July 2018 finance reports: City of Houston

Every level of government requires finance reports in January and June, whether or not there is an active election cycle in that year. That includes the city of Houston, whose january report data we inspected here. Our next election is in 2019, and while this is still traditionally a little early for there to be much activity, there are the finance reports. Here’s what we’ve got:

As you may recall, there wasn’t much in the way of fundraising for anyone except Mayor Turner last time. I don’t know if it’s due to the time of year, the approach of the next election, or the overall political climate, but as you can see nearly all of our elected officials have been busy. The report for Martha Castex-Tatum, who was elected in May to succeed the late Larry Green, is in a shorter period than everyone else since she had to post 30-day and 8-day reports for her cycle; the others are all for the full January through June time frame.

Looking at these numbers, only Jack Christie has acted like the term-limited Member that he is. Brenda Stardig, Jerry Davis, Ellen Cohen, and Mike Laster have been more or less business as usual. I’ve speculated before about the possible future ambitions they may have, and I don’t have anything to add to that. I’m sure there’s a reason why the three non-Cohen members have been stockpiling the loot like this, but until they do something tangible it’s hard to say what that might be.

Which doesn’t mean we can’t speculate at all. I look at what Dwight Boykins and David Robinson are doing and I wonder a little. Both are on the ballot next year for their final terms (as always, modulo future rulings in the interminable term limits litigation), and while Robinson had to fend off four challengers and win in a runoff in 2015, Boykins cruised home unopposed. It could be that Robinson is merely gearing up for the next battle while Boykins is doing his best to keep potential opponents at bay. It could also be that they’re looking beyond their next term to a time when both the Mayor’s office and the Controller’s office will be open seats. I have no idea and no evidence – like I said, I’m just speculating. Dave Martin is also in that “one more term and has a lot of cash” group, but we don’t tend to elect Mayors who fit Martin’s political profile, though perhaps Controller might appeal to him.

Be all that as it may, this is the first time since we switched to four-year terms and no blackout period for fundraising that we’ve seen incumbents establish a clear financial advantage for themselves. No one on the outside has yet taken a concrete step (like designating a campaign treasurer and raising their own money) towards running for a Council seat, but do keep in mind there are several now-former candidates for Congress in town who likely have some cash remaining in their coffers (sorry, I’m only checking on still-active candidates). Surely it would not be a surprise if one or more of them decided to act more locally next year. Given that possibility, it’s hard to blame any of the members who are up for re-election next year to take precautions.

The remaining reports I included because they’re there. As we learned after the death of El Franco Lee, the remaining funds in Larry Green’s campaign account are to be distributed by his campaign treasurer, whose name is Kevin Riles. As we see from Lee’s July report, there’s no particular rush to do whatever that turns out to be. I don’t remember what Citizens to Keep Houston Strong was about, but Bill White is their treasurer. I’m sure we’ll see plenty more PACs and PAC activity as we move towards referenda for firefighters’ pay parity and the revenue cap.

Council approves Mayor’s budget

The annual ritual is observed.

Houston City Council adopted Mayor Sylvester Turner’s $4.9 billion budget by a vote of 13-4 Wednesday, ending three hours of otherwise amiable debate with an impassioned speech from Councilman Jack Christie that concluded with the councilman resigning his post as budget committee chair and voting no.

Christie was joined in opposing the budget by council members Mike Knox, Greg Travis and Michael Kubosh, who said they wanted the mayor to make more of an effort to cut spending.

“I can keep playing politics, go along to get along, or start fighting vigorously for our tax-paying citizens and not waste their money,” Christie said, listing his past ideas for constraining costs or forming commissions to study cost-cutting that were not implemented. “As a political body, we are failing the people of Houston.”

Turner rejected the criticism. He said the budget is “sound,” and noted that Kubosh’s lone amendment would have given each council member an additional $100,000 for staff salaries. Knox submitted no amendments, and Travis submitted amendments that sought cost-cutting recommendations from the administration but listed no specific cuts.

Christie also submitted no cost-reduction amendments, and, in fact, twice admitted one of his items — earmarking $150,000 to fund an external study on the emissions of the city’s vehicle fleet — was “a waste of money” because he already knows a shift to alternative fuels is the right move.

“It’s so easy to just say to the administration, ‘Mayor, you didn’t cut enough,’” Turner said after the meeting. “Every individual that voted ‘no’ put forth no ideas, no amendment to reduce the cost. Not one. Not that they offered it and we voted them down — they didn’t offer any. To the contrary, they put forth amendments that would increase the amount that we were going to have to expend.”

The general fund budget for the fiscal year that starts July 1 is $2.5 billion. That fund is supported primarily by property and sales taxes and funds most core services, such as the police and fire departments, parks, libraries and trash pickup.

That is $83 million, or 3.5 percent, more than the current budget. The increase largely is driven by a $42 million increase in debt service, related mostly to the issuance last year of $1 billion in pension obligation bonds as part of the mayor’s pension reform package.

Also driving the increase is $14 million in previously-agreed-to raises for police that take effect July 1. About 57 percent of the general fund, or $1.4 billion, goes to public safety — the police and fire departments, the municipal courts and emergency operations.

The story also notes the $17 million the city may wind up being short thanks to an unfriendly Census estimate and the stupid revenue cap; it’s not clear to me if that would apply to this year or next if the city’s appeal fails. I’m not surprised there were no cost-cutting amendments of any substance. Turns out that’s a hard thing to do, especially in a budget that’s mostly about public safety, trash pickup, parks, and libraries. You know, basic things that people want and need. Good thing talking about it remains free.

January 2018 finance reports: City of Houston

We didn’t have any city of Houston elections in 2017, and while we ought to have some charter amendments on the ballot in 2018 we won’t be voting for people till next year. Still, everyone has to file campaign finance reports. Let’s see how everyone has been doing since last July.

I started writing this post before the tragic death of CM Larry Green. CM Green was among the members who are term-limited; the others are Stardig, Davis, Cohen, Laster, and Christie. I did not find a finance report for Karla Cisneros; she had $25,336 on hand in the July ’17 report. No one raised a whole lot – not a big surprise, especially given how there was already a bunch of Congressional fundraising going on in the latter half of 2017 – and in fact many people spent more than they took in. If one of the potential negatives to the change to four-year terms was that it gave incumbents that much more time to accumulate cash, I’d say that effect has so far been muted. Among the first-termers, Amanda Edwards was a big money-raiser in 2015 and Greg Travis still has loan money. Mike Knox got a boost in this period, which he will need because he’s got a big target on his back for 2019. Steve Le doesn’t have much on hand, but he too can self-fund to an extent.

While those term-limited candidates continue to be among the top cash-holders, none of them increased their shares during this period. I continue to believe that at least some of them have another candidacy in their near-term future, but that’s just my impression. Some of the possibilities they may contemplate will depend on how the 2018 elections go. Let’s not get ahead of ourselves, though. I’m just reporting what we know now. I’ll check back in July. Look for a post on the HISD and HCC reports as soon as I can get around to it.

Looking ahead to 2019

Yes, yes, I know. We’ve barely begun the 2018 cycle. Who in their right mind is thinking about 2019? I plead guilty to political insanity, but the beginning of the year is always the best time to look forward, and just as 2018 will be unlike any election year we’ve seen before, I think 2019 will be unusual, too. Let’s just take a moment to contemplate what lies ahead.

I’ve posted this list before, but just to review here are the Council members who are term-limited going into 2019:

There is an opportunity for progressives to elect a candidate more favorable to them with CM Christie’s departure, and his At Large colleagues Mike Knox and Michael Kubosh will also draw attention. Against that, I would remind everyone that Bill King carried Districts C and J in 2015, so we’re going to have to play defense, too.

It is too early to start speculating about who might run where, but keep two things in mind. One is that there’s likely some pent-up demand for city offices, since there won’t have been an election since 2015, and two is that some number of people who are currently running for something in 2018 will find themselves on the sidelines by March or May, and some of them may decide to shift their focus to a more local race. The point I’m making here is expect there to be a lot of candidates, and not just for the term-limited offices. I don’t expect Mayor Turner to be seriously challenged, but I do expect the firefighters to find someone to support against him. Finally, I expect Pasadena to be a hotbed of action again for their May elections, as Democrats missed by seven votes in District B winning a majority on Pasadena City Council.

The following HISD Trustees are up for election in 2019:

Jolanda Jones – District IV
Diana Davila – District VIII

Skillern-Jones was forced into a runoff in 2015, but she then won that easily. Lira was elected this year to finish Manuel Rodriguez’s term. Jolanda is Jolanda, and no election that includes her will ever be boring. Davila sued to get on the Democratic primary ballot for Justice of the Peace, but was not successful. I have to assume whoever runs against her will make an issue of the fact that she was job-hopping in the interim.

The following HCC Trustees are up for election in 2019:

Zeph Capo – District 1
Dave Wilson – District 2
Neeta Sane – District 7

It is too early to think about who might be running for what in Houston and HISD. It is very much NOT too early to find and begin building support for a good candidate to run against Dave Wilson and kick his homophobic ass out of office. That is all.

Mayor Turner lowers tax rate hike amount

I’m sure we’re all glad to see this.

Mayor Sylvester Turner on Wednesday said the temporary property tax rate hike he has proposed would be cut in half after federal officials approved his request to increase reimbursement for the city’s Hurricane Harvey recovery efforts.

Turner earlier this month had pitched an 8.9 percent increase for one year, but said it would not be enough to cover all of the city’s cost of recovering from the unprecedented storm and flooding. It would be the first rate hike in two decades.

On Wednesday, he said that increase could be halved – to an extra $50 next yearfor the owner of a $225,000 home with a standard homestead exemption – thanks to a White House decision to boost reimbursement of many of the city’s recovery costs from 75 to 90 percent.

“We’re going to do everything we can to hold our line. We’re trying to minimize our request,” Turner said. “I understand what people’s concerns are with what they’re going through in their homes, and we don’t want to add to the burden.”

No tax hike would be necessary, Turner said, if state leaders agree to tap their roughly $10 billion rainy day fund. That suggestion drew support from council members.

“We need it now. It’s raining,” said Councilman Jack Christie, who has spoken against a tax rate hike. “We’re behind you to do that to where we don’t have to raise taxes.”

Several times in recent days, Gov. Greg Abbott has said he expects funds will be tapped to pay for Harvey costs, but said damage estimates must be completed before dollars are withdrawn. The latest tally Wednesday projected $574 million in damage to public infrastructure, including $177 million in Harris County.

“I think most people understand that Texas will be tapping into the rainy day fund,” he said in San Antonio last week. “The important thing, though, is that we address the economic issues appropriately. We need to first understand what obligations we’re going to have, how much they will amount to, and decide upon the best strategies to pay for that.”

See here and here for the background. You know what could eliminate the need for any tax hike whatsoever? If the state of Texas, which has some $10 billion sitting around doing nothing, were to cover the remaining costs that insurance and the feds won’t. I wonder if anyone has briefed Paul Bettencourt about this possibility, since he seems to be so entirely bereft of constructive ideas. To be sure, even Dan Patrick has been talking about using the Rainy Day Fund to help Houston and everywhere else recover from Harvey. That’s both good and necessary. But the city of Houston has to pay for things now, and it has to make sure it has the financial wherewithal to pay for those things now since it is not allowed to carry expenses over from one accounting year to another (this is another way of saying the city must “balance” its budget), so unless there’s a firm commitment in place from the state that the city can rely on, it’s got to make its own plans to pay for any uncovered expenses. If Paul Bettencourt and the usual suspects on City Council don’t like that, they are welcome to direct their concerns to Greg Abbott and Dan Patrick. The Press has more.

When might the Supreme Court speak on the Houston term limits lawsuit?

So as you know there is an ongoing lawsuit over the language used in the 2015 referendum that altered the city’s term limits ordinance. It was filed shortly after the election, with the city winning the first round in district court. Appeals are ongoing, with the most recent ruling coming this past January on a procedural matter. In addition to all this, the plaintiff in the original suit filed a writ of mandamus with the Supreme Court on June 2 that asks them to direct the district court judge to vacate his previous order allowing the 2015 result to stand and to require city elections this November. I’m on the plaintiff’s attorney’s email list (for my sins, no doubt) and as he sent out a missive last week urging his followers to contact the Supreme Court and ask them to rule on the writ in time for an election to occur, I figured I ought to bring this up.

