November 2020 Early Voting Day Nine: Starting to run out of clever subtitles

And now, for something slightly different, Part One:

This was hard for Jacob Monty.

As a lifelong Republican, the 52-year old Houston attorney has been in the trenches with former President George W. Bush, never voted for a Democrat for president and even was part of President Donald Trump’s National Hispanic Advisory Council.

But there he was on Wednesday at a Texas Democratic Party press conference, going public with his decision to vote for Joe Biden for president.

“This is not a decision I took lightly, I love the GOP,” said Monty who has given hundreds of thousands of dollars to GOP causes over the years.

But Monty said voting Trump out is the only way he sees to save the GOP he grew up in.

“I’ve not changed my philosophy, I’ve just determined that Donald Trump is an existential threat to America and a threat to the GOP,” he said, adding that he’s still voting Republican down the ballot.

Well, there’s one Biden/Cornyn voter, which addresses a point I’ve raised a time or two in discussing polls. We thank you for your moral decision, sir.

Slightly Different Part Two:

A “Seinfeld” reunion of sorts is in the works — to raise money for Texas Democrats as the state continues to see robust early voting turnout.

Julia Louis-Dreyfus, Jason Alexander and Larry David are slated to share behind-the-scenes stories and dish about their favorite episodes online in a “fundraiser about something” hosted by Seth Meyers.

“We knew that we had to reunite for something special and the movement on the ground for Texas Democrats up and down the ballot is the perfect opportunity to do just that,” the three stars said in a joint statement. “Texans are getting out to vote in droves and showing the world that Texas has never been a red state, it’s been a non-voting state.”

The event begins Friday, and you can find more information about it here. You can insert your own Seinfeld quote or GIF, Lord knows there’s a million of ’em. It sure is nice to be on the receiving end of some positive attention, isn’t it?

Anyway, this is the post where we talk early voting numbers, so let’s do that. The Day Nine daily EV totals are here. You can find the daily totals for 2008 and 2012 (and 2016 as well, but I’ve got a separate link for it) here, for 2016 here, and for 2018 here. I’m just going to keep on keeping on with the pretense that early voting actually began this Monday, except with 628K votes already in the bank. The “original” Day Three numbers are here.

Things continue to slow down a bit, at least as far as in person voting goes. The early voting period in 2016 was quite active, and unlike the comparison I’m doing with this year, when the universe of people who haven’t voted yet is now much smaller, there was still a lot of room to grow. It won’t surprise me if Week 1 of 2016 catches all the way up to Week 2 of 2020 by Friday or so. Nonetheless, we remain comfortably at a pace to reach 2016’s entire turnout before the end of early voting.

We are now at 88.7% of 2016’s early vote (plus mail ballot) turnout of 985,571, and at 65.3% of 2016 total turnout. We passed 2012’s early vote total (777,067) and 2008’s early vote total (746,025) on Wednesday. We could reach their final turnout totals (1,188,731 for 2008, 1,204,167 for 2012) early next week. Total early vote turnout from 2018 was 867,871, and we passed that today. (This tweet only counted ballots cast in the 2016 Presidential race; it did not include undervotes or absentee ballots, so it is not a true measure of “turnout”.) Total 2018 turnout was 1,219,871, so we could pass it along with 2008 and 2012 on the same day. With nine days to go, we will need to average 51,623 votes per day to reach 1,338,898 total votes. The mail ballots returned has already exceeded the 101,594 from 2016, and there’s 130,993 ballots still out there.

I’ve had quite a few people point out that women make up a much larger portion of the early voters than men. Through yesterday, 52.1% of voters have been women, 43.1% have been men, and 4.8% don’t have a gender listed on the Secretary of State’s list of registered voters. I think it’s worth pointing out that there are more women who are registered to vote in Texas than men. The breakdown of all registered voters is 50.9% women, 45.3% men, and 3.8% with no gender information listed.

Voters with previous Democratic Primary history (who have not voted in a previous Republican Primary) have seen their share of the vote decrease by 6.9% since my first report. Voters with previous General Election history (who have not voted in any party’s primary) have increased their share by 4.1% and voters with no General Election or Primary Election history have increased their share by 2.7%.

The report, which is through Tuesday, is here. If we really are headed towards twelve million people voting, then the share of people with no previous voting history is going to get pretty high, probably around 25%. I mean, total turnout from 2016 was under nine million, and in 2018 it was about eight and a half million, so there’s a big gap to make up. Similarly, the number of people with general election history but no primary history will also get bigger. Republicans had 2.8 million voters in their 2016 primary, and there were two million Dems in 2020. Even assuming there are some primary voters from other elections that are still around, we’re not even halfway to twelve million. The million dollar question is, who are these people voting for?

November 2020 Early Voting Day Eight: Any idea what pattern we’ll follow?

The Chron provides five takeaways from early voting so far.

Democrats appear to be doing well in Harris County, but don’t call it a wave yet. Turnout to date has been strong in precincts carried by Trump and Clinton in 2016. Why is this good news for Democrats? Because Clinton won more precincts and carried the county by 12 points.

Harris County already is a blue county, and a similar Democratic turnout this year would mean another shellacking for local Republicans.

A surge in voter registration probably helps Democrats. Harris County added more than 298,000 voters since 2016. That is more than the population of Lubbock. Democrats disproportionately benefit from this, political scientists say, because new registrants are more likely to be younger and people of color, two groups that favor that party.

Democrats have an edge among primary voters. Through the first five days of voting, 27 percent of voters had cast a ballot in this year’s Democratic primary, compared to 15 percent who had voted in the Republican primary, according to an analysis by University of Houston political scientists Brandon Rottinghaus and Jeronimo Cortina. Fifty-nine percent of voters through Saturday had not voted in the primaries. Since Texas does not have party registration, primary voting history typically is one of the best indicators to determine how a resident will vote in a general election.

The one thing no one knows is how turnout ultimately will be. Sure, Harris County smashed early voting records with an unprecedented four-day streak of more than 100,000 ballots. The pace already has slowed, however, and the big question remains: Are more people going to vote overall or are voters casting ballots early or by mail to avoid Election Day crowds?

Here’s a tweet summary, which notes that the electorate is so far much more female than male (good for Dems, since Dems do better among women in the polls) and younger voters are showing up (also good for Dems). I will note that while this week is a bit slower than last week, we almost certainly couldn’t keep up that 100K per day pace, and we’re well on our way towards exceeding 2016 turnout during the EV period. We still have ten days of early voting to go, and we really could slow down a lot, but until then what we’re doing is piling up votes, with a lot of time left to pile them even higher.

I think I’ve decided to pretend we’re at the normal Day Two and compare to previous years, just with the knowledge that 628K people have already voted. We’ll see how long this makes sense. A bit slower than Monday, but still ahead of 2016 for in person votes – which, remember, is after there had already been six full days of voting – and with a lot more mail ballots. We’re still very much on pace to equal all of 2016 in the early voting period.

We are now at 81.4% of 2016’s early vote (plus mail ballot) turnout of 985,571, and at 59.9% of 2016 total turnout. With ten days to go, we will need to average 53,709 votes per day to reach 1,338,898 total votes. The 104,826 mail ballots returned has already exceeded the 101,594 from 2016, and there’s 140,270 ballots out there.

I will leave you with this:

Through Monday, 28% of registered voters have voted early (4,708,734 voters). The more interesting thing is that the total is half the total of all votes which were cast during the 2016 General Election…and we still have another week and a half of early voting (and Election Day too).

I’m not ready to give an exact number, but we will likely surpass 12 million people voting in this election. That would be 71% turnout. In 2016, turnout was 59.4% with 8,969,226 people voting.

November 2020 Early Voting Day Seven: It’s Day One all over again, sort of

Here’s a mid-day headline that needed some revision by the evening.

Harris County is on pace to reach half of of 2016’s total voter turnout by Monday evening, the county clerk reported.

By 11 a.m. Monday, the seventh day of early voting, more than 20,000 local ballots had been cast, putting the county on pace for about 690,000 total by the time polls close for the day at 7 p.m. That would be about 51 percent of the 1.3 million county voters who cast ballots in the presidential election four years ago.

The volume of voters has declined since last week, when more than 100,000 turned out for four consecutive days. The Harris County clerk’s website showed just one of 112 polling sites, the North Channel Branch Library, with a wait time exceeding 40 minutes at noon on Monday.

Across Texas, 4.1 million residents have cast ballots, more than any other state.

For whatever the reason, Monday started kind of slow. Things picked up later in the day, and the eventual total for the day exceeded that projection. I’ll get to the overall figures in a bit, but first the preliminaries. The Day Seven daily EV totals are here. You can find the daily totals for 2008 and 2012 (and 2016 as well, but I’ve got a separate link for it) here, for 2016 here, and for 2018 here. As this is essentially Day One for the normal early voting period, I’m going to compare today’s totals with the Day One numbers from previous years. In other words, a reprise of this post, with updated mail ballot totals.

“Total” isn’t accurate for this year, but if today had been Day One, you can see that we still would have outpaced previous elections. The mail ballot certainly played a role in that, but the in person totals were a new high compared to the other years as well, even if they’re down a bit from last week. Like I said, we couldn’t keep up that pace forever. Now let’s update the numbers for 2020:

We are now at 73.0% of 2016 early turnout (including mail), and 53.8% of total 2016 turnout. At today’s pace, we’d reach 2016’s early vote turnout of 985,571 by close of business on Thursday. There were 101,594 mail ballots returned in 2016, and it seems likely at this pace we will pass that either today or tomorrow. A total of 244,359 mail ballots have been sent out, and so far 37.9% of them have been returned. My estimate remains that some 185K mail ballots will ultimately be cast, so we’re basically halfway there.

An average of 56,278 voters per day for the remaining 11 days of early voting is needed to equal final 2016 turnout of 1,338,898. That’s down from 59,182 yesterday. Oh, and we have a new number for voter registration:

If turnout as a percentage of registered voters is 61.33% as it was in 2016, then 1.52 million people will vote. If it’s 62.81% as it was in 2008, then 1.55 million will vote. Turnout of 68.62% is needed to get us to 1.7 million, as suggested by County Clerk Chris Hollins. I would not say that is out of reach.

Texas, the “We don’t want you to vote” state

And by “We” I mean “Republicans”.

In five states controlled by Republican governors and legislatures, new policies allow all voters to use COVID-19 as an excuse to mail in their ballots. In Iowa, the Republican secretary of state sent absentee ballot applications for the November election to every active, registered voter. And in Mississippi, one of the few states not offering universal absentee voting this year, Republican state leaders extended the deadline to receive mail ballots.

Republican lawmakers across the country, including those in battleground states with tight Senate races, have lifted restrictions and defied President Donald Trump’s unfounded warnings of mail-in voter fraud by expanding the practice, in an attempt to prevent the coronavirus from spreading at polling sites.

And then there is Texas, one of five states where voters cannot use fear of COVID-19 to vote by mail, one of 10 without widespread online voter registration and one of two without either option. Top Republicans, including Gov. Greg Abbott and Attorney General Ken Paxton, have made a series of moves they say are necessary to protect election integrity — but that also make it harder for Texans to cast ballots.

Democrats have condemned the actions as thinly veiled attempts at voter suppression designed to prevent them from winning control of the Texas House and delivering the state’s 38 electoral college votes to their presidential nominee, Joe Biden.

Republicans wave off those assertions, noting the expanded voting policies sought by Democrats were not implemented in prior election cycles. And they point to Abbott’s decisions to add a week of in-person early voting and let voters drop off mail ballots before Election Day — though the governor later undercut the latter move by limiting each county to one drop-off site, forcing Harris County to close 11 and prompting accusations of voter suppression from Democrats and lawsuits from civil rights groups.

“There’s no question that the intent behind these moves is to cause there to be fewer Democrats voting,” said Joseph Fishkin, an elections expert at the University of Texas School of Law. “You want to call that voter suppression, I think that’s not unreasonable.”

I’m not sure what else you’d call it if the intent is indeed to make it harder to vote, but whatever. I’ve hit on these themes before, and I’ll repeat them here, because there are two basic facts we have to keep in mind. One is that if the Republicans felt confident that they were the majority, they would not feel the need to compulsively push to restrict the vote. It’s not just the things we’ve seen this year, it’s the resistance to online voter registration, it’s everything about the voter ID law, it’s the fanatical insistence that vote fraud – exclusively by people who don’t vote for them, of course – is rampant, and so on and so forth. They fear that if it were easy and convenient to vote, they’d lose. Donald Trump says it out loud, but their actions have been saying it just as loudly for much longer.

And two, the only way out of this is through it. That means overcoming all the obstacles and winning enough elections to be able to pass laws that will reform and repeal these laws. The courts won’t save us – indeed, considering the Fifth Circuit and SCOTUS, the courts will be another obstacle to overcome. It’s not just this year – we cannot begin to make real progress until we win statewide elections, and that means making an even bigger push in 2022. It’s not just about winning the elections, too – it’s about putting pressure on the leaders we elect to enact the reforms we demand and deserve. This is a long haul, and there will be setbacks along the way. But it is the way, and there’s no going around it. Remember this, and use it to push for the changes we need.

Derek Ryan sent out an email that covered the first four days, which you can see here. For the table above, I broke out the drive-through votes from the other in person votes, because why not. And no, I didn’t know that mail ballots were delivered on Sunday, but apparently they are. Looking at the 2016 EV file, that was the same then, too. The more you know…

I’m going to throw some more numbers at you now.

– As of the end of Sunday’s early voting, 25.47% of all Harris County registered voters had turned out. There are, as noted, twelve more days of early voting to go.

– In 2016, total final turnout was 1,338,898. To equal that amount during the early voting period, an additional 710,910 people would need to vote. That’s an average of 59,182.5 per day. I don’t know that it’s necessary to get to this level by the end of early voting, but it would seem that it is well within the range of possibility. I’ll keep track of that as we go.

– In 2016, 76.4% of all mail ballots were returned. As of Sunday, 31.0% of all mail ballots had been returned. There were 123,999 mail ballots sent in 2016, and as of Sunday there had been 243,623 mail ballots sent. Mail ballots are still being sent – the original total was 238,062, and the deadline for requesting a mail ballot is October 23 (i.e., this Friday). If 76% of mail ballots are returned this year, over 185K votes will be cast by mail.

– This week is “normal” for early voting, at least as far as hours go. In Harris County, EV locations will be open 7 AM to 7 PM Monday through Saturday, then 12 PM to 7 PM on Sunday. There are extended EV hours the week after that, but we’ll discuss that later. I’m dying to see what the daily level of voting looks like this week. Have you voted yet?

November 2020 Early Voting Day Five: How not to look at the early voting totals

You can click over to see the thread, but it’s based on the share of votes that came from precincts won by Hillary Clinton in 2016 versus the share of votes that came from precincts won by Trump in 2016. As of Day Three, the same share of votes from Clinton precincts had been cast in this year’s election, which led to the conclusion that Biden was not outperforming Clinton, at least not yet.

There are several problems with this approach. First and foremost is that “precincts” is too rough a measure to use. Precincts are not uniform in size – there are precincts with upwards of four thousand voters in them, and there are precincts with fewer than one thousand, even those with fewer than one hundred. There are precincts that would have gone well over eighty percent for one candidate or the other, and precincts that were close to fifty-fifty. People move, so over the course of four years a given precinct could be quite different in composition or size. And as we have seen, some people have shifted their voting preferences – college-educated white women, in particular – so one’s vote in 2016 isn’t quite as predictive of one’s vote in 2020 as one might think.

