I included Mealer and Cagle for post-election inclusion mostly out of curiosity. Jack Morman did not have a report filed or I’d have included him as well. Cagle’s July report showed over a million bucks on hand. Life comes at you fast. (Except for Steve Radack, who still has a nice chunk of change in his account.) On the other side of that, you can see that Judge Hidalgo left it all on the field. She’ll have plenty of time to build that treasury back up; she did a pretty good job of that this cycle, so I’d expect to see her total tick up in short order. I didn’t look closely at new Commissioner Briones’ report, but I’d bet a nice lunch that a substantial chunk of her cash arrived after the election. It’s good to be a Commissioner.

I don’t think I’ve seen reports for District Attorney on the county election site before. DA is technically a state office – for smaller counties, the DA can cover several of them at once – so I’d normally expect to see them on the Texas Ethics Commission site. Not that I’m complaining. I figure it’s just a matter of time before incumbent DA draws a primary challenger or two, so we’ll want to keep an eye on her fundraising totals. Nothing else of great interest in this group – I’d expect both Ed Gonzalez and Christian Menefee to start posting bigger numbers soon. As for Joe Danna, is there ever a time when he isn’t running for Sheriff?

I don’t know if we will get Constable/JP redistricting, but there are always some interesting primary contests here, and even with the same maps we could have interesting November races in Precincts 4 and 5. Along those lines, I note two potential future Constable candidates: Don Dinh, a Deputy Constable in Precinct 1 since 2020 who was for 24 years before that a sergeant in the Fort Bend County Precinct 2 Constable’s office, filed a designation of treasurer to run for Constable in Precinct 5. I’m going to guess he’d run as a Democrat, but I can’t say for sure at this time. A William Wagner, about whom I could find nothing, filed the same for Constable in Precinct 7. He would almost surely run as a Dem in this heavily Democratic precinct.

Oh, and the second place where there might be a Democratic primary fight worth watching is in Precinct 1. Alan Rosen had his eye on the Sheriff’s office back when Ed Gonzalez was a nominee for head of ICE, but that’s off the table now. He may or may not seek to run for something else – do remember that the minute he says something to that effect he’ll have to resign, so all we would have before then is speculation – but either way I won’t be surprised to see some competition for the Precinct 1 slot. One of his top staffers ran against Judge Hidalgo in the 2022 Dem primary, and I imagine there will be some kind of response to that. That would not be a cheap race as things stand now, as you can see.

Not much else to say at this time for 2024, but I will note that at least some of the Democratic judges whose election is being challenged by a sore loser are raising funds for their legal defense. If you have a favorite or two among them and a few bucks to spare, I’m sure they’d appreciate a contribution.

The active shooter hoax at our neighborhood school

This made for a super eventful Tuesday afternoon.

Police and panicked parents scrambled to Heights High School Tuesday afternoon, in frantic response to a false report that a gunman had shot 10 people in a room on the 2,400-student Houston ISD campus.

The school went into lock down around 1 p.m., and police officers found the room locked and immediately breached the door, according to Chief Troy Finner. Two sweeps of the school found nothing, according to the Houston Police Department.

“We have no injuries here,” Finner said at a news briefing as a crowd of parents stood at an intersection near the high school. “Thank god for that.”

Officials intend to determine who made the hoax call and hold that person accountable. Finner said police believe the call may have come from outside the school.

“There was no active shooter here — there was a fight,” said Constable Alan Rosen.

An email notified parents later that Heights High, as well as nearby Hogg Middle and Harvard and Travis Elementary schools, were placed in lockdown.

“As a precautionary measure, we went into lockdown mode,” Heights Principal Wendy Hampton said in an email to parents. “Houston Police Department and HISD Police are onsite and continue to investigate, though no evidence has been found to substantiate the threat. We take all threats seriously as the safety of our students and staff is always our top priority.”

As it happens, I had to go into the office Tuesday afternoon. I was headed out a little after 1 PM, and was on Studewood going towards the I-10 entrance when I saw three HPD cars with lights and sirens going headed the other way at full speed. I didn’t give it much thought until after I had arrived at the office, took a minute to check Twitter, and found out what was happening. I don’t currently have any kids at Heights or the other schools that got locked down, but my kids have friends there and I have friends and neighbors who have kids at all of them. It was pretty stressful, to say the least, and I had the luxury of not having to be frantic about my own kids. My thoughts today remain with those parents and those kids.

Shannon Velasquez burst into tears on Tuesday afternoon as she waited on the sidewalk near Heights High School, where her daughter and hundreds more students were locked down in their classrooms after someone made a false report about a mass shooting.

The mother knew her daughter was fine — she had spoken with the sophomore student on FaceTime as she sped to school from work.

Still, she could not shake a horrible feeling, and her frustration bubbled over as she heard conflicting information from parents and officers about where she should go to reunite with her child.

“As if this isn’t bad enough?” she said. “I just can’t wait to put my arms around my kid.”

Anxiety, panic and confusion erupted on Tuesday afternoon in the residential streets surrounding Heights High School. Personnel from at least eight law enforcement agencies sped to the scene with lights and sirens. Panicked parents rushed from jobs and lunch appointments. Some drivers ditched their cars on the grassy median along Heights Boulevard, and walked or ran several blocks to the school.

Parents gathered information from their children, other parents, news reports and officials — eventually learning that their kids were safe and the massive frenzy actually stemmed from a false alarm.

Still, some parents said they were frustrated by sparse communication from the school, district or law enforcement agencies, although HISD and law enforcement agencies have defended their response.

Luis Morales, HISD spokesman, said notifications went out to parents 23 minutes after the district became aware of the situation.

“We were able to get that out a quicker than we have before,” Morales said, adding that the district must verify information before sending out notifications.

Chief Troy Finner said during a news briefing on Tuesday afternoon that he sympathized with parents who were frustrated. But safety comes before notifications, he said.

“We have to search the school. That is the most important thing — to stop the threat if there’s a threat,” he said. “We don’t have time to call. Once we make it safe, we start making those calls.”

Houston Fire Chief Samuel Pena said more than two dozen units from HFD responded to the scene. The first unit arrived two minutes after HFD received the call, he said, and quickly began coordinating a rescue team with police.

“The community expects the first responders to get on scene quickly, to get on scene and coordinate and start taking action as soon as they get on scene,” he said. “That’s exactly what we did.”

I have nothing but sympathy for the parents here. I was scrambling around looking for accurate information too, and the stakes were much lower for me. I have no doubt I’d have been out of my mind and super upset at how long it took to get updates. I also have a lot of sympathy for HISD and HPD, who were understandably reluctant to get out ahead of what they knew. I don’t have a good answer for this.

As relieved as we all are that this turned out to be nothing, we have to talk about the law enforcement response, since that is an obvious item of interest after Uvalde. In addition to HPD, there were deputies from the Precinct 1 Constable and the Sheriff’s office at the scene, and I assume there were some HISD cops as well. We do know that HPD entered Heights HS in search of the alleged shooter, which is good to know, but we don’t know more than that about who was in charge and who was making what decisions. Given what we know about the thoroughly botched response in Uvalde, this should be used as an opportunity for HPD and HISD to review their processes, make sure they have agreements in place, and so on. In the end, thankfully this was just a drill. We damn well better learn from it.

Plaintiff in Constable Precinct 1 lawsuit responds

She’s not having it with the dismissal of Constable Alan Rosen as a defendant from the lawsuit.

The booze-fueled undercover hotel operations were bad. Felecia McKinney’s worst moment at the Precinct 1 Constable’s Office, however, came two years ago, during an undercover sting at a Massage Heights near the Texas Medical Center.

Another Precinct 1 employee had been assaulted at the business. Her bosses wanted her to pose as a customer, wait to see if he acted again, and then give a signal to bust him and take him down.

When she emerged from the spa, a superior told her to drive herself to the hospital to get a sexual assault examination while Constable Alan Rosen held a celebratory news conference in the business’ parking lot, she said at a press conference Friday.

After the spa sting, McKinney and Erica Davis — the Precinct 1 employee whose assault led to the investigation of Massage Heights — sued the establishment, saying the budget spa chain, its employee, owner and franchisor were negligent in training and supervision. Davis agreed to a monetary settlement in the case but McKinney’s complaint is still pending. Criminal charges against Wenjin Zhu, the massage therapist accused of sexually assaulting Davis and McKinney on the massage table two days apart, are also still pending. Zhu is detained in the county jail.

Though her lawyers have described her experience in court filings, McKinney had never addressed the public about her sexual assault in August 2019 until her brief remarks to reporters at her attorney’s office Friday morning.

“He knows what happened to me,” McKinney said of Rosen. “He intended it. He ordered it. And to hear him claim victory — and that he wouldn’t be held personally accountable for something he’s admitted to doing makes me feel attacked, unheard, and very alone.”

What angered her the most, she said, was reading comments from Rosen’s defenders that the constable should never have been included in the lawsuit in the first place.

“This case was never about money for me. It was about exposing the truth and holding people accountable,” she said, her voice catching. “When I read his comments and his attorney’s comments, I felt really victimized in ways I never expected. …When I saw the claim that he never should have been in the lawsuit, after ordering an operation that I go in to be sexually assaulted, I broke down.”

I don’t know if the decision to remove Rosen as a defendant was a good one or not – I presume it can be appealed, but regardless of that the lawsuit itself if still ongoing. The allegations still refer to things that happened under Constable Rosen’s watch. I’m still far from convinced that any of the undercover actions were a good use of law enforcement resources, whether or not the deputies in question were put in needless danger. I don’t know what will come of this case, but we need to hear what Ms. McKinney and her fellow plaintiffs have to say.

Constable Rosen removed from sexual harassment lawsuit

Good news for him, but the suit continues.

Harris County Precinct 1 Constable Alan Rosen has prevailed in a legal effort to be removed from a lawsuit accusing department supervisors of sexual misconduct against female subordinates in an undercover anti-prostitution unit.

In a five-page ruling, U.S. District Judge Kenneth M. Hoyt on Monday ruled Rosen could not be personally sued for the misconduct allegations that several current and former deputies and another employee had made about conduct within the unit. Plaintiffs can continue to pursue their lawsuit against Harris County and Assistant Chief Deputy Chris Gore and Lt. Shane Rigdon, the judge ruled.