So as we are now halfway through June, I have to think that time is rapidly running out for a non-farcical election to be conducted this November. Normally at this time, multiple candidates for a variety of offices, especially the open ones, will have been at work for months. There are always people who pop up to run in July and August, including a few at the filing deadline, but by this point you usually have a pretty good idea of who is out there. Funds have been raised, materials have been printed, websites and social media presences have been built, volunteers have been recruited, etc etc etc. Campaigns require resources, and one of those resources is time. We’re basically four months out from the start of early voting. To get a campaign up and running from scratch, especially for an At Large position, that’s not a whole lot of time. It could be done, but it would greatly favor those who already have some of the other resources, namely money and some amount of name recognition. In other words, incumbents and people who can write a check to get their campaign going quickly.

For what it’s worth, the Supreme Court issued a ruling requiring a vote on HERO on July 24, 2015, which was in response to a writ of mandamus. That was about a referendum and thus didn’t directly involve any candidates, though I’d argue that it had a negative effect on the pro-HERO side, since the antis had been gearing up for a campaign for some time by then. Let’s call that the outer bounds of when a writ mandating city elections for this year may happen, though really I’d say that’s too late. Bear in mind that Council members Brenda Stardig, Jerry Davis, Ellen Cohen, Mike Laster, Larry Green, and Jack Christie are all in their last terms one way or the other, so if those terms wind up ending this year instead of 2019, a whole gaggle of hopefuls are going to have to get up to speed immediately. There’s no question that the Supreme Court has no qualms about meddling in the affairs of the city of Houston, but that doesn’t mean it feels compelled to do so. We ought to know soon enough.

Houston will get involved in the SB4 fight later this month

Very good to hear.

Mayor Sylvester Turner plans to ask City Council to vote this month on joining lawsuits challenging the constitutionality of Texas’ new “sanctuary cities” law, ending months of equivocation on the controversial immigration enforcement measure.

If City Council votes to sue, Houston would join San Antonio, Austin, Dallas and several other local governments already challenging the state or planning to do so.

“I will ask this month City Council to consider and vote to join the lawsuits challenging the constitutionality of SB4,” Turner tweeted Thursday morning, after the Houston Chronicle ran a front page story about his decision to remain on the sidelines of debate over the statute.

Turner has asked the city attorney’s office to review the law known as Senate Bill 4, which allows police to ask people their immigration status if detained even for a routine traffic stop, but otherwise continues to deflect questions about whether he plans to challenge it.

That has meant carefully sidestepping the term “sanctuary city,” while touting Houston as a diverse, “welcoming city” and assuring residents that Houston police will not violate their constitutional rights.

On Wednesday, the mayor attempted to redirect attention to Austin by urging Houstonians to take up their concerns at the Capitol, even though the law has been signed and the Legislature is not slated to revisit the issue during its July special session.

“The right forum to reconsider Senate Bill 4 before it goes into effect on Sept. 1 is Austin, Texas, and I’d encourage people to write to call to drive or go to Austin,” Turner said. “Go to Austin by the hundreds, by the thousands, and ask those who authored, voted for and signed Senate Bill 4 to repeal Senate Bill 4. Those of us around this table, we cannot repeal Senate Bill 4, as we did not author Senate Bill 4.”

So Houston may follow in the footsteps of San Antonio and Bexar County and Dallas, if Council goes along. According to the full Chron story, it looks like that will happen.

Houston could sue over SB4 without City Council approval, but Turner nonetheless promised a vote. City Council is in recess next week, meaning a vote would come June 21 at the earliest.

As of Thursday, the left-leaning City Council appeared to be breaking along party lines, with Democratic members largely favoring a lawsuit and Republican members generally opposed.

District I Councilman Robert Gallegos, who supports a lawsuit, said he worried the law could tear families apart if it causes more parents to be deported, calling it “an open door for racial profiling.”

District C Councilwoman Ellen Cohen also plans to vote to sue, citing concerns that the law could discourage victims from reporting crimes, echoing law enforcement leaders across the state, including Houston Police Chief Art Acevedo.

“We now have a percentage of the population that, out of fear for their own lives and deportation, won’t report, and it jeopardizes women’s lives and others,” Cohen said.

At-large Councilman Michael Kubosh said he opposes a lawsuit because of the potential cost.

“I don’t want to spend the money on a lawsuit that’s already been well-funded by other cities,” Kubosh said. “It won’t have an effect on the outcome of the case.”

He and others also worried that suing the state could put Houston at risk for losing federal funding.

Two council members, Mike Laster and Brenda Stardig, declined to say how they would vote, and at-large Councilman Jack Christie said he was likely to abstain.

“I’m not in favor of suing people to just show where we stand,” Christie said. “We show where we stand by example.”

There’s a sidebar on the story with a vote count for when this does come before Council (and while it could come as early as June 21, you can bet your bottom dollar someone will tag it for a week). Counting Mayor Turner, there are eight Yeses, five Nos, Christie’s abstention, and three who declined to comment or could not be reached. Of those three, I’d expect two Yeses – Mike Laster, who has since suggested on Twitter that he would likely vote in favor, and Jerry Davis – and one No, Brenda Stardig. You should probably reach out to your Council member and let them know how you feel about this. In the meantime, I agree with Campos, this would not have happened, at least at this time, had not there been pressure from the Texas Organizing Project and the DREAMers. Activism works, y’all. A look ahead to Houston’s 2017 elections

I want to return to something in that story about Mayor Turner’s 2017 agenda, which was near the bottom but which is a very big deal for the coming year:

A lawsuit over the ballot language used last year to extend terms to a maximum of two four-year terms, from three two-year terms, hovers in the background.

A state district judge ruled in March that the language was “inartful” but legal, and the case now is under appeal.

At stake in the near term is whether Turner and members of City Council must run for re-election in 2017 or wait until 2019.

See here for the background. Usually around this time I’m writing about the upcoming election year and what we have to look forward to. Thanks to this lawsuit, we could have a year with no city elections, or a year in which nobody knows we have city elections until April or May and everyone operates on an insanely accelerated schedule from there. With that in mind, let’s look at our Year of Elections 2017 with a frame of The Elections We Will Have, The Elections We May Have, and The Elections We Could Have.

The Elections We Will Have

Whatever else happens with the term limits lawsuit, there will be elections in HISD and HCC. The following trustees for each board are up for election this year:

HISD – Anna Eastman (District I), Mike Lunceford (District V), Greg Meyers (District VI), Anne Sung (District VII), Wanda Adams (District IX)
HCC – Carolyn Evans-Shabazz (District 4), Robert Glaser (District 5), Chris Oliver (District 9)

Mike Lunceford is not running for re-election, so his seat will be open. Greg Meyers has already submitted his resignation, and a replacement Trustee will be selected by the Board in January. It is not clear if the Board will prefer a caretaker who will not run for election in November or if the new member will try to stake a claim. Anne Sung of course won the special election to succeed Harvin Moore a couple of weeks ago. Whatever happens in November, the Board will have three different members in the traditionally Republican districts than it had at the start of 2016. That has some negative potential, as all three were devoted to public schools in a way that is not necessarily characteristic of modern Republicans, meaning that whoever wins in November could be more antagonistic than what we are used to seeing. We’ll have a better idea when we know who is selected to replace Meyers, and who emerges to run for these seats. As for Eastman, she is my Trustee and as far as I know she is in for another term, but I haven’t spoken to her in the last few weeks, and she has not made any formal announcements. I’m not aware of any reason why Adams would not run for another term.

In HCC, both Shabazz-Evans and Glaser won elections to complete the unexpired terms for trustees who had resigned following their 2011 campaigns. Evans-Shabazz was appointed to replace Carroll Robinson in District 4 in May of 2015, and then was unopposed for election. Glaser won a contested race to succeed Richard Schechter in 2013; appointed replacement Leila Feldman did not run for the seat. Oliver is a multi-term incumbent who easily defeated a challenger in 2011. Sometimes there are interesting things to say or look forward to in these races. This is not one of those times.

There will also be some number of constitutional amendments on the ballot in November, but we won’t know what they are until May or so when the Legislature finishes its business. If the term limits lawsuit goes down, preserving the new four-year terms for city officeholders, these referenda will be the only guaranteed items on your ballot this year.

The most interesting race in the area that is not in Houston will be in Pasadena, where Mayor Johnny Isbell is term-limited out and where the City Council lines may or may not be redrawn, pending the ruling in the voting rights lawsuit that is currently in the judge’s hands. That election will be in May. Other area cities such as Bellaire, West U, Sugar Land, and Rosenberg, also have elections in May. I hope to have some more information about some of these races in a subsequent post. Also of interest in May will be the San Antonio elections, where Mayor Ivy Taylor has some competition for a second full term. I’m sure I’ll do some writing about that as well.

The Elections We May Have

In addition to the statewide ballot propositions, there are two local ones that could be on your November eSlate machine, both of which could be quite contentious. Mayor Turner has stated his intention to put a referendum about the revenue cap on the ballot this year, though one presumes that could change if his pension reform bills do not pass. You can be sure that the opposition to this, mostly from the likes of Paul Bettencourt and no doubt with the help of the statewide Republican cabal, will be ferocious and very well-funded. Which in a way will be good for Mayor Turner, because if he can successfully cast this as a partisan issue, especially a “statewide Republicans meddling in our business AGAIN” issue, he ought to at least begin with the larger share of the vote. Getting those people to vote, whether or not there are other city elections to draw them out, will be the challenge. I suspect Mayor Turner doesn’t do anything without planning out how it will go, so I sure hope he has a plan for this one.

The other possible ballot item we might have is an updated Metro Solutions plan, which may include more rail construction projects, possibly including another shot at the Universities Line. This has been floated as an option by Metro Chair Carrin Patman, but it is not yet clear that it would be on the ballot, and if it would be there this year if so, and it is not yet clear what the scope of it would be. Needless to say, any rail component would generate some opposition, with a new Universities Line plan bringing out the usual suspects, some of whom would already be fully engaged in a revenue cap fight. It’s an interesting question whether you’d rather have this item on the ballot by itself, or in the same space as a revenue cap item. I’m glad that’s not my call to make.

The Elections We Could Have

This is the one that is entirely contingent on the Supreme Court, which as we know has not hesitated to stick its collective nose in our electoral business. If the 2015 term limits referendum is thrown out for having insufficiently clear wording, then the people who will be the most affected are the Council members who are in their last terms: Brenda Stardig, Jerry Davis, Ellen Cohen, Mike Laster, Larry Green, and Jack Christie. Cohen’s District C and Laster’s District J represent challenges for Democrats, as Bill King carried both districts in the 2015 Mayoral runoff. The ideal District C candidate is in the Anne Clutterbuck-Ellen Cohen spectrum, while the low turnout District J will always be a bit of a wild card. Against that, Dems will have opportunities in both Christie’s At Large #5 and first-term CM Mike Knox’s AL #1, though as we have discussed before, cattle call races with lots of similarly-profiled Democrats have benefited Republican citywide candidates in the recent past. The ideal here is for a candidate who begins with a lot of backing to get in and largely hoover up all the support – think Melissa Noriega in 2007, or Amanda Edwards in 2015.

I don’t want to spend too much time on this, as it’s even more speculative than usual, but I do want to at least put a marker on it, since if these elections do happen they may happen all at once, with little warning and not much time to prepare. I’ll be keeping an eye on this, and will be ready for either a busier or more relaxed interview season this fall.

Council approves proposed finance law changes

That was easy.

City Council approved changes to Houston’s campaign finance law Wednesday with no discussion, effectively doubling contribution limits per general election cycle and boosting the amount many candidates can reimburse themselves for personal loans.

The revisions, which go into effect Friday, are meant to clarify rules left unclear after the court struck down the city’s fundraising blackout last year and voters extended terms to four years from two years.

Rather than collecting a maximum of $5,000 from individuals and $10,000 from political action committees per two-year election cycle, candidates will be allowed to raise that much during the first two years of their term, and then do so again during the second two years. The contribution cycle would reset if the candidate were forced into a runoff.

The new rules also permit council and controller candidates to repay themselves tens of thousands of dollars more for personal loans they make to their campaigns.

Mayor Sylvester Turner reiterated during a news conference Wednesday that the changes are intended to reconcile the old two-year fundraising cycle with the current four-year cycle, though some viewed the modifications as a boon to incumbents and wealthy candidates.

“That was just an attempt to try to just mirror what has been the case and simply just adapt it to a four-year term,” Turner said.

