

KTRK also noted that some of the facts in dispute cannot be checked on either end. That makes this more of a PR battle than anything else. Do people, who clearly like using Uber’s service, side with them against the city and buy into the argument that needless regulation is making it impossible to operate? Or do they see the fingerprint requirement as a basic safety measure, which Uber should have no issue with complying? That seems to me to be the basic outline of the dispute, and it’s why I’m so interested in who Uber’s proxies will be in the fight. I’m sure Mayor Turner’s response to this has been along the lines of “I don’t need this $#!+ right now”. Who will be on his side? BOR has more.

Mayor Sylvester Turner, working to close a $160 million budget deficit, has proposed scrapping payments that scores of Houston neighborhoods served by private trash haulers receive to help offset the cost of their waste contracts.

The idea when the program started in the 1970s was that residents should not have to pay property taxes for city trash services they were not receiving – particularly because they were already paying for waste pickup in their homeowner association dues. The city also came out ahead because the $6 monthly per-house subsidy was cheaper than the cost of the city serving each home itself, now estimated at $18 per home per month.

In scraping together a balanced budget for the fiscal year that starts in July, however, Turner felt the program was expendable. In many cases, the subsidies go to residents who have chosen to pay for more extensive services than those the city provides, such as having the trash picked up more frequently than once a week, or having workers walk up a resident’s driveway to retrieve the trash rather than the homeowner rolling a bin to the curb.

Cutting these “sponsorship” payments to the 48,000 homes participating would save the city $3.5 million.

“When I drilled down in every department and every line item and I saw that line item sticking out, my question was, ‘Is this one that people can give up without hurting them and the core services, things that are essential to the city?'” Turner said. “I decided this was something the city at this particular point in time was not in a position to continue to sponsor.”

City Council will begin hearings on Turner’s proposed budget on Monday, leading up to a final vote that could come as early as May 25.

“If they end up saying it’s that big of a difference, that they will give up their contracts and will turn to the city, then yeah, OK, more than likely I’ll remove it,” Turner said. “I’m not trying to make their situation bad, I’m simply trying to balance a budget that’s $160 million short, and I’ve asked people to engage in shared sacrifice.”

The mayor also suggested, wearing a slight grin, that reporters examine the subdivisions now receiving trash subsidies.

The three City Council districts home to 83 percent of the city’s sponsorship agreements, records show, also are the three districts with the highest median household incomes in the city: District G on the west side, District E in Kingwood and Clear Lake, and District C, which covers much of the western half of the Inner Loop.

[CM Dave] Martin acknowledged that he and many of his neighbors receiving private trash service in District E can cover a $6-per-month increase in their civic association dues.

“If you’re used to getting your trash picked up twice a week and you’re used to backdoor service, most people are probably going to say, ‘Keep my six bucks,'” Martin said. “They’re mostly the people that have the means to pay an extra $6 a month.”

Yes indeed. And now is the time for the city to say to these folks that we can no longer afford to subsidize their premium trash collection service. We all have to make sacrifices in these lean times, don’t you know. The irony is that if enough people decide that the sacrifice they’d prefer to make is the higher level of service, in return for saving a few bucks a month, then it won’t be worth the city’s effort to make them make that sacrifice. I suspect that the vast majority of them will take the original deal, of keeping the service but paying full price for it. If nothing else, it will allow those who are so inclined to piss and moan about how hard they have it now. Surely that’s worth the six bucks a month to them. KUHF has more.

Does President Barack Obama regularly drop a line to Houston City Council members?

Probably not, but we could soon find out, thanks to a public records request that opponents of the city’s equal rights ordinance, known as HERO, filed this week. It’s a response to a public records request that a nonprofit filed earlier this month seeking correspondence between members that voted down the city’s equal rights ordinance and national anti-LGBT groups.

At the time, Councilman Michael Kubosh called a press conference to denounce the request, saying he was particularly upset that just the six council members that voted against the law, not the full council, were subject to the request. He called it “bullying.”

A week later, however, HERO opponents have taken the same approach. In a request filed Wednesday, conservative lawyer Jared Woodfill sought all communication between pro-HERO council members and a slew of local and national figures and groups, most pro-LGBT.

Fourth on the list, sandwiched between Mayor Annise Parker and the Human Rights Campaign, is Obama. Presidential hopefuls Hillary Clinton and Bernie Sanders along with mayor-elect Sylvester Turner are also included.