Hoyt explained his ruling by saying he’d concluded that the plaintiffs’ allegations against Gore and Rigdon were “enough to raise a right to relief” but that the plaintiffs had not made any claims that would support Rosen’s individual liability under civil rights law.

Rosen touted the ruling in a news release in which he said he had “full faith in the Court’s review” of the motion.

“I thank the court for its considered review of the law as it pertains the motion to dismiss me from this matter,” he said, “and for granting that dismissal such that my full focus can remain on the needs of the residents of Precinct 1.”

Lawyers for the female deputies said they were undeterred, pointing to Hoyt’s decision to allow the suit to proceed against Harris County and against Gore and Rigdon.

“While Alan Rosen has been able to protect his personal financial interests, his conduct is still very much a part of the lawsuit,” attorneys Cordt Akers and Bill Ogden said, in a written statement.

See here, here, here, and here for the background. You can see a copy of the ruling in the story. While this is good news for Constable Rosen personally, the lawsuit is still active – this was a motion to dismiss, and it was denied for the other two defendants. For that reason, ignore this:

Rosen attorney Ben Hall said Wednesday that his client “should never have been in the lawsuit in the first place.”

He said believed Rosen was added to the lawsuit to tarnish his political viability.

“I think the fact the judge dispensed (with this matter) so quickly will at least remove this stain,” Hall said, “So he can move down the road. And if it is his fate to be sheriff, I think he’d be a fabulous sheriff.”

Sorry, but this still happened on his watch. He may not be legally liable for damages, but he’s still responsible. Maybe if the remaining defendants are cleared we can talk about his future ambitions, but until then let’s cool our jets. This is far from over.

FBI looking into Constable “bachelor party sting” mess

Never a good sign.

Federal investigators are probing the Harris County Precinct 1 Constable’s Office after several current and former female employees accused superiors of sexually exploiting them during undercover anti-human trafficking operations, a lawyer for the women confirmed Thursday.

Attorney Cordt Akers, who is representing several of the women, confirmed Thursday that federal investigators had subpoenaed his clients to learn more about their allegations.

“Our clients have been in full cooperation with the federal authorities in their investigation into the horrible misconduct in the Precinct 1 Human Trafficking Unit,” he said, in response to questions from the Chronicle. “The serious nature of these crimes deserves serious attention, and we are happy that this conduct will no longer go unchecked.”

FBI Spokeswoman Christina Garza declined to comment on the case.

“Per Department of Justice policy, the FBI does not confirm or deny the existence of any investigation,” she said.

In an emailed statement, County Judge Lina Hidalgo said she was “aware” of the allegations and “obviously concerned,” but said the lawsuit prevented her from saying anything more.

Precinct 2 Commissioner Adrian Garcia — who has previously clashed with the constables over questions about efficiency or redundant or wasteful law enforcement operations — said the FBI “must have the opportunity to thoroughly investigate these allegations.”

“Without knowledge of specific facts, this is not a time to speculate on what may have transpired,” he said. “That being said the allegations that have been made public are extremely disturbing and these women deserve to have their allegations thoroughly investigated.”

Unless something leaks, we’re not going to know any more about this until such time as the FBI finishes its business. So sit back and wait patiently, and be glad you’re not Alan Rosen right now. Again with the existential Constable question

Here’s a long and detailed story in the Chron about the history and purpose of the Constable office in Harris County, where they are bigger and do more than anywhere else in the state.

The lawsuit’s allegations were stunning: Harris County Precinct 1 deputy constables assigned to fight human trafficking had been exploited and molested by their superiors during undercover “bachelor party” stings. Undercover deputies pretended to be partying, with the hope of convincing escorts to agree to sex for cash — so they could try to build cases against the women’s pimps. But female deputies said they received little training before being thrown into “booze-fueled playgrounds” in which their bosses groped them.

Precinct 1 Constable Alan Rosen defended his agency, saying internal investigators hadn’t found any violations of policy or law, but for many, the accusations against high-ranking officials of the department reignited a debate that has simmered in Houston for the last half century: What is the appropriate role of the constables? And why were deputy constables running undercover prostitution stings — far afield from their traditional roles of policing rural counties or working as process servers and protecting local justice of the peace courts?

Many constables’ offices elsewhere in Texas have just a few employees. But not in Harris County. For a half century, Houston-area constables have steadily accrued more power and more responsibility. Now, they occupy a position unlike any other in Texas. According to records from the Texas Commission on Law Enforcement, Harris County’s largest constable jurisdictions far outnumber any other constables’ offices elsewhere in the state. Harris County’s largest constable’s office, Precinct 4, mans 567 deputies and dispatchers and has a budget of $60 million, according to county records. The largest department outside of Harris County, the Montgomery County Precinct 3 Constable’s Office, has 65 employees, state records show, and a budget of about $6 million, according to Montgomery County records.

Critics say the offices are bloated and out of control, duplicating other law enforcement agencies and creating a two-tier system where wealthy neighborhoods pay for what amounts to a private security force. Defenders say constables provide badly needed backup to the region’s larger departments, while constables themselves say that because they are elected, they are more responsive to their constituents.

“Constables are first line on community policing,” said Matt Wylie, newly elected president of the Justices of the Peace and Constables Association and Constable of the Johnson County Precinct 1 Constable’s Office. “We are elected by smaller percentage of county, more accountable to people we serve.”

The story is based on the scandal in the Constable Precinct 1 office that we are still waiting to learn more about. It’s a long story and there’s way too much to excerpt, but let me address a couple of points. I do think there’s a lot of duplication of effort in what the Constables do versus what the Sheriff and HPD do, and I don’t think there’s any good way to address that. Ideally, there would be better communication and coordination between these organizations, but there isn’t the incentive for that to happen and no way to enforce it. We could of course just limit what the Constables do, so that they’re more like Constables in other counties, but given where we are now that would be a heavy lift.

I know that we have had this discussion before, probably circa 2012 when two different Constables got arrested for various bad acts. In poking around a bit, I see that there was a report by then-County Attorney Vince Ryan on the practices of the various Constable offices. Maybe an update to that report, which is now almost a decade old and was criticized for not being comprehensive enough, is in order. How much duplication of services is there? How much do the Constables fill in gaps in other law enforcement services? What return are we getting on those fancy task forces that several of them have set up? An outside view of all that might shed some light on things.

In the meantime, I just want to know more about what is going on with the Precinct 1 situation. I recognize that there’s only so much that can be said while there is pending litigation, but this is still a public office and we need to know what the scope and purpose of that “human trafficking” division is, and what they have actually accomplished. We needed to know that before all this crap hit the fan.

Bring in an outside investigator

That’s the Chron editorial board’s advice for Constable Alan Rosen.

Rosen’s office declined to comment to the editorial board Thursday, but in an earlier statement, he said that when he was made aware of the allegations, he “proactively” ordered an internal affairs investigation months ago and “immediately” replaced the supervisor of the human trafficking unit. The investigation, he said, found no violations of law or policy. The constable, whose name has been floated as a replacement for Sheriff Ed Gonzalez if he joins the Biden Administration, suggested the allegations were being brought to impugn his department’s reputation.

“I have a zero-tolerance stance against sexual assault and sexual harassment and would never allow a hostile work environment as alleged,” he said.

If Rosen means that, he shouldn’t hesitate to call for an independent investigation by the FBI’s public integrity unit or the Texas Rangers to get to the bottom of the disturbing claims. Harris County Judge Lina Hidalgo and others on the commissioners’ court should be seeking the same probe and certainly not consider Rosen for the sheriff’s post until they get to the bottom of what happened.

We don’t encourage public officials to cast early blame without all the facts. And indeed, people other than Rosen have pushed back on the lawsuit’s claims, including that the implication that Harris County District Attorney Kim Ogg wasn’t willing to get involved.

“The allegation that our office failed to take action is completely false. It’s offensive,” said DA spokesman Dane Schiller. “There was no cover-up, no laziness, no lack of caring by our prosecutors.”

Still, somebody must investigate — other than the department accused. If the allegations don’t pan out, Rosen’s name is cleared. If they are true, the officers’ actions suggest far more than workplace harassment but deeper corruption, potentially criminal wrongdoing and a toxic culture in urgent need of reform.

See here and here for the background. I basically agree with all of this, and I agree that it’s what Constable Rosen himself should want. It’s the best way to get at the truth and have it accepted as such. If Constable Rosen resists this idea, then Commissioners Court should give him a push, or take the decision out of his hands. Let’s not waste time on this, we the voters in Precinct 1 deserve to know what’s going on.

Another deputy constable files suit

More bad.

When Precinct 1 Constable deputies accused their bosses of sexually exploiting them during undercover vice operations last week, their attorney vowed there would likely be more allegations in the near future.

On Wednesday, Cordt Akers returned to the podium in the foyer of his Montrose firm, and introduced Pct. 1 Deputy Constable Jasmine Huff. And Huff, he said, had also been sexually exploited during so-called “bachelor party stings” while working on the department’s human trafficking task force.

“She is not hiding behind the anonymity of Jane Doe lawsuit, as is her right to do,” Akers said.

Huff is the fourth current or former deputy of the Harris County Precinct 1 Constable’s Office to say she was sexually mistreated while working on the the agency’s Human Trafficking Task Force. A fifth employee —Jacquelyn Aluotto, who worked for the agency as an advocate for victims of human trafficking — has also sued Precinct 1, saying she was ignored and then fired when she conveyed concerns about the department’s vice operations to superiors.

The suit, initially filed last month, names Rosen, Assistant Chief Deputy Chris Gore, and Lt. Shane Rigdon. The alleged incidents occurred in the department’s human trafficking task force in 2019 and 2020. In response to the initial lawsuit, which raised similar allegations of sexual misconduct and other improprieties, Rosen released a statement late last month saying his office had previously investigated the alleged incident, but found no violations of law or department policy.

In response to the latest accusations, Rosen on Wednesday issued a statement declining to comment on the case because “there is a legal matter pending” and privacy issues.

In an amended 45-page complaint filed in federal court Wednesday morning, Huff’s attorneys alleged that she was a young deputy when her bosses assigned her to the HCCO-1 Human Trafficking Unit.