See here for the background. This must not have been too controversial, because no one even tagged it. CMs Christie and Edwards were the only No votes. The Chron editorial board does not approve.

Contribution limits are supposed to serve as a check on corruption, but good government advocates aren’t the only people who support them. One of the odd little secrets of politics is that a lot of campaign donors actually like these rules. The disgraceful truth is that writing fundraising checks to elected officials is widely considered an unavoidable cost of doing business with government, so quite a few lobbyists will privately tell you they wish contribution limits were even lower.

Last year, in the same election that put Sylvester Turner in the mayor’s office, Houstonians voted to change the city’s term limits. Instead of holding municipal elections every two years and limiting elected officials to a maximum of three terms in office, voters opted for holding elections every four years and a maximum of two terms.

If you cast a ballot in that term-limits referendum, you might have reasonably assumed the new, longer terms also meant city politicians could drag the sack for campaign cash only once every four years. But if that’s what you thought, dear voter, you’ve been bamboozled.

In a cynical act of self-preservation, Houston’s mayor and City Council Wednesday adopted new campaign finance rules that essentially double the maximum contributions they can collect from each individual donor and political action committee before any election. Even though voters decided to let them stay in office four years between elections, our city’s elected leadership bestowed upon themselves the right to squeeze donors for campaign checks every two years.

I just don’t feel that strongly about it, mostly because I don’t think the amounts involved will have any effect on the outcome of elections. I agree that the way this ordinance was written it gives an advantage to incumbents. Simply doubling the amount that could be raised in a four-year period rather than allowing the same amount to be raised twice would have made it easier for challengers to keep up. I wonder if the donor class, who I agree would rather not have to write more checks if they can avoid it, will necessarily play along. As I noted before, it was already the case that very few PACs made the maximum $10K donation that had been allowed to candidates. Just because they can give more in our now-longer election cycle doesn’t mean that they will. As always, we’ll have to keep an eye on the finance reports to see what effect there is from this.

What Council members think about the Uber threat

I was scrolling through Facebook and came upon this post from CM Michael Kubosh:

Mayor Turner wants UBER to stay, but they must follow the city’s ordinance that requires a CRIMINAL BACKGROUND CHECK and FINGERPRINTS. Council Member Michael Kubosh said that all public service drivers for buses, cabs, train, limos, shuttles and jitneys require the same CRIMINAL BACKGROUND CHECK and FINGERPRINTS. They must follow the rules. They came to Houston during the 2014 Rodeo operating illegally and the City Council changed the Ordinance to make room for their business model. NOW LOOK WHAT THEY ARE WANTING.

Which got me to wondering about other Council members and what they thought. Of the five Council members that voted against the original ordinance in 2014, four remain on Council: Kubosh, Jack Christie, Jerry Davis, and Mike Laster. I went looking, via Google, Facebook, and Twitter, to see who else has had something to say.

And the answer is, most of them have not said anything as yet. One who has is Brenda Stardig, who is the Chair of the Public Safety committee:

CM Dave Martin was quoted in one of the stories I blogged about after Uber issued its ultimatum:

“If you don’t want to follow the rules we all agreed to, have a good opportunity in another city,” District E Councilman David Martin said. “But we cannot be blackmailed when it comes to public safety.”

And that’s pretty much it for actual opinions. The only other Council member to say something was Greg Travis:

Mayor Sylvester Turner wants uber to stay in Houston, but wants the company to operate under the same rules as other transportation companies. Uber wants to eliminate regulation for its drivers to have city fingerprint check. Rather, uber wants to use its own background check. Mayor says uber’s background check inadequate. Your thoughts?

Comments on that post ran more in Uber’s favor than against, for what it’s worth. Also for what it’s worth. all four of these Council members – Kubosh, Martin, Stardig, and Travis – are Republicans; so is Jack Christie among the No votes from 2014, while Davis and Laster are Dems. I mention that mostly to note that if Uber is trying to make a free-market/deregulation argument, it’s not working on the kind of people you’d think it might work on. This discussion is just getting started, and Lord knows Uber is willing and able to dump a ton of resources into winning it, so this is hardly a final whip count. But clearly, Uber has some ground to make up to win this one.

CM Jack Christie is a genuinely nice person, the kind of moderate Republican one fears is going extinct in Texas. He’s definitely been fortunate in the opposition he’s faced. He was fortunate to get then-CM Jolanda Jones into a runoff in 2011 – he trailed her in the November vote, and probably would have lost at that time if it had been just him and her in that race – then won in a low-turnout runoff, which unlike the runoff he lost to her in 2009 did not have a Mayoral race on the same ballot. He faced nominal opposition in 2013 from a couple of late entrants, and was put into a runoff again this year against a candidate who was not well known and who did not generate a lot of Democratic excitement. He’s one of six third term Council members who got two bonus years from the term limits change (five second-year members get four bonus years), and as a senior member of Council ought to have plenty of opportunities to help new Mayor Turner make his mark on the city.

Despite having interviewed her for the runoff, I’m still not sure what to make of Sharon Moses. I thought she came across reasonably well in the interview, though like many first-time candidates she didn’t have a deep knowledge of most issues. A lot of Democratic groups were hesitant with both her and Georgia Provost, and while Provost generally won their endorsements, Moses lagged behind, which is one reason why I expected Provost to do better. She was involved in a dustup over HERO and LGBT equality at a meeting of the Meyerland Democrats’ meeting prior to the runoff. Some of you may have seen a report on that elsewhere; Moses disputed that written account, but a couple of people later corroborated it to me in person. I don’t know how much of that was genuine disagreement and how much was a first-time candidate who maybe didn’t express her views as clearly as she could have, but the electoral effect was clear. In the end, the beneficiary was Jack Christie, and perhaps the candidates who will run for his to-be-open seat in 2019, the only open citywide office on the ballot that year barring anything unexpected.

Is Bill King a sign of a trend?

Probably not. Doesn’t mean that other candidates like him can’t do well, however.

Bill King’s near-upset over Sylvester Turner in the Houston mayoral runoff stoked the hopes of some Republicans that the party soon could break Democrats’ 34-year hold on City Hall.

Political experts, however, attributed King’s success more to his unique profile as a moderate fiscal conservative than a Republican resurgence in the Bayou City.

“King pretty skillfully positioned himself. He didn’t run as a Republican but happily accepted the support of Republicans,” University of Houston political scientist Richard Murray said. “You might get elected with support from Republicans, but that’s not enough to win unless the turnout is extremely skewed.”

Murray estimated Republicans make up about 35 to 40 percent of the city electorate, just 21 percent of whom cast a ballot in last Saturday’s runoff election to replace term-limited Mayor Annise Parker.

Kingwood Tea Party co-founder Jim Lennon said King’s bid instilled new confidence in Houston Republicans.

“With the results of this race being so close, I think there’s a change in attitude,” Lennon said. “We know we can win. We know we can put together a coalition.”

Nonetheless, Lennon acknowledged that the former Kemah mayor’s bid may be difficult to replicate.

“I don’t think there’s a deep bench of Republican politicians that can duplicate that,” Lennon said.

As you know, I largely agree. King was a decent candidate who took advantage of the opportunities he had and ran a good campaign. He was also lucky – again, I don’t think we’d be having this conversation if Oliver Pennington had not dropped out of the race. I think we’d be talking about why Adrian Garcia fell short against Turner in the runoff. That’s the way it goes, and every successful politician, like every championship sports team, gets a bit of luck here and there.

Republicans may not be able to win a Mayor’s race in Houston, but they’ve done a lot better in At Large Council races. Steve Costello, Jack Christie, Michael Kubosh, and now Mike Knox have all won citywide since 2009. Of course, the first three all won with the support of a significant number of Democratic voters – Costello (who basically profiled and governed as a moderate Dem) and Christie have done well with Anglo Dems, while Kubosh has solid support among African-American voters stemming from his previous work on the red light camera referendum. Only Knox won based on Republican votes, and that comes with a bit of an asterisk, given how low profile his runoff election was. The real test will be in 2019, when Christie is termed out and Knox will have to run without the backdrop of a King candidacy. If the Dems could unite on a single candidate against Knox (I know, I know) then that person ought to be favored. But let’s worry about that later, like maybe after the current electeds get sworn in and figure out where their offices are.

Finally, however swell the GOP establishment may feel about their near-miss with Bill King, it should be noted that they also had a good chance to win the Controller’s office as well, but missed that by a wider mark. Bill Frazer was a well-qualified candidate who was much more clearly identified with the Republican Party and who was as focused on pensions and fiscal matters as King. He was also Chron-endorsed and led the field in November after running a strong race in 2013, yet he wound up more than 10,000 votes behind Chris Brown (remember to add in the Fort Bend votes when you tally it all up). Brown had a bit of a financial edge, he had a bunch of ads running on cable TV, and he definitely made this a D-versus-R race. At a guess, I’d say that he had the support of a lot of Anglo Dems who had gone with King. All of which is a longwinded way of saying what Jim Lennon said: It’s hard for them to duplicate what King did.

The Chron used this data to create some maps – a City Council district map, a precinct map, and a turnout map.

Remember as always that this is Harris County data only. Turner did win Harris County, by a small amount. The bulk of his margin is in Fort Bend, which is mostly in District K. You have to give King some credit. He won F and J after having trailed in them in November, and he carried C by a fairly healthy amount. I thought if he won in C he’d be in a strong position to win overall, and he came close to that. In November I suggested that King needed to duplicate Jack Christie’s 2011 runoff performance against Jolanda Jones to win. A performance like Christie had in District C would have done it for King, but he had some other avenues as well. Two questions to ponder in analyzing this result: How many previous supporters of Garcia and Bell and Costello did King move to his column, and how many new voters did he bring out? I will try to get a handle on that when I get a copy of the voter roster. A question I’m not sure how to answer is why did King do better on Election Day than he did in early voting, despite the expectations of some pundits? Turner clearly did a good job getting his voters out early. Maybe that’s all there was to it.

As for Turner, he did what he had to do. His margins in districts B and D were awesome, but it wasn’t just about the percentage, it was about the absolute total. It’s clear Turner needed the high turnout he got in those districts, but I think it’s an oversimplification to credit his win to “high turnout”, as I’d argue that King benefited from it as well. I’d love to see someone dig up precinct information from the 2001 Mayoral runoff between Lee Brown and Orlando Sanchez and do a side by side comparison with this year. I’m guessing there would be a lot of overlap.

I’ll be looking at the other races over the coming days. This result is understandable by looking at the numbers, as both candidates did what they needed to do, with Turner ending up on top. Some of the others are more of a puzzle, especially given the context of the Mayoral race. But we’ll get to that when we get to that. What are your impressions?

Here are the Chron stories for the Council/Controller and HISD races. A couple of stray thoughts:

– Chris Brown and David Robinson are to me the big winners of the make-it-partisan strategy that was employed. I was especially worried about Robinson, because an elevated level of African-American turnout would not necessarily favor him. But both won Harris County, by larger margins than Turner (15,000 votes for Robinson, 9,000 for Brown), and both won Fort Bend, so I have to think that the message about who was the Democrat got through.

– That said, I strongly suspect that undervoting was a key in these races, and also in the AL1 race. Brown won early voting by about the same margin as Turner did, but then also won on Election Day. Robinson led early voting by a smaller margin than Turner, mostly on the strength of absentee ballots. He then dominated Election Day. On the flipside, Georgia Provost trailed in early voting, losing in absentee ballots while barely leading the in person early vote. Basically, she collected 10,000 fewer in person early votes than Turner did, while Mike Knox lost only 5,000 votes off of King’s total. This is something I plan to look into more closely when I get the precinct data.

– A lot was made before the election about King leading the vote in District C. It was a small lead, and a lot of District C voters went for Adrian Garcia, Steve Costello, and Chris Bell. If I had to guess right now, I’d say Turner won District C, but other races may be all over the place. King clearly got some crossovers, almost surely more than Turner did, but how many will be hard to tell. I really think the undervotes will tell a big part of the story.

– I’m sad to see CM Richard Nguyen lose, but I can’t say I’m surprised. Again, I’ll be interested to see what the precinct data says. After the Mayor’s race, this one had the lowest undervote rate, at 8.77%.

– Amanda Edwards’ and Karla Cisneros’ wins means that Council will have four women but only one Latino. I’m guessing that’s going to cause some angst.