See here for the background. I’m sure CMs Kubosh and Martin will be holding a press conference to denounce this bit of bullying any minute now. Or maybe we’ve all managed to get a grip and recognize that this is just normal politics and nothing to get upset about. Regardless, I expect this request to have about the same effect as the other one, which is to say, not much. But at least everyone will have gotten it out of their system.

So what kind of City Council will Mayor-elect Sylvester Turner have to work with?

In addition to Turner replacing term-limited Mayor Annise Parker, the council also will gain five new faces, four thanks to term limits and one who defeated an incumbent. Political analysts, however, sensed little ideological shift among the 16-member body.

How city government will function or fail to do so, observers say, thus circles back to Turner. With a looming $126 million budget deficit to close by June, the 26-year Texas House veteran will be tested quickly.

“Having a career legislator lead the council is likely to have a significant change in how the city operates,” said Mustafa Tameez, a Houston political consultant. “He’s likely to lean on his experience and run the council as a legislative chamber versus, in the past, other mayors saw it as an executive office and the council may have been a nuisance.”

If the political tilt of the council shifted with Saturday’s results, analysts said, it may have been slightly to the right. Conservative former policeman Mike Knox will replace moderate Steve Costello in the At-Large 1 seat; physician Steve Le, who opposed the city’s nondiscrimination ordinance, ousted District F incumbent Richard Nguyen, who voted for it. As a counterbalance, the analysts said, municipal finance lawyer Amanda Edwards’ replacement of C.O. Bradford in the At-Large 4 race is a shift to the left.

In conservative District G, where lawyer Greg Travis replaces Oliver Pennington, and in progressive-leaning District H, where educator Karla Cisneros replaces Ed Gonzalez, observers saw little ideological change.

Observers guessed the general split to be roughly 10 to 11 progressive votes and six to seven conservative ones, depending on the issue, though council members are known to invoke the adage that there is no Republican or Democratic way to fill a pothole.

The new council will have four years to work out the kinks, thanks to voters, who approved a move from a maximum of three two-year terms of office to two four-year terms on Nov. 3.

That change, coupled with the loss of rules banning campaign fundraising during certain months – known as a blackout period – will bring the biggest changes to City Hall, Tameez said.

Let me start by saying I completely agree with Tameez here. I believe the change to four-year terms is going to have a big effect on how our municipal government operates and how our elections are conducted. I have no idea what those changes will look like, and neither does anyone else. It’s just going to be different, and we won’t begin to understand how until four years from now.

As for the makeup of Council, again I basically agree with what’s being said here. Mike Knox is to the right of Steve Costello, but I’d argue Amanda Edwards is to the left of C.O. Bradford. Losing Richard Nguyen hurts, but District F has always operated as a Republican-friendly district. Nguyen only declared himself to be a Democrat in 2014 – he was a political enigma when he was elected. It’s a loss, but we were playing with house money.

And to a large extent, none of that matters very much anyway. The Mayor still sets the agenda, and as long as the Mayor can get nine votes for whatever is on that agenda, it gets enacted. It will be interesting to see if Turner, a master of dealmaking and getting things done in a hostile environment, adopts a collaborative Lege-like approach to Mayoring (*), as that would be a great departure from every other Mayor in my memory, or if he exercises the power of the office like all his predecessors have done. Usually there’s at least one Council member who acts as a foil to the Mayor; of the holdover Members, Michael Kubosh and Dave Martin were the main antagonists to Mayor Parker. Will one or both of them maintain that role with Mayor Turner, or will someone else pick up the baton? The next budget gets adopted in June, so we ought to have some idea soon enough. Feel free to speculate on these topics in the comments.

Council members complain about open records requests

Councilmen Michael Kubosh and Dave Martin on Tuesday blasted a records request from a D.C.-based nonprofit to those council members who voted against the Houston equal rights ordinance, known as HERO, last year.

The Campaign for Accountability’s request seeks communication between prominent local anti-HERO activists as well as anti-LGBT groups, such as the Alliance Defending Freedom and the Family Research Council, and the six council members who voted against the law. Kubosh and Martin were joined by Councilwoman Brenda Stardig and councilmen Jack Christie, Dwight Boykins and Oliver Pennington in opposing the law in May 2014.

At a press conference outside City Hall on Tuesday, Kubosh said council members were being “harassed and intimated” by the request. He called on the mayor to condemn the request, and said the six council members were unfairly targeted.

“I felt like when we received this open records request for over tens of thousands of emails and 51 names of individuals and organizations that we’re going to have to search through, this is a type of bullying,” Kubosh said.