See here for the background. I’m skipping over the details of the allegations for the same reason as before, it’s disturbing stuff and you can read it in the story. I have the same reaction as before, that this is bad on every level, and even if you believe that Rosen had no direct involvement, this happened on his watch. He’s responsible for that.

Brock Akers, another attorney on the case (and Cordt Akers’ father) also rejected accusations that the lawsuit was an attempt to hamstring Rosen’s political ambitions. Prior to the lawsuit’s filing, Rosen had been widely rumored to be interested in seeking appointment to replace Harris County Sheriff Ed Gonzalez, or to run for sheriff in 2024.

Akers called such speculation “flat out wrong.”

“These things happened,” he said.

County commissioners have yet to address the allegations against Precinct 1, or Rosen, a fellow elected official. In response to questions, a spokesman for Judge Lina Hidalgo said she was “aware of these allegations and obviously concerned,” before declining to comment further because of the ongoing court fight.

I have not seen any names floated as possible replacements for Sheriff Gonzalez as yet – I daresay that will wait at least until his confirmation hearing is on the Senate calendar. Rosen would normally be an obvious possibility, and he is known to have bigger ambitions, but again, this happened on his watch. I don’t know how this turns out, but it sure seems like a bad time to be seeking a promotion.

Time for a new Constable scandal

This is super duper ugly.

Untrained deputies picked for “undercover” vice assignments — only to be molested and traumatized by superiors. Prostitution stings devolving into “booze-fueled playgrounds.” And a concerned Precinct 1 Constable Office’s employee, fired after she reported the alleged misconduct to the department’s internal affairs division.

Those are among allegations laid out in a bombshell 40-page civil rights lawsuit filed Monday morning in federal court against Harris County, Precinct 1 Constable Alan Rosen, and two of his top-ranking superiors.

Three current and former deputy constables — and one other plaintiff — alleged a wide array of misconduct at the constable’s office, one of the largest in Harris County, including sexual harassment, sexual battery, civil rights violations and retaliation. The alleged incidents took place in 2019 and 2020.

At a Monday morning news conference, attorney Cordt Akers discussed the lawsuit, flanked by three of the plaintiffs in the case: Felecia McKinney, Jacquelyn Aluotto and Liz Gomez.

Rosen, he said, ran, oversaw, and approved an “ongoing free for all.”

“Senior male deputies were given carte blanche to use young female deputies for their own sexual pleasure on these operations without fear of repercussions.”

Rosen’s office has not commented on the lawsuit.

According to the lawsuit, the supervisors of the constable’s office’s human trafficking unit decided to change operations to perform “bachelor party” stings. The plan was simple, according to the lawsuit: deputies set up surveillance in a hotel room, and male and female deputies — all undercover — pretended to be partygoers, with some of the female deputies posing as prostitutes, potentially enticing sex workers to agree to sell sex for cash — and quickly leading to an arrest.

Three current and former female deputy constables alleged they were picked for the undercover unit despite being inexperienced rookies. Gomez “was continuously subjected to sexual harassment, unwarranted touching, unwanted kissing, molestation, and sexual ridicule during her work on the Human Trafficking Unit,” according to the suit.

The suit also states the female deputies were ordered to purchase and wear revealing clothing for these operations — only to be kissed and otherwise molested by one of their superiors, and that deputies drank copious amounts of alcohol during the so-called “bachelor party” stings.

Attorney Brock Akers — Cordt Akers’ father and another lawyer on the case, said that the case was unique in the many decades he has practiced law in Harris County.

“I thought that I’d seen it all. I was wrong,” he said. “(Precinct 1) leadership gave in to their own prurient turning the female deputies they commanded into the sex exploitation victims they were arguably trying to save.”

There’s more, and there’s a copy of the lawsuit embedded in the story. It doesn’t get any better, and at no point is the question “why did anyone think that ‘bachelor party stings’ was ever a good thing to expend law enforcement resources on” answered. I’m basically at a loss for words here. Constable Rosen’s office hasn’t commented yet, and I suppose maybe there’s something they could say in their defense that might mitigate some of this, but offhand I have no idea what that might be. Here’s what I think should happen, assuming there isn’t some clear evidence to suggest these charges aren’t true: Constable Rosen and the two other named defendants should resign, and the Harris County Attorney’s Office should decline to take any legal action in their defense, other than to negotiate a very generous settlement. The rest of us should once again wonder what the office of Constable is good for these days, and why we still have them as separate elected offices with their own organizations, instead of folding them into the Sheriff’s office.

(The irony of this story coming out on the same day that the House passed the anti-police defunding bill is something, that’s for sure.)

UPDATE: The later version of the story contains this from Constable Rosen:

In a lengthy statement issued Monday afternoon, Rosen said he had a zero-tolerance stance against sexual assault and sexual harassment “and would never allow a hostile work environment” as alleged in the lawsuit. The constable also said when his internal investigators began looking into the matter several months ago, he “immediately” transferred leadership of the Human Trafficking unit to another supervisor, who is still overseeing the unit today.

He said the court filing was “an effort to impugn the good reputation” of his department. Rosen explained in the statement that when he learned of concerns “by a third party several months ago,” he instructed internal investigators to probe the matter.

“We did this even though no one made a formal complaint,” he said, in the statement. “To this day, not one of these plaintiffs has ever made a formal complaint. Each employee interviewed was given the opportunity, in a safe environment, to express any concerns. Their own interview statements contradict many of the allegations in the lawsuit.”

The department’s Administrative Disciplinary Committee found no violations of law or policy, Rosen wrote.

The Harris County Election Security Task Force

I hadn’t realized that this was a thing, but it was and I’m glad it was.

A task force formed to ensure the security of the November election in Texas’ biggest county has found no evidence of wrongdoing after finishing its work.

The Harris County Election Security Task Force was made up of the Harris County Precinct 1 constable’s office, the district attorney’s office, the county attorney’s office and the county clerk’s office. In a report published Friday, the task force said it “received approximately 20 allegations of wrongdoing that needed to be elevated to the level of a formal investigation.”

“Despite claims, our thorough investigations found no proof of any election tampering, ballot harvesting, voter suppression, intimidation or any other type of foul play that might have impacted the legitimate cast or count of a ballot,” the report says.

The task force operated from Oct. 13 through Nov. 3, which was Election Day, according to the report. Undercover officers made 6,311 visits to 122 early voting and 806 Election Day polling sites. The task force responded to 77 calls for service. And it used four explosive-detecting K-9 units to to make 323 sweeps of polling locations, as well as “continual sweeps” while voters dropped off ballots at NRG Stadium on Election Day. (The task force found no explosives.)

“We all worked together to ensure our elections, which are the lifeblood of democracy, were free and fair and that any and all allegations were thoroughly investigated,” Ogg said.

The report is here, and it’s an easy read. This is good from a pragmatic perspective, in that it was good for the various law enforcement agencies to work together and coordinate efforts, and it was good from a transparency perspective, as each incident is detailed along with the response and resolution. You should read through the incident reports, which begin on page 8 and are the bulk of the document. Incident #2 was the subject of some fever-swamp “reporting” on right wing websites – a fellow Democrat who had come across one of those stories emailed me about it early on, and I noted in my reply to them the various ways in which it sounded like BS – while incident #22 was the Aguirre situation, which the report noted was referred to the DA’s office. The fact that in addition to responding to calls from the public, the task force made regular proactive checks on voting locations to ensure their safety was retroactively reassuring to me. It also had an actual, positive effect, unlike the fear-mongering and snipe hunting our state leaders engaged in. Put this down as another innovation from 2020 that we should keep on doing in the future.

A closer look at the Aguirre/Hotze debacle

This WaPo story was pointed out in the comments here, and it’s worth your time to read. I should note that while the Houston Chronicle has not (at least so far) identified the air conditioning repairman that Aguirre attacked, this story did identify and talk to him. For now, I’m going to stick to the Chron’s style guide, so where the WaPo story includes his name, I’m going to put “[the ACRM]” in my excerpt, to stand for “the air conditioning repairman”.

The episode illustrates the extreme and sometimes dangerous tactics that a set of conservative groups have employed in an effort to substantiate President Trump’s unproven allegations of widespread voting fraud in the election. Theories about truckloads of missing mail-in ballots, manipulated voting machines and illegal mail-in ballot collections have abounded in far-right circles, despite a lack of credible evidence, leading to threats of violence against election workers and officials.

Many of the fraud allegations have come in the form of lawsuits that have been rejected by state and federal judges across the country.

The overall effort in Houston stands out because it relied on an expensive, around-the-clock surveillance operation that, for reasons so far unknown publicly, targeted a civilian — authorities called him “an innocent and ordinary air conditioner repairman” — with no apparent role in government or election administration. The operation was also financed by a newly formed nonprofit group run by a well-known GOP donor in Texas and prominent former party officials in Harris County, the state’s most populous county, corporation records show.

The nonprofit group, the Liberty Center for God and Country, paid 20 private investigators close to $300,000 to conduct a six-week probe of alleged illegal ballot retrievals in Houston leading up to the election, the group has said. None of its allegations of fraud have been substantiated.

The group’s president, Steven F. Hotze, did not respond to an interview request.

Aguirre declined to say why the operation focused on [the ACRM].

“I’m not trying my case in the paper,” Aguirre, who was released on $30,000 bail, told The Post in a brief phone interview on Dec. 16. “I don’t care about public opinion. I’m trying my case against these corrupt sons of [expletives].”

The origins of Aguirre’s election fraud investigation date to the formation of the Liberty Center for God and Country in late August.

Hotze’s nonprofit group was created “for the purpose of ensuring election integrity primarily,” said Jared Woodfill, Hotze’s personal lawyer and the former executive director of the Harris County Republican Party, the county that includes Houston. Woodfill is listed on state incorporation records as a director of the nonprofit group, along with Jeffrey Yates, the former longtime chairman of the county’s Republican Party. Yates did not respond to phone messages.

“The socialist Democrat leadership in Harris County has developed a massive ballot by mail vote harvesting scheme to steal the general election,” a now-deleted fundraising page for the group alleged. “We are working with a group of private investigators who have uncovered this massive election fraud scheme.”

The group raised nearly $70,000 through a GoFundMe page from Oct. 10 through last week. Hotze has said publicly that he donated $75,000 to the probe and that an unnamed individual had donated another $125,000.