– Here’s my guess at a whip count if and when another HERO comes up:

Likely Yeses – Robinson, Edwards, Davis, Cohen, Cisneros, Gallegos, Laster, Green

Likely Nos – Knox, Kubosh, Stardig, Martin, Le, Travis

Voted No originally, but maybe could be swung – Christie, Boykins

Counting Mayor Turner, a worst case vote would likely be 9-7 in favor. It would be nice to focus some effort on Christie and Boykins and maybe get that to 10-6 or 11-5. It’s a small thing, but I’d hate to give the other side the talking point that HERO 2.0 was less popular on Council than the original was. If it’s not possible to move that needle, then aiming to take a couple of seats to make up the difference and trying again after 2019 might be the best course of action. Christie’s term will be up, while Mike Knox and Steve Le could be targeted. By the same token, Jerry Davis, Ellen Cohen, and Mike Laster will also be termed out, and those seats would need to be defended, so this strategy has some risk as well. I’m just thinking out loud here. Point being, it’s never too early to start thinking about this sort of thing.

Overview of the open Council seat runoffs

Kind of late in the cycle given the number of lesser known candidates in these races, and not nearly complete, but here it is anyway.

In addition to the first open mayor’s race in six years, Houstonians can expect to see at least four new faces on City Council next year – three of which will come from contests to be decided in Saturday’s runoff election.

In the At-Large 1 race, former police officer Mike Knox faces photographer and philanthropist Georgia Provost.

In the At-Large 4 race, municipal finance lawyer Amanda Edwards faces former Harris County Department of Education trustee Roy Morales.

Edwards, who has served on nonprofit boards such as Project Row Houses, worked in the Georgia Legislature while in college, then for U.S. Rep. Sheila Jackson Lee, D-Houston, before heading to Harvard Law School.

City Council must better articulate Houston’s goals, she said, so it does not work at cross purposes by retaining what she views as suburban parking rules, for instance, in areas primed for the sort of density that would enable bicycling and walking.

She said voters must be asked to modify a decade-old cap on city property tax collections at least to protect public safety spending, and rising pension costs also must be addressed.

“I can’t think of more complicated, pressing issues than some of the ones we face right now,” she said.

The race to replace term-limited Ed Gonzalez in largely Latino District H pits elementary school teacher Karla Cisneros against HPD community service officer Jason Cisneroz.

Cisneroz, an Army veteran, worked at City Hall as a staffer for Gonzalez and former Harris County Sheriff Adrian Garcia. Cisneroz said he believes a staffing shortage at HPD can be resolved, in part, by more effectively coordinating calls for service with other law enforcement agencies.

Cisneroz has emphasized the economic disparities in District H. Corralling stray dogs and catching illegal dumpers, he said, also would be top priorities. He also called for an independent “developer integrity unit” to make sure new projects do not adversely affect roads and drainage in the area.

“People talk about inequality all the time,” Cisneroz said. “I’m living it every day.”

Cisneros, too, has focused much of her campaign on inequality in the district, pointing to her experiences teaching elementary school on both sides of Interstate 45. The former Houston school trustee said many of the city’s tax increment reinvestment zones, which keep some property tax revenues within their boundaries for public improvements, have “institutionalized inequality.” Cinseros said she would work to limit the expansion of these zones and to disband others.

Not very conducive to excerpting, so read it all yourself. If there isn’t a story in today’s paper about the At Large #2 and #5 runoffs, I’ll be very disappointed. I mean, we could have a very different Council next year, with a ton of new faces, and yet I’d bet most of the voters who will cast a ballot today couldn’t name more than one or two of the eight At Large candidates off the top of their heads. I expect the undervote rates to be pretty high – not as high as they were in November, but in excess of 20% per race. We’ll see.

The Forward Times points out another notable aspect of today’s races.

This election is not like any other in Houston’s rich history.

After the November election, Council Members Jerry Davis (District B), Dwight Boykins (District D) and Larry Green (District K) were all re-elected to council. With Council Member C.O. “Brad” Bradford being term-limited, that reduces the number of African American council members to three. As a result of the general election results, however, Houstonians now have an opportunity to vote to have seven African Americans serving on Houston City Council at the same time, by voting for candidates in four At-Large city council races.

In the At-large Position 1 race, entrepreneur Georgia Provost faces Mike Knox; in the At-Large Position 2 race, Rev. Willie R. Davis squares off against incumbent David Robinson; in the At-Large Position 4 race being vacated by term-limited C.O. “Brad” Bradford, attorney Amanda Edwards faces Roy Morales; and in the At-Large Position 5 race, Sharon Moses faces incumbent Jack Christie, who defeated two-term incumbent Jolanda Jones, who fell short in her quest to complete her final term.

Not only would there be seven African Americans serving on Houston City Council, but in the race to replace outgoing Mayor Annise Parker as mayor of the city of Houston, Sylvester Turner also has a chance to be the 2nd African American mayor in Houston’s history. That would make a total of eight African Americans around the horseshoe at Houston City Council.

Some of those eight are better than others, obviously, but no question we could have a historic result. The story notes that we could have had six elected African Americans in 2011, but fell short when Jolanda Jones was defeated. Provost and Moses also have the chance to be the first African American women on Council since Wanda Adams’ departure in 2013. It will be interesting to see whatever happens.

Here’s the Chron story on the Mayoral fundraising, the short version of which is “lots raised, lots spent”. For all that spending, I haven’t seen many TV ads – one for Bill King, a couple that attacked Bill King, and that’s about it. I have gotten some mail from Turner, and I’ve seen a bunch of Turner web ads. I’m sure they’re both on the radio, too. I’ve also seen a few ads for Chris Brown, and for Amanda Edwards.

Edwards has truly been an impressive fundraiser – not many Council candidates have the wherewithal to run TV ads, and in a race where making sure people have some idea who you are is job #1, that’s a big deal. David Robinson is next in line, though I do wonder why hasn’t spent a bit more than he has. (I could say the same about Mike Laster, but he has far fewer voters to connect with, and arguably more justification for being on cruise control.) Jack Christie has a lower number than I would have expected – I’m not sure if he’s not sweating it, or if this is a sign of trouble for him that hadn’t been apparent before now.

None of the other candidates have raised much, though Knox didn’t do too badly before the November election. Provost, Davis, Morales, and Moses – none of them has had much, yet at least three of them (sorry, Roy) have a decent shot at being elected. Those of you who think there’s too much money in politics, this is what an alternate universe looks like. Or if you prefer, those of you who think that fundraising totals are the primary indicator of electoral viability, these are your counterexamples. Make of it what you will.

Runoff endorsement watch: New business

As I mentioned before, there are a couple of runoffs in which the Chron did not endorse a candidate who is still in the running. Those races are At Large #1, #4, and #5; I had forgotten about #4 when I recounted that. The Chron has now made their choices, while restating their preference in the other race.

The runoff to succeed term-limited Councilman Steve Costello is a study in contrasts. Mike Knox, who led a crowded field in the general election with about 25 percent of the vote, is a former Houston police officer and the author of a book on gang and youth violence. His focus is on bringing the city budget under control by instituting what he calls “a confirmed revenue stream budget.”

His opponent, Georgia Provost, is a photographer and owner of a photography studio and public relations firm. A longtime community activist in the Third and Fifth wards, she is a fund-raiser for various charitable organizations supporting youth and law enforcement, a leader with the Texas Metropolitan Organization and executive director of the Texas Southern University Bayou Bend Alumni/Ex-Students Association Inc. This is the second council race for both candidates.

Knox is articulate and knowledgeable about the issues, but Provost brings grass-roots awareness and years of experience helping solve problems in her community. We believe those are qualifications that will prove valuable on the council. We’re confident she will speak up for Houstonians too often ignored by city government. We endorse Provost.

Candidates often like to run as symbols of a greater issue: the conservative candidate, the community representative, the education wonk. In this race to replace term-limited Councilman C.O. Bradford, Amanda Edwards has become a sign of Houston’s future – hard-working, engaged and passionate.

A municipal finance lawyer with Bracewell and Giuliani, Edwards has more on-the-ground experience than plenty of politicians twice her age (she’s 33). A graduate of Harvard Law School, she has spent years working for community development corporations and nonprofits across the country, from Atlanta (where she served as student body president at Emory University) to New Orleans (where she moved after Hurricane Katrina).

At-Large 5: Jack Christie

For the past four years, Jack Christie has proven to be one of the most confounding members on City Council. He’s collaborative, soft-spoken and effective at working behind the scenes. He’s also expressed a personal opposition to vaccinations and water fluoridation.

Still, to this day, you can count on one hand the number of times that Christie has raised these issues at City Council. There are also plenty of times when the incumbent proved himself to be a well-prepared workhorse.

Christie faces a challenge from Sharon Moses, a former City Council staffer. When she met with the Houston Chronicle editorial board, Moses said she wasn’t running to oust the incumbent. If there’s no reason to boot him from office, voters should re-elect Christie.

The Chron re-endorsed David Robinson in AL2. Edwards was an obvious choice – frankly, she is who they should have endorsed in the first place. Far as I know, they have never endorsed Roy Morales in any of the races he has been in; they were pretty dismissive of him when they endorsed Michael Kubosh over him in the 2013 AL3 runoff.

Both of the other two could have gone either way. The Chron had said some nice things about Knox when they endorsed Tom McCasland in Round One. They didn’t mention Provost at all in that, though they had some kind words for her in their 2013 District D runoff endorsement. I approve of this choice, and I’m guessing they overlooked Provost in November because she wasn’t running much of a campaign at that time. As for Christie, he has been endorsed twice by the Chron before, just not this year. They weren’t necessarily disenchanted with him, I think they just liked Philippe Nassif more. I’m sure they considered Sharon Moses, but for better or worse, in this case they were happy enough to come back to him.

This is not Jack Christie’s first runoff. It’s his third, in fact: He lost narrowly to then-CM Jolanda Jones in 2009, the defeated her somewhat less narrowly in 2011. He won without a runoff in 2013, and is now back in a familiar position. A review of the precinct data from the two previous runoffs is instructive. The comparison between the two isn’t exact due to the Council redistricting of 2011, but the basics are the same: Christie was clobbered in the African-American parts of town, but did well enough everywhere else. In 2009, the higher overall turnout from the Mayoral runoff was enough to sink his ship by making the margins he had to overcome in B and D that much greater, but the lower turnout of 2011 plus his improved performance in other parts of the city were enough to give him the win. We will be in a turnout environment more like 2009 than 2011 this year, and with Sylvester Turner running that could well boost his opponent and give him problems as was the case in 2009, but this time he’s running against a little-known first-time candidate and not a high-profile incumbent, which ought to work to his benefit. I surely expect a higher undervote rate this year than in 2011 when the AL5 runoff was the main event. I make Christie the favorite, but his re-election is far from assured.

As for Sharon Moses, I’m still getting to know who she is. She sent out a campaign email earlier in the week, which I have pasted beneath the fold. Her challenge and her path to victory are basically the same as they are for Georgia Provost, except that 1) her opponent is a two-term incumbent; 2) her opponent is fairly moderate and has a history of winning crossover support; and 3) she herself is less known than Provost is. Moreover, while Provost has picked up all the Dem-friendly runoff endorsements that I have seen so far, Moses has been a bit less successful in that endeavor. Both Provost and Moses were endorsed by the HCDP and by the Planned Parenthood Gulf Coast Action Fund, but only Provost was endorsed by the Houston GLBT Political Caucus. I can see scenarios where they both get elected and where they both lose, but if only one of them wins I’d bet money it’s Provost and not Moses.

As for Philippe Nassif, it was a good effort by another first-time candidate, but the district view shows that he still had a ways to go. He did well in the friendly confines of District C, though not well enough to outdo Christie, but did not make enough of an impression elsewhere. If he wants to run again in 2019 – and he should, unless he gets elected to something else between now and then or moves to another city – my advice would be to stay engaged seek out opportunities to get his name out there. Take a more prominent and visible role in the 2016 and 2018 elections. Write some op-eds for the Chronicle. Find a cause and throw yourself into it. There are far more ultimately successful candidates who lost their first race (or races) than there are instant winners. Stay engaged, keep yourself out there, and you’ll enter 2019 more prepared than most. I hope to see you on my ballot again.