There’s also the fact that the main Democratic strategy is just simply adding to their pile of potential voters, and then turning out as many of them as possible. I’ve said multiple times and in several contexts that there are just simply more Democrats in Harris County than there are Republicans. We saw this illustrated very starkly in 2016, when the total number of Democratic voters increased a lot more from 2012 than the number of Republicans did. See here for my explanation of that. The core of the Democratic voter registration strategy is that most of the folks who had not been voting before were people that were likely to support Democrats, and the focus has been on getting them registered check) and then turning them out. That worked quite well in 2016 and in 2018, and it’s the plan for 2020.

Well, what about the data that we have that suggests most of the voters so far are the old reliables? I will remind you, we haven’t even gotten to the starting line for what would have been the early voting period for this year, and there’s already been a ton of votes cast with that full time span to get everyone else out. There are better ways to estimate what the electorate so far looks like, I’ve talked about this before, and it’s based on using a data model on the vote roster that gives every voter a score of how likely they are to vote D or R, and then sum it all up. There’s some assumptions baked in, and the quality of the data varies a bit from cycle to cycle, mostly because underlying conditions change, but on the whole it’s a reasonable picture. One thing we know is that the first Saturday of the early voting period is a banner day for Democrats, at least in Harris County. That was even true in disaster years like 2010. This year we have two Saturdays, so maybe things will be a bit different – for sure, this Saturday will not be the high-water mark for the week, which is a change from other years – but it is a reminder that different people vote at different times.

In fact, in recent elections, it’s been Democrats who have done better on Election Day than in early voting. Here’s a comparison of the straight ticket vote for the last three high-turnout races:

“Early” combines the mail vote with the early in person vote. I skipped the third party straight-ticket vote for this comparison. Obviously, with a lot more of the vote occurring early, that part of the vote has a much greater effect on the outcome. My point is simply that in past years, the early vote was not necessarily indicative of where everything would end up. Dems in general were trailing in 2012 after early voting, and mostly caught up on Election Day. That was also true for candidates like Ann Harris Bennett in 2016, and Lina Hidalgo in 2018.

I should note that this pattern has also held true for the two most recent lower-turnout races, in 2010 and 2014, which were Republican-dominant years. Dems actually cast more straight ticket votes on Election Day in 2010 than Republicans did, though it wasn’t nearly enough to mitigate the losses they suffered. In 2014, Dems lost all three parts of the vote, but by a smaller margin on Election Day.

The one year where this pattern was broken was 2008 – Dems won the early vote, and Republicans won Election Day, though not by enough for the most part to win countywide. Now to be fair, this year resembles 2008 in a lot of ways – Democratic enthusiasm was through the roof that year, and no one was surprised to see the initial results on Election Night. It will not surprise me if Republicans do better on Election Day than they do in early voting. That doesn’t necessarily mean they’ll make up ground on Election Day – it may just mean they lose the day by less, as was the case for Dems in 2014. Remember, the thesis here is there are more Dems than Republicans. That means that if Republican turnout is pretty good so far – and it does seem to be – then it also means they’re going to run out of voters faster than the Dems. I’d submit that’s what happened in both 2016 and 2018.

All this is for Harris County. I can’t speak for other counties. In a place like Denton County, for example, where Dems made great strides in 2018 but were still outnumbered overall as of that year, it may be that the population growth there plus the level of enthusiasm on the Republican side is enough to not only hold off further Dem advances, but increase the Republican advantage. We won’t know, or at least I won’t know, until we start seeing results. The same strategy of registering more voters, on the same belief that they are on balance more Dem than Republican, holds there. How well it works remains to be seen.

Derek Ryan sent out an email that covered the first four days, which you can see here. For the table above, I broke out the drive-through votes from the other in person votes, because why not. I’ve been meaning to ask if they’re tracking dropped off mail ballots separately, I need to follow up on that. Having a Saturday be at two-thirds the level of the Thursday and Friday would be deeply weird in a different year, but this year, who can say? I have no idea what to expect this week or next weekend. Early voting hours today are 12 to 7, instead of the usual 1 to 6, so maybe we’ll get 30-35K. If that’s about right, then with some 620K early and mail votes in the hopper as of Monday, the “normal” start for early voting, we’d need to average 60K votes per day to equal the 1.34 million total turnout from 2016. We’ll see how it goes on Monday and Tuesday, but yeah, I do think that’s within reach. It would mean something like 200K (for the lower end) to 400K (for the high-end Chris Hollins-predicted 1.7 million) voters left for Election Day. Like I said, we’ll see what the next week brings. How hard it is to vote is a policy choice

Harris County tried to make it easier. The state GOP, various other Republican contingents, Greg Abbott, Ken Paxton, and others fought that choice every step of the way.

Much of the Democrats’ dream of turning Texas blue is pinned on ramping up turnout in Houston and other Texas cities where voters, many of whom are people of color, trend heavily their way.

In a bitterly contested election, overlaid with the fears and risks of an uncontrolled pandemic, Harris County has become a case study in raw politics and partisan efforts to manipulate voter turnout. Republican leaders and activists have furiously worked the levers of power, churning out lawsuits, unsubstantiated specters of voter fraud and official state orders in their bid to limit voters’ options during the pandemic.

Their power hemmed in by state officials, Houston Democrats have launched a robust effort to make voting as easy as possible, tripling the number of early and Election Day polling locations and increasing the county’s election budget from $4 million in 2016 to $33 million this fall. They reject GOP claims that making voting easier carries inherent risks of widespread voter fraud.

The battle lines were acknowledged in one of the many lawsuits Republican leaders and activists filed in the past few months attempting to rein in Harris County’s efforts to expand voting access.

“As Texas goes, so too will the rest of the country. As Harris County goes, so too will Texas,” the GOP lawsuit read. “If President Trump loses Texas, it would be difficult, if not impossible, for him to be reelected.”

Local political observers agree the writing is on the wall: Most of Houston’s residents are people of color, its local leaders are Democrats, and it is the fastest-growing county in the state, according to recent census data.

“This county looks like what Texas is going to look like in 10 years, and they know that if Harris County can become solidly entrenched in the Democratic Party, it’s just going to disperse from there,” said Melanye Price, endowed professor of political science at Prairie View A&M University and a Harris County voter. “I think in some ways they’re going to have more of an influence, and the governor knows that, and the attorney general knows that, and that is why they’ve decided to hobble them at every turn.”

It’s no coincidence, Harris County Clerk Chris Hollins said, that GOP efforts to tightly enforce Texas voting laws — among the nation’s most restrictive — target an important Democratic stronghold and one of the country’s most diverse cities.

“If you look at [election results] for Harris County, you see a very clear trend,” Hollins said. “If I were in the business of trying to suppress Democratic votes, I know where I would target.”

The piece will be largely familiar to anyone who has been following along, but go read the rest for a review. Again, I want to emphasize, Harris County – by which I mean Judge Hidalgo and Commissioners Ellis and Garcia and County Clerk Hollins – made a choice to invest the time and money to make it easier to vote. They did things that I think were revelations to all of us, who have been so used to the old ways for so long. “Wait a minute, we can have a lot more early voting locations? And more voting by mail, with options to drop off ballots instead of waiting on and worrying about the postal service (but we can also track our ballot if we do mail it), and with drive-through service? Who even knew any of this was possible?” Just spend a few minutes on Twitter or Facebook and see the many selfies and videos people have posted with their enthusiastic reaction to all this.

And then remember that every step of the way, Republicans of all stripes have tried to stop any of this from happening. From the two Republican Commissioners voting against that money that was budgeted for the election, to the Governor (who, to be fair, did extend the early voting period, and did extend the period during which mail ballots could be dropped off to all of early voting, even if he did later limit it all to one location) and the Attorney General and the Steven Hotze/Allen West minions filing lawsuit after lawsuit, every single innovation was opposed with a barrage of lies about “vote fraud” and not much else. Thanks to a batch of sympathetic Republican judges, though, they have been quite successful at it.

I’ve made this point before, but this is a long-term loser for the Republicans. People like ease and convenience. They want new ways to do things that take less time and require less effort. The Democrats, in Harris County and elsewhere, want to give it to them. The Republicans want to take it away or make sure they never get it in the first place. What side of that argument do you want to be on in the next election, or even before that in the next legislative session? Texas is a lousy state in which to vote, with obstacles everywhere you look. That’s a policy choice, enabled by the Republicans who run the state. The only way to change that is to change who runs the state. Look at Harris County’s vision for how voting could and should be, and then look at what the Republicans have done about it. What happens when the voters want something to be done about this?

All those voter registration efforts did what they set out to do

News item #1: Texas adds nearly 300,000 more voters in the last two weeks, approaches 17 million voters overall.

Still the only voter ID anyone should need

In just two weeks, Texas added more than 284,000 more voters to its rolls just before the registration deadline and now has a record-setting 16.9 million voters heading into the first day of early voting on Tuesday.

That is an increase of 1.8 million voters just since the last presidential election in 2016 — a 12-percent increase in voters.

Nowhere have the gains been greater than along Interstate 35 — a region that has become a blue spine in the heart of an otherwise red state. Of the 1.8 million voters added since 2016, half have come from the 21 counties that stretch from Laredo north into San Antonio, Austin, Waco and the Dallas-Fort Worth region.

The biggest percentage increase has been in Central Texas where Hays, Williamson and Comal counties have all seen their voter registration rolls grow by 24 percent or more. Further north, outside of Dallas, suburban Collin and Denton counties have seen voter rolls grow 19 percent and 21 percent respectively.

In Bexar County, voter registration has jumped from just over 1 million in 2016 to 1.2 million this year.

“There’s an energy out there,” former San Antonio Mayor Julián Castro said on a conference call with former Congressman Beto O’Rourke on Monday. “There’s a hunger for change.”

Just as a point of comparison, at the same 59.39% turnout level that we had in 2016, Texas will see a smidge over ten million voters. Approximately 78% of all voting age Texans are registered, which is where it was in 2016. Note that not all voting age Texans are eligible to vote – we do have a large non-citizen population, after all – so I don’t know offhand what the maximum would be. But we’re likely not that far from it.

New item #2: Record voter turnout expected, as Harris County roll grows by 234K since 2016.

Harris County has added nearly 234,000 voters to its rolls since 2016, despite adding just 143,000 residents during the same period.

As of Monday, the county had a record 2,468,559 registered voters for next month’s presidential election, according to the soon-to-be-final tally by the county voter registrar office.

The Texas Secretary of State’s Office has yet to confirm a final tally of registered voters from all 254 counties. The current count stands at 16.9 million, an increase of 12 percent, or 1.8 million, since four years ago. About 28 percent of that increase came in Harris, Bexar and Travis counties.

The growth benefits both major political parties, said Southern Methodist University political science professor Cal Jillson, but gives an edge to Democrats, who have a greater number of potential supporters who are unregistered.

Republicans draw a lot of support from Anglo voters, who already are registered and participate at high levels. African American and Latino residents, who historically have faced higher barriers to voting, could be a crucial source of new supporters for Democrats, he said.

“There’s just more room to grow the vote on the Democratic side than the Republican side,” Jillson said.

Young voters who just turned 18, especially Latinos, and naturalized citizens are two pools of voters where Democrats can make gains, University of Houston political science professor Jeronimo Cortina said.

“Democrats have a more diverse pool of people that sympathize with the Democratic Party,” Cortina said. “Part of it is, you have a tremendous pool of eligible potential voters in the state, especially in the urban areas, that four years ago was not tapped.”

Going again by 2016 turnout, which was 61.33%, would put turnout at over 1.51 million in Harris County, easily surpassing the 1.34 million we had in 2016. We would need over 68% turnout to get to 1.7 million, a number that County Clerk Chris Hollins has floated. That’s a bit high for me, but we could get close to 1.6 million if this really is a high-water year for turnout. Remember, the record number of people who voted in 2016 were a lower percentage of registered voters than in 2012 or 2008, but because there were so many more registered voters, the overall total was higher. Turnout as a percentage of registered voters was 62.81% in 2008, and at that level we’d top 1.55 million voters, for an increase of over 200K from 2016.

As we’ve seen so far, turnout numbers have been off the charts. A lot of that is from regular voters, but not all of them. There’s almost two million more voters in Texas than there were in 2016 – it won’t take much from them to have a significant effect, and that’s before we take into account the potential for higher turnout among less-frequent voters. We can’t say too much just yet, but the conditions are there to make the kind of difference Dems have been working towards.

November 2020 Early Voting Day Four: One hundred thousand is the magic number

Lather, rinse, repeat.

The county announced it had passed the 100K mark in a tweet just after 6 p.m. It was the four straight day with more than 100,000 ballots cast by county voters.

Those four days now mark the four highest single-day totals in the county’s early voting history.

Through the first four days of early voting, roughly 500,000 Harris County residents have cast their ballots at early voting locations or through the mail. That is about half the total early and absentee turnout from 2016, when some 985,000 Harris County residents voted before Election Day.

Seemed like yesterday started out slowly, with the rain in the area, but by the end of the day we had reached the same 100K benchmark as before. Saturday has always been a heavy day during early voting, but that’s been in the context of shorter first week hours and only Saturday of the EV period. I expect it will still be busy, but maybe not much different than what we’ve seen so far. But who knows?

November 2020 Early Voting Day Three: It’s still raining voters out there

People want to vote.

About 1.9 million Texans had cast ballots in-person or by mail as of Wednesday, according to state and county election data, continuing to crush state records for early voting.

The 2020 presidential election is expected to be one of the highest turnout elections in recent memory, with many ballots flooding in by mail amid the coronavirus pandemic. Texas surpassed 1.1 million ballots cast on the first day of early voting on Tuesday. Early voting will continue through Oct. 30 – six days longer than the usual two-week period because of the public health crisis.

Election Day is Tuesday, Nov. 3.

The record-breaking tallies come amid multiple legal battles to expand voter access in Texas. The state is one of just five that do not allow voters to use the fear of the coronavirus as a reason to vote by mail, but all seniors ages 65 and older are automatically eligible for it.

Honestly, I believe that all of the blatant attempts to make it harder to vote are just pissing people off at this point, and we Dems were pretty damn mad to begin with. I understand why the Republicans are doing what they’re doing, but I think it will backfire on them – I think it already is backfiring on them. The thing is, most people actually want the voting process, which includes voter registration, to be easier and more convenient, for the simple reason that it’s good for them. You can fearmonger all you want about “fraud”, but people will like the experience, in the same way that they like same-day delivery for online shopping and home delivery for takeout. Who doesn’t like that kind of thing? Whatever electoral benefits there may be for the Republicans this year, it’s very much a long-term loser to oppose this stuff, at every turn and with complete vehemence.

Anyway, people are very much still voting in force in Harris County.

Harris County is on pace to welcome another 100,000 voters to its polls Thursday, continuing its record-breaking early voting turnout.

Roughly 80,000 people had cast their ballots as of 4 p.m. Thursday, according to the Harris County Clerk’s office, a rate of about 8,800 voters per hour. If that pace holds up through 7 p.m. when the polls close, the county would process another 106,000 or so ballots Thursday.