Hotze turned to Aguirre to assemble a team of 20 private investigators, according to Aguirre’s attorney, Terry Yates, who is not related to Jeffrey Yates.

“Mark would say he’s the guy who was in charge,” Terry Yates told The Post.

I’m not going to try to guess what might be going on in Steven Hotze’s whack-a-mole brain, but I do want to understand why these jokers came to focus on this one poor guy. There had to be some reason for it, however irrational and ultimately wrong-headed. If nothing else, the attorney that eventually files a massive lawsuit against Hotze for the pain and suffering our ACRM endured will want to know the full story.

In September, Aguirre wrote an affidavit for a lawsuit brought by Hotze and the Harris County GOP before the Texas Supreme Court seeking to curtail early and mail-in voting. The affidavit alleged Democrats had devised a scheme to submit as many as 700,000 fraudulent ballots in Harris County. The Texas Supreme Court dismissed the lawsuit on Oct. 7.

Nevertheless, law enforcement officials in Harris County began looking into the claims in the affidavit. The affidavit did not mention [the ACRM], but described what it contended was a broader ballot-harvesting effort directed by local Democratic officials.

Four investigators from the Harris County Precinct 1 Constable’s Office, which is responsible for investigating voter integrity issues, were assigned to the investigation, an official said.

“We looked into the allegations,” said Constable Alan Rosen, who said investigators conducted interviews with various people but got no cooperation from Aguirre and other private investigators. “We wanted to investigate their side of the story and they wouldn’t talk to us.”

“No proof was ever substantiated,” according to Rosen.

As the Nov. 3 Election Day neared, Aguirre and other unidentified private investigators began to monitor [the ACRM] more closely, court records show. By mid-October, they had devised a plan to carry out extensive monitoring that kept eyes on the air conditioning repairman day and night, court records show.

Beginning around Oct. 15, the investigators started “24 hour surveillance” on [the ACRM]’s mobile home, a police affidavit states. They set up a “command post” nearby, renting two hotel rooms for four days in a Marriott hotel, according to the affidavit. As they watched [the ACRM], Aguirre unsuccessfully tried to convince law enforcement authorities at the state level that he was on to something big, according to several law enforcement agencies and court records.

On Oct. 16, Aguirre called a member of the state attorney general’s election task force, Lt. Wayne Rubio, to request that Rubio order a traffic stop of [the ACRM]’s vehicle, court records show. Rubio declined. Aguirre “seemed upset that the Department of Public Safety could not stop and detain an individual based solely on [Aguirre]’s uncorroborated accusations,” Rubio later told police, according to the affidavit.

Aguirre told Rubio that he would make the traffic stop and execute a “citizen’s arrest,” the affidavit states. Rubio did not respond to interview requests, and the Attorney General’s Office declined to comment.

Aguirre also contacted Jason Taylor, a regional director at a separate statewide law enforcement agency — the Texas Department of Public Safety — the agency said in a statement to The Post. That contact came a day before Aguirre is accused of ramming [the ACRM].

“Mr. Aguirre brought up the allegations of election fraud during a phone call on Oct. 18, 2020, with the Texas Department of Public Safety (DPS) Regional Director,” a spokesman wrote. “Based on that call, the matter was then discussed with the (DPS) Texas Ranger Division. The decision was then made to refer Mr. Aguirre to the Office of the Texas Attorney General.”

Aguirre later told police he was frustrated that he had “not received any help” from law enforcement agencies, according to the police affidavit.

So many questions here. What evidence did Aguirre present to DPS and the AG task force? Clearly, it was pitiful, because had there been anything at all to the juicy allegation of Democrats engaging in massive fraud, these guys would have been all over it, but that’s not the whole picture. The bigger question is, should Aguirre’s delusions have given these guys cause to worry about his actions and the potential danger to the ACRM? Did they take his threat of a “citizen’s arrest” seriously, and if not why not? Imagine for a minute if our ACRM had had a concealed carry license, and had made the determination when he saw Aguirre approach him that his life was in danger (which, as it happens, it was) and he needed to defend himself. Or instead imagine if Aguirre had gotten jumpy and made the same decision for himself. This “citizen’s arrest” could very well have had a body count, which is why I ask, should the law enforcement officers that Aguirre complained were unwilling to help him have taken action against him instead? It’s more grist for our ACRM’s future attorney, I suppose.

Police later reviewed grand jury subpoena records from Aguirre’s bank, the police affidavit states, and saw wire transfers of nearly $270,000 to his account from the Liberty Center for God and Country with payments of $25,000 each wired on Sept. 22 and Oct. 9, and $211,400 deposited the day after the alleged assault.

Houston police declined an interview request and said they would not answer specific questions about the case because the department’s investigation is ongoing.

The Harris County District Attorney’s Office, which charged Aguirre after a grand jury indictment, also declined to answer questions. “This is an active, ongoing investigation,” spokesman Michael Kolenc wrote in an email.

As I said before, I really hope that this ongoing investigation includes Hotze and the malevolent organization he spawned to finance this travesty. I sure won’t be surprised to learn that they were not scrupulous in following the law prior to Aguirre’s attack on the ACRM. Don’t be afraid to go where the evidence leads.

Constable Rosen tests positive for COVID-19

Harris County Precinct 1 Constable Alan Rosen has tested positive for the novel coronavirus, his office confirmed Wednesday.

Rosen is the second local elected official known to have contracted COVID-19, the disease caused by the virus. Houston City Councilwoman Letitia Plummer tested positive May 11.

Rosen was confirmed positive on Saturday, five days after being tested while experiencing a mild fever, spokesman Kevin Quinn said.

The constable informed his command staff of his diagnosis but not the public because it was a personal medical matter, Quinn said. Rosen declined an interview request.

“I appreciate everyone being thoughtful and kind with their words of support,” he said in a statement. “In these times, it’s so important to wear a mask, wash your hands frequently and socially distance.”

Rosen has been working from home for 10 days, and any employee with whom he interacted before his diagnosis has been tested, Quinn said. Five Precinct 1 employees have tested positive since the outbreak began here in March.

As noted, CM Plummer tested positive earlier in the month. She hopes to be free of the virus soon, as does Constable Rosen. I wish them both the best.

All have filed who are going to file

Barring any late challenges, disqualifications, or lawsuits, what we have now is our lineup for the March primary. Most of what there is to say was covered in yesterday’s post, but here are the highlights and there is some big news.

– Pretty much all of the “not yet filed” people did indeed file. There are three notable absences that I can see, though do keep in mind that the SOS page may be behind and shouldn’t be considered final until we have confirmation. Be that as it may, two people I don’t see are Judge Elaine Palmer (215th Civil Court; no one is listed on the Dem side for this court as of Monday night) and Precinct 1 Constable Alan Rosen. Hold those in mind, because there are news stories about some of the other interesting bits. Until I hear otherwise, the absence of any mention of those two suggests to me there’s no news, just a not-fully-updated SOS filing page.

– News item #1: Commissioner Steve Radack retires.

Steve Radack will not seek a ninth term as Harris County commissioner for Precinct 3, vacating a powerful position he has held for three decades that Democrats hope to flip next year.

Radack, 70, said he plans to invest his time and significant campaign account into helping Republicans regain seats after disastrous elections in 2016 and 2018.

“I’m not through being involved in public service, and I felt that there’s a lot I can do to help the Republican Party,” Radack said.

Radack and Harris County’s other Republican commissioner, Jack Cagle, endorsed Spring Valley Village Mayor Tom Ramsey for the seat.

Brandon Rottinghaus, a political science professor at the University of Houston, said Radack’s impending retirement speaks to the shifting county electorate, which has helped Democrats sweep every countywide race since 2016.

“It is getting harder and harder for Republicans to compete in a rapidly changing county,” Rottinghaus said.

Several candidates from both major parties have joined the race. Ramsey, City Councilwoman Brenda Stardig and former West University Place Mayor Susan Sample will run in the Republican primary. The Democratic race will feature Michael Moore, chief of staff to former Mayor Bill White, former state Rep. Kristi Thibaut, educator Diana Martinez Alexander and three other candidates.

I wish Commissioner Radack well in his retirement. And I am very much looking forward to seeing a Democrat elected to succeed him.

– News item #2: Council Member Jerry Davis will challenge State Rep. Harold Dutton in HD142.

Houston City Councilman Jerry Davis filed Monday to run as a Democrat for House District 142, a northeast Harris County seat long represented by state Rep. Harold Dutton.

Davis, who has represented District B since 2011, is prevented from seeking re-election due to Houston’s term limits. His council district overlaps part of the House district, which includes the Fifth Ward and runs east and then north to FM 1960.

The move ensures Dutton, D-Houston, will have his most challenging primary in years. He was first elected to the Legislature in 1984 and frequently has coasted to victory without primary opposition. Last cycle, he beat primary challenger Richard A. Bonton, 65 percent to 35 percent.

Bonton is running for the seat again this cycle.

I always figured CM Davis would run for something else when his time on Council ended, it was just a matter of what opportunity there would be. I’ll have more to say about this later, but for now this is an exciting race.

Well, I did hear that a “big name” was set to enter this race. Now we know.

– News item #4:

And now Beto has endorsed Sima. I’ve already published one interview in CD02, and I have another in the works. I’ll figure out something for this.

– Five Democratic incumbents in Congress do not have primary opponents: Reps. Lizzie Fletcher (CD07), Vicente Gonzalez (CD15), Veronica Escobar (CD16), Sylvia Garcia (CD29), and Colin Allred (CD32). Everyone else needs to be gearing up for March. As was the case in 2018 and for the second time ever, Dems have at least one candidate in all 36 districts.

– All of the statewide offices except CCA Place 9 are contested, with several having three candidates. Already, the potential for multiple primary runoffs is high.

– According to the TDP, in the end Dems have candidates in all but one of the Senate districts that are up (only SD28 is uncontested), and they have candidates in 119 of the 150 State House races. HD23 drew a candidate, but HDs 43 and 84 apparently did not. In Harris County, only HD127 is uncontested.

– There is now a third candidate for HD148, an Emily Wolf. I cannot conclusively identify her – maybe this person? – so it’s impossible to say more than that.