There’s not a whole lot to say here. Kubosh won a majority in every Council district, only coming close to not having a majority in District F. Some of this is a perk of high name ID, but said name ID was earned through work on the red light camera referendum and by being visible on Council. There have been a lot more people running for At Large seats in recent elections, challenging incumbents as well as piling up in open seat races. Since 2009, when CM Melissa Noriega ran unopposed, two At Large members have been dislodged, and every At Large incumbent save Steve Costello and Brad Bradford in 2013 have had at least two opponents. Sue Lovell and Jolanda Jones survived runoffs in 2009, while David Robinson and Jack Christie face them this year. In that context, Kubosh’s achievement as one of only two At Large incumbents to clear 60% against multiple opponents in this time frame (Bradford in 2011 is the other) is even more impressive. Give the man his due.

With all this recent interest in At Large races, and with the next election being four long years away (barring any further intervention from the Supreme Court), one wonders what the landscape will look like the next time these seats are up. As noted once before, CM Christie is the only At Large member whose term would be up in 2019, meaning that if he loses then every citywide officeholder as of January 2, 2016, can be on the ballot in 2019. (Like CM Kubosh, CM Robinson is in his first term, so regardless of the outcome in At Large #2, the incumbent in that seat can run for re-election.) With four years between races, one would think that there will be a lot of pent-up demand for Council offices, which may attract another truckload of citywide hopefuls. On the other hand, districts A, B, C, J (if CM Laster wins), and K will all be open then, so perhaps that will siphon off some of that demand. I really have no idea what it will be like, but barring anything strange, it seems reasonable to say that CM Kubosh will be a favorite to win a third term. Check back with me in January of 2019 and we’ll see how good that statement looks at that time.

Endorsement watch: Bell for King

As the headline notes, this came as a surprise to many.

Former Congressman Chris Bell publicly backed fiscal conservative Bill King in the Houston mayoral runoff Tuesday, a move that could bolster King’s efforts to make inroads with progressive voters.

Bell’s endorsement came as a surprise to many political insiders expecting the progressive former mayoral candidate to support King’s rival, Democrat Sylvester Turner.

Bell cited King’s focus on pension reform, public safety, road repair and flooding as reasons for his endorsement, as well as the businessman’s thoughtful approach to policy issues.

“It might come as a surprise to some because of my political persuasion, but it really shouldn’t,” Bell said alongside King in Meyerland. “Truth be told, we agree much more than we disagree. As far as the major principles of his campaign, we’re in complete agreement.”

If you say so, Chris. From my perspective, the main area of overlap between the two campaigns was an enthusiasm for bashing Adrian Garcia. On a number of issues I can think of, from HERO to the revenue cap to ReBuild Houston to (yes) pensions, there seemed to be little in common. It’s easier for me to see agreement between Steve Costello and Sylvester Turner than it is for me to see concurrence between Bell and King. Perhaps it’s in the eye of the beholder, I don’t know. But really, on a broader level, it’s that Bell positioned himself quite purposefully to Sylvester Turner’s left, with his greater purity on LGBT equality being a main point of differentiation. Though he missed out on getting the Houston GLBT Political Caucus’ endorsement – amid a fair amount of grumbling about Turner buying the recommendation via a slew of last-minute memberships – Bell had a lot of support in the LGBT community; a couple of his fervent supporters courted my vote at the West Gray Multi-Service Center by reminding me of an old Turner legislative vote against same sex foster parenting. This is why it’s hard to believe his claims about there being so much in common between him and King, and why this announcement was met with such an explosion of outrage and cries of betrayal. It’s not a partisan matter so much as it is a strong suspicion that either the prior assertions about being the real champion of equality were lies or that this endorsement had to come with a prize. If Chris Bell honestly believes that Bill King will be the best Mayor, that’s his right and his choice. But no one should be surprised by the reaction to it.

Does this help King? Well, he needs to get some Anglo Dem support to win, and that was Bell’s base. Of course, speaking as someone in that demographic, I’ve seen very little evidence that any of his erstwhile supporters were impressed by this. Quite the reverse, as noted above. I guess it can’t hurt, I just wouldn’t expect it to do much.

In the meantime, various organizations have been issuing new and updated endorsements for the runoffs. A few highlights:

– As previously noted, the HCDP endorsed all Democratic candidates with Republican opponents. That means Sylvester Turner for Mayor, Chris Brown for Controller, Georgia Provost, David Robinson, Amanda Edwards, Sharon Moses, Richard Nguyen, and Mike Laster for Council, and Rhonda Skillern-Jones and Jose Leal for HISD Trustee.

– The Houston GLBT Political Caucus added Georgia Provost and Karla Cisneros to their list of endorsed candidates. Turner, Brown, Edwards, and the incumbents were already on there. They did not take action on Moses and Leal.

– The Meyerland Democrats made their first endorsements in a city election: Turner, Brown, Provost, Robinson, Edwards, Nguyen, and Laster.

– Controller candidate Chris Brown sent out another email touting endorsements, this time from five previous Controllers – Ronald Green, Annise Parker, Sylvia Garcia, George Greanias, and Kathy Whitmire. As you know, I’m glad to see Green support him.

– As noted here, the Harris County GOP Executive Committee endorsed Willie Davis in AL2, though it wasn’t exactly unanimous.

– The Log Cabin Republicans transferred their endorsements to Bill King and Mike Knox, and reiterated their support for David Robinson, Jack Christie, and Steve Le. Guess being staunchly anti-HERO has its drawbacks.

– A group called the Texas Conservative View endorsed the candidates you’d expect them to – King, Frazer, Knox, Davis, Roy Morales, Christie, Steve Le, Jim Bigham – and one I didn’t, Jason Cisneroz. All of them were repeats from November except for Morales; they had previously endorsed Jonathan Hansen.

– Finally, the Houston Association of Realtors gave Bill King an endorsement that does mean something and makes sense, along with Amanda Edwards.

I think that catches me up. I’m sure there will be more to come – in particular, the Chron has a few races to revisit. They need to pick a finalist between Brown and Frazer, and make a new choice in AL1 and AL5. I’ll let you know when they do.

UPDATE: The line I deleted above about “being staunchly anti-HERO” was a reference to Willie Davis not getting the LCR endorsement in At Large #2. It made sense in my head when I wrote it, but I can see now that I didn’t make that clear at all. And given that the LCRs endorsed David Robinson in November, it doesn’t make sense even when I clarify who I intended that to be about. So, I take it back. Sorry for the confusion.

The seven other candidates combined for 2.57% of the vote, so for the sake of space and my sanity, I’m omitting them from these tables, but I will say a few words about them here. Hoc Thai Nguyen, who had the seventh-highest vote total, scored 6.60% of the vote in District F, and 3.02% in J, the two most Asian-heavy parts of town. As it happens, F (1.93%) and J (1.15%) were Marty McVey’s two best districts, too. Nguyen also broke out of the square root club (*) in A (1.01%) and I (1.08%). No other candidate reached 1% in any district. Demetria Smith, who ran for District D in 2013, came closest with 0.93% of the vote in D. At the bottom of the ladder were Joe Ferreira (240 votes) and Dale Steffes (302), but it was Steffes who had the worst performance in any district. Nearly half of his votes (143 of them) came in District G, and he collected all of 2 votes in J and 3 votes in B. Ferreira got 7 votes in B, but made it to double digits everywhere else. Neither he nor Rafael Munoz made it to triple digits in any district, however. I guarantee, this is the kind of analysis you won’t see anywhere else.

The conventional wisdom on Sylvester Turner is that he needed to broaden his appeal beyond African-American voters, who were expected to strongly support his candidacy. He certainly received their strong support, as the results in B and D attest. Turner also finished first in districts F, J, and K, and finished second in A, C, G, H, and I. That looks pretty reasonably broad to me. If you’re alarmed by him finishing behind King in C, I would simply note that there do exist Republicans in District C, and C was where both Chris Bell and Steve Costello had their strongest showings. I feel confident saying that much of that vote will transfer to Turner. Ben Hall didn’t dent Turner’s support in B and D; given that plenty of anti-HERO voters also supported Turner, it seems likely to me that he will pick up a fair bit of Hall’s support. And perhaps with some help from Adrian Garcia’s endorsement, Turner ought to do well in H and I. None of this is guaranteed, of course. People do actually have to come out and vote, and if there’s any sense of inevitability that might make some people think they needn’t bother to show up. For what it’s worth, I get the sense from too much Facebook reading that plenty of disappointed HERO supporters are not depressed but angry, and that they know their best chance of a second shot at an equal rights ordinance is with Mayor Turner, not Mayor King. I think they’ll show up. Runoff early voting starts December 2, so we’ll know soon enough.

A word about Garcia before I move on: If every single voter in H and I had voted for him, his Harris County total would have been 62,623. If you then subtract the votes Bill King got in H and I from his total, he’d be left with 62,954. Garcia gained a net 267 votes on King in Fort Bend and lost a net 26 votes in Montgomery, so when you add it all up, he’d still have been out of the money. Now I know that H and I aren’t solely made up of Latinos – hell, I live in H, and I’m almost as white as King – and there are plenty of Latino voters in other districts. There could also have been higher turnout in these districts; both were under the overall average. My point in using this bit of shorthand is to say that it was really Garcia who needed to broaden his support, and to that end his biggest problem was other Democrats, not any anti-HERO surge. I think Garcia was handicapped by his late entry into the race, much as Sylvester Turner was by his late entry into the 2003 Mayor’s race. By the time Turner jumped in, after the legislative session, Bill White had locked up a significant amount of support from Democratic voters, including a non-trivial number of black Democrats. By the time Garcia got in, he had to ask a lot of people to reconsider the decision they’d already made about whom to support for Mayor in order to ask them to support him. That’s a much harder thing to do. He had his reasons for getting in so late, and it’s always easy to be a Monday morning quarterback. I’m just saying the reasons why Garcia isn’t in the runoff go beyond simply counting the number of Latinos that voted.

And while we’re still talking about broadening appeal, there’s Bill King. Look at those numbers above. King did very well in E and G, fairly well in A, C, F, and J, and not so well anywhere else, including below-the-Hoc-Thai-Nguyen-in-F-line finishes in B and D. Where does King turn to sufficiently improve his performance in the runoff to have a shot at it? I feel like the basic model for this is Jack Christie’s runoff win against Jolanda Jones in 2011, which is to say broaden his appeal outside of his Republican base, maximize those votes, and limit Turner to his own base in B and D. Easier said than done, but it has been done. It’s been suggested to me that a factor that may have driven turnout at least as much as the HERO vote was Republican voters in the city having a real choice for Mayor for the first time since 2003. There may be something to that, but if so I’d note as before that King received just 30,000 more votes than Roy Morales did in 2009, which receiving 33,000 fewer votes than Orlando Sanchez did in 2003. Make of that what you will. King ought to have room to boost Republican turnout in the runoff – Republicans have a few candidates they might like to support elsewhere on the runoff ballot as well – but I don’t think that gets him over the line on its own. I think he can’t win unless he can take some votes away from Turner. How he might do that, I assume we’ll find out.

I’ve got more of these to do over the course of the week. Remember again, these are draft canvasses, so no overseas or provisional ballots, and these numbers are all Harris County only. (*) This is an old Rice joke. The “square root club” referred to anyone for whom the square root of their GPA was higher than their actual GPA. This is a geeky way of saying “less than 1.0”, which for these purposes means “less than 1.00 percent”.

Initial day-after-election thoughts

– We now have two cycles’ worth of data to suggest that having more good candidates in a Council race does not necessarily lead to better outcomes. Following in the footsteps of At Large #3 in 2013, a handful of Democratic candidates in At Large #1 split the vote with sufficient closeness to keep them all out of the runoff. The votes were there, they just went too many places. Lane Lewis + Tom McCasland = candidate in the runoff, pretty close to Mike Knox in total. Lane Lewis + Tom McCasland + Jenifer Pool = leading candidate going into the runoff. I have no idea what, if anything, there is to be done about this. There is no secret cabal that meets in a back room to decide who does and doesn’t get to file for a race, and we wouldn’t want there to be one if there were. I’ll just put this out there for candidates who are already looking at 2019, when the terms will be double and the stakes will be concurrently higher: If there’s already a candidate in a race – especially an open seat race – that would would be happy to vote for in a runoff scenario, then maybe supporting them in November rather than throwing your own hat in the ring is the better choice. I realize that framing the choice this way turns this decision-making process into a multi-level Prisoner’s Dilemma, but one can’t help but wonder What Might Have Been.

In AL 4, Amanda Edwards faces Roy Morales, who caught and passed Laurie Robinson by less than 900 votes by the end of the evening. As for ALs 1 and 5, I’m still deciding. I said “some” clarity, not complete clarity.

– Speaking of CM Christie, if he loses then there will be no open citywide offices in the next election, which is now 2019. That won’t stop challengers from running in some or all of the other AL races, but it would change the dynamics.