The tally was 128,186 on Tuesday and 114,996 Wednesday. More than a quarter million Harris County residents already have cast ballots, with more than two weeks of early voting remaining.

In 2016, the county fielded roughly 884,000 early votes.

We may surpass that number by early next week. I mean, at some point we will stop seeing such high daily totals, as we will literally run out of voters eventually, but with 2,468,559 total registered voters, the well is still pretty deep.

Let’s go back to what I said earlier about ease and convenience, because Harris County, under Judge Hidalgo and with Commissioners Rodney Ellis and Adrian Garcia and of course County Clerk Chris Hollins, has done the work to make this all happen.

Yesterday I got the first Derek Ryan email breaking down the statewide vote roster so far. A taste:

Through the first two days of early voting, nearly two million people have voted by mail or in person. That is roughly 10% of all registered voters in Texas. I say roughly because so many people registered to vote during the week before the registration deadline that we don’t know what the total number of registered voters in the state is.

Of all the people who have voted through the first two days of early voting, about 90% have previously voted in a General Election in Texas. What does this tell us? There are a lot of people eager to vote, but they aren’t necessarily “new” voters.

What else does the data tell us? Democrats are energized and ready to vote (but you didn’t necessarily need me to tell you that). For example, of all voters who have voted in all four of the last four Democratic Primaries, 40.6% have already voted early. Of all voters who have voted in all four of the last four Republican Primaries, 24.6% have voted early. It is worth noting that when everything is said and done, 95%+ of both of these groups will end having voted.

When reviewing the breakdown of early voters by age, please note that ballot by mail voters are nearly all age 65 or older. Because early voting has only been taking place for a few days, senior voters who voted by mail will skew the percentages. Their share of all votes cast will likely come down as we continue through early voting.

There’s more, and you can see his nice charts for the data. It remains the case that about 30% have no previous primary history, which includes the new voters.

While we are clearly seeing a ton of energy from the old faithfuls, especially on the Dem side, there are some advantages to that. One, that energy is contagious, and when people see that their friends have voted, they’re more likely to vote. Most importantly, it means the campaigns can concentrate their energy and resources on the lower-propensity folks, since they don’t have to spend nearly as much time contacting the regulars. Believe me, every Democratic candidate and campaign manager is happy with this.

There’s also one more thing, which hadn’t occurred to me before I saw this tweet:

I mean, if you’ve already voted, then there are no adverse conditions on Election Day that can stop you – bad weather, traffic problems, illness, electric outages, bear attack, whatever. These things do happen.

One last thing, as we await a final word on drive-through voting: A lot of people have used it. 32,509 votes have been cast by drive-through voters. I don’t know what the Supreme Court is gonna do with that mandamus petition, but the potential for them to wreak havoc is non-trivial.

November 2020 Early Voting Day Two: One million votes on Day One

Pretty impressive so far.

More than a million Texans have already cast ballots after just the first day of early voting.

And the state isn’t even finished counting the first day’s numbers.

Record breaking early voting, combined with unusually high mail-in ballot returns show Texas has already surpassed 1 million votes with still three more weeks of voting come.

Harris County by far had the biggest turnout on the first day, with almost 170,000 ballots cast in-person or through mail-in voting as of Wednesday morning. In 2016, Harris County had just under 130,000 ballots submitted on the first day.

Dallas County was next with almost 60,000 in-person votes cast on the first day, with at least another 30,000 votes now in from mail-in voting.

Bexar County recorded just over 33,000 votes cast in-person on the first day of early voting and has already seen more than 45,000 mail-in ballots come in. The 78,000 votes are way ahead of the 52,000 combined mail and in-person voting during the first day of early voting in 2016.

El Paso County saw one of the biggest jumps in the state with almost 34,000 votes already in through early voting and mail-in balloting. The county reported just over 19,000 combined in 2016 on the first day of voting.

You can track early voting numbers around the state here, though please note that as of late yesterday afternoon, there were still a lot that were missing or incomplete. I’ll take more of a look at this later, when things have stabilized a bit.

If you were wondering how Day Two of 2020 could possibly compare to Day One, well, that total for all of Day Two in 2016 was exceeded by 4PM, so folks still very much have the urge. This year is the first year where Day Two was a decline from Day One, but considering that both days are higher than any previous EV day, I think we can accept it. Oh, and two days in we’re basically at ten percent turnout.

By the way, there were 114,996 in person votes and 3,012 mail votes, so we’re at 44,349 mail ballots overall. I feel confident we will easily reach 2018 mail levels, and should at least approach 2016. I can’t wait to see what the rest of the week brings for in person voting, too. Have you voted yet?

November 2020 Early Voting Day One: People sure were ready to vote

You’re going to hear the words “record-breaking” a lot.

More than 125,000 Harris County residents went to the polls Tuesday to cast ballots on the first day of early voting, smashing the county’s previous records.

As of about 7:30 p.m., the county was reporting roughly 128,000 votes with some people still casting ballots.

The polls were scheduled to close at 7 p.m., but people who were in line at that time still can vote.

The previous record for the first day of early voting was roughly 68,000 in 2016, which the county surpassed around 1:40 p.m. Tuesday.

Harris County Clerk Chris Hollins said the county also broke the record for most early votes on any day, which was set on the last day of the 2016 period.

“We’ve had a record first day of Early Voting in Harris County,” the clerk’s office said on Twitter.

Here is your Day One report. It looks funny because it doesn’t all fit on one page horizontally, and there are so many more locations than before. It’s not going to make sense to do daily comparisons with past elections, but let’s compare Day Ones just for fun:

I threw 2018 in there because it was such a high-enthusiasm election. You can find the daily totals for 2008 and 2012 (and 2016 as well, but I’ve got a separate link for it) here, for 2016 here, and for 2018 here.

I would not read anything into the smaller number of mail ballots so far, mostly because there will be another six days of their return before we’d be at the same point in the calendar as the other years. My guess is we’ll be past where 2018 was and close to 2016 if not past it by next Monday.

What does this mean for final turnout? Hard to say right now, though as noted the excitement and drive to vote is as think as rush hour traffic. The daily vote roster will give us some idea how many of these folks are the old reliables and how many are newer or less likely to participate. For sure, some of this is a shift in behavior, but we’re now already more than ten percent of the way to 1.5 million total voters, and that’s on the low end of the “turnout as a percentage of registered voters” scale. Note also that some folks prefer to wait a bit precisely because Day One is always busy. I’m probably going to vote early next week, or maybe later this week. Let’s see what the next few days look like, and remember that outside of Day One, the rest of the first week is usually the slow period.

All that fervor to vote did mean some long lines and a few glitches, but overall things went as well as you could want in Harris County.

In Harris County, which is operating 112 early voting locations, 10 of which include drive-through voting, dozens of people were waiting in line at some of the busiest sites, including NRG Arena and the Multi-Service Center on West Gray Street, by the time polls opened at 7 a.m.

It look less than seven hours for Harris County to surpass its record of 68,000 in-person votes on the first day of early voting from the 2016 presidential election.

Some sites, such as the Houston Food Bank, which is operating an early voting site for the first time, did not have any lines shortly after polls opened.

At the multi-service center, a socially distanced line formed around the block, filled by voters who had lined up well before 7 a.m.

“I’ve never seen it like this,” said Hannah McCauley, a voter who said she never misses an election. “If I have to wait, I have to wait.”

Tijuana Jones, 49, was in line an hour before the polls opened and still was facing about a 30-minute wait by 7:45 a.m.

“It is time,” Jones said. She was ready to vote against President Donald Trump, she said, no matter how long the line.

I heard on Facebook and Twitter from a lot of folks who needed more than an hour to cast their ballot. Normally that’s a bad thing, because no one should have to wait that long, but remember: This was Day One, there are 17 more days on which to vote, there will be some round-the-clock locations later in the period, and there were 112 locations, spread all around the county. I mean, if you’re going to West Gray to vote, you know what you’re in for.

This is a different matter:

In Fort Bend County, an election system glitch caused frustration and delays, apparently the result of election officials setting computers for next week instead of Tuesday, according to District Attorney Brian Middleton. As a result, the county’s election system was down countywide and hundreds of people were left waiting in line.

“It’s just inexcusable,” said Middleton, outside of the Smart Financial Centre. “Certain things just should not happen.”

Middleton said his office would investigate the incident. Fort Bend County Judge KP George also promised to take action.

“Those who are responsible, we will do something about it and make sure it won’t happen again,” George said.

State Rep. Ron Reynolds, a Missouri City Democrat who gathered with other elected officials outside the Smart Financial Centre voting location in Sugar Land, said he received complaints from residents about the voting delays.

“The computers aren’t working because the county officials that were responsible for making sure that they could vote (at) the appropriate time didn’t think enough of the voters to correctly set the machines,” said Reynolds. “I find that very irresponsible. I think that it is derelict of their duties. You could say it’s a form of voter suppression. It really disturbs me.”

Voting machines went down again at Smart Financial Centre and three other locations around 10:30 a.m. because of technical issues, according to Middleton.

However, 26 other polling locations were operating across the county.

Voting hours were extended for the rest of the first week in Fort Bend to make up for this. Juanita has some sharp words for the county’s elections administrator, who was hired by the previous administration, so we can surmise who “those who are responsible” may be.

2020 early voting starts today

As a matter of historical pattern, today is likely to be very heavy, and the two or three days before the end of early voting are also very heavy, with the last day usually swamping the rest. Keep that in mind if you want to vote in person and minimize your exposure to crowds. If you have a flexible schedule, vote in the later morning – say, between 9 and 11 – or mid-afternoon – say, between 2 and 4 – to avoid the rush hour and lunchtime folks. Look to see how busy your location is, and choose another if it looks less crowded. We can all do a little something to avoid and minimize risk.

And while the courts will likely not do anything to stop Greg Abbott’s vote-suppresing order to close mail ballot dropoff locations, you can still drop yours off at Reliant Arena, or just put it in the mail as people have always done. Just do it quickly, don’t wait on it, and track its progress. If you have requested a mail ballot and for some reason have not received it, and you cannot vote in person (I have a friend who asked about this for her son at college), by all means call the County Clerk’s office and have them check it out. They should be able to send you another one ASAP if the first one didn’t get sent or got lost.

At this point I would say if you’ve been going to the grocery store or getting takeout, you can and probably should vote in person, picking a good place and time as noted above. But do make a plan, because turnout is gonna be lit.

Harris County election officials are preparing for a record number of voters to cast their ballots before Election Day, a process that will ramp up across Texas on Tuesday as early voting begins for the November general election.

County Clerk Chris Hollins, the elections administrator for the state’s largest county, said he expects as many as 1.7 million Harris County voters to turn out, a total that would shatter the record 1.3 million votes from 2016. Political analysts and elections officials are projecting an unusually large share of the votes will come during the early voting period, which Gov. Greg Abbott extended by six days, and through the mail as voters look to avoid contracting COVID-19 at crowded Election Day polling sites.

“It’s very likely that you’re looking at close to about three-quarters of all the vote being in before Election Day, which is a dramatic turnaround from what we’ve had just a few years ago,” said Jay Aiyer, an assistant county attorney working on elections at the Harris County Attorney’s Office. “It’s better to think of the election process as less about Election Day and Nov. 3 and really more about ‘election weeks.’”

I should note that 74% of the vote in 2016 was early or by mail, and 71% was early or by mail in 2018. So this is in line with recent elections, though with likely much higher numbers this time around.

Hollins had mailed out 235,000 ballots by this past weekend, his office announced, more than doubling the total from 2016. He had anticipated sending out roughly 10 times that amount to all 2.4 million registered voters in Harris County, but Texas Attorney General Ken Paxton stopped the effort through a legal challenge.

The clerk’s office had received 22,000 completed mail ballots by the weekend, while another 13,250 voters had dropped off their ballots in person at NRG Arena through Friday.

Driving part of the expected turnout increase is the steady growth of Harris County’s voter rolls. The county has added nearly 234,000 registered voters since 2016, far more than the 143,000 new residents added during the same span.

Military ballots

When we talk about the deadline to print and send out mail ballots, we are specifically talking about ballots sent to active duty military personnel, which by federal law are to be sent out 45 days before Election Day to facilitate them being returned in a timely fashion.

The very people risking their lives to defend the nation are among those most likely to have their ballots left uncounted in the presidential election in November.

When nearly 1 million absentee ballots are sent to military and overseas Americans worldwide by Saturday — kicking off voting for the 2020 election — history shows many will never be returned in time, and a greater percentage will be rejected compared to the rest of the population.

“There’s just a high percentage of ballots that just don’t make it back in time,” said Texas State University’s Don Inbody, an expert on the history of military voting and author of The Soldier Vote. “They’re active duty military. They’re usually pretty busy so they are not going to be quite as efficient as you’d like them to be in getting their ballots back.”

That looms particularly large this year, as polls show military voters are more divided than ever on the presidential election and that they could have an impact on close races in states such as Texas, North Carolina and Florida.

Federal data shows that members of the military are less likely to vote than the civilian population. In 2018, only 26 percent of military members voted compared to 52 percent of the rest of the population. In that election, nearly half of all ballots sent out to military and overseas voters who requested them were never returned. And of those that were returned, nearly 6 percent were rejected by elections officials for various reasons according to a report from the U.S. Election Assistance Commission.

Nationwide, about 1 percent of absentee ballots are rejected among the civilian population.

The biggest reasons for ballots being tossed out include them not being returned in time, problems with the voter’s signature and missing postmarks.

During the last presidential election in 2016, Texas elections officials sent out almost 30,000 ballots to uniformed military and their dependents stationed around the nation and worldwide. But just 60 percent were returned, one of the worst rates in the nation. Nationwide military voters returned ballots nearly 70 percent of the time in that presidential election, according to the Election Assistance Commission.

Something I learned when I looked at the vote rosters from the primary runoffs is that military and overseas ballots are coded differently in that file than “regular” mail ballots are. By law, these ballots are counted if they are received up to five days after Election Day, as long as they were mailed by Election Day. That’s only true for military and overseas ballots. For the primary runoffs in Harris County, the number of these ballots was quite small, like 20 or so; I’d have to go back and look again to get an exact number, but it was in that neighborhood. Each ballot matters and we should make every reasonable effort to ensure that these ballots are received and returned and counted, but if the result in Texas comes down to these ballots then the race was super close to begin with.

The swan song for eSlate machines

We’re still using them for this election, as clunky and outdated as they are, but they’re on the way out.

Harris County may shatter turnout records with as many as 1.5 million voters in this year’s presidential election, the county clerk estimates.

It also has achieved a less desirable position, however — the county will be the largest jurisdiction in the United States that cannot audit its election results because it uses a voting system that does not produce a paper record.

Of all the paperless votes in the country, about 1 in 5 will be cast here, according to an analysis by the New York University Law School-based Brennan Center for Justice.

“If there’s some reason to cast doubt on the election outcome, there’s nothing independent of the software to turn back to with a paperless system,” said Lawrence Norden, director of the center’s election reform program. “All you can likely do is re-run the results and have the software come up with the same results as the previous time. I don’t think that’s great for voter confidence.”

Despite warnings from election security experts and an acknowledgment by past Republican and Democratic county clerks that new machines were needed, Harris County failed to follow the state’s other urban counties in doing so before 2020. Texas is one of 14 states that still permits paperless voting systems.