– And on the Republican side, State Rep. Mike Lang in HD62 is your promised surprise retirement. Dems do have a candidate in this not-swing district.

– Looking at the Republican filings, quite a few Democratic judges have no November opposition. We have officially come full circle.

Again, remember that the SOS page may not be complete. The parties have five days to notify the SOS of their candidates. It’s possible there are still surprises lurking, to be confirmed and reported. If you’re not sure about a particular candidate, google them or find them on Facebook, to see if there’s been an announcement. I’ll have more as we go this week.

The “Has Not Yet Filed” list

Today is the actual, official filing deadline. Anyone who has not filed for a spot in the primary by 6 PM today is not a candidate for a Democratic nomination in 2020. A whole lot of people have already filed, and a whole lot more will file today – I’m going to have a lot to talk about with this tomorrow and for the rest of the week – but there are still a few notable absences (with the caveat that the SOS list may not be complete). So with that in mind, here are the “why aren’t they there yet?” list to ponder as the hours tick down.

US Senate: MJ Hegar is not yet listed. John Love, the Midland City Council member who announced his candidacy in October, has ended his campaign, on the grounds that he lacked the time and finances. Good for him for recognizing his situation, and I hope he looks at 2022 for another possible statewide campaign. Eleven candidates have filed so far, Hegar will make it 12 when she makes it official.

US Congress: Reps. Joaquin Castro (CD20) and Colin Allred (CD32) are not on the list as of Sunday evening. Some of the more recent entrants in CDs 03 and 31 – Tanner Do, Chris Suprun, Dan Jangigian – are not yet on the list. Much-ballyhooed CD28 challenger Jessica Cisneros is not yet on the list. Wendy Davis has CD21 to herself right now, as Jennie Leeder has not yet appeared. CDs 19, 27, and 36 do not yet have Democratic candidates. And while this has nothing to do with our side, the Republican field in CD22 is mind-bogglingly large. Good luck with that.

Railroad Commissioner: Kelly Stone had not filed as of Sunday, but she has an event on her candidate Facebook page announcing her filing at 2:30 today. Former State Rep. Robert Alonzo has joined the field.

SBOE: All positions are accounted for. Letti Bresnahan remains the only candidate in District 5, the most flippable one on the board. I still can’t find any information online about her candidacy.

State Senate: No candidates yet in SDs 12, 18, 22, or 28. Not surprising, as none are competitive, but a full slate is still nice. Sens. Borris Miles and Eddie Lucio now each have two opponents, the field in SD19 is four deep, and Rep. Cesar Blanco still has SD29 all to himself.

State House: Far as I can tell, the only incumbent who hasn’t filed yet is Rep. Rene Oliveira in HD37. Of the top targets for 2020 based on Beto’s performance, HDs 23, 43, and 84 do not yet have Democratic candidates. Those are if not the bottom three on the competitiveness scale, with the first two trending away from us, they’re close to it. If they go unfilled it will still be a waste, but about the smallest possible waste. Rep. Ron Reynolds does not have a challenger. Sean Villasana, running for the HD119 seat being vacated by Rep. Roland Gutierrez as he runs for SD19, has the field to himself so far. In all of the big counties, the only one missing a Dem right now is HD99 in Tarrant, which is not particularly competitive.

District Courts: Limiting myself to Harris County, Judges Jaclanel McFarland (133rd Civil), Ursula Hall (165th Civil), Elaine Palmer (215th Civil), and George Powell (351st Criminal) have not filed. Other candidates have filed in the 165th and 351st, as have candidates in the 337th Criminal (Herb Ritchie) and 339th Criminal (Maria Jackson) where the incumbents are known to not be running again. Alex Smoots-Thomas now has an opponent for the 164th, and I am told another may be on the way.

Harris County offices: All of the candidates I’ve tracked for District Attorney, County Attorney, Sheriff, and Tax Assessor have now filed; I’m told another candidate may be filing for Tax Assessor, but I don’t know any more than that. David Brown has not yet filed for HCDE Position 7 At Large, but he was at the CEC meeting yesterday and I expect to see him on the ballot. Luis Guajardo has not yet filed for Commissioners Court in Precinct 3. There’s still no JP candidates in Precincts 4 and 8, and no Constable in Precinct 8. And Precinct 1 Constable Alan Rosen is still missing. Could that mean something? We’ll find out today. I’ll have a report tomorrow.

Filing update: Focus on Harris County

One more look at who has and hasn’t yet filed for stuff as we head into the final weekend for filing. But first, this message:


That’s general advice, not specific to Harris County or to any person or race. With that in mind, let’s review the landscape in Harris County, with maybe a bit of Fort Bend thrown in as a bonus. Primary sources are the SOS candidate page and the Patrick Svitek spreadsheet.

Reps. Sylvia Garcia and Lizzie Fletcher do not have primary opponents, though the spreadsheet does list a possible opponent for Garcia. As previously discussed, Rep. Al Green has a primary opponent, and Rep. Sheila Jackson Lee has three so far, with at least one more to come. Elisa Cardnell and Travis Olsen have filed in CD02. Mike Siegel and Shannon Hutcheson have filed in CD10, and none of the three known contenders have filed yet in CD22. (Before you ask, no, I don’t know why some candidates seem to wait till the last minute to file.)

In the Lege, the big news is that Penny Shaw has filed in HD148, so the voters there will get their third contested race in a four month time period. At least with only two candidates so far there can’t be a runoff, but there’s still time. Ann Johnson and Lanny Bose have filed in HD134, Ruby Powers has not yet. Over in Fort Bend, Ron Reynolds does not have an opponent in HD27, at least not yet. No other activity to note.

Audia Jones, Carvana Cloud, and Todd Overstreet have filed for District Attorney; incumbent Kim Ogg has not yet filed. Christian Menefee and Vince Ryan have filed for County Attorney, Harry Zamora has entered the race for Sheriff along with incumbent Ed Gonzalez, and Jack Terence, last seen as a gadfly Mayoral candidate in the late 90s and early 2000s, has filed for Tax Assessor; Ann Harris Bennett has not yet filed. Andrea Duhon has switched over to HCDE Position 7, At Large, which puts her in the same race as David Brown, who has not yet filed. Erica Davis has already filed for Position 5, At Large.

In the Commissioners Court races, Rodney Ellis and Maria Jackson are in for Precinct 1; Michael Moore, Kristi Thibaut, Diana Alexander and now someone named Zaher Eisa are in for Precinct 3, with at least one other person still to come. I will note that Precinct 1 Constable Alan Rosen has not yet filed for re-election, but three other candidates, two of whom filed within the first week of the period, are in for that position. Rosen’s name has been bandied about as a possible Commissioners Court challenger to Steve Radack, and if he is planning to jump to that race it makes sense that he’d take his time, since he’d have to resign immediately afterward. I have no inside scoop here, just a bit of idle speculation. There are no Dems as yet for either Constable or JP in Precincts 5 or 8.

This brings us to the District Courts, and there’s some interesting action happening here. There are a couple of open seats thanks to retirements and Maria Jackson running for Commissioners Court. Herb Ritchie is retiring in the 337th; two contenders have filed. One person has filed in Jackson’s 339th. Someone other than George Powell has filed in the 351st, and someone other than Randy Roll has filed in the 179th. I’m not sure if they are running again or not. Steve Kirkland has a primary opponent in the 334th, because of course he does, and so does Julia Maldonado in the new 507th. Alexandra Smoots-Thomas does not yet have a primary opponent.

Fort Bend County went blue in 2018 as we know, but Dems did not have a full slate of candidates to take advantage of that. They don’t appear to have that problem this year, as there are multiple candidates for Sheriff (where longtime incumbent Troy Nehls is retiring and appears poised to finally announce his long-anticipated candidacy for CD22, joining an insanely large field), County Attorney, and Tax Assessor (HCC Trustee Neeta Sane, who ran for Treasurer in 2006, is among the candidates). The Dems also have multiple candidates trying to win back the Commissioners Court seat in Precinct 1 that they lost in 2016 – one of the candidates is Jennifer Cantu, who ran for HD85 in 2018 – and they have candidates for all four Constable positions.

There are still incumbents and known challengers who have been raising money for their intended offices who have not yet filed. I expect nearly all of that to happen over the weekend, and then we’ll see about Monday. I’ll be keeping an eye on it all.

Some county race updates

2020 is going to be a very different election year in Harris County, because for the first time in anyone’s memory all of the non-HCDE countywide offices are held by Democrats. If you’re a Democrat in Harris County and you want to run for judge or an executive countywide position, you either need someone to step down or you need to challenge an incumbent Democrat. This month, we’re seeing some activity on that score, as two Democratic hopefuls have filed designation of treasurer reports for the purpose of running for County Attorney against three-term incumbent Vince Ryan. They are Ben Rose, who ran for HD134 in 2016, and Christian Menefee, past president of the Houston Black American Democrats (HBAD). That makes this one of the main local primaries to watch for 2020.

I have expected that someone, possibly more than one someone, would challenge Ryan, assuming he doesn’t decide to retire. We can agree that while Vince Ryan has generally been a fine County Attorney – his office has been sufficiently aggressive in enforcing environmental law that the Lege has taken steps to clip his wings, and he quickly put an end to then-Clerk Stan Stanart’s equivocating nonsense following the Obergefell ruling, among other things – a lot of people did not care for how he handled the bail lawsuit. If Ryan does run for a fourth term, I’m sure we’ll relitigate that with vigor. Regardless of whether Ryan is on the ballot or not, I hope we also have a spirited argument about what the role of the Harris County Attorney should be in a blue county with a Democratic majority on Commissioners Court. Is there room to take a more activist role in fighting against the actions by the state and federal government that directly harm Harris County? Maybe the answer to that question is No, and maybe the answer to that question is “Yes, but it comes with significant risk”, but I think it’s a question worth exploring. Let’s talk about what a Harris County Attorney should be doing, not just what that office and the person in charge of it have been doing.

I mentioned that the two At Large HCDE seats that remain in Republican hands are the last countywide seats held by a member of the GOP. They are At Large positions 5 and 7, now held by the execrable Michael Wolfe and the dinosaur Don Sumners. Both of them now have declared challengers, as Andrea Duhon and David Brown have filed treasurer reports against them. Duhon, who ran for and narrowly lost the HCDE Precinct 3 race last year, is up against Wolfe, while Brown will oppose Sumners. I won’t be surprised if they have company in their primaries, but for now they’re the ones.