– In District Council runoffs, it’s Cisneros versus Cisneroz in District H, which is going to make that race hard to talk about. Roland Chavez finished 202 votes behind Jason Cisneroz, who got a boost from late-reporting precincts; he had been leading Chavez by less than 40 votes much of the evening. Jim Bigham finished all of 28 votes ahead of Manny Barrera for the right to face CM Mike Laster in December, while CM Richard Nguyen trailed challenger Steve Le but will get another shot in five weeks. I’m concerned about Laster and Nguyen, but at least their opponents pass my minimum standards test for a Council member. That would not have been the case if either third-place finisher (Barrera and Kendall Baker) had made the cut.

– Moving to HISD, if I had a vote it would go to Rhonda Skillern-Jones in II. I would not vote for Manuel Rodriguez in III, but I’d need to get to know Jose Leal better before I could recommend a vote for him.

Yep, five votes. There were 3,742 undervotes in this race. I have since been forwarded a press release from the Diaz campaign noting that provisional and overseas ballots have not yet been counted, and hinting at a request for a recount down the line. I’d certainly be preparing to ask for one.

– Speaking of undervoting, one prediction I made came true. Here are the undervote rates in At Large Council elections:

AL1 = 28.56%
AL2 = 31.02%
AL3 = 33.09%
AL4 = 28.35%
AL5 = 32.34%

That’s a lot of no-voting. Contrast with the contested district Council races, where the (still high) undervote rates ranged from 15.97% to 22.49%. See here for a comparison to past years.

– Meanwhile, over in San Antonio:

In a stunning outcome, Republican John Lujan and Democrat Tomás Uresti were leading a six-candidate field for Texas House District 118 in nearly complete results late Tuesday.

In his second run for the office, Lujan, 53, showed strength in a district long held by Democrats, narrowly outpolling members of two prominent political families.

“I’m still on pins and needles. It’s not a done deal,” Lujan said with many votes still uncounted.

In his low-key campaign, the retired firefighter, who works in sales for a tech company, emphasized tech training to prepare students for the workforce. His backers included some firefighters and Texans for Lawsuit Reform PAC.

Uresti, 55, a legal assistant, is vice chairman of the Harlandale Independent School District. With 35 years of community involvement as a coach, mentor and tutor, Uresti capitalized on his network of friends and family name — his brothers are state Sen. Carlos Uresti of San Antonio and Tax Assessor-Collector Albert Uresti.

“Democrats are going to pull together again to win this one,” Tomás Uresti said of the impending runoff.

A runoff between Lujan and Uresti would be Jan. 19.

Gabe Farias, son of outgoing Rep. Joe Farias, came in third, less than 300 votes behind Uresti. Three Democratic candidates combined for 53.3% of the vote, so I see no reason to panic. Even if Lujan winds up winning the runoff, he’d only have the seat through the end of next year – the real election, which may produce an entirely different set of candidates, is next year, and Democrats should have a clear advantage. Nonetheless, one should never take anything for granted.

– Waller County goes wet:

Waller County voters overwhelmingly passed a proposition Tuesday to legalize the sale of all alcoholic beverages, including mixed drinks.

Though Waller County is not dry everywhere to all types of alcohol, various parts of it have operated under distinct alcohol policies passed in the decades following Prohibition. The change will apply to unincorporated areas of the county.

“I’m ecstatic with the numbers,” said Waller County Judge Carbett “Trey” Duhon III, who had publicly supported the proposition. “… It’s a good result for the county and for all the citizens here.”

Supporters like Duhon have said the measure was needed to smooth over confusing, overlapping rules and to help attract restaurants to a county poised to benefit from Houston’s sprawling growth.

– I’m still processing the HERO referendum, and will be sure to dive into precinct data when I get it. (I have a very early subset of precinct data for just the Mayor’s race and the two propositions. I may do some preliminaries with it, but this data is incomplete so I may wait till the official canvass comes out.) One clear lesson to take from this campaign is that lying is a very effective tactic. It also helps when lies are reported uncritically, as if it was just another he said/she said situation. Blaming the media is the world’s oldest trick, and I’m not going to claim that lazy reporting was a deciding factor, but for a group of people that considers itself to be objective truth-seekers, they sure can be trusting and unprepared for for being lied to. As with item 1 above, I don’t know what if anything can be done about this.

– Bond elections and miscellaneous other things are noted elsewhere. Have I missed anything you wanted to see me discuss?

Omnibus election results post

I’m going to take the easy way out here, because it’s been a long day/week/month and I’m hoping to get some sleep tonight, and just hit the highlights. There will be plenty of time for deeper analysis later, and of course we are now officially in runoff season. There’s absolutely no rest for the political junkie.

– Obviously, the HERO result is deeply disappointing. I’ll leave the Monday morning quarterbacking to others, but I will say this: Whatever you think about this issue, get ready for Jared Woodfill to be the public face of Houston for a few days. There’s no way this is good for anyone.

– It’s Sylvester versus King in the Mayoral runoff. The runoff will basically be the campaign we should have had in November, which will be dominated by the Mayor’s race and not the HERO campaign and the avalanche of lies that accompanied it. Don’t expect the same crowd to show up in December – if I had to guess it would be turnout in the 150K range, as it was in 2009.

– The Controller’s race was reasonably according to form, with Bill Frazer and Chris Brown in the runoff.

– Four out of five At Large races will go to runoffs, with CM Michael Kubosh being the only candidate who can take November off. I suggested there might be some goofy results in these races, and we have them, in ALs 1 and 5, where candidates who didn’t do much if any campaigning are in the runoffs. The single best result of the night is Amanda Edwards’ big lead. She will face Roy Morales, who sneaked past Laurie Robinson into second place, in December.

– And the single worst result from last night, even worse than the HERO result, is Juliet Stipeche losing her race to Diana Davila. A terrible blow for the HISD Board. Jolanda Jones won easily, Rhonda Skillern-Jones leads but is in a runoff, and Manuel Rodriguez also leads but is in a runoff, with Jose Leal and nor Ramiro Fonseca. What a weird night. On the plus side, both Adriana Tamez and Eva Loredo won re-election to the HCC board easily.

– Mike Laster and Richard Nguyen are both in runoffs, in J and F. I feel pretty good about Laster’s chances, less so about Nguyen’s. Greg Travis is a close winner in G, and Karla Cisneros leads in H, Jason Cisneroz holding off Roland Chavez for second place; the difference between the two was in double digits most of the night. If there’s one race on the ballot where someone calls for a recount, it’ll be this one.

– I guess if you really wanted to change Houston’s term limits law, this was the election to do it. There was absolutely no campaign either way, and for all the shouting about “ballot language” in the HERO and Renew Houston elections, I’ll bet a large chunk of the people who voted for Prop 2 had no idea what they were voting for.

– All the county bond issues passed, as did all the state props, and Montgomery County finally got a road bond to pass. Hope it’s all you want it to be, MontCo.

I will have more to say later. For now, this is all the energy I have. I’m going to be looking for national reaction stories to the HERO referendum. I strongly suspect it will be ugly, and I expect the likes of Dan Patrick and Jared Woodfill to keep lying about it in the face of such blowback. But we’ll see. A few comments:

– Neither Dwight Jefferson nor Jew Don Boney have 8 day reports, or for that matter 30 day reports. I have no idea why this is the case. Carroll Robinson’s 8 day report does not list a total for expenses, and it has no itemization of contributions or expenses; there’s basically nothing after the initial cover page.

– Bill Frazer had $16,450 in in-kind contributions listed as “pro-rata share of mailer”, from the C Club and Houston Realty Business Coalition. $69,215 of his expenses were from personal funds, including $50,250 for advertising, $7,490 for “GOTV mailout printing”, and $9,747 for postage.

– 22 off MJ Khan’s 44 contributors gave non-Houston addresses. I think I’ve seen his circa-2009 ad and Chris Brown’s “high school swim team” ad more than any Mayoral candidate’s ads except for maybe Costello. Khan also spent $825 on Facebook ads, because why not?

I have not had the time or energy to do the same scrutiny on Council reports, but this Chron story provides a few highlights.

1. At-large 1: Candidates competing to replace term-limited Stephen Costello, who is running for mayor, dropped nearly $299,00 during the past month. The biggest spender was Tom McCasland, former CEO of the Harris County Housing Authority, whose political action committee dropped nearly $155,000. Mike Knox, who has positioned himself as the conservative candidate, spent $57,000 and Lane Lewis, chair of the Harris County Democratic Party, spent $44,000.

2. At-large 4: In another competitive at-large race, seven candidates combined spent $252,000. Amanda Edwards, a municipal finance lawyer, has significantly outpaced competitors in spending, dropping $208,000.

4. At-large 2: Incumbent David Robinson and four contenders spent a combined $147,000. Challenger Eric Dick, a lawyer and former mayoral candidate, shelled out the most, spending almost $75,000. Robinson spent more than $47,000.

Since they didn’t go into it, I will note that in At Large #3, CM Kubosh spent about $28K, while Doug Peterson and John LaRue combined to spend about $12K; in At Large #5, CM Christie spent $60K, while Philippe Nassif spent $13K. I know I’ve received some mail from Amanda Edwards (and also received a mailer yesterday from Chris Brown), as well as two robocalls from Eric Dick and – this is the strangest thing I’ve experienced this campaign – a robocall from “former Houston Rocket Robert Reid on behalf of [his] good friend Griff Griffin”. Who knew Griff even did campaigning? Not that this appeared anywhere on his finance report, as either an expense or an in-kind donation, of course. Let’s not go overboard, you know. Anyway, if you look at the 2015 Election page, you will see that as with the Controllers, several At Large candidates have not filed 8 day reports. James Partsch-Galvan and Joe McElligott have filed no reports; Moe Rivera and Jonathan Hansen have not filed 30 Day or 8 Day reports; Jenifer Pool filed an 8 day but not a 30 day; and Larry Blackmon and Brad Batteau filed 30 day reports but not 8 day reports. It’s possible some of these may turn up later, so I’ll keep looking for them. I’m working on the district reports as well and will list them as I can.

Endorsement watch: Youth wins out

You have to say this about City Councilmember Jack Christie: He’s a conscientious public servant. Holding the At-Large 5 seat, the two-term incumbent is, in his words, “a workhorse, not a show horse,” is always well prepared and seems to get along with others on the council. For those reasons and others, we endorsed him in 2013 for a second term on the council. We cannot endorse him for a third.

Despite his work on the council and his record of service on the State Board of Education and on the Spring Branch school board before being elected to the council in 2011, we find it incongruous that a chiropractic physician who has taken a special interest in health-care plans for city employees opposes vaccinations. He contends that they jeopardize children’s health and that there are other, more effective ways to nurture natural immunity. He’s best known for his comment two years ago that “you don’t die from the flu.” In our view, opposition to vaccinations goes against the overwhelming scientific consensus and is a dangerous position for an elected official to hold, particularly one whose experience is in medicine.

Nassif is our choice for At-Large 5. Granted, the 30-year-old son of Mexican and Lebanese immigrants is young, but he’s been involved in public service for more than a decade. He offers voters detailed positions on transportation and infrastructure, fiscal responsibility and quality-of-life issues. He would work, for example, to address growing income inequality in Houston by advocating for affordable housing and providing incentives for developers to provide controlled-price rental units in developments across the city. He also supports the Houston equal rights ordinance (which Christie opposes).

I had Christie as a 65% favorite in this one, but I will note that I suggested the Chron might go for Nassif because 1) HERO 2) vaccines and 3) he’s good. So, I think I deserve a fair amount of partial credit. Good on Philippe for knocking their socks off.

Time to guess the Chronicle’s endorsements

We are a bit more than a month out from the start of early voting, and as such we are getting close to the start of Chronicle endorsement season. I know from doing candidate interviews that the Chron has been holding screenings in recent days, so it shouldn’t be long now. So while we wait for that, why not take a crack at guessing what their endorsements will be?

I want to stress up front that these are not my endorsements. I’m not making any endorsements, here or elsewhere. Nor are these necessarily the candidates I think the Chronicle should endorse. I’m not making any value judgments. These are my best guesses at who the Chron will endorse, based on past history and my read on what they are looking for this year.