The county since 2002 has used the Hart InterCivic eSlate machine, remembered by many voters by its spinning wheel interface. It records votes on a mobile memory card which then is brought to a central counting site, uploaded onto a computer and tallied.

Fort Bend County Elections Administrator John Oldham said he decided to make the switch after the Legislature in 2019 nearly passed a ban on paperless machines. Plus, his 13-year-old machines had begun to fail.

“They were having issues with the capacitors on the motherboard burning up,” Oldham said. “The last couple years, we were getting 15 to 20 of these things happening every election.”

Harris County failed to move as quickly, however. Both 2018 candidates for county clerk, Republican Stan Stanart and Democrat Diane Trautman, pledged to replace the aging eSlates.

“We must replace the current electronic machines with a machine that produces a verifiable paper trail,” Trautman said a few days after she won the election.

She initially had hoped to acquire the new machines in time for the 2020 presidential election — Houston even hosted a voting machine trade show this past July — but within months of taking office concluded the timeline was not feasible.

The county last December began soliciting vendor proposals, aiming to debut new machines in the May 2021 elections.

Launching a new voting system in a low-turnout election is wise because it allows county clerks to resolve inevitable problems with a wider margin for error, said Rice University professor of computer science Dan Wallach.

“Otherwise, you’re just inviting new system jitters making a mess when you really, really want smooth sailing,” Wallach said in an email.

At least we know what we’re getting with them. While it’s true that the 2018 candidates for County Clerk made promises that have not yet been fulfilled to replace the eSlates, Stan Stanart was first elected Clerk in 2010, so he could have moved sooner than that. Be that as it may, we’ll get new machines for next year. Expect there to be some serious activity in this department when the new elections administrator comes on board.

Trib overview of the Senate race

It really comes down to the top of the ticket. There’s no getting around it.

MJ Hegar

Even before a pandemic struck, protests over racial justice took to the streets and a vacancy opened on the U.S. Supreme Court, this year’s U.S. Senate race was poised to be different from the last one in Texas.

John Cornyn is not as polarizing as Ted Cruz, the thinking went, and MJ Hegar is no Beto O’Rourke.

Add in a wave of news and other high-profile 2020 contests, and Texas voters are getting a much lower-octane race, a far cry from Cruz’s battle royale against O’Rourke and all its theatrics.

But that does not mean this year’s race is lacking in contrast.

As he embarks on the final several weeks of his quest for a fourth term, Cornyn is pitching himself as a “steady hand on the wheel” who has the stature to guide Texas through a turbulent time. Hegar, meanwhile, is happily running to the contrary — as a disruptive change agent who can usher in a new era of federal representation for a changing Texas.

While Hegar’s pitch is broadly similar to what O’Rourke’s was, Cornyn is taking a notably different path than Cruz, a student of base-first politics who believed what he needed most in 2018 was maximum conservative turnout. Instead, Cornyn is running for reelection with more appeals to the political center, often inviting questions — most vocally from Hegar — about whether his rhetoric matches his record.

But in any case, it is a dynamic destined to shape the final several weeks of the top statewide race after the presidential contest.

At the end of the day, Cornyn’s fate may be tied to Trump more than anyone else come November. Asked about his biggest challenge this November, Cornyn brought up the massive turnout that is expected, largely driven by the polarizing president, and how different it will be from when he was last on the ballot. A total of 4.6 million people participated in the 2014 Senate election, and Cornyn said he likely will have to garner more votes than that alone this fall to win a fourth term.

With Trump dominating the political landscape across the country, Cornyn said he does not “just want to kind of surf the waves of national news cycles” and wants to make a case for himself independent of Trump. The president gave Cornyn an early reelection endorsement, helping to ensure a noncompetitive primary.

Cornyn occasionally offers gentle dissent with the president but has not emphatically broken with him on any major issue in recent memory. When it comes to the November election, he said he would like Trump to talk more about his accomplishments, namely on the economy — and that he has expressed as much to the president.

“To me the real question in this election is: Who do you think is best suited to help rebuild our economy in the wake of the pandemic?” Cornyn said. “Is it Joe Biden and Kamala Harris? Or is it Donald Trump and Mike Pence? And for me, it’s not even close.”

Beyond policy, though, Hegar has sought to make the race almost as much about character, pitching herself as a stronger avatar of Texas toughness.

In ads, Hegar talks up her military heroism and rides her motorcycle, and on the stump, she has denounced Cornyn as a “spineless, pantywaist, bootlicking ass-kisser.” She defended the approach in the interview, saying it is “important people understand his level of cowardice because I’ve been to D.C.” — to lobby for women in combat — and she has seen firsthand what it takes to overcome adversity there.

I agree with John Cornyn, it will take more than 4.6 million votes to win in November. That’s actually not saying much – even Wayne Christian topped 4.6 million in 2016, with the statewide judicial candidates all exceeding 4.7 million and in some cases 4.8 million. Five million seems like the bare minimum to win, and let’s be honest, that is a bigger leap for Dems to make, since Beto was the first Dem ever to top four million. To that extent, the Presidential race almost certainly helps Dems like Hegar more than it does Republicans like Cornyn. It’s still a big gap to close. The capacity is there, and Dems took a huge leap forward in 2018, but let’s keep the magnitude of the task in mind.

How much this race will be distinguished from the Presidential race is unclear. This is literally the first race on the ballot after the Presidential race, so any concerns about the lack of straight ticket voting should be minimal. I’ve seen maybe one ad for each candidate so far – Lacey Hull and Lizzie Fletcher, neither of whom are on my ballot, have been a much more frequent presence on my teevee. The Beto/Cruz race in 2018 was the top of that ticket, both literally and practically, since the Governor’s race was a much quieter affair. Some people may decide to vote in this race, in particular to split a ticket in this race, based on the campaigns, but my guess is that will be minimal. If Joe Biden wins Texas, MJ Hegar has an excellent chance of beating John Cornyn; if Donald Trump wins Texas, Cornyn will almost certainly get re-elected. I think a Biden/Cornyn combination is slightly more likely than a Trump/Hegar parlay, but how probable either scenario is I have no idea. The main message here is what it’s always been: Vote. Make sure everyone you know votes. It’s as simple as that.

NYT/Siena: Trump 46, Biden 43

The second of two polls from yesterday, both of which are interesting in their own way. The NYT story about the poll, which included results from Iowa (Biden leading by3) and Georgia (tied), is behind their firewall, so I’ll give you a tweet summary and then dive into the data, which is available to me. First, the tweet:

The data for all three polls is here, and you can find the Texas results beginning on page 23. I will present the highlights here.

– The first question is about how likely you are to vote. The five responses (not counting Don’t Know/Refused) are Almost Certain, Very Likely, Somewhat Likely, Not Very Likely, and Not Likely At All. Putting aside what distinguishes those labels, every subgroup – including 18 to 29 year olds, Latinos, and any other group you might consider to be lower propensity – was over 90% for Almost Certain plus Very Likely. Democrats were 65% Almost Certain and 32% Very Likely, with Republicans 62% Almost Certain and 34% Very Likely, and Independents 61% Almost Certain and 30% Very Likely. At 91% for the sum of those two categories, Indies were the “least” likely to vote.

– The second question was about how you will vote: In person on Election Day, In person before Election Day (i.e., early in person), and vote by mail. Fifteen percent of voters overall said vote by mail, which is a lot more than what we’re used to, but shouldn’t be a total that will overwhelm local election administrators. For example, in Harris County in 2016, 7.3% of all ballots were mail ballots, so this would be double that as a percentage, slightly more in real terms since there will likely be more total votes. Putting it another way, there were 101K mail ballots in Harris County in 2016, for turnout of just under 1.4 million. If we have 1.5 million votes, and 15% are mail ballots (the “Houston” region subgroup had 14% saying they would vote by mail), that’s 225K mail ballots. I don’t believe that will cause any major problems in processing.

(The Quinnipiac poll had 13% of respondents say they would vote by mail. That poll is a bit goofy as we’ve discussed, but these two numbers largely agree with each other.)

– The two subgroups that say they will vote by mail the most were those 65 and older (33%, and no surprise) and the 18 to 29 year olds (19%), which I’m going to guess will be a slight overestimation in the end. Democrats (16%) planned to vote by mail more than Republicans (12%), but not by much. However, Dems will be voting early overall more than Republicans – 57% early in person plus 16% by mail for Dems, to 51% early in person and 12% by mail for Republicans. If this is accurate, we could have a bit of a “red shift” on Election Day, which is very much what happened in Harris County in 2008 – Dems voted so heavily during the early period that there just weren’t as many left to vote on Election Day. Something to keep an eye on, especially if various Dem hopefuls have an early lead.

– The list of candidates included the Libertarian and Green nominees in the Presidential race, each of which drew one percent, but just the Libertarian in the Senate race; he took four percent. Both questions allowed the respondent to volunteer that they were voting for someone else, but in each case the number for that was zero percent; a couple of subgroups in each reached one percent for Someone Else. In 2016, the “other” candidates received a collective 4.52% of the vote in the Presidential race.

– Biden carried Democrats 91-2, while Trump won Republicans 93-5. Six percent of Democrats said “Don’t know”, with one percent each specifying the Libertarian or Someone Else. Only two percent of Republicans said they didn’t know, and none gave any other answer. Black respondents were at 20% for Don’t Know, and Latinos were at 8; given that Black respondents went for Biden 71-7 and Latinos went for him 57-32, it seems likely that Biden’s overall totals are a bit lower than they will be in the end. Biden also carried indies by a 41-37 margin.

– There were five regions given as subgroups: Austin/San Antonio/South (presumably South Texas), Dallas/Fort Worth, Houston, Minor, and Rural. No, I don’t know what “Minor” means or how it is distinguished from Rural, nor do I know what specific counties are in the first three groups. Here’s how this shook out:

Seems clear where most of the Black and Latino vote is coming from, not that this is a surprise. Given that, these numbers would seem to portend very well for the various legislative and Congressional Democrats in those regions. I wish I knew more about this so I could try to do some kind of comparisons, but I don’t. Sorry.

– The Hegar/Cornyn numbers largely recapitulate the Biden/Trump numbers, with Hegar having slightly softer numbers among Dems and groups that tend to vote Dem than Biden does. She’s 81-6 among Dems (Cornyn is at 84-6 among Republicans), with 2% for others an 11% Don’t Know. Black voters go for her 66-9, but the Libertarian candidate gets six percent with another 18% on Don’t Know. Latino voters are 52-32 for Hegar, with 13% Don’t Know. As I’ve said multiple times, I think this race will closely mirror the Presidential race.

That largely covers it, and for more you can read Nate Cohn’s Twitter thread, in which he adds some thoughts. In particular, talking about the likely voter model, “Texas is a state where turnout is particularly uncertain and the upside is likely on the side of Mr. Biden”.

Let’s not overstate the no-straight-ticket effect

With all due respect, this is some ado about not very much.

With straight-ticket voting no longer an option in 2020, the Harris County Clerk estimates the average resident will spend a significantly longer time in the voting booth this fall, which could cause long lines at polling sites in the state’s most populous county.

In an effort to avoid voting delays, Harris County Clerk Christopher Hollins has nearly tripled the number of early voting sites to 120 and increased Election Day polling places by 8 percent, to 808. The $27.2 million plan, the most expensive election in county history, also includes extended voting hours and drive-through balloting.

Gov. Greg Abbott also has added an extra week of early voting.

With a projected record turnout of as many as 1.7 million voters, the clerk’s office hopes residents vote early or by mail, if eligible, said Benjamin Chou, Hollins’ director of innovation.

“No matter how much we do, I think at the end of the day there will be lines,” Chou said. “It’s just a matter of will we avoid a nightmare scenario by doing as much as we can, by stretching the limits of what we thought was possible even just a few months ago.”

The Legislature abolished straight-ticket voting, effective in 2020, in an effort to ensure residents make informed choices about candidates.

The elimination of that method, combined with a ballot with more than 80 races and limited access to mail ballots have made this year particularly difficult for elections administrators. A stopwatch test by Hollins’ office calculated that a straight-ticket ballot takes two minutes to cast, while selecting a candidate for each individual race in November would take 15 minutes.

Using those estimates and turnout data from 2018, when 76 percent of voters selected a straight ticket, a Houston Chronicle analysis found county voters would spend a combined 187,000 more hours in the voting booth if forced to vote each race individually.

A more likely outcome is that some voters, late for work or family obligations or simply overwhelmed by the length of the ballot, make choices in only the top races, said University of Houston political science Professor Elizabeth Simas.

“The fear would be they go to vote for president, maybe vote for senator, and then they walk out,” Simas said. “And we’re not going to get a large number of votes cast for the races that are much lower down the ballot.”

I will stipulate that going from clicking one button and being done to having to click a button fifty-something times will make your stay in the booth that much longer. (I have no idea where that “ballot with more than 80 races” item comes from. I just checked my own sample ballot, and I counted 54 total races, and that includes a handful of races with just an unopposed Democrat. The non-Presidential ballot is longer, as there are more statewide contests and more local judicial races, but we’re not in 2022 just yet.) There’s no question that it will take voters longer to vote the whole ballot, and if you are the kind of voter who deliberates over every race and carefully chooses a candidate in each, then yes, you could be there for 15 minutes or so.

But here’s the thing: That kind of voter wasn’t the person who had been clicking the straight-party button before now. And I can tell you, from my own personal experience, if your intent is to mostly or entirely vote for just the candidates of your preferred party, then it doesn’t actually take all that long to complete the ballot. I feel pretty confident saying I’ve been in and out of there in five minutes or less.

I don’t want to minimize the problem. It is going to take longer for many people to vote this year. There will very likely be some lines as a result. It’s clear that part if not all of the reason for eliminating straight ticket voting was the belief by Republicans that making it take longer to vote would benefit them. There have been so many stories this cycle in which a Republican candidate or consultant refers to this, as if it’s a key part of their strategy to win in an electorate that does not favor them. Putting aside the fact that I don’t believe “ballot fatigue” is a thing that significantly favors Republicans, I just don’t think the time factor will be that big, either. We have plenty of voting locations, we have six extra days plus a whole lot of hours to vote, and we have a lot more people voting by mail this year. I appreciate that Chris Hollins is thinking about this, but it is not something that will keep me awake at night.

That’s our current total of registered voters in Texas.

Still the only voter ID anyone should need

Texas has once again shattered vote registration records, adding more than 1.5 million voters since the last presidential election.

Texas now surpassed 16.6 million voters, according to the latest numbers announced Tuesday by Texas Secretary of State Ruth R. Hughs. And there are still almost two more weeks to add more.

“Ahead of the November election, I encourage all eligible Texans who have not already done so to register to vote by October 5th so that they can help shape the future of the Lone Star State,” Hughs said.

In the four previous presidential election cycles, Texas added about 700,000 new voters on average — less than half as many as have been added this cycle.

That fast growth in voters adds another wrinkle to Texas politics that have already been shifted by the pandemic. Campaigns don’t know how those voters are going to break or even if they are going to show up to vote at all, said Brandon Rottinghaus, a University of Houston political science professor.

“It brings a lot of uncertainty,” Rottinghaus said.

That includes guessing whether they’ll show up by Election Day. It’s much harder to mobilize first-time voters and get them to the polls, Rottinghaus said.