The Campaign for Accountability, a watchdog group that files records requests all over the country, responded in a written statement that the move was not meant to intimidate council members. The group called Kubosh’s charge an “outlandish allegation that seems contrived more to attract press attention than to express a serious concern.”

In an interview, deputy director Daniel Stevens also denied Kubosh’s allegation that Mayor Annise Parker, a proponent of the law, was behind the request. Kubosh called it a “lump of coal” from the mayor.

Mayoral spokeswoman Janice Evans responded to Kubosh’s comments in a written statement, saying his charge that the mayor is connected to the request is “totally unsubstantiated.”

“There are hundreds of people who have made political contributions to the mayor during her 18 years in office. Receiving open records requests is very common. We tend to get one or more a day here in the mayor’s office and they often come from people who disagree with something the mayor has done or a position she has taken on an issue. They can be overwhelming and time consuming to process but it is part of being an elected officeholder. If this is the first time the council member has received one, he should count himself lucky.”

Indeed. Of course some of these requests are going to be annoying, politically motivated, and/or time-consuming. That’s part of the job. You want to complain about people who don’t like you demanding to poke through your emails, go have a drink at the bar with Hillary Clinton. I’m sure she’d have a sympathetic ear to lend. Beyond that, I say suck it up.

If you think I’m being a bit harsh here, I admit that I am. But ask yourself a simple question: What would the reaction have been like from the folks at this little event if it had been Mayor Parker calling a press conference to decry the “bullying” open records requests of a political opponent? My guess is that sympathy would not have been the first order of the day. Sometimes the best course of action is to just get over yourself and show these people that you have nothing to hide and they’re the ones who are wasting their time. Assuming that’s how you feel about it, of course.

One more thing:

Sen. Paul Bettencourt, R-Houston, also attended the event in support of Kubosh and Martin. Bettencourt is already planning to convene the Senate Intergovernmental Relations committee to look into why the city has been rebuffed by the Texas Supreme Court on ballot language issues, including one pertaining to HERO. He added Tuesday that he would seek to discuss a law that would “limit out-of-state access to this type of punitive open records request.”

Seriously? I’m going to outsource my reply to one of the commenters on the Chron story, who is not at all aligned with me politically:

Note to “Uncle Paul” — all your anti-transparency bill would do was (sic) lead the out of state organizations to get a member or supporter from Texas to file the request. It is done more frequently than you think, anyway.

So unless you’re proposing to do away with open records requests altogether, such legislation would do exactly nothing. But thanks for playing. The Press has more.

Many City Council members who attended a special meeting Friday to discuss Mayor Annise Parker’s controversial deal with the city’s firefighters pension called the gathering a success, despite two members walking out and breaking a quorum before a vote could be held to support or oppose the agreement.

The meeting’s unusual ending matched the unusual situation. Typically, the mayor alone calls City Council meetings and decides what items will appear on the agenda for a vote, a power that council members can subvert only by teaming up in a group of at least three to force a special meeting.

Council members C.O. Bradford, Michael Kubosh, Brenda Stardig and Dave Martin did that last Monday, saying the council had been excluded as Parker negotiated the three-year agreement to lower the city’s costs and that the deal must be vetted publicly.

The unrealized vote would not have been binding because the council has no legal authority over the agreement, but organizers hoped the resolution would raise public awareness of the city’s pension situation and send a signal to the Legislature, which controls Houston’s three pension funds. State Sen. John Whitmire and mayoral candidate and state Rep. Sylvester Turner, both Houston Democrats, have agreed to carry the legislation in Austin.

“A vote would have sent a signal to the state Legislature, so I’m disappointed that we didn’t get the opportunity to express our opinion to the state,” said Martin, who opposes the deal, “but I thought the discussion was good, so I leave here pleased.”

Parker spokeswoman Janice Evans said the administration is moving forward on getting the deal passed in Austin, and stressed that the mayor has never claimed the agreement represents true pension reform.

“The meeting turned out as we thought it would … a lot of talking, but no new solutions offered and no new information presented,” Evans said.

See here for the background. The Wednesday Council meeting at which Mayor Parker presented the plan to Council could be characterized similarly. Of interest is that not only will there be a bill to enact the negotiated deal, but also one to give the city the kind of control over the pension fund that Mayor Parker had been pushing for before. From the press release that CM Costello sent out on Friday evening:

City of Houston At-Large Council Member Steve Costello was extremely instrumental in crafting House Bill 2608 which was filed today by State Representative Jim Murphy of Houston. Local control of pensions is key to the citizens of Houston. H.B. 2608 will allow the mayor and city council to directly negotiate with its pension plans to create the most beneficial structure for both taxpayers and retirees.