Finally, I haven’t seen a treasurer filing, but Diana Alexander has announced her intention to challenge County Commissioner Steve Radack in Precinct 3. Alexander manages the Indivisible Houston, Pantsuit Republic, and Pantsuit Republic Houston Facebook groups; I don’t know anything else about her at this time. I can say for certain that others will be entering this race, as this is the top local prize for Democrats to pursue. Some names I have heard mentioned in connection with this include term-limited Council Member Mike Laster, former State Rep. Kristi Thibaut, and Precinct 1 Constable Alan Rosen, who would not be able to say anything about this without triggering resign to run. If you’ve heard other names being bandied about for this, please leave a comment and let us know.

We’re gonna need a bigger meeting room

Seems reasonable.

With a newfound public interest in Harris County Commissioners Court meetings, which at times have been so crowded that would-be attendees have been turned away, court members plan to build a larger chamber.

Commissioners Court [asked] County Engineer John Blount to design a new chamber on the first floor of the county administration building at 1001 Preston. The current chamber, on the ninth floor, has a capacity of 90 people. Blount said a first-floor chamber could fit as many as 220.

“We have to get a better courtroom,” Blount said. “If people had to do it again, no one would ever put the highest-occupancy facility on the highest floor of the building.”

The new chamber would occupy the west half of the first floor, which currently houses some employees of the county tax assessor-collector’s office. The office’s customer service windows on the east half of the floor, where residents can pay taxes or register a vehicle, would remain the same.

Blount said the county could design the new chamber in four to six months and complete construction about a year after that. The work would not affect in-progress renovations on the first floor, which include the replacement of exterior windows and doors. Blount said estimating a cost to build a new chamber would be a “pure guess” at this stage,

“There’s not a lot of structural work. It’s pretty straightforward,” he said.

The Harris County Precinct 1 Constable’s office, which protects downtown county properties, said a first-floor courtroom would require fewer deputies, spokesman Kevin Quinn said.

Security staff have to perform extra work on the ninth floor, he said, because the metal detector checkpoint is between the court chamber and the elevators to overflow rooms.

“Every time people come back and forth, they have to be re-screened,” Quinn said.

Seems pretty reasonable to me. The existing space is overcrowded, inconvenient, and requires extra security personnel. The proposed new location will have adequate seating for everyone, will be easier for everyone to get to, will require less security presence, and will be inexpensive to construct. Go for it.

Deterring dumping

Tough problem, good use of technology.

[Radny] Scales, a Harris County Environmental Crimes Unit lieutenant, and his team of nine investigators depend heavily on video cameras to crack down on illegal dumping, a crime that disproportionally affects the city’s poorest neighborhoods.

The City Council voted last month to add 22 cameras to create a portfolio of nearly 150 total. Precinct 1’s nearly $600,000 program also includes a fleet of drones, as well as several full-time employees.

It’s paying dividends: A two-year program started in 2016 to catch those who illegally dump their trash in remote locations across Houston yielded 694 investigations and 396 charges.

“It’s been working for the city as a whole — better than what we thought,” said Jerry Davis, the councilman for District B, who initiated the program to catch illegal dumping.

The majority are people charged in the crime are private citizens: The average offender is a 50-year-old who dumps 75 pounds of waste, according to statistics the county provided. Contractors looking to dodge the expense of paying to throw away their garbage at a designated facility account for just 20 percent of offenders.

Beyond just being eyesores, illegal dumping sites present serious consequences, including being safety hazards and serving as a breeding ground for potentially disease-ridden mosquitoes, snakes and other wildlife. Dumping sites can also contribute to flooding and could potentially have a serious impact in future weather disasters.

“When you have drains that have been stopped up because people put furniture and tires and plastic, it’s going to cause flooding,” [Precinct 1 Constable Allen] Rosen said.

Illegal dumping is a big problem in some parts of the city, and has been for a long time. Video cameras are basically the only realistic hope for catching the perpetrators in the act, but it takes a lot of them because stuff gets dumped all over the place. It’s good some real resources being put into this, because it’s a real quality of life issue for a lot of people. I hope this is big enough and sustained enough to put a serious dent in the problem.

Harris County could use a bit of cybersecurity training

Oopsie.

On Sept. 21, not three weeks after Houston was ravaged by Hurricane Harvey, the Harris County auditor’s office received an email from someone named Fiona Chambers who presented herself as an accountant with D&W Contractors, Inc.

The contractor was repairing a Harvey-damaged parking lot, cleaning up debris and building a road for the county, and wanted to be paid. Chambers asked if the county could deposit $888,000 into the contractor’s new bank account.

“If we can get the form and voided check back to you today would it be updated in time for our payment?” read a Sept. 25 email from Chambers.

On Oct. 12, Harris County sent the money out. The next day, the county quietly was scrambling to get it back, after being alerted that the account did not belong to D&W, that Chambers did not exist and that county employees had been duped by a fraudster.

The county recouped the payment, but the ongoing investigation into who tried to take the county’s money and nearly got away with it has ignited a debate over the financial security and cyber security of the third-largest county in America. That debate comes as experts point to a growing number of increasingly sophisticated attackers from around the world, homing in on untrained employees or system vulnerabilities.

The incident now has become wrapped into an FBI investigation into a group that has attempted to extort local governments around the world, law enforcement officials said.

Meanwhile, some officials are moving to revamp their practices as others say further scrutiny of county defenses is necessary.

There’s a lot going on here, and a lot of room for process improvement. The county can provide training to employees to better recognize phishing attempts, and send out test emails to ensure that the training took hold. Extra checks and verifications, like pre-screening vendors an maintaining a list of approved vendors, can be put into place before any payments are made. Keeping on top of threat intelligence, to know what the new scams are that are going around, and ensuring that the email system and the proxy servers recognize junk mail and malicious websites. Cybersecurity is a process, and it contains multiple layers. The fact that the county almost got scammed is in itself not a great shame – it does happen, to many organization – but only if the opportunity to learn and improve from it is fully embraced.

January 2017 campaign finance reports: Harris County officeholders

We may or may not have City of Houston elections this year, but we will definitely have Harris County elections next year. Here’s a brief tour of the finance reports for Harris County officeholders. First up, Commissioners Court:

Jack Morman will likely be a top target in 2018 – he has one announced opponent already, and will almost surely have others – and no one can say he isn’t ready for it. I expect that cash on hand number to be well over two million by this time next year. Money isn’t everything, and returns on more campaign cash diminish beyond a certain point, but whoever runs against Morman will have some ground to make up to be able to get a message out and a ground operation going. Meanwhile, the campaign coffers of the late El Franco Lee have more in them than Morman and Rodney Ellis combined, and I still have no idea what’s happening with that. I have some suggestions, if anyone administering that account is curious.

I skipped the offices that were just elected, because life is short. Ed Emmett’s modest total is further evidence that he was not originally planning to run for re-election next year. I feel confident that he’d have more cash in his coffers if that had been the idea all along, and I also feel confident he’ll make up some ground before the next reporting deadline. Diane Trautman would be up for re-election to the HCDE Board, but as we know she is going to run for County Clerk, so I’m including her here. I’ll be interested to see if any money pours into this race. Orlando Sanchez has had that $200K loan on the books since at least the July 2014 report. I still don’t know where he got the money for it, or why he apparently hasn’t spent any of it since then, but whatever.

All of the Constables, as well as the Justices of the Peace in Place 1, were on the ballot last year, but as I have never looked at these reports before, I figure what the heck. Alan Rosen has always been a big fundraiser. Sherman Eagleton survived a primary and runoff, which is what that loan money is about. I presume all of the action for Mark Herman was in late 2015 and early 2016, after he got promoted and needed to win a primary. I’d have to check to see if Silvia Trevino raised and spent a bunch of money early on and then took a break, or if she just relied on name recognition to win. She did win without a runoff, so whatever she did do, it worked.

The Place 1 JPs were elected last year as noted, while the Place 2 JPs will be up next year. David Patronella’s form did not list a cash on hand total. For what it’s worth, all three groups (Constables and the two sets of JPs) have the same partisan mix, five Dems and three Republicans. I don’t have any further insights, so we’ll wrap this up here.

Endorsement watch: First, reform the office

The Chron has almost as much to say about the office of Constable as it does about the candidates for Constable that they prefer.

Harris County needs to bring these law enforcement fiefdoms in line: Update precincts to equalize populations, reduce the competing bureaucracies, centralize the evidence room and put county law enforcement responsibility in the hands of the Sheriff’s Office. Harris County also needs to encourage unincorporated regions to directly fund their own law enforcement, whether through independent taxing districts or incorporation into formal cities.

It is time to return constables to their core duties. It will save taxpayer dollars, streamline government and knock out some of Harris County’s most problem-prone institutions.

Constable, Precinct 1: Alan Rosen

Since his election in 2012, Constable Alan Rosen has set the standard across the county for professionalism. While his precinct covers the western half of the Inner Loop and inside Beltway 8 from US 290 to Interstate 69, Rosen, 48, also has the countywide responsibility of serving juvenile and mental health warrants and of overseeing environmental investigations and animal cruelty cases. The Democratic incumbent has put a strong emphasis on training and community relationships. For example, when Houstonians marched downtown to protest police brutality and in support of racial equality, Rosen spoke to the crowd about the shared pain felt by communities and law enforcement officers.

Constable, Precinct 2: Christopher (Chris) Diaz

Our choice is the incumbent Christopher (Chris) Diaz, a former mayor and councilman in Jacinto City.

Constable, Precinct 3: Dan Webb

Incumbent Preinct 3 Constable Ken Jones is retiring and residents of Harris County would do well to cast their ballots for Republican Dan Webb, who currently holds a Department of Public Safety Commission as a Special Ranger and has 33 active-duty years of law enforcement service. Webb promises to fix the “good ol boy” promotion system at this precinct, which encompasses Channelview, Huffman, Crosby and Highlands and part of the Northshore communities.

Constable, Precinct 4: Jeff McGowen

If Precinct 4 Constable Mark Herman, a Republican, worked in the private sector, he would have been fired for the evidence room scandal that occurred on his watch. This race should be viewed as an opportunity to remove a politician who has failed at a job and elect a replacement.