As noted, we had 16.4 million as of the July runoff. According to the sidebar on the story, there were 13.6 million RVs in 2012, so we’re up three million from then. All things considered, that’s pretty darn good, and we sill have two more weeks to bump that number up even more. My stupid simple projection of the 2020 vote had us topping 9.7 million ballots cast if we match the 59.8% turnout rate of 2016. With the revised RV figure, we’re over 9.9 million. It would take a turnout rate of almost 60.2% to get to ten million, which I think is well within reach. The winner in Texas will need to get five million votes, at least. That’s a big step up from the four million Beto got in 2018, but it’s well within reach. Reform Austin has more.

Don’t expect any surprises in the judicial races

There’s a simple reason why the Democratic candidates and incumbents are expected to win all the judicial races in Harris County, as they did in 2016 and 2018. I’ll tell you why in a minute, but see if you can guess the reason for yourself.

Harris County judicial candidates from both parties traditionally have had little control over their electoral fates, with outcomes at the top of the ballot largely dictating results at the bottom in recent years. A single party has won every county-level judicial race in four of the last six election cycles, and from 2008 to 2016, more than half the judges from the party that carried Harris County finished within one percentage point of their fellow candidates that year, according to analysis from Rice University political science Professor Mark Jones.

After Democrats Hillary Clinton and Beto O’Rourke won Harris County by 12 and 17 percentage points in 2016 and 2018, respectively, Republicans acknowledge they face long odds of winning the countywide vote this year. Party officials and judicial candidates are encouraged, though, that Texas no longer allows voters to cast their ballots for every candidate from one party by pressing a single button, a process called straight-ticket voting the Texas Legislature eliminated.

“A lot of people do not know the judicial races,” said Kevin Fulton, vice chair of the Harris County Republican Party and the head of the party’s coordinated campaign for its judicial candidates. “Harris County has one of the longest ballots in the country. Most people do not know the difference between their county court and district court judges, and so they were just going in and checking the top of the ballot for ‘straight Democrat’ and not knowing the impact they were having on the bottom of the ballot.”

The absence of straight-ticket voting, Fulton said, gives Republican judicial candidates more influence over the outcome and leads to more people voting for “a judge that they actually know or a philosophy they actually believe in.”

Jones offered a different outlook.

“Barring one of the two dozen Democratic candidates committing a felony between now and Nov. 3, no Republican has any hope whatsoever of winning one of those races,” he said. “Even if they committed a felony, I’d be skeptical that they would lose.”

I’ve had plenty to say about straight-ticket voting, and I’m not going to repeat myself again. The willingness to believe that Democrats will somehow forget to vote in many, many more races than Republicans is adorable, not backed up by any evidence that I have been able to find, and will hopefully die a deserved death after this election.

As for the reason why Professor Jones is right about the judicial elections in Harris County? You may want to sit down for this, but the answer is because there are more Democrats in Harris County than there are Republicans. Shocking, I know. But how do I know? Let’s use my favorite metric, which happens to be judicial races themselves, to demonstrate. Here are the high and low vote totals for each party’s candidates in a District Court, County Court, or Court of Appeals (i.e., First or 14th) race over the past four Presidential years:

However you want to look at this, the size of the Republican electorate didn’t budge much from 2004 to 2012, and grew by less than 100K voters total over that 12-year span. For Democrats, the growth was over 200K voters. Pretty simple, no? Part of the problem for the Republicans is that Harris County’s voter rolls really started to grow after 2012, and that increase in the voter population was fueled by people who mostly vote Democratic. That trend isn’t reversing, it’s not even slowing down just yet. We’re probably going to get well over 1.4 million votes cast in Harris County this year – remember, County Clerk Chris Hollins thinks we can hit 1.7 million – which means it’s going to take over 700K votes to win a countywide race. Which party’s candidates do you think is better positioned to do that? That’s pretty much all you need to know.

Recruiting poll workers

One good thing Facebook has ever done.

Facebook has set out to recruit poll workers, providing free ads for state election officials to help fill jobs at voting centers in a very unusual election year.

“With the election less than three months away, we’re seeing a massive shortage of poll workers to staff our voting booths across the country because we are in a global pandemic,” said Facebook spokesman Robert Traynham.

The California tech giant has partnered with the nonpartisan Fair Election Center to share data about where to apply to be a poll worker based on a user’s location. Notifications posted in Saturday’s newsfeeds for all U.S. based Facebook users over 18 directing those who clicked to information about jobs with their state’s election offices.

The local effort to fill 11,000 such vacancies is going well, according to Harris County Clerk Chris Hollins. He said he does not foresee a shortage, it’s just a matter of screening the flood of applicants, many of whom have worked the polls before.

“We have been very pleasantly surprised at the enthusiasm for people to be election workers,” Hollins said. “We first put out the call a month and a half ago the immediate response to that was 500 to 700 applications a day.”

The office has had 9,000 applicants to date. The pay begins at $17 per hour and Hollins is hiring for multiple shifts and seven days a week during three weeks of early voting. To qualify, applicants must be 18 or older and registered to vote in Harris County, and may not be a relative or employee of a candidate or have a prior conviction for election fraud.

“People are just excited and more politically engaged than ever and want to be a part of the history that’s going to be made this year,” Hollins said. “During the time of COVID-19 and time of George Floyd and Breonna Taylor and the (Nicolas) Chavez news…I think people want to be a part of the change that they want to see in society and doing your civic duty and being a part of elections.”

For those of you in Harris County, go here to apply to be a poll worker. I’ve pointed this out to Olivia, the 16-year-old, and she was interested, but like her old man she’s kind of a procrastinator, so I will need to give her a nudge. If you’re in some other county, by all means check with your local election administrator. We all need to show up this year.

You may wonder, why does Harris County need this many poll workers? Here’s one reason:

Just behold all of the early voting locations here. The ones with the little car icon next to them (like Fallbrook Church, the first one listed on page 2), have curbside voting. Early voting in person starts October 13 – mail ballots will be sent out beginning later this week – so make your plan, and find a way to help someone else vote, too.

They just don’t want you to vote by mail

It’s okay if you’re a Republican, of course.

As states across the country scramble to make voting safer in a pandemic, Texas is in the small minority of those requiring voters who want to cast their ballots by mail to present an excuse beyond the risk of contracting the coronavirus at polling places. But the ongoing attempts by the White House to sow doubt over the reliability of voting by mail has left Texas voters in a blur of cognitive dissonance. Local officials are being reprimanded by the state’s Republican leadership for attempting to proactively send applications for mail-in ballots, while the people doing the scolding are still urging their voters to fill them out.

What was once a lightly used and largely uncontroversial voting option in Texas — one even Republicans relied on — is now the crux of the latest fight over who gets to vote and, equally as crucial in a pandemic, who has access to safe voting.

“Ensuring vulnerable populations can vote by mail during a pandemic is designed to protect human life & access to the vote,” Harris County Judge Lina Hidalgo said on Twitter this week after the county’s mailing plan was temporarily blocked by the Texas Supreme Court. “Those who stand in the way—using voter suppression as an electoral strategy—are throwing a wrench in democracy. We’ll keep fighting.”

Lt. Gov. Dan Patrick characterized efforts to expand mail-in voting during the pandemic as a “scam by Democrats” that would lead to “the end of America.” In a rolling series of tweets, President Donald Trump has pushed concerns of widespread fraud — which are unsubstantiated — in mail-in ballots. Texas Attorney General Ken Paxton quoted a local prosecutor saying voting by mail “invites fraud.”

Meanwhile, the Texas GOP sent out applications with mailers urging voters to make a plan to request their mail-in ballots. Fighting in court against Harris County’s plan, Paxton’s office argued “voting by mail is a cumbersome process with many steps to limit fraud.”

Luke Twombly, a spokesperson for the Texas GOP, confirmed the party had sent out ballot applications “like we do every year” to older voters and voters with disabilities that would allow them to qualify. Twombly did not respond to a follow up question on how the party determined voters who would be eligible based on a disability, nor did he respond to questions asking for specifics on the party’s get-out-the-vote efforts tied to voting by mail.

“The cynical explanation is that the intent here is to make it as easy as possible for Republicans to vote by mail but discouraging others and casting doubt over the process following the lead of the president,” said Rick Hasen, an elections lawyer and professor at the University of California-Irvine. “I think that’s a real fine needle to thread.”

It might be in the GOP’s best interest to “encourage voters to vote safely” by mail, particularly as the state’s vote-by-mail rules allow many of their base voters to be automatically eligible for an absentee ballot, but the president is complicating matters for them, Hasen said

“They are caught between a rock and a hard place,” Hasen said.

Some Texas Republicans quietly express frustration that party leaders are casting doubt on a system that they have worked for years to cultivate. West and other prominent Texas Republicans have floated unsubstantiated concerns that increased mail-in voting creates opportunities for widespread voter fraud. In interviews with multiple Republican operatives and attorneys who have worked on campaigns in the state, all suggested privately that the modernized system precludes such a scenario. None of these Republicans would go on the record, for fear of alienating colleagues.

There are some documented cases of fraud in mail-in voting in Texas. But like voter fraud overall, it remains rare.

“This issue … of fraud and voting fraud and all that was brought up years ago, 19 years ago when I was secretary of state,” said U.S. Rep. Henry Cuellar, a Laredo Democrat who was appointed Texas secretary of state by former Gov. George W. Bush, a Republican. “I looked at it as secretary of state, and it was so rare, so rare.”

In an effort to combat confusion among voters, Harris County said it intended to send the applications for mail-in ballots with “detailed guidance to inform voters that they may not qualify to vote by mail and to describe who does qualify based on the recent Texas Supreme Court decision.” In its mailers, the Texas GOP instructs voters to “take immediate action” by confirming they meet the eligibility requirements and filling out an application proactively sent out by the party.

[Derek] Ryan, the Republican voter data expert, suggested that a past Republican campaign emphasis on vote-by-mail lends credibility to the objections Republicans are raising in Harris County.

“Voting by mail is our bread and butter,” said Ryan, the Republican voter data expert. “I kind of dismiss that more ballot by mail votes automatically favor the Democrats over the Republicans. That might not necessarily be the case. I think that kind of says the Republicans who are opposed to it aren’t necessarily doing it because they think it benefits the Democrats. They’re doing it because of election integrity.”

But in light of those objections, the Texas Democratic Party painted the GOP’s mailings to voters who did not request them as “a shocking display of hypocrisy.”

“It seems if Republicans had their way, the only requirement for Texans to cast a mail-in ballot would be ‘are you voting for Donald Trump?’,” Abhi Rahman, the party’s communications director, said in a statement this week.

I don’t know that I have anything to say here that I haven’t said multiple times already. There’s no valid principle behind the Republicans’ zealous objections to vote by mail, which is something they have used and still use but apparently cannot believe that anyone else would dare use against them. The screeching claims of fraud are just the usual shibboleth, packaged for today’s needs. We know that national Republicans have largely given up on their ability to win a majority of the vote. It’s just kind of morbidly fascinating to see Republicans in Texas adopt the same stance. Who knew they had so little faith in themselves?

Turning out more Asian-American voters

Keep an eye on this.

A national progressive group focused on getting Asian Americans to vote says it is going “all in” on Texas, looking to spend $1 million in the state where Asian Americans are the fastest growing segment of the population.

It’s the first time that AAPI Victory Fund, a super PAC focused on mobilizing Asian American and Pacific Islanders, has focused its efforts on Texas, which the group believes Democrats can win if they are able to get enough Asian Americans to vote.

“We’ve just decided to go all in on Texas,” said Varun Nikore, the group’s executive director.

Much of the spending will likely be directed at the Texas suburbs, where growth in the Asian American population is especially prevalent — a development that Democrats see as providing a path to victory in November. Nikore said that a string of recent polls showing President Donald Trump and former Vice President Joe Biden neck and neck in Texas convinced the PAC it needs to start investing there.

“Texas is emerging as the battleground right underneath everyone’s noses,” Nikore said. “From a funder perspective, everyone thought this was a pipe dream but … at some point somebody’s got to say there’s something tangible going on here that we can’t completely ignore.”

The number of eligible Asian American voters in Texas grew by nearly 50 percent from 2012 to 2018, far outpacing the statewide voting population growth of 12 percent during that time, according to AAPI Data, a nonpartisan group that tracks demographic trends. Asian Americans now make up 5.5 percent of the state’s electorate, according to AAPI Data.

There was a Chron story from May on this topic as well, if you missed it. I noted that the selection of Kamala Harris as Joe Biden’s running mate has had the effect of firing up Asian-American voters, which makes an effort like this all the more worthwhile. Asian-American voters have been reliably Democratic in recent years, but as is often the case with a community that contains a lot of immigrants they do not turn out at high levels. They’re also a very heterogeneous community, and require a more nuanced and tailored approach to engaging with them. But the reward is quite clear, as there are over 700K Asian-American voters in Texas, so a boost of 100K turnout could net 50K or so votes for Dems, based on past results. More like this, please. Here’s a nice little fact sheet if you want more (source).

A very simple projection of the November vote

In my earlier post about the current state of voter registrations, I noted that you could see the county-by-county totals in the contest details for the Senate runoff. What that also means is that if you have current (till now, anyway) voter registration totals, you can do a comparison across the counties of where voter registration totals have gone up the most, and how the vote has shifted in recent elections. In doing so, you can come up with a simple way to project what the 2020 vote might look like.

So, naturally, I did that. Let me walk you through the steps.

First, I used the 2020 runoff results data to get current registration totals per county. I put that into a spreadsheet with county-by-county results from the 2012 and 2016 Presidential elections and the 2018 Senate election to calculate total voter registration changes from each year to 2020. I then sorted by net change since 2012, and grouped the 254 counties into three buckets: Counties that had a net increase of at least 10,000 voters since 2012, counties that had a net increase of less than 10,000 voters since 2012, and counties that have lost voters since 2012. From there, I looked at the top race for each year.

First, here are the 2012 big gain counties. There were 33 of these counties, with a net gain of +2,488,260 registered voters as of July 2020.

The shift in voting behavior here is obvious. Hillary Clinton did much better in the larger, growing counties in 2016 than Barack Obama had done in 2012, and Beto O’Rourke turbo-charged that pattern. I have made this point before, but it really bears repeating: In these growing counties, Ted Cruz did literally a million votes worse than Mitt Romney did. And please note, these aren’t just the big urban counties – there are only seven such counties, after all – nor are they all Democratic. This list contains such heavily Republican places as Montgomery, Comal, Parker, Smith, Lubbock, Ector, Midland, Randall, Ellis, Rockwall, and Kaufman. The thing to keep in mind is that while Beto still lost by a lot in those counties, he lost by less in them than Hillary Clinton did, and a lot less than Obama did. Beto uniformly received more votes in those counties than Clinton did, and Cruz received fewer than Trump and Romney.

Here’s where we do the projection part. Let’s assume that in 2020 these counties have 59.8% turnout at 2018 partisan percentages, which is to say Biden wins the two-party vote 54.3% to 45.7% for Trump. At 59.8% turnout there would be 7,732,410 voters, which gives us this result:

In other words, Biden gains 100K votes over what Beto did in 2018. If you’re now thinking “but Beto lost by 200K”, hold that thought.