What are they looking for this year? I don’t think that’s any mystery. They’re looking for candidates who support HERO and who are sufficiently “serious” about pension reform. That doesn’t mean these are their only criteria, nor does it mean that they can’t or won’t endorse a candidate who doesn’t agree with them on one or both of them. I’m not there in the screenings, I don’t know what else might be on their minds. I’m just making what I hope are reasonable guesses. None of this should be taken seriously. Consider this the political nerd’s equivalent of Sean Pendergast predicting the Texans’ season, with fewer references to the WWE and Game of Thrones.

So with all of that said, let’s begin.

Mayor

At first glance, you’d think this would be a tough one to guess, but looking back at what I wrote above, it jumps right out at you: I believe the Chron will endorse Steve Costello. He checks all their boxes, and he has the most experience in city government to boot. King and Hall are both anti-HERO. McVey is an extreme longshot. I think they will be too critical of the recent issues with the jail to go with Garcia. Bell and Turner are possible, I guess, but I don’t think the Chron would consider them “serious” enough on pensions; the Chron did not care for the agreement that Turner helped broker with the firefighters earlier this year. The more I think about it, the clearer it seems. I’ll be surprised if it’s not Costello.

Controller

This one is murkier. Chris Brown is possible, but I think they will ding him for being Ronald Green’s second in command, and it’s not like they were ever big fans of his father. They endorsed Bill Frazer in 2013 and could endorse him again, but I think that was at least partly about Green’s baggage. I also think that if I’m right about Costello, they may be reluctant to endorse two Anglo Republicans for the top offices of a city that is not particularly Anglo nor Republican. I believe they will view Carroll Robinson’s tenure with the HCC Board as a negative. Honestly, I think the favorite at this point is Dwight Jefferson, who was part of the best Metro board in recent memory and who has no obvious negatives about him. I’ll say Jefferson 60%, Frazer 25%, Brown 15%.

At Large incumbents

With incumbents there’s an extra factor to consider, namely whether the incumbent in question has done anything to disqualify himself or herself. There are no Helena Browns this year, so the main question is how big a strike against someone is a vote against HERO? I’ll get to that in a minute. In At Large #2, I think David Robinson is an easy call. He checks the boxes, and none of his opponents are anyone I’d expect the Chron to consider seriously. Kubosh and Christie are the tougher ones to guess. How much will their opposition to HERO be held against them? My guess is “some”, but unless the screening goes badly for them or I’ve underestimated the commitment the Chron has to HERO, I figure they’re both favorites. I’ll make it 80% for Kubosh and 65% for Christie, with the difference being that Christie made some goofy statements about vaccines in his first term, and Philippe Nassif is compelling enough that the Chron might take a flyer on him as a “breath of fresh air” candidate.

At Large open seats

I’m going to go with Tom McCasland in AL1 and Amanda Edwards in AL4. Edwards feels like the safer choice. It would have been a harder call if Laurie Robinson hadn’t flipflopped on HERO, but if my conviction about this means anything, it means it in this race. In AL1, I could see the Chron supporting Lane Lewis or Jenifer Pool – as with Carroll Robinson, I think the Chron will not consider Chris Oliver’s time with HCC to be a positive – but I think McCasland’s resume will carry the day. Let’s say 60% McCasland, 30% Lewis, 10% Pool.

District seats

All district incumbents will be endorsed. This is easy, as there are no disqualifiers and outside of F and J no challengers that are likely to be considered. The cases worth examining are the open seats in G and H. G is a two-candidate race, and you can make an argument for or against either – both candidates are sufficiently qualified, and both are against HERO in a district where that would be expected. The main negative for Sandie Mullins Moger is being on the HCC board – yeah, there’s a theme here – and the main negative for Greg Travis is that he recently announced an endorsement by Helena Brown. I make it 55-45 for Travis. As for H, I can see any of Jason Cisneroz, Roland Chavez, and Karla Cisneros getting the nod. For no reason I can easily explain, I think Karla Cisneros is a slight favorite – let’s say 40-30-30. Have I mentioned that I’m guessing?

HISD and HCC

For HISD, they’ll stick with incumbents Rhonda Skillern-Jones and Juliet Stipeche, and they’ll reverse themselves from 2011 and go with Ramiro Fonseca over Manuel Rodriguez. In the open District 4 seat, I don’t seem the picking Jolanda Jones, so I’ll say they’ll endorse Ann McCoy. The only contested races in HCC involve the two incumbents running for re-election, Adriana Tamez and Eva Loredo. I’ll be surprised if they don’t endorse those two.

Referenda

Obviously, they’ll endorse HERO. I think they’ll be as “meh” on the term limits item as I am, and will either give it a lukewarm thumbs up or they’ll advocate a No. Same for the Harris County bond issue, with a slightly better chance of a Yes. I have no idea on the state constitutional amendments, if they bother with them. There were none that excited me one way or the other, though there are a few I’m likely to vote against.

So that’s how I see it. Go ahead and tell me where I’m wrong in the comments. I’ll check back in a few weeks and see how good a job I did trying to read their mind.

We enter our final week of City Council interviews with a tour of the other contested At Large Council race, in At Large #5. CM Jack Christie is in his second term, having first been elected in a close-fought race against then-CM Jolanda Jones in 2011. A chiropractor, CM Christie serves on the Budget and Fiscal Affairs and Ethics, Elections and Council Governance Committees while also serving as Vice Chair of the Transportation, Technology and Infrastructure Committee. He has also served on the Texas State Board of Education and the Spring Branch ISD Board of Trustees. Here’s the interview:

Endorsement watch: The score so far

We’ve had a slew of endorsements for municipal races this past week. I’ve been keeping track of them as best I can on my 2015 Election page. This isn’t always easy to do, because some groups are not very good at posting their endorsements anywhere. I gather, for example, that the HPFFA has made endorsements, based on these tweets, but so far no official list appears to be visible. Groups whose endorsements I have added to the page so far:

I’ve separated the traditionally Democratic/progressive groups from the rest. There are still a lot of groups out there to endorse – HOPE (they have endorsed Sylvester Turner for Mayor but I’ve not seen anything else from them as yet), SEIU, Houston Black American Democrats, Houston Association of Realtors, Houston Contractors Association, the C Club, Texas Organizing Project, and the firefighters if they ever produce a list. Things may change as more endorsements come in, but here are my initial impressions on what we’ve seen so far.

Sylvester Turner has done very well so far. I had thought some endorsing organizations might want to keep their powder dry in this crowded field, but Turner has stood out with his ability to collect support from different groups. Given all the competition for the LGBT group endorsements, snagging two of them is an accomplishment. Stephen Costello nabbed the other two, with the nod from the Stonewall Young Dems being a bit contentious. Adrian Garcia got on the scoreboard with the Tejano Dems; I’m sure that won’t be his last endorsement. Chris Bell has impeccable credentials for some of these groups, but he’s come up empty so far. You have to wonder if they’re getting a little discouraged over there, and you have to wonder if their fundraising is taking a hit. Ben Hall is getting Hotze support; I’ll be interested to see if he buys Gary Polland’s endorsement in the Texas Conservative Review. Will also be interesting to see if a more mainstream group like the C Club throws in with Hall or goes with an establishment choice like Bill King.

My initial reaction to Chris Brown’s dominance in Controller endorsements so far was surprise, but on reflection it all makes sense. He’s really the only viable Democrat running – Carroll Robinson has Hotze taint on him, and Jew Don Boney doesn’t even have a campaign website. Frazer got the Log Cabin Republicans, and I expect him to sweep up the other R-based endorsements. Keep an eye on what the realtors and contractors do in this one, if they get involved at all rather than waiting for the runoff.

Lane Lewis has crushed it so far in At Large #1, not only sweeping the Dem/progressive endorsements over three quality opponents, but also picking up support from the police, firefighters, and BOMA, who didn’t endorse in any of the other three open citywide races. He won’t win any Republican endorsements, of course – I assume new entrant Mike Knox will, if he can get his campaign organized in time to do whatever screenings are needed – but at this point I’d make him a favorite for most of what’s left. Amanda Edwards has impressed in AL4, though Laurie Robinson has split a couple of endorsements with her and will be a threat to win others. Not clear to me who will take the Republican support that’s available.

I expected more of an even fight in the two At Large races with Democratic challengers to Republican incumbents, but so far Doug Peterson and Philippe Nassif have taken them all. As I understand it, Durrel Douglas hasn’t been screening for endorsements – this can be a very time-consuming thing if you are doing a solo campaign – so Nassif has had a clear path and has taken it. As for AL3, I get the impression that Peterson is considered the more viable candidate against CM Kubosh. I though both he and John LaRue were good interview subjects, for what it’s worth. CMs Kubosh and Christie have gotten the “friendly incumbent” endorsements so far, and I expect that will continue. CM David Robinson has gotten those and the Dem/progressive nods. I’ll be interested to see if HBAD backs Andrew Burks; I expect Gary Polland to give Burks some love for being a HERO opponent, but I don’t know if groups like the C Club will join in with that. Burks is doing his usual thing campaign-wise (which is to say, not a whole lot), so anything that requires an organized response is probably beyond his grasp.

Not a whole lot of interest in the District Council and HISD/HCC races. I’m a little surprised that Karla Cisneros hasn’t picked up any endorsements in H, but there’s still time. Ramiro Fonseca has done well against Manuel Rodriguez, who is deservedly paying for the rotten things his campaign did in 2011. Jolanda Jones still has some game. Beyond that, not much to say.

So that’s where things stand now. As I said, they may look very different in a month’s time. And as with fundraising, a good showing in endorsements only means so much. Plenty of candidates who have dominated the endorsement process have fallen short at the ballot box. So consider all this as being for entertainment purposes only, and take it with a handful or two of salt.

Finance reports come trickling in

As always, the Mayoral reports lead the story.

Former Harris County Sheriff Adrian Garcia closed out the first half of the year with more than $1.3 million in the bank, eclipsing City Councilman Stephen Costello by a mere $7,423.

According to their campaign finance reports, Garcia raised $1.5 million and spent just over $122,000, while Costello raised about $30,000 less in contributions, was loaned $90,000 and spent $496,000.

State Rep. Sylvester Turner and former mayor of Kemah Bill King trailed in cash on hand, reporting $1.1 million and $544,000, respectively.

Costello’s campaign previously said his funds include a $250,000 personal contribution and a $262,000 transfer from his council account.

Among those with reports already in, King spent the most in the first half of the year, coughing up more than $680,000. He raised more than $755,000 and lent himself an additional $500,000.

Turner’s expenditures came in just under King’s, at $601,000, according to his report. However, his campaign noted that $125,000 of those expenditures were related to his state office, not his mayoral campaign.

After starting the race with about $900,000 in the bank from his legislative account, Turner raised an additional $763,000 in the nine days between when his state fundraising blackout period ended and the close of the reporting period.

See here for more. As previously noted, the reports are not in their usual place due to changes in state law and the reporting system. For now, you can see the reports that the city has posted here. I’ve linked to them on my Election 2015 page and will keep updating that as more of them appear. I’ll do a more in depth look at the reports once they’re all there, starting with the Mayorals, which were added to that page as of last night. Expect that for next week.

The Chron story has a spreadsheet embedded in it with totals for candidates who had turned in reports by publication time. Among the other Mayorals, Chris Bell had raised $381K and had $190K on hand; Ben Hall raised $94K and loaned himself $850K to have $812K on hand; and Mary McVey had raised $60K and loaned himself $1.075M to have $1.071M on hand. Forget the price of oil, this Mayoral campaign will be stimulating the local economy over the next few months.

So far, mayoral fundraising has far overshadowed that for Houston’s second-highest political post, city controller.

Deputy controller Chris Brown reported raising $270,000 and spending $22,000, leaving him with more than $222,000 in cash on hand.

Meanwhile, Bill Frazer, runner-up in the 2013 controller’s race, raised $129,000, received $32,000 in loans, spent $120,000 and closed out the first half of the year with more than $53,000 in the bank.

Former Metro board member Dwight Jefferson lagged behind with $11,000 raised $1,800 loaned and $9,000 spent. It was unclear how much cash he had on hand.

Carroll Robinson had raised $50K and had $5K on hand; Jew Don Boney did not have totals posted. Other hauls of note: Amanda Edwards dominated At Large #4 with $165K raised and $118K on hand. Laurie Robinson was the runnerup with $43K and $26K, respectively. In At Large #1, Tom McCasland ($141K raised, $98K on hand) and Lane Lewis ($104K raised, $62K on hand) were far out in front; Chris Oliver raised $37K and had $23K on hand, while Jenifer Pool had not yet reported. CM Michael Kubosh was the only one with any money in At Large #3, raising $63K and banking $44K. Philippe Nassif had a very respectable $73K raised in At Large #5, but only $12K of it remained, far less than CM Jack Christie’s $100K cash on $124K raised; Durrel Douglas had not yet reported.