Council Member Costello has also written and distributed a letter to the local Houston delegation encouraging them to support the bill, local control and vote against the Parker/Turner plan.

“There’s no way for the city to pay our pension benefits as currently structured without severely limiting the city’s ability to provide basic city services to its citizens. Without showing real leadership and tackling the pension benefits themselves, the amount the city owes does not change,” Costello said.

“This bill will provide for a more sustainable and responsible pension program that is good for our city, our brave firefighters and Houston taxpayers. Fortunately, Representative Jim Murphy has filed H. B. 2608, and I am pleased to have played a key role in crafting a bill that actually moves us toward a solution,” according to Costello.

Costello continued, “I’m going to continue to fight hard for local control. The City must be able to fulfill our promise to our public safety and municipal employees in a way that is also fair to Houston taxpayers.”

There was no mention of a bill like this at the beginning of the session, when everyone seemed to want the city and the firefighters to work this out among themselves. It’s interesting to hear people like Sen. Paul Bettencourt, who was at the meeting and who expressed his support of Rep. Murphy’s bill, talk favorably of local control when he’s busy helping Greg Abbott eviscerate it elsewhere. Be that as it may, I guess this answers my question about what Costello thinks he can do differently than Mayor Parker – if he’s able to help get HB2608 to Abbott’s desk, it would be quite an accomplishment. The politics of this are going to be fascinating to watch, that’s for sure. I just hope that the Mayoral candidates that lobby for one bill or the other in Austin get equally and visibly involved in beating back the many bad bills out there.

Council meeting called to discuss firefighter pension deal

Four City Council members have taken advantage of a rarely used provision in city law to call a special meeting Friday to discuss Mayor Annise Parker’s controversial deal with the city’s firefighter pension board that was announced last week.

Typically, the mayor alone controls what items appear on the council agenda to be voted on, a power that can be subverted only when a trio of council members teams up to call a meeting.

Council members C.O. Bradford, Michael Kubosh, Brenda Stardig and Dave Martin did so Monday morning, with one more signer than was required. City officials said this appears to be the first time the legal maneuver has been used in Parker’s more than five-year tenure.

It’s not clear whether enough of the foursome’s colleagues will attend to muster a quorum, but the symbolism of the meeting is more significant than any action that could be taken, given that the group will simply consider registering support for or opposition to the pension deal.

Regardless, Parker’s liaison to council, William-Paul Thomas, said he will work against a quorum. Parker had said she would not put the deal to a council vote because it does not call for the expenditure of city funds.

The three-year agreement would see the city pay a projected $77 million less into the pension fund and see firefighters contribute an estimated $20 million more. Supporters call it a compromise that will free up city funds during a budget crunch, while critics call it a risky missed opportunity that will see $57 million less paid into the system without any changes to the cost of benefits.

Bradford said the aim of Friday’s meeting is for council to discuss the pension deal openly and to send a signal to Austin on the council’s view of the agreement. Firefighters’ pension benefits and the city’s contributions to the fund are controlled by the Legislature, and the mayor’s deal would need to pass in Austin to take effect.

Firefighters union president Alvin White – whose organization is a separate entity from the fire pension board – early Monday raised his own concerns, saying the union “is the only legally recognized entity authorized to negotiate Houston firefighters’ workplace rights, wages and benefits.” White said he was entering into talks with fire pension chairman Todd Clark to “protect our members’ rights” in the deal, which requires firefighters to contribute 12 percent of their pay toward their pensions, up from 9 percent today.

Those talks yielded progress Monday night, however, with White saying the resolution would allow the union the flexibility it needs to negotiate future contracts. Clark did not return a call for comment Monday; a pension spokeswoman said he was busy working to get the bill filed at the Legislature.

See here for the background. At least this gives me some idea what the fuss is about, since the net effect is that the fund will receive $57 million less in payments over the next three years. The fund is in good enough shape that these underpayments probably won’t cause any issues, but for obvious reasons this is not a sustainable approach. I don’t know what these members have in mind to discuss or what if anything they might be able to accomplish, but I see no reason not to let them have their meeting. Maybe they’ll come up with some good questions to ask, or maybe they’ll agree with the Mayor’s judgment. Let them meet and make up their own minds. Campos has more.