Now let’s look at the 2012 small gain counties, the ones that gained anywhere from eight voters to 9,635 voters from 2012. There are a lot of these, 148 counties in all, but because their gains were modest the total change is +243,093 RVs in 2020. Here’s how those election results looked:

Obviously, very red. Beto carried a grand total of ten of these 148 counties: Starr, Willacy, Reeves, Jim Wells, Zapata, Val Verde, Kleberg, La Salle, Dimmit, and Jim Hogg. This is a lot of rural turf, and as we can see Trump did better here than Romney did, both in terms of percentage and net margin. Ted Cruz was a tiny bit behind Romney on margin, but did slightly better in percentage. The overall decline in turnout held Cruz back.

Once again, we project. Assume 58.5% turnout at 2018 partisan percentages. That gives us 1,714,030 voters for the following result:

Trump winds up with the same margin as he did in 2016, as the 2018 partisan mix helps Biden not fall farther behind. Trump is now in the lead by about 150K votes.

Finally, the counties that have had a net loss of registered voters since 2012. There were 73 such counties, and a net -17,793 RVs in 2020.

Again, mostly rural and again pretty red. The counties that Beto won were Culberson, Presidio, Jefferson (easily the biggest county in this group; Beto was just over 50% here, as Clinton had been, while Obama was just under 50%), Zavala, Duval, Brooks, and Frio.

Assume 55.9% turnout at 2018 partisan percentages, and for 277,148 voters we get:

Again, basically what Trump did in 2016. Add it all up, and the result is:

That’s actually quite close to the Economist projection for Texas. If you’re now thinking “wait, you walked me through all these numbers to tell me that Trump’s gonna win Texas, why did we bother?”, let me remind you of the assumptions we made in making this projection:

1. Turnout levels would be equal to the 2016 election, while the partisan splits would be the same as 2018. There’s no reason why turnout can’t be higher in 2020 than it was in 2016, and there’s also no reason why the Democratic growth in those top 33 counties can’t continue apace.

2. Implicit in all this is that turnout in each individual county within their given bucket is the same. That’s obviously not how it works in real life, and it’s why GOTV efforts are so critical. If you recall my post about Harris County’s plans to make voting easier this November, County Clerk Chris Hollins suggests we could see up to 1.7 million votes cast here. That’s 360K more voters than there were in 2016, and 500K more than in 2018. It’s over 70% turnout in Harris County at current registration numbers. Had Beto had that level of turnout, at the same partisan percentages, he’d have netted an additional 85K votes in Harris. Obviously, other counties can and will try to boost turnout as well, and Republicans are going to vote in higher numbers, too. My point is, the potential is there for a lot more votes, in particular a lot more Democratic votes, to be cast.

Remember, this is all intended as a very simple projection of the vote. Lots of things that I haven’t taken into account can affect what happens. All this should give you some confidence in the polling results for Texas, and it should remind you of where the work needs to be done, and what the path to victory is.

A word about mail ballot drop boxes

I learned something in this story.

Travis County voters nervous about delays with the post office will be able to hand-deliver mail-in ballots or drop them off at drive-thru sites this fall, County Clerk Dana DeBeauvoir said Tuesday.

“If they want to vote by mail but now they’re worried, at least they have a drive-thru option,” she told county commissioners.

DeBeauvoir said reported issues at the post office have put local election officials “in a jam” and that they’re creating more options for people planning to vote by mail in the upcoming election.

She said she anticipates about 100,000 people in Travis County will vote by mail. There are about 833,000 eligible voters in the county, she said, and about 123,000 of those voters are over 65, which means they qualify for a mail-in ballot under Texas’ limited program.

Other states also allow election officials to set up “drop boxes” for voters to hand-deliver ballots. Those are illegal in Texas, however; voters must hand their ballots directly to an official.

“Voters will still have to show up in person with only their own ballot,” DeBeauvoir said. “They can’t deliver anybody else’s for them. We want to be sure that voters understand that they’ll need to produce ID and they will have to sign a signature roster.”

DeBeauvoir said there will be a walk-up site to hand-deliver ballots, as well as three drive-thru locations downtown. She said there should be about 10 lanes to drop off ballots.

“We think we can have enough capacity to handle the number of voters we feel like are going to take advantage of this, because of what happened to the post office,” she said.

I did not know that drop boxes as they are being used in other states are illegal in Texas. I’m not surprised, but it is another typical annoyance. Harris County is doing something similar as voters will be able to drop off mail ballots at any County Clerk office, though whether there would be drive-thru service for that is not clear to me. I think there will be drop off boxes at some early voting sites, like the NRG Arena, but that’s only for the early voting period. I’d like to see someone in the Lege revisit this issue in the next session, and put a bill to expand mail ballot drop off access on the agenda.

If Dana DeBeauvoir is correct about there being 100K or so votes by mail in Travis County, that will shatter records. I had to check the SOS archive pages for early voting because the Travis County elections website does not split out mail ballots from other early votes, but in 2016 there were 20,090 mail ballots as of the last day of early voting, which was 4.2% of final turnout. In 2018, those numbers were 17,830 mail ballots, and 3.6% of final turnout. Where it gets more interesting is in the 2020 primary runoff, which of course was done in the height of the COVID-19 outbreak. We also do have mail totals from the county: For the 2020 Democratic primary runoff, there were 20,641 mail ballots cast out of 124,608 total ballots, or 16.6% of turnout, a massive increase. On the Republican side, it was 2,974 mail ballots and 19,257 total ballots, or 15.4%. A hundred thousand mail ballots in November would be around twenty percent of total turnout. Like I said, a big big increase. If other counties are expecting something similar, then this really will be a very different election than what we have seen before.

Harris County goes all in on voting access

Wow.

Harris County voters this November will have more time and more than a hundred additional places to cast ballots in the presidential election, including drive-through locations and one day of 24-hour voting, under an expansive plan approved by Commissioners Court Tuesday.

With the additional polling locations, an extra week of early voting and up to 12,000 election workers, Harris County Clerk Chris Hollins is pledging a smooth November election.

On a 3-2 vote, the court agreed to spend an additional $17.1 million — all but about $1 million to come from federal CARES Act dollars — to fund Hollins’s ambitious election plan. The money is on top of the $12 million the court approved earlier this year to expand mail-in voting amid fears that in-person balloting could spread the coronavirus during the ongoing pandemic.

The clerk’s plan includes extended early balloting hours, including multiple nights to 10 p.m. and one 24-hour voting session, drive-through options, as well as new equipment to process an expected record number of mail ballots.

“The County Clerk’s office has made it our top priority to ensure a safe, secure, accessible, fair and efficient election for the voters of Harris County this November,” Hollins told court members. “And to ensure this outcome, our office has … executed a robust set of 24 initiatives, many of which were piloted in the July primary runoff election.”

Hollins’ plan is among the boldest unveiled by a Texas elections administrator to improve a voter’s experience and increase turnout in a state with historically low participation, said University of Houston political science Professor Brandon Rottinghaus.

“These changes would rocket Harris County to the top of the list as the most progressive approach to voting,” Rottinghaus said.

Rice University political science professor Mark Jones said the plan could inadvertently undermine a push by Democrats to expand mail voting for voters under 65 during the COVID-19 pandemic.

“Hollins is making sure that voting in person is safer than going to the grocery store,” Jones said. “To the extent to which other county clerks follow his lead, it’s more and more difficult to make the case that voting in person represents a risk to someone’s health.”

In previous elections, Harris County operated about 40 early voting and 750 Election Day sites. The additional funding, Hollins said, will allow the county to operate 120 early voting and 808 Election Day locations.

He estimated 1.7 million voters may turn out, a record in any Harris County election and an increase of 361,000 since the 2016 presidential contest.

The two Republican commissioners voted No to this, one complaining that it cost too much and one complaining that there were too many voting locations inside Precinct 1, which is where the city of Houston is. Remember how Commissioners Court was 4-1 Republican before last year? Apparently, elections do have consequences.

I had mentioned Hollins’ assertion of 120 early voting locations following the HCDP precinct chairs meeting, where he addressed us after we voted for County Clerk and HCDE nominees. It’s still kind of amazing to see this all actually move forward. There’s also another piece to mention:

Doubling down on increasing the use of voting by mail in November, Harris County will send every registered voter in Texas’ most populous county an application for a mail-in ballot for the general election.

The move, announced Tuesday by the county clerk’s office, puts Harris County — which has more than 2.4 million residents on its voter roll — ahead of most other counties when it comes to proactively working to bump up the number of voters who may request mail-in ballots. Election officials expect a record number of people to vote by mail this year, but not all of Harris County’s registered voters will ultimately qualify.

Harris County Clerk Chris Hollins has said he was encouraged by the county’s return rate ahead of the July primary runoff election when it sent applications to every registered voter who was 65 or older. Typically, voters must print out or request applications for ballots by mail from the county or the state and deliver or mail them to their local elections office. In between the March primary election and the July primary runoff, the county saw a more than 100% increase in vote-by-mail applications, Hollins said.

“If you’re eligible to vote by mail, we want you to vote by mail. It’s safest for you. It’s safest for all your neighbors,” Hollins said in a previous interview, arguing that every additional mail-in voter would make the election safer for those voting in person because they’d have to stand behind one less voter who could potentially infect them. “Voting by mail is the safest way to vote, and all those who are eligible to vote should strongly consider casting their vote in that manner — not only for themselves but as a service, a duty to other residents.”

Wow again. The county will purchase mail-sorting equipment and hire a bunch of temporary workers to deal with all the mail. We definitely saw a lot of people who had not voted in the March primary return mail ballots in the runoff. That certainly suggests that sending out the mail ballot applications in such a universal fashion helped boost turnout, though without a deeper study of other runoffs I can’t say that for sure. The Texas Democratic Party is also sent out mail ballot applications, though of course they sent them just to Dems. I don’t know how many registered voters in Harris County are 65 and over, and I don’t know how many people will apply for a mail ballot under the disability provision, but the potential certainly exists for there to be a lot of voting by mail this fall. Just remember to send everything in as early as you can, and consider using the mail ballot dropoff locations at the County Clerk annex offices.

You may think that this is a lot of mail ballot applications being sent to people who can’t or won’t use them, and you may think this is a lot of money being spent to conduct this election. I got a press release from usual suspect Paul Bettencourt complaining about how the County Clerk was making it too darn easy for people to vote. (Remember when he was in charge of voter registration in Harris County as Tax Assessor? Remember how voter registration totals lagged well behind population growth during his term, and never started to catch up until after he was gone? Good times, good times.) My scalding hot take is that what County Clerk Chris Hollins is doing this year should be the norm going forward. Open up a ton of early voting sites, have really convenient hours for them, send mail ballot applications to everyone, and more. All of us expect, every day, a level of ease, convenience, and time-savings in the things we do. I can’t think of any reason why “voting” shouldn’t be on that list. Maybe starting with this year, it finally will be.

Despite it all, voter registration keeps increasing

Still the only voter ID anyone should need

Not even the worst pandemic to hit Texas in a century was enough to stem the surge in voter registrations that has remade the state’s electorate over the past four years.

Just since March, Texas has added nearly 149,000 voters even as the political parties and voter registration groups face new obstacles in signing up people in a world of social distancing and stay-at-home orders.

The state now has a record 16.4 million voters, 2.1 million more than it had just over four years ago — a 15-percent increase in registrations that is nearly equivalent to the voter rolls of the entire state of Connecticut.

“It is a totally different electorate than it was in 2016,” said Luke Warford, voter expansion director for the Texas Democratic Party.

Harris County and Bexar County have led the way in the last three months with voter registration efforts. In Harris County, voter rolls have grown by 16,000, while in Bexar they are up almost 14,000. Combined, the two counties account for one-fifth of the increase in registrations statewide.

Texas voter registration rolls historically have grown very slowly. From 2002 to 2012, the rolls grew by 800,000. But now, registration is in hyperdrive. Just since November of 2018, Texas has added almost 600,000 voters.

Some of the change is coming from transplants moving from other states, while many others are coming from minority communities that voter registration advocacy groups have targeted over the last four years.

In short, Brandon Rottinghaus, a University of Houston political science professor, said 2020 is setting up as a real shootout in regions of the state that have become more competitive because of the diversification and growth of the electorate.

“It’s another step toward Texas being a true battleground,” Rottinghaus said.

In Texas voters don’t register by party affiliation like many other states, making it unclear exactly how many Republican or Democratic voters are in the state.

But about one-third of the 1.3 million new voters since November 2018 come from three counties: Harris, Travis and Bexar — all deeply blue since 2016.

Harris and Bexar being at the top of the list doesn’t surprise Antonio Arellano, who is the leader of Jolt, a voter advocacy group focused on registering young Latino voters and getting them involved in politics. He said his group has been on the ground in those two counties.

While the coronavirus made registration drives impossible in traditional locations such as libraries, county fairs and large events, younger voters can still be found with direct messages on social media, text messages, and digital ads. The virus hasn’t affected those efforts at all.

“We harness culture, art and technology to get it done,” Arellano said.

Each year in Texas, 200,000 Latinos turn 18 — a population that is Jolt’s main focus.

Nice. The March voter registration figures are here, the January figures are here, and the November of 2018 figures are here. Harris County is right at 2.4 million, and I think we have a shot at getting to 2.5 million for November. As the story notes, average monthly voter registration figures are actually up since April, about double what it had been from November of 2018 through March. People have been working it, with Jolt, Battleground Texas, and Beto’s Powered by People all doing a lot of heavy lifting. You want to make a difference, get trained as a volunteer deputy voter registrar – the Harris County Tax Assessor has online ZOOM training sessions to become a VDVR – and join up with one of these groups. Every new voter matters.

I actually drafted this about a month ago, just before the primary runoffs, then as is sometimes the case kept putting off publishing it. Because I procrastinated, you can now see the state and county-by-county voter registration figures by looking at the contest details for the Senate runoff. But this post is even more of a delayed special than that. In the Before Times, I had drafted a story about where a lot of voter registrations were coming from – short answer, the I-35 corridor from San Antonio to D/FW – but between the primary and the world falling apart, I never got around to publishing it. I’m repurposing it for this post, so read on for what I had written a couple of months ago.

The Kamala effect

I assume you are all aware that California Sen. Kamala Harris is now the Democratic nominee for Vice President. I didn’t post about that on Wednesday because it was hardly news by the time I published, but there are things to discuss. Pretty much as humidity follows the rain in Houston, we now have several articles about how Harris’ place on the ticket may have an effect on the race in Texas. So let’s take a look and see what we can learn.

Kamala Harris

“I think Kamala Harris is the perfect choice for the moment,” Abhi Rahman, a spokesman for the Texas Democratic Party, told The Texas Tribune on Wednesday. “She’s the perfect pick for Texas and for this entire country. … A lot of us knew her potential and what she could bring.”

In Harris, Texas Democrats see a winning formula — someone who can excite key members of their electorate but who holds positions that won’t alienate the more moderate voters the party is trying to win over with President Donald Trump on the ballot. The party faithful, still energized by former U.S. Senate candidate Beto O’Rourke’s closer-than-expected margin of defeat in 2018, think that the mainstream Democratic politics shared by both Biden and Harris will give the state the much-needed boost to flip the state blue. Texas hasn’t nominated a Democrat for president since Jimmy Carter in 1976.