For district races, CM Mike Laster had a big haul and an equally big financial lead in J, while CM Richard Nguyen had a decent total in F. His opponent, Steven Le, did not have a report up as of last night. There was surprisingly little money raised in the two-person District G race; Greg Travis led in cash on hand over Sandie Moger thanks to a $41K loan to himself. Roland Chavez had the most raised and the most on hand in H, with Karla Cisneros and Jason Cisneroz a notch back. Abel Davila raised a small amount but loaned himself $20K to be even in cash on hand with the other two.

That’s it for now. For the other races, HISD and HCC reports lag behind the city’s – HISD by a little, HCC by a lot – so I’ll keep an eye on those and update as needed. As always, fundraising is just one aspect of one’s candidacy, and is in no way predictive in many races. We only get a few chances a year to see who’s funding whom, and this is one of them. I’ll have more when I can.

Two challengers emerge in At Large #5

After Jan Clark bowed out in At Large #5, incumbent CM Jack Christie was left with no opponents after he announced his intent to run for re-election. That lasted until yesterday. Early in the morning, this email hit my inbox.

Nassif had previously been a candidate for At Large #1. He had previously criticized Lane Lewis for remaining on as HCDP Chair while running for that position. My guess is that Lewis has sucked some of the oxygen out of that race for other Democrats, as many people thought might happen, and Nassif decided to take his chances elsewhere.

And for a brief while, Nassif was the only Democrat and the only challenger in the AL5 race against CM Christie. Then later in the day, this email arrived.

I grew up in Houston’s South Park on Selinsky street. After High School I went to college online majoring in Social Science at Western Governors University and worked full time for the Texas Department of Criminal Justice as a correctional officer–eventually moving up the ranks to sergeant and lieutenant. After five years, I decided to leave the prison system and instead work to improve the communities that led so many people from neighborhoods like mine to prison. After resigning, I worked for the Harris County Democratic Party before moving to Austin to work for a Democrat in the Texas House of Representatives. After the 2011 legislative session, I eventually moved back to Houston with the goal of empowering communities here. Since then, I’ve had the pleasure of meeting amazing Houstonians while working to make our city a better place.

For the past five years, I’ve worked as a community organizer standing shoulder to shoulder with Houstonians. From the fight for the HERO (Houston Equal Rights Ordinance) to recent wins with justice reform through the grass-roots organization I co-founded, I’ve seen great things happen.

In 2011, I met Debra Walker and Betty Gregory who were among those leading fighting for IKE repair funding.

In 2012, when our city considered expanding Hobby Airport, I worked with community leaders like Pat Gonzalez to include community members in the decision making process.

In 2013, we came together at city hall to pass the #DownWithWageTheft Ordinance which ensures an honest day’s pay for an honest day’s work. We can address our city’s looming budget problems if we work with other government entities to close loopholes like this one.

In 2014, I met Houstonians like Fran Watson and Kristopher Sharp who worked together to pass the Houston Equal Rights Ordinance (HERO) protecting every Houstonian from discrimination. In 2015, we’re running for city council. Together.

Not too long ago, my opponent Jack Christie voted to give Valero a projected $17 Million tax break. CLICK HERE FOR LINK. With our crumbling roads, infrastructure and pension gaps, we don’t need elected officials who make decisions like this one. The men and women who work for the city (like my father who’s worked 29 years for the City of Houston) shouldn’t have to take a furlow day or cut in benefits at the expense of elected officials like my opponent who’d prefer to balance our budget on the backs of hard working families.

We have two choices. We can either sit back and allow others to continue making decisions on our behalf, or, we can seize this opportunity to change the way Houston does business. It doesn’t matter whether you’re black or white or Hispanic or Asian or Native American or young or old or rich or poor, able, disabled, gay or straight, transgendered or cisgendered, all of us deserve an equal seat at the table.

Let’s build a better Houston.

To say the least, the race for At Large #5 just got a lot more interesting. I know both Phillippe and Durrel – I noted that Chron story he linked above about the new generation of black leaders in Houston – and they’re both exciting candidates. Between them and Atlas Kerr in AL3, they are also among the youngest candidates we’ve seen for city office recently. If they can succeed in boosting the participation rate among younger voters this November – it wouldn’t take much to do that – they could have a big effect on the composition of the electorate, and maybe on the issues that get discussed. I look forward to seeing how they campaign.

Finally, on a tangential note, Metro Board member Dwight Jefferson announced his intention to resign from the Board and run for City Controller. Jefferson had been considering a run for some time, so this will make it official. He joins a crowded field that includes HCC Trustee Carroll Robinson, 2013 Controller candidate Bill Frazer, former Council member Jew Don Boney, and Deputy Controller Chris Brown.

Christie will not run for Mayor

Jack Christie announced this morning that he will run for a third term as the At-Large Five Member of Houston City Council.

Christie stated, “Numerous people asked me to run for Mayor, which was incredibly flattering, but after careful consideration, I have decided to run for re-election. There are several great people in the mayoral race. I encourage voters to choose a candidate who will do whatever is necessary to actually fix the many serious financial problems our city is facing. I want to be there to help the next Mayor take bold and decisive action to rescue Houston from a financial disaster”

”If the voters give me the honor of a final term, I will continue to be a fiscally responsible voice at the council table. We must cut spending. We must balance the budget. We must do more to fix the pension issue beyond a few years. Our crumbling roads are a symptom of the financial crisis we are straining under. I will work tirelessly to find real solutions for Houston.”

Jack Christie is the former Chairman of the Texas State Board of Education and is running for his third and final term on Houston City Council.

The buzz of late had been that CM Christie was going to stay put, so this does not come as a surprise. I presume at least some people were still talking about the possibility of his jumping into the Mayoral race; this announcement should end that. As of today, Christie does not have an opponent for re-election. It’s still early days, so that may change, but barring anything dramatic he’s a strong favorite to win that third term.

At Large comings and goings

Meet Atlas Kerr, who will be running in At Large #3 against CM Michael Kubosh.

I am an accounting and finance double major at the University of Houston’s Bauer College of Business. I have in-depth knowledge over capital budgeting, debt/bond valuation, and capital asset price modeling. I am a registered volunteer instructor at the Women’s Resource of Greater Houston that teaches budgeting and financial literacy classes to women, high school teenagers, and men.

I am of African-American and Hispanic decent. I am a first generation American on my mother’s side and first generation college student on my father’s. As a proud Houstonian, Texan, and American, I believe in the American dream and have made vow to fight for equality for all inhabitants of our great city and tear down barriers of race, gender, sexual orientation, and socio-economic status. Although we all come from different places and have grown up with different backgrounds, the law treats everyone as equals. This is the reason why I have so much respect for and strive to be a part of the legislative force of the municipal government.

For the entire duration of my campaign, I will be following in the footsteps of my greatest political hero Bob Lanier and run without identifying myself as either republican or democrat. Houston municipal elections are run non-partisan and I fully intend on running this way so that voters can be assured that my campaign platform are my own personal beliefs and no one else’s.

I have watched every single city council and committee meeting since 2012 and have met with many former and current city councilmembers to get the best possible picture of where the city is currently and where it has come from. I have such a great and profound respect for Houston. I want to thank my professors for being so accommodating, my friends and family for their outstanding support, and my contributors for believing in me. Without any of you, all of this would not be possible.

In prior communication with me, Kerr said that he had filed to run for Mayor in 2011 under the name Brian Carr, but he was not a resident of the city of Houston at that time, so he did not make it to the ballot. The name change was a personal decision he made.

Meanwhile, Jan Clark, who had previously announced her candidacy for At Large #5, has since announced that she will not run.

Thank you all very much for the incredible show of support. I am humbled and overwhelmed and so very grateful. However now I must tell you I am terminating the campaign. I got in committing fully, but due to recent changes in my personal obligations I cannot devote the time and effort needed to run the campaign I can be proud of, and you can be proud to support. Unless things change dramatically, very dramatically, I will not run in the 2015 election.

Yes, I considered waiting a while to terminate in case my circumstances changed again soon, but I chose to make a final decision now in part because it is still early enough that the campaign has not yet “accepted” any contributions. Contributions received have been refused/returned. Investing other people’s money believing I would end up having to make the same decision later is not something I could do. When I run, be assured I will not waste your contribution.

Please stay tuned. There are issues to talk about and many ways to serve the people of our great city. Having every reason to believe my circumstances will be in different in a year, I fully intend to run for city council in the 2017 cycle. At which time I will again ask for your support. It will be here before we know it.

Sorry to see her have to drop out, but I believe that counts as the first candidate announcement for 2017. I look forward to seeing her on the ballot then.

Two Council challengers to incumbents

So far all of the action we’ve seen for city offices has been for the open seats being vacated by term-limited incumbents. Recently I became aware of two folks who plan to run for offices that will have incumbents on the ballot as well. First up is Jan Clark, who sent me an announcement about her candidacy for At Large #5. From her Facebook page:

Jan Clark is pleased to announce her candidacy for Houston City Council At-Large Position 5. She is a proud almost-native Houstonian and unabashed Houston booster. Jan brings fourteen years of municipal law experience in addition to her more than forty years of residency in Houston.

Jan grew up in the Inwood Forest area of northwest Houston and attended public schools. Jan worked in the food and beverage industry to support herself and pay for much of her education. She earned a Bachelor of Science in Political Science from the University of Houston and a Juris Doctorate from the University of Houston Law Center. While at the Law Center, she received the Faculty’s Distinguished Service Award. In addition, she was awarded two Public Interest Fellowships.

Jan began her legal career in the City of Houston as a Municipal Prosecutor. She accepted greater challenges and responsibilities throughout her career in municipal law in a practice that encompassed aviation to zoning (in another city). Jan served as the advisor to the Mayor’s Office for Cultural Affairs for civic art, and worked with the Office of Business Opportunity on small and disadvantaged business and Hire Houston First programs. Jan was awarded the Edward A. Cazares Award for Excellence and Professionalism in Municipal Law while at the City of Houston.

After leaving the City in 2012, Jan established a successful real estate practice taking her to neighborhoods all around Houston. She has seen not only the greatness of Houston and its people but also the very real effects of the decisions made at City Hall.

“I believe knowledge and experience about city government are positive attributes needed on City Council. As a councilmember, I will focus on long-term solutions for our transportation, infrastructure and fiscal challenges. I believe we need stable, responsible structure and continuity regardless of the length of any particular mayoral administration. I pledge to use every available tool to open opportunities for more small businesses in order to grow our economy. Houston needs serious people committed to ensuring our city government works efficiently and effectively for all Houstonians.“

Campos confirms that CM Jack Christie is running for re-election here, and is busy raising money for it. I know of at least one other person who has at least thought about running in At Large #5. Jan Clark is the first person I’m aware of to make a public announcement. We’ll see if she’s the only one.

The other candidate I heard about was Matt Murphy. From his webpage:

My wife (Rachel) and I have lived in District D since we renovated and preserved one of the beautiful homes that compose the Riverside Terrace neighborhood nearly 8 years ago. In 2009, we were blessed by the birth of our only child (Shawn). Together, we have considered District D the only place we have called home as a family, and we plan to stay here forever.

District D is in the process of reinventing itself in the 21st century. This reinvention is transforming the ethnic composition of the neighborhoods. We are becoming a melting pot of races, ages, sexual orientations, and religious beliefs. Although this is a move in the right direction, this has also led to more and more tensions between neighbors because of differences. It will continue to do so without proper representation and leadership.

Through past experience and the study of expert research we can conclude that if you know your neighbors name, then you are obligated to look after them regardless if you agree on every social issue. As neighbors, we all have common ground, our community, and neighbors that know each other are catalyst for positive change that breaks down the barriers of tension and fear. With that philosophy in mind, I am also announcing the immediate launch of the “Know Your Neighbor” initiative in conjunction with my announcement to run for Houston City Council District D.

The “Know Your Neighbor” initiative will guarantee victory for our community because it brings neighbors together and will carry on far beyond any aspirations of a political candidate. CM Dwight Boykins is in his first term in District D. He upset more than a few people with his vote against the Houston Equal Rights Ordinance, though that may not hurt him in that district. I’ll be interested to see how Murphy or any other challenger campaigns in D.