Voters in this massive precinct, which stretches across north Harris County from US 290 to Lake Houston, luckily have a qualified candidate in Jeff McGowen. The Democratic challenger is a 23-year veteran of the Harris County Sheriff’s Office and is a strong advocate for community policing. In a meeting with the editorial board, McGowen, 46, offered proposals on improved training and greater coordination between precincts.

Constable, Precinct 6: Richard “Rick” Gonzales

Silvia Treviño isn’t asking anyone to call her madre, but students of Texas history should see reflections of Pa and Ma Ferguson – the unfortunate tag-team husband and wife Texas governors – in this race for Precinct 6 Constable.

Silvia’s husband, former Precinct 6 Constable Victor Treviño, is currently on probation for spending charity dollars at a Louisiana casino and faces newfound scrutiny for running an evidence room that had not been cleaned out or organized during his 26 years. Now Silvia is running to take her husband’s former position and defeated incumbent Precinct 6 Constable Heliodoro Martinez in the Democratic primary.

It is time to make a full break and elect someone new.

Constable, Precinct 8: Phil Sandlin

Incumbent Phil Sandlin is the right man to be constable of this southeast precinct that borders the Houston Ship Channel and includes NASA and many large chemical complexes.

I’m not going to argue with any of the Chron’s endorsement choices. There are a lot of less-than-inspiring candidates on the ballot, though thankfully my own Precinct 1 is in a much better place than it was four years ago. I think the Chron’s litany of complaints about the function and role of the Constable in Harris County deserves attention. We are going to be electing a new County Judge in 2018, and I hope we will also have a spirited race for County Commissioner Precinct 2. Both of these present an opportunity to have a discussion about the role of the Constables, among other things. If we want things to be different we can make it so, but it’s not going to happen without an active effort.

CM Ed Gonzalez to run for Sheriff

City Councilman Ed Gonzalez, an 18-year Houston Police Department veteran, announced Tuesday that he will run for Harris County Sheriff next year.

Gonzalez is finishing his third and final term as councilman of District H, the majority Hispanic district that includes the Near Northside and the Woodland Heights, in addition to some neighborhoods north of the 610 Loop. Gonzalez currently serves as mayor pro tem and chairs the council’s Public Safety and Homeland Security Committee.

“My passion has always been public safety, it’s been kind of my wheelhouse,” Gonzalez said. “It’s something that I just feel, as a someone who cares about public safety, I want to continue to serve in this capacity. I want to give voters a choice.”

CM Gonzalez has represented me in City Council for his three terms, and I think highly of him. Mayor Parker credits him for a lot of the work on the sobering center, which has been both a money saver and an improvement in justice. As I noted before, the name that has always come up whenever I ask someone about who might run for Sheriff has been Constable Alan Rosen. I have no idea if Constable Rosen is or has ever been interested in running for Sheriff, but I was corrected about the assertion I had made that he’d have to resign if he ran for Sheriff. That requirement does not apply to non-countywide office holders like himself, so he could continue to serve as Constable while running for Sheriff. He would, however, have to make a choice since his term as Constable is up at the end of 2016. Either he files for re-election or he tries for Sheriff; it’s not a free shot. Th deadline is next Monday, so we’ll know soon enough. Regardless, I’m delighted to have a candidate of CM Gonzalez’s quality in the race, and I look forward to his campaign.

Morris Overstreet to run for DA

I know we’re all still recovering from Tuesday, but the 2016 filing season is almost upon us, and the Democratic race for Harris County DA just became a contested race.

Former appeals court judge Morris Overstreet announced Thursday that he would seek the Democratic nomination for Harris County District Attorney.

Overstreet, a former judge on the Texas Court of Criminal Appeals who has been a licensed attorney since 1975, said he wanted to bring integrity to the state’s largest DA’s office, currently helmed by Republican Devon Anderson.

“I want to instill integrity, so that the people of Harris County have public trust in the office of the district attorney,” Overstreet said. “As a trial judge and a prosecutor involving hundreds of jury trials and thousands of non-jury trials, I’ve never had any criminal conviction reversed because of any error committed by me.”

Here’s a post of Facebook from Overstreet’s announcement. He had released a video on YouTube on October 28 teasing the announcement. Overstreet was a candidate for Chief Justice, 1st Court of Appeals in 2010, and more recently was appointed by the Waller County Sheriff to an independent panel of civilians to evaluate his department in the wake of Sandra Bland’s death. Overstreet joins Kim Ogg in the race, presumably against incumbent DA Devon Anderson, who has not yet announced but is expected to run and who as far as I know has not attracted a primary opponent. I look forward to the debate in this race, Lord knows there’s plenty to talk about.

As far as the rest of the primaries go, County Attorney Vince Ryan, the sole Democratic countywide officeholder, is expected to run again, and I have not heard word of a primary opponent nor of a Republican challenger yet, though I’m sure there will be the latter. Brandon Dudley, chief of staff to Sen. Rodney Ellis and 2010 judicial candidate, is running for Tax Assessor against Mike Sullivan; Ann Harris Bennett, who ran for Tax Assessor in 2012 and County Clerk in 2010 and 2014, is also running. So far, no one has announced on the Democratic side for Sheriff. The name people bring up when I ask about it is Precinct 1 Constable Alan Rosen, who would be up for re-election this year. He himself has not said anything, for the same reason former Sheriff Adrian Garcia couldn’t talk about running for Mayor – he’d have to resign as soon as he did say something. There’s some speculation around outgoing CM Ed Gonzalez as well, but Rosen is the name I keep hearing. Incumbent Sheriff Ron Hickman should have at least one primary opponent, 2012 candidate Carl Pittman, but beyond that I don’t know. I’ll do a roundup on judicial and legislative and other races another time. If you have a name and some reasonably informed scuttlebutt to add to this, by all means please do.

Fighting illegal dumping

Illegal dumping of trash is a huge problem in some Houston neighborhoods. Enforcement is especially tricky because unless you catch someone in the act, there’s little to no evidence to go on. One way to help catch dumpers in the act is with cameras at locations where dumping frequently occurs. Council Member Jerry Davis has been working to get a camera program to fight illegal dumping going. He was able to get some money from the budget to work on this but couldn’t work out the details with HPD. We pick up the story from there.

So last year, Davis and his staff instead turned to Harris County for help. He offered Precinct 1 Constable Alan Rosen the $250,000 to purchase, assemble and monitor 25 cameras in areas where people frequently cast off garbage.

Deputies from constable precincts 1 and 5 make up the county’s environmental crimes unit but have jurisdiction throughout the county. The deputies would largely focus on areas in council districts with the most illegal dumping complaints, ranging from Sunnyside to Kashmere Gardens to the East End. The county would own the cameras and keep any funds generated from prosecuting crimes.

In Houston, any amount of illegal dumping can result in fines, and more than 5 pounds can yield jail time.

On Wednesday, City Council approved the agreement, which could span three years with renewals. Harris County commissioners are expected to take it up early next month.

“It was a lengthy process and, yes, we did get a little bit upset at times,” Davis said. “But we just persevered and worked with the legal department to make sure this gets done because the people are counting on it.”

HPD environmental senior officer Stephen Dicker largely agreed with Davis’ assessment of why the city opted to work with the county. Dicker said HPD talks fell apart two years ago when he told the city he would need to add 15 people, effectively doubling the investigations unit, to set up, man and track the new cameras to the tune of $1.7 million. The money simply wasn’t there.

The city’s environmental unit also tends to focus on larger commercial and industrial offenders that have a bigger public health impact, Dicker said.

“The emphasis just doesn’t match up,” Dicker said. “He’s looking at just trash on the streets. We do water pollution, air pollution. Those are much bigger impacts. But we do hope the program with the county works.”

I’m glad to see this because it really is a problem, and for those of us who are lucky enough to live in a neighborhood where it doesn’t happen, we have no idea what it’s like to put up with this. I get why HPD focuses its environmental enforcement efforts on commercial and industrial offenders, but I’m still disappointed that the department didn’t have the capability to take this on, given what a big quality of life issue it is. This is one reason why I keep saying that we need to have a much better understanding than we currently do about how HPD prioritizes its budget, which very much informs how it prioritizes what crimes it pursues. I have no doubt that there wasn’t an additional $1.7 million to be found in the HPD budget as it currently stands, but I also have no doubt that we could re-prioritize that budget in a way that would have allowed this. Maybe we would still not choose to pursue this, but we can’t know that until we have a clearer picture of what HPD does and why it does what it does and doesn’t do what it doesn’t do.

I will also note that one of the things that a garbage fee could help finance is a stronger enforcement organization against all forms of illegal dumping. We fund the Solid Waste department through general revenue, which makes Houston different than other Texas cities. They do a great job, but they could do more of it, and there would be more room in the budget for other things. And no, I don’t expect this to be brought up for discussion any time soon. I’m just saying.

Now what do we do with those body cameras?

KPRC addresses an important question.

HPD has been running a pilot program regarding body cameras for more than a year. 100 officers are currently wearing a body camera. The department has yet to finalize a policy on the use of these cameras and the retention of video.

As it stands now, each officer is responsible for turning on the camera and recording an incident and then downloading the video and the end of every shift. Each camera records up to four hours of video.

HPD officers wearing these cameras are also required to check a series of categories indicating what type of incidents they recorded during a shift. HPD officials said “use of force” incidents are flagged in the system and the video is immediately reviewed.

HPD is not deleting any video at this point. HPD also has not given a specific time frame as to when these cameras will be implemented depart wide.

Harris County Sheriff Adrian Garcia put 38 body cameras on the streets and is still crafting policy. Garcia has said he wants a full implementation within 90 days. Garcia’s is also experimenting with different types of cameras that can be mounted on the head, chest or shoulder.

Precinct 1 Constable Alan Rosen began a pilot program 5 months ago with three cameras. Rosen says the cameras are deployed during all tactical assignments and when high risk warrants are served.

Rosen’s office is also experimenting with different types of cameras and whether an officer will be responsible for turning on the cameras or a having system where the cameras are turned on automatically during a call. The Precinct 1 Constable’s is saving all video for 90 days unless part of a complaint or criminal case.