This year the once-reliable Republican stronghold of Texas is approaching swing state status. A June 3 poll by Quinnipiac University gave Trump a 1-percentage-point lead in the state. A July poll by the same university gave Biden a 1 point lead over Trump.

Though Harris’ selection may have eroded any hope for progressives that Biden would choose someone from the Bernie Sanders and Elizabeth Warren-led wing, others in the party are hoping Harris can get more suburban women to the polls and can help hone Biden’s pitch to Black voters, a bloc that needs to turn out in strong numbers if Democrats are going to have a chance in the state.

Harris is the daughter of immigrants; her father is from Jamaica and her mother is from India. By picking her, Democrats argue, Biden may have given the party’s most loyal voters a reason — beyond animosity toward Trump — to work for and elect the ticket.

“The Black, Hispanic and South Asian communities have been engaged in the political process for quite a number of years,” said state Sen. Carol Alvarado, D-Houston. “These communities were largely already there for Biden, but this is going to solidify that support. These communities aren’t just casting votes, but they’re going to get out there and work.”

Along similar lines, here’s the Chron:

“For Texas, there is not a better pick,” said Mustafa Tameez, a Democratic strategist in Houston.

“She has a multicultural background,” Tameez said. “Having someone who can authentically speak to those populations in the suburbs is going to create momentum. Having somebody like that on the ticket automatically jump starts it.”

Political scientists say Democrats are probably right about the boost Harris can provide in the suburbs, even though she may not excite progressives in the state who were crucial to elevating O’Rourke’s 2018 campaign and mobilizing younger voters in general in Texas.

Harris, who is the daughter of immigrants, could be especially effective in areas like Fort Bend County, one of the biggest and fastest growing counties in the state, where more than 28 percent of the population is foreign born and more than 20 percent are Asian-American.

“By selecting someone who isn’t overwhelmingly identified with the most progressive wing of the party, Biden’s pick can technically appeal to both sets of voters — moderate whites and moderate white women who may be considering the Democratic party, and people of color in Texas,” said Joshua Blank, research director at the University of Texas at Austin’s Texas Politics Project.

Harris also could appeal to minority voters who make up the bulk of the Democrats’ base in Texas — both the Asian-Americans who are driving much of the growth of the state’s suburbs, and with Black women who “have been the base and buckle of the Democratic party,” said Michael O. Adams, a political scientist at Texas Southern University

“There’s a lot of energy there,” Adams said.

Harris addresses the biggest concern that Democrats had coming out of 2016, when a record 137.5 million Americans voted in the presidential election.

But data from the Pew Research Center shows that while almost every demographic group saw a corresponding boost in turnout, black turnout declined for the first time in 20 years, falling from 66.6 percent in 2012 to 59.6 percent in 2016.

In the battleground states of Michigan, Wisconsin and Pennsylvania there was a huge drop-off in turnout among women of color who previously voted for President Barack Obama, said Aimee Allison, founder of She The People, a California-based group that has been pushing Democrats to more genuinely address issues of importance to women of color. All three of those states wound up voting for Donald Trump, paving his way to the White House.

“Women of color are one of the largest and most influential Democratic constituencies — and no candidate can win the nomination or the White House without us,” Allison said earlier this year.

In 2019, Allison organized the first She The People rally in Houston at Texas Southern University, an ode to former Houston Congresswoman Barbara Jordan. That event put Harris and other early Democratic contenders for the White House before an audience of mostly women of color in an early test of who could connect with that critical base of voters.

For Harris, it would be one of three stops at Texas Southern University while she tried to build momentum in Texas — a state where her campaign never gained traction despite those early forays into Houston.

Still those trips illustrated Harris’ ties to historically Black colleges and universities. Harris is a graduate of Howard University and a member of Alpha Kappa Alpha, a Black sorority with 300,000 members and more than 1,000 local chapters.

“Things like this resonate well in the Black community and the Black electorate,” said Adams at TSU.

A lot of opinions, but not a lot of data. It’s really hard to say what the actual effect of Kamala Harris as the VP candidate as opposed to any of the other possible candidates may be. She has her strengths and her drawbacks, but overall and in many ways looks to be a big positive for the ticket. The main job of any VP nominee is to first do no harm, and then from there to be the most effective voice for the Presidential nominee that one can be. I appreciated the insights that Morgan State poli sci professor Jason Johnson gave in this episode of the What Next podcast. I tend to agree with the position that Donald Trump will have the biggest effect on the election, because the election is entirely about Donald Trump. I think Harris advances the argument that a vote for Biden (now Biden/Harris) is a vote to restore sanity and stability in America, and I’m confident she will be an outstanding campaigner. That’ll play just fine in Texas.

There is another factor to consider.

On a quiet street in Bellaire, the Sinha sisters, in seventh and fifth grade, already know all about the historic nomination of Sen. Kamala Harris as the Vice President on the Democratic ticket.

“I think that Kamala Harris has inspired young women like me that we can do anything we put our minds to,” 10-year-old Anisa Sinha said.

“Kamala, she comes from a culture that really celebrates the strength of powerful women,” said older sister Reva, who is heading into seventh grade. “I just feel like she helps me and other young women feel seen and heard.”

The girls’ parents smile with pride hearing those words from their daughters. As Indian Americans, the fact that a child of Jamaican and Indian immigrants is nominated for the second highest office in the country is a point of pride.

“I think the intersection of her being Black and Asian is really important,” said Pranika, the girls’ mother. “Not only is she a woman of color, but the fact that she is representing two populations that are historically underrepresented in politics is really important. My great aunt’s name is Kamala, so I identify with that as well.”

Meanwhile, Judge R.K. Sandill, the first civil district judge of South Asian descent elected in Texas, shares the same sense of hope.

“If my Twitter and Facebook feed is any indication, the South Asian community is pumped,” he said. “We’ve been huge (monetary) contributors to both parties for a long time. But now that we’re on a track to engage, not just with activists, but also for our kids.”

Sandill remembers when he first ran for office 13 years ago, South Asian candidates were almost unheard of in Texas. Now, there are several other judges from his community, and the Fort Bend County Judge, K.P. George, is Indian American.

Harris’ background could increase voter turnout in November, and could possibly make a difference in a few tight races down the ballot.

“In a diverse state like Texas, she brings a lot to the table,” political consultant Keir Murray said. “Texas has more Black voters than any state in America, more than 1.5 million. And she’s South Asian, and the Asian American population is the fastest growing and most politically dynamic in Texas.”

In fact, as Michael Li notes, Texas is home to over 700K Asian voters, more than double what any other battleground state has. Asian-Americans voted strongly Democratic in 2018, so if there is a boost in turnout with them thanks to Kamala Harris, that will be a benefit as well. That might be a good topic for some political scientists to look into, now and after the election once the voting results are in. We know she has a lot of strengths as a candidate. Now we look forward to seeing her use them.

Interview with Sherrie Matula of Sisters United Alliance

Sherrie Matula is a longtime Democratic activist (she was a founder of the BAAD Women club) and two-time candidate (for HD129 in 2008, and for HCDE in Precinct 2 in 2016, which she lost by 0.2 percentage points), but that’s not the reason I’m interviewing her. I’m interviewing her because she’s the founder and President of Sisters United Alliance, a small data-driven effort to turn out Democratic-aligned women voters in Texas. Beginning in 2016 and focusing in that election on Harris County, SUA identified 89,000 low-propensity women who were already registered to vote and contacted them by mail and by phone to encourage them to vote for Democratic candidates. Forty-three percent, or 39K of those 89K women they targeted, did cast a vote. They followed that up in 2018 with a larger focus that included Fort Bend, Galveston, Brazoria, and Montgomery Counties plus four small counties between Houston and Austin, and had similar results.

Sisters United has expanded their reach again for 2020, and it’s an effort that deserves more attention. SUA is aiming at precisely the kind of voters that campaigns tend to overlook, and they have been successful at getting them to vote. Abbott officially extends early voting for November

It’s just by a week, but at least the announcement has been made early.

Gov. Greg Abbott on Monday extended the early voting period for the November election by six days, citing continued challenges posed by the coronavirus pandemic.

Early voting for the Nov. 3 election will now begin Oct. 13 instead of Oct. 19. The end date remains Oct. 30.

The extension of the early voting period is not a surprise. During a TV interview in late May, Abbott said he would add more time to the early voting period for the November election — as he did for the primary runoff election earlier this month — but did not elaborate.

Last week, Harris County Clerk Chris Hollins asked Abbott to provide more details so that election officials could have enough time to prepare. In a letter to the governor, Hollins requested that Abbott move the start date to Oct. 13 at the latest.

But the Monday announcement from the governor gave eligible mail-in voters more time to turn in their completed ballots in person if they would like to do so. Current law allows those voters to submit their ballots to the early voting clerk’s office in person instead of mailing them in — but only while polls are open on Election Day. Abbott’s latest move expands that option to the entire early voting period.

Democrats said Abbott’s latest moves were still not enough to create a safer environment for voting in November.

“Abbott’s decision to extend early voting by six days is exactly like his COVID-19 response: the bare minimum and not fully thought through,” state Democratic Party Chairman Gilberto Hinojosa said in a statement.

See here and here for the background. I certainly would have preferred a second extra week of early voting, but this is what we’re gonna get. Note that the extra week actually starts on Tuesday, because Monday the 12th is a holiday (Columbus Day), and early voting doesn’t happen on national holidays because some buildings that are used for early voting are closed.

The extra days for early voting will help, not as much as it could have, but it will help. And god knows, we really better be in an improved position with the virus by October, or we’ll have a whole lot of other big problems to be concerned with. I would expect that election administrators will try to extend voting hours where possible, and hopefully will work to have as many locations open as possible. The restriction on mobile voting sites still sucks and was an otherwise pointless attack on voting access, but there remains unresolved litigation about that, so who knows. The ability to drop off mail ballots in person any time during early voting (confession: I hadn’t known about the prior restriction on that) is good, and I’ll bet Harris County Clerk Chris Hollins sets up numerous dropoff locations.

This is the situation we have, and we have to make the best of it. Apply for a mail ballot if you’re 65 or older or if you believe you meet the disability requirement. Plan when and where you will vote, to try to avoid using the busier sites. Volunteer now to work the election if you can. Don’t be the jerk who refuses to wear a mask when voting. And keep raising hell about the overall response to the pandemic, because getting the infection rate down is by far our best friend. Some brief runoff thoughts

You know the drill here…

– The Election Night Results page at the SOS shows 955,735 votes total in the Democratic Senate runoff. That number is likely to increase a bit over the next few days, as we’ll see shortly. It means about 300K votes were cast on Tuesday, a bit more than thirty percent of the overall total. This turnout is the highest of any Democratic primary runoff since 1990, back when Dems were the dominant party.

– That turnout was fueled in part by the Senate runoff, and in part by a burning anger at the botched pandemic response and zealous attempts by the Republicans to curtail mail voting. Some national folks commented on this, and how it maybe lends credence to the whole “Texas is in play” narrative, and not just at the Presidential level. We’ll keep checking on the polls going forward to see how far that carries us.

– As there were no statewide Republican runoffs, a direct turnout comparison is tricky. The early voting total for Republicans was 421K, not too shabby all things considered. So maybe they got to 600K or a bit higher.

– Let’s talk mail ballots for a minute. Texas Elects has a terrific overview, but let’s focus on this:

Absentee ballots are counted by a subset of election officials known as the Early Voting Ballot Board (EVBB). Well, in many counties, there are two EVBBs for primary and runoff elections. County political party chairs are the presiding judges, and there are at least two other members. A separate Signature Verification Committee with as many as 12 members may also be created, and larger committees are possible. If you’re interested in the minutiae of all this, the Secretary of State’s 2020 EVBB handbook (pdf) has it in spades.

Counties with a population of 100,000 were able to convene their Early Voting Ballot Boards as early as July 4 (likely July 6 because of the holiday) to begin the process of qualifying and scanning mail ballots. Counties with populations under 100,000 were able to convene their EVBBs as early as last Friday.

An absentee ballot may only be accepted if:

  • The carrier envelope was “properly executed”
  • The voter’s signatures on the ballot application and carrier envelope were not signed by someone else, unless it was a lawful witness
  • The ballot application states a legal ground for voting by mail (In other words, one of the pre-printed boxes is checked or otherwise marked and the voter hasn’t hand-written some other reason, like coronavirus)
  • The voter is registered to vote
  • The ballot was sent to the applicable address; and
  • If required, a statement of residence was included and properly completed.
  • It also has to be received by the county election official by no later than 7 p.m. on Election Day, with exceptions for certain overseas civilians and military voters.

When the EVBB accepts the ballot, the voter’s name is entered on the poll list and the ballot is separated from the envelope. The ballots cannot be counted until polls closed on Friday, the end of the early voting period, in counties with 100K or more residents, and until polls open tomorrow (Tuesday) in all other counties.

This is an easily overwhelmed process. All of this requires human intervention. Absentee ballots arriving by 7 p.m. on Election Day are supposed to be counted and included in election night results. There is reason to believe that a significant number of absentee ballots will arrive very late in the process. For example, as of Friday, Harris Co. had received more than 70K absentee ballots, and another 74K had not yet been returned.

Mail ballots received on Election Day are still treated as “early voting” and will be included within the early vote canvass. In close races, we will be noting who is ahead among absentee ballots, as that may provide an advantage as more votes are counted. Or not.

All of this is to put perspective on why we may not have definitive results on Election night. All of this may be magnified in November, and not just in Texas.

That’s why the final vote totals may creep up a bit, and also something to think about for the fall. You may want to ask your local elections administrator what you can do to help.

More along those same lines.

As dress rehearsals go, Tuesday’s Texas primary runoff elections weren’t bad, but for some voters and poll workers, they revealed problems that need to be fixed before November’s big show.

With much lower turnout than primary or general elections, the first in-person election day during the coronavirus pandemic saw voters reporting heavily sanitized polling places, an ample supply of gloves, finger cots or pencils to mark up their ballots, and socially distanced lines. With a tiny ballot in many places, some were in and out of polling places in minutes.

But some Texans who sought to vote by mail — and submitted their applications on time — indicated they never received their ballots. Some opted instead to vote in person. Others went uncounted. It’s unknown how many were affected.

Other voters sent in their mail-in ballots only to have them returned unopened. Some of those reached county elections offices after a second attempt, while others still appeared lost on election night. It’s also unknown how many were affected.

In some counties, previously advertised polling places were shuttered at the last minute for lack of workers, some fearing the pandemic or reluctant to risk exposure to voters who were not required to wear masks. Others walked off the job Tuesday morning after discovering some of their fellow poll workers wouldn’t be donning masks.

And throughout the night, the Texas secretary of state’s portal for reporting election night returns was either broken or incorrect, first displaying garbled numbers in various races on the ballot and later showing discrepancies with county reports.

“I would say a number of the problems we saw in this election are red flags that, left unaddressed, could result in massive problems in November,” said Anthony Gutierrez, executive director of Common Cause Texas, in a statement.

At least the SOS website got fixed in relatively short order. The rest of it, yeah. No one should have to do this to cast a ballot.

– Looks like there will be a fight over the CD23 Republican result. Good luck sorting that one out, fellas.

– The SD14 special election runoff needs to be scheduled. I expect it to be in the end of August or so. My condolences to everyone in that district who will have to see two perfectly good Democrats rip each other up for the next six weeks or so.