“I think it’s also going to help the public understand what we go through on a daily basis, the split second decisions law enforcement has to make,” said Rosen. “The public has to have confidence in its police.”

See here and here for some background. I hope HPD finalizes its policies soon. I would prefer for there to be clear rules about when cameras are to be in operation, with clear and enforceable consequences for not following those rules. We also need to know who will have access to the data, how long it will be kept, and what the process will be for requesting a specific video or set of videos. I’m sure there are some best practices out there that can be copied, so copy away. This has the potential to do a lot of good, but we have to do it right and ensure that everyone has confidence in it.

Precinct 1 Constable overview

The Chron takes a look at the Constable race in Precinct 1, which will determine the successor to disgraced former Constable Jack Abercia.

[Republican Joe] Danna, 59, and a Precinct 1 deputy for 18 years, pledged to reorganize an office top-heavy with administrators and move them from offices to patrol duty. He started the constable’s first motorcycle escort service and manages escort services for other law enforcement agencies.

Danna wants to establish an undercover unit to combat street crime, as well as a group to investigate credit card fraud and identity theft.

“I’ve been in the streets protecting and serving the citizens and business owners, assisting them with what the constable’s office does best, enforce the law,” Danna said.

His opponent, [Democrat Alan] Rosen, is a private investor who has spent 21 years in law enforcement. He currently serves as a volunteer reserve major in the Harris County Sheriff’s Office, and runs the criminal warrants and fugitive warrants unit. He began his law enforcement career in Precinct 1, where he was a patrol deputy, and notes he is the only candidate with a college degree, experience as a patrol deputy, and experience supervising other law officers.

“One of the biggest things the office needs is an ethical cleansing,” Rosen said. “If elected constable, I intend to put forward a very comprehensive ethics policy to include everybody in the office, to include myself.”

Here’s the interview I did with Alan Rosen for the Democratic primary, and here’s a guest post he wrote before the runoff. Rosen has the Chron endorsement and has been a strong fundraiser throughout the cycle. By 2008 partisan numbers, he’s also the favorite to win. I think Rosen will do a good job, and I’ll be voting for him.

Endorsement watch: Constables

The Chron makes recommendations in the three contested races for Constable.

Alan Rosen for Constable, Precinct 1: As a reserve major and commander of the Special Operations Bureau for the Harris County Sheriff’s Office, Alan Rosen has the law enforcement and management experience that makes for a well-qualified constable.

Chris McDonald for Constable, Precinct 2: A lieutenant in the Baytown Police Department, Chris McDonald has a straightforward, realistic perspective on the Harris County constable offices: They’re good ol’ boy clubs.

Ken Jones for Constable, Precinct 3: Ken Jones is completing his third term as constable for Precinct 3, which covers northeast Harris County, and voters should give him a fourth.

All three Constable precincts favor Democrats, though with all the weirdness this year in Precinct 2, who knows what might happen (McDonald is the Republican). I note that the Chron called out Rosen’s opponent Joe Danna for being a poor choice for the office. All I know is that Danna is the early favorite for the Eric Dick Award for Most Illegally Placed Signs, at least in my neck of the woods.

Fall interview season begins tomorrow

I know that we just finished the primary runoffs, but we’re also now more than halfway through August, so it’s time to start doing interviews with candidates for the fall. I’ll be up candid, I don’t know exactly how many interviews I plan to do. For the most part, I don’t anticipate re-interviewing candidates that I spoke to for the May election – I’m already too far behind even if I did want to do that. I’m mostly going to concentrate on area races, but as always things can and do change, so don’t hold me to that. Lloyd Doggett; though I did finally make contact with a staffer before the primary, at this point I doubt there’s any interest on his end. There was a contested primary in CD10, but both candidates were late filers. I am trying to reach Tawana Cadien, who won the nomination, but she has no phone number that I can find and she has not as yet responded to an email I sent. 2012 Democratic primary runoffs

All state results here. Best news of the night was Paul Sadler‘s easy win. Can we please raise some money for this guy?

Congressional results: James Cargas in CD07, Pete Gallego in CD23, Rose Meza Harrison in CD27, Marc Veasey in CD33, and Filemon Vela in CD34. I’m delighted that three quality members of the Texas Democratic legislative caucus will have a shot at serving in Congress next year. As for Filemon Vela, I’m still suspicious of the guy, but we’ll see how it goes.

In the Lege, Gene Wu had another strong showing in HD137, and I feel very good about his chances to win this Dem-favored-but-not-a-lock seat in November. Parent PAC didn’t have any skin in the runoffs, but Annie’s List did, and they went one for two, as Nicole Collier will succeed Veasey in HD95, but Tina Torres lost to Phillip Cortez for the nomination in HD117. That’s a critical race in November.

The biggest surprise of the night was also some good news, as Erica Lee romped to a huge win in the HCDE Position 6, Precinct 1 runoff. She won with close to 75% of the vote, so maybe, just maybe, that will be enough to convince anyone who might file another lawsuit that they’d be wasting their time. I truly hope this is the end of it, because this is by far the best possible outcome. Congrats to Erica Lee, to Alan Rosen in Constable Precinct 1, to Zerick Guinn in Constable Precinct 2, and to all the other winners last night. Onward to November, y’all.

UPDATE: Litigation is coming for the HCDE election.

The Department of Education has filed a federal lawsuit seeking to void the May primary and Tuesday’s runoff. Lee, Harris County and both political parties want to dismiss the case, which is ongoing.

Johnson said he had planned legal action on behalf of the 1,400 excluded voters whether he won the runoff or not.

“The whole point of this was to make sure the disenfranchised voters had a voice,” Johnson said.”

I guess it was too much to hope for otherwise.

UPDATE: When I went to bed last night, Zerick Guinn was leading by what I thought was a safe margin. Apparently, not safe enough as today Chris Diaz is shown as the winner by 3 votes. I smell a recount coming.

UPDATE: The plot thickens. Here’s the 10:12 PM update from the County Clerk website, which the last update I saw before I went to bed. See how Zerick Guinn has 2695 votes? Now here is the 12:43 AM update in which Guinn has mysteriously dropped to 2061 votes, which puts him behind Diaz and his 2064. How does that happen?

Precinct 1 Constable runoff overview

Here’s the Chron overview of the Democratic runoff for Constable in Precinct 1 between Alan Rosen and Cindy Vara-Leija.

Alan Rosen

Rosen is an investor and a reserve major with the Harris County Sheriff’s Office, who has been a certified peace officer for 21 years. He spent six years with Precinct 1 in the 1990s as a full-time deputy and a volunteer reserve. Vara-Leija retired from Precinct 1 as a captain last fall after more than three decades.

Both pledged to perform a thorough review of the agency. Rosen says he will implement an ethics policy; Vara-Leija says she will form an office to investigate external and internal complaints and monitor staff behavior.

“I have valuable insight that my opponent does not. I did come from Precinct 1,” Vara-Leija said. “I know exactly where to go, how to take care of problems that I know are already there.”

Rosen countered that his broad experience – including stints at three constable precincts and the Sheriff’s Office – better places him to restructure the department. “It’s not going to be the same old cronyism that goes on down there,” he said. “I’m a candidate of change.”

Cindy Vara-Leija

Vara-Leija accused Rosen of misrepresenting his post at the Sheriff’s Office by not clarifying that he is a reserve. Rosen called that a “non-issue,” noting that reserves have the same training and arrest powers as full-time officers and that his training hours and patrol experience exceed his opponent’s.

“The sheriff himself does not designate the difference between a reserve or a paid person,” Rosen said. “I’ve arrested hundreds of felons.”

Though the Harris County District Attorney’s Office had been asked to investigate how some Precinct 1 deputies had received mail from the Rosen campaign – officers’ addresses are exempted from public disclosure – prosecutors have confirmed that Rosen was not the target of the probe.

Online, Rosen supporters have questioned whether Vara-Leija knew of Abercia’s alleged crimes while at the precinct.

“My responsibilities and my duties were to supervise and to make sure those under my command were taking care of the community’s needs,” Vara-Leija said. “Whatever was going on in the constable’s office, I was not privy to.”

Unlike the Precinct 2 Constable race, the Chron has made an endorsement in this one, recommending Vara-Leija in May. I think they’re both good people and good candidates, so you can’t go wrong whoever you choose. As long as you vote, it’s all good in this race.

Alan Rosen: A Call To Protect Our Children

The following is from a series of guest posts that I will be presenting over the next few weeks.

Every day, the internet opens up new doors for communication, commerce, and the betterment of all our lives. But, with great advances in technology come huge risks and the responsibility rests with each of us to protect our greatest treasure: Our children.

Right here in Houston, a family told Channel 11 that their 12-year-old daughter had been lured into the sex trade by someone chatting with her on Facebook. KHOU reported the girl was taken to an undisclosed location and forced into prostitution. The girl was missing for 48 hours, which must have felt like an eternity to her parents. The family said they were able to finally track her down thanks to GPS on the girl’s cell phone. Technology was what led her astray, but technology is also what brought her back.

These stories make my heart sink – not only as a law enforcement officer, but as a father. I don’t mind telling you it keeps me up at night thinking that something might happen to one of my children. But, worrying isn’t what solves problems. We must all be more proactive and find the best ways to make the lives of our children safer and richer. We shouldn’t close them off from the learning opportunities presented online, but we can’t turn a blind eye to the dangers.

Here at home, I established the first Child Predator Apprehension Team at the Harris County Sheriff’s Office. Positive change can happen and it’s simply a matter of actually doing the work. We’ve done the work and it continues to this day. We increased warrant apprehension rates 161 percent and capture rates for the Child Predator Apprehension Team is 84 percent. Those are people who would otherwise be on the streets of Harris County preying on our children.

The next thing we need to do is create an Internet Predator Task Force. We have to take a stand and I propose we do it through the best use of technology. We can keep an eye on these child-targeted sites and let the bad guys know we’re watching them here in Harris County.

Local and state leaders are figuring out that a proactive approach is the best way to get real results. For example, our neighbors to the east in Louisiana are about to start requiring every registered sex offender to include their criminal status in their social media profiles. It may seem like a small step, but it’s a shield in the fight to keep our kids safe. It is up to us to work proactively with families, legislators and community leaders to stay ahead of those who would harm our most precious asset—our children.