– Beyond that, I don’t have any deep insights at this time. We’ve got a good slate of candidates, and as of Wednesday we’ll start seeing June finance reports for everyone. Eyes on the prize in November, y’all.

Today is Primary Runoff Day

Today, Tuesday, July 14th, is Election Day for the July 2020 Primary Runoff Elections.Voters can cast their ballots anytime between 7 a.m. and 7 p.m. at any of the 109 voting centers throughout Harris County. For the nearest voting location and estimated wait times go to HarrisVotes.com/WaitTimes. A total of 154,313 voters cast their ballots during the ten-day Early Voting period that concluded on Friday, July 10th.

“These are challenging times for all of us, but I want to encourage everyone to exercise their right to vote,” said Harris County Clerk Chris Hollins. “This runoff is a critical part of the election process, because it will determine which candidates go on to represent their parties in the General Election in November.”

To protect voters and election workers from COVID-19, all voting centers have been set up to allow for social distancing.  Poll workers have been provided with personal protective equipment including gloves, face masks, and shields. Sanitizing stations are set up at all polling sites, and voters are being provided with finger covers to use while voting. Additional face masks are available for voters who do not have one. Voters exhibiting symptoms of COVID-19 can vote curbside to avoid entering the polling center.

To cast a ballot, you must be registered to vote and have one of the following forms of ID:

  • Texas Driver License issued by the Texas Department of Public Safety (DPS);
  • Texas Election Identification Certificate (EIC) issued by DPS;
  • Texas Personal Identification Card issued by DPS;
  • Texas License to Carry a Handgun (LTC) issued by DPS;
  • U.S. Military ID Card containing the person’s photograph;
  • U.S. Citizenship Certificate containing the person’s photograph; or
  • U.S. Passport.

Except for the U.S. citizenship certificate, the form of identification you use must be current or have expired no more than four years before being presented at the polls. If you don’t have any of these to use for identification, you can (1) sign a sworn statement explaining why you don’t have those IDs and (2) bring one of the following:

  • Valid voter registration certificate;
  • Certified birth certificate;
  • Current utility bill;
  • Government check;
  • Pay stub or bank statement that includes your name and address; or
  • Copy of or original government document with your name and an address (original required if it contains a photograph).

To expedite your time at the polls, go to HarrisVotes.com to print your personal sample ballot, make your selections, and take it with you when you go vote. If you start the voting process and think you have received the wrong ballot, make sure you let an election official know immediately—before casting your vote.

Also from the inbox, a list of places you can drop off your mail ballot if you didn’t receive it in time to put it in the mail. This is the first time in recent history that there has been more than a single drop-off location in Harris County, as the release says, which is cool. The 11 locations listed there are open 7 to 7, same as the period for voting.

Polling locations can be found here. As a reminder, you can vote at any of these locations. My guess is that the large majority of votes have already been cast for this runoff, so the lines should not be too bad. Do check the wait times at whatever location you’re looking at before heading out, though. And for crying out loud, bring a mask to wear. It’s precisely that mask wearing was not mandated for polling places that has caused some problems in other counties.

A lack of workers willing to run polling sites as Texas continues to report record coronavirus infections is forcing election officials in two major counties to scale back plans for the July 14 primary runoff elections.

Citing a drop-off spurred by fear of the virus, Bexar County, the state’s fourth largest, is expected to close at least eight of its planned 226 voting locations for next Tuesday, according to County Judge Nelson Wolff.

In Tarrant County, the third largest, election officials learned Thursday that the local Republican and Democratic parties had agreed to shutter two of 173 sites planned for election day voting after the parties were unable to find election judges to run the polling places.

Although poll workers are generally being provided with protective gear, Gov. Greg Abbott’s decision to not require voters to wear masks when they show up at polling locations is driving some poll workers away, Wolff said.

“There is protection for them in terms of what they try to do, but anybody can walk in without a mask,” Wolff said Wednesday evening during his daily coronavirus-related briefing. “The governor did not cover elections, and so they don’t want to work. Quite frankly, I don’t blame them.”

For this election, this shouldn’t be such a big deal. There should be plenty of other locations, most people have probably already voted, and turnout is fairly minimal, though it’s been higher than usual for a primary runoff. The fear, and the bigger picture, is what might happen in November. All signs point to record-breaking turnout this fall, and the last thing we’ll need for that is a scramble for poll workers. I appreciate that Greg Abbott extended early voting for this runoff – I think it made a positive difference – and I believe that will be in play for November. But I refuse to accept that anyone who doesn’t have a valid health reason to not wear a mask should have their personal preferences prioritized over the health and safety of poll workers. The mask mandate needs to extend to the polling places. We’re not taking this seriously enough otherwise.

I’ll have results for you tomorrow, and whatever thoughts I can muster afterward. I’ll look at the data when it’s available. Now go vote if you haven’t already.

2020 Primary Runoff Early Voting, Final Totals: Democrats carry the day

Today’s going to be a numbers-heavy post. Let’s start with Texas Elects, giving us a penultimate day summary:

Early voting in person ended today (Friday) for the July 14 primary runoff and special elections.

Through yesterday (Thursday), 532K people have voted in the Democratic runoff statewide – 193K by mail and 339K in person – which is already the fourth highest total since 1990. The number of voters will almost certainly eclipse the 2014 total today (Friday) and should easily pass the 2002 total on Election Day. The highest number of Democratic runoff voters since 1990 was in 1994, when 747K people voted in the runoff statewide.

Nearly 349K people have voted in the Republican runoff in those counties and portions of counties with runoff races – 97K by mail and 251K in person. Despite the lack of a statewide race, the number of Republican runoff votes cast is already the fifth highest in state history, trailing only the past four election cycles. Turnout is on pace to eclipse all but the 2014 (1.36M) and 2012 (1.11M) totals.

Statewide Democratic turnout through yesterday was 3.25% of all registered voters, and Republican turnout was 2.13% of all registered voters, not just those in areas with runoff races. Combined turnout for all of 2018 was 5.7%, and it was 4.0% in 2016.

The reference to 2014 is surely a mistake, as there were only 201K votes cast in the Senate runoff between David Alameel and Keisha Rogers that year. There were 434K votes in the 2018 gubernatorial runoff between Andrew White and Lupe Valdez, but 2020 was already past that total as of Thursday. I’ve looked at some other years but am just not sure what that third “highest since 1990” total may be.

I can tell you where we are as of Friday statewide:

We have now topped the 2002 Senate runoff between Ron Kirk and Victor Morales (620K), and I have no doubt we will blow past the 1994 level on Tuesday. That’s not too shabby. Data on the Secretary of State website only goes back to 1992, so I don’t know what the 1990 primary runoffs looked like, but 1990 was the last year of Democratic statewide dominance in Texas. That’s not a bad harbinger to echo.

How much does any of this mean, though? Erica Greider thinks Republicans should be worried.

“I think we’re seeing the ramifications of having failed Republican leadership, and no one is seeing it more than those of us here in Texas,” said Billy Begala, a spokesman for the Texas Democratic Party.

Begala made his remarks Friday morning, the last day of early voting in advance of Tuesday’s primary runoff elections.

“It didn’t have to be this bad,” he said of the resurgence of COVID-19 in Texas. “It really didn’t.”

The coronavirus has complicated elections administration. Democratic officials have been urging Texans to vote by mail, if they’re eligible. And Texans who’ve gone to the polls in person have noticed unusual precautions, in most of the state’s major counties. In Harris County, for example, voters have been provided with rubber finger cots and disinfectant wipes as well as the traditional “I voted” stickers.

Still, turnout — which is typically abysmal for runoff elections in Texas — has been higher than expected through the early voting period. As of Thursday, some 900,000 voters had cast ballots across the state, a majority of them in the Democratic primary runoff.

“The key takeaway is that if we’re able to make voters feel safe, and of course be safe, then it’s a very positive experience for them,” Harris County Clerk Chris Hollins said Friday.

The turnout through the early-voting period, he continued, raises the prospect that Harris County will see higher turnout in November than the 60 to 62 percent that’s typical in presidential election years.

“If I were a betting man I’d put money on 65 for sure, and I might take some odds on 70,” Hollins said.

Voter registration, similarly, has continued apace, despite the challenges presented by the pandemic. Since March, nearly 149,000 voters have been added to the rolls in Texas, bringing the statewide electorate to a record 16.4 million people.

I haven’t seen an official number for Harris County voter registration yet – we’ll know it for sure when we get election night returns – but I’ve heard 2.4 million at this time. At 62% turnout, about what we usually get in Presidential years, that’s a bit short of 1.5 million votes in Harris County. 65% is 1.56 million, 70% is approaching 1.7 million. That’s going to be more Democratic votes than it is Republican votes. It’s just a matter of how many.

Still, Republicans should be nervous about surging July turnout given that Democrats don’t have a marquee name on the ballot like former congressman Beto O’Rourke, who excited Democrats nationwide in his near-miss U.S. Senate bid in 2018.

“I don’t know that here in Texas we have one specific candidate or officeholder who is the standard-bearer for the party,” Begala acknowledged.

Perhaps voters are simply fed up with the incumbents, who happen to be Republicans, for the most part.

“I think it’s that when voters look around right now, when Texans look around right now, they see a pandemic, they see horrific racial injustice, they see record unemployment,” said Amanda Sherman, the communications director for Hegar. “Voting is a way for them to do something about it.”

I’m not sure that the high runoff turnout matters that much for November, but it does show that even in the pandemic Dems are turning out. There’s evidence from around the country that relentless Republican efforts to make voting harder have resulted in hardier and more persistent voters, especially Black voters. Maybe we’re seeing some of that here.

The Friday runoff EV file is here, and the final EV turnout report from March is here. 18,526 Democrats showed up to vote in person on Friday. That’s more than the entire early voting in person population for the Republicans, who didn’t have a statewide race but did have a couple of countywide races. And as noted, Republicans were far more reliant on a rate basis on mail ballots than Dems were, though Dems returned far more mail ballots. You can draw your own conclusions.

I promised you more data about the early voting population, at least through Wednesday. I’m a man of my word, so here’s what I found when I examined age and gender data for the primary runoff.

Among the mail voters, there were 16 people born prior to 1920, with the oldest being born in 1915. Another 10 were born in 1920. In other words, 26 people who are at least 100 years old had voted as of Wednesday.

The daily voter rosters do not include year of birth or gender, only the full March roster does. As such, I only have that data for the people who had also voted in March. Of 41,739 total mail voters who had voted in March, 40,195 are 65 or older. The remaining 1,544 are under 65.

23,373 of the 65 or older mail voters are female, including 15 of the 16 pre-1920-birth voters and eight of the ten born in 1920. 58.1% of mail voters are listed as female. 16,230 are listed as male, for 40.4% of over-65 mail voters.

868 of the 1,544 under-65 mail voters are female (56.2%), 641 are male (41.5%).

(For some voters, the value in the Gender field is null, which may be a data glitch, or may be a stated preference of the voter. Because the number is so small, and because as far as I know there is no other option for this field that is allowed by state law, I suspect this is just a data error.)

I did not extend this to the in person early voters – I promise, I’ll circle back when I get the full voter roster for the runoff. But Keir Murray posted some facts about the voting data through Thursday:

How can you vote if you currently have coronavirus?

There is one way, if it is approved.

Thousands of Harris County voters who recently have tested positive for coronavirus and now are quarantined should be allowed to vote online in the primary runoff election, County Attorney Vince Ryan argued in an emergency court filing Thursday.

The novel voting method has never been used in Harris County, but was permitted for the small-scale North Texas Ebola outbreak in 2014.

If approved by a state district judge, the estimated 10,000 residents who have tested positive for COVID-19 after the July 2 deadline to apply for a mail ballot would be allowed to submit a ballot via email. Forcing infected residents to vote in person would risk “putting thousands of other voters at risk,” Ryan wrote.

“The effect of this is to leave thousands of Harris County voters with a choice: 1, violate their quarantine and risk exposing poll workers and other voters to a deadly virus, or 2, become disenfranchised and lose their constitutional right to vote,” Ryan said. “That is a choice no Texan should be forced to make.”

A hearing [was] scheduled in the 80th District Court for 4 p.m. Friday. Ryan filed the brief on behalf of County Clerk Christopher Hollins.

The Dallas County elections administrator in 2014 obtained a court order allowing residents quarantined by the Ebola outbreak to submit mail ballots via email.

The Texas Election Code also permits counties to receive emailed ballots from some active duty members of the military stationed overseas.

Ryan said Harris County’s request follows COVID-19 elections guidance issued in April by Secretary of State Ruth Hughs, which said counties may want to consider seeking court orders to expand voting options for quarantined voters. A spokesman for the secretary of state did not immediately respond to a request for comment.

I admit, I did not know that this was a possible option. It makes sense, and in practical terms it’s likely that only a small number of people would actually vote in this fashion. I mean, even with record-breaking turnout in this primary runoff, we’re still going to fall short of ten percent of all registered voters in Harris County. More to the point, given that most of the people who would have voted in this election already have, we’re talking maybe two or three percent turnout among those who have not yet cast a ballot, so maybe 200 or 300 people total. I’d still take the under on that bet. But the principle is solid, and if the law allows for this, then by all means let’s do it. I assume we’ll get a quick ruling on this, I’ll keep my eyes open for confirmation of that and will update this post as needed.

UPDATE: And the answer is no.

A state district judge on Friday denied a request by Harris County Clerk Christopher Hollins to allow thousands of voters who recently tested positive for coronavirus, and now are quarantined, to vote online in the primary runoff election.

The novel voting method never has been used in Harris County, but was permitted for the small-scale North Texas Ebola outbreak in 2014.

Judge Larry Weiman, however, said he shared concerns raised by the Harris County Republican Party that online voting was not secure. Weiman, a Democrat, also said at the emergency telephone hearing that the county clerk had not produced an example of a voter being disenfranchised by exposure to coronavirus.

“The plaintiff hasn’t shown any injured party,” Weiman said.

The Harris County Republican Party and Texas Attorney General’s office argued against the plan. Assistant Attorney General Anne Mackin said Hollins’ proposal amounted to a “rewrite of the Texas Election Code,” which already provides ill voters a method to vote by mail after missing the application deadline, so long as they are able to physically produce a doctor’s note.

Hollins sought to have that requirement waived in favor of an emailed statement certifying a voter has been exposed to COVID, saying infected residents or members of their household risk infecting county employees by delivering a form to a public building.

“It’s inappropriate to substitute a new process,” Mackin said.

The Election Code permits counties to receive emailed ballots from some active duty members of the military stationed overseas. Attorney and state Rep. Briscoe Cain, R-Baytown, and attorney Kevin Fulton argued on behalf of the Republicans that method requires service members to use secure email addresses which allow elections administrators to verify their identities.

Weiman said he shared these concerns about security. He invited the Texas Legislature to make changes to the Election Code if lawmakers feel they are needed.

It was a nice idea while it lasted, but there would have been issues. The fact that there were no named voters asking for this is a legitimate point. It would have been very nice to be able to test something like this in a low-stakes primary runoff, in case it’s needed in November, but I think we probably do need to have the Lege address some issues first. There are ways to make this process secure, none of which I suspect would have been available now, and the need for a written-on-paper doctor’s note is obviously archaic. If this experience can serve as a template for updating the relevant bits of the election code, it will still have been a useful exercise.
