How the May election is being run in Harris County

Fresh off last November’s midterm elections, Harris County Elections Administrator Clifford Tatum has implemented operational upgrades to the county’s system and vote collection process for presiding judges working at polling locations.

These changes have been in full swing as early voting for the May 6 election – which covers races for school board trustees, public infrastructure bond proposals and smaller county municipal leaders and mayors – started this Monday, April 24 and will end on Tuesday, May 2.

Tatum’s moved to alter the county’s procedures after some Republican candidates made claims of voter suppression that they said were due to paper ballot shortages at least 20 of the total 782 polling locations.

To avoid similar issues from reoccurring, the county has digitized its inventory system, moved from its old phone system to the software tracking system, ServiceNow, and designated several of its early voting polling locations as supply centers – locations where ballot paper or other election items that are needed can be picked up, according to Nadia Hakim, deputy director of communications for Harris County election administrator’s office.

Additionally, the county has designated six rally centers where presiding judges will go after they have completed their closing procedures; instead of having to drive all the way to a central downtown location as they did with NRG Arena in the last election.

Each judge will be assigned to one of the six locations; this is meant to make the unofficial results available to the public sooner, Hakim said.

Brandon Rottinghaus, University of Houston political science professor said that this election can be used as a trial run as it features local races on the ballot making it a smaller scale, lower stakes election.

“It is helpful for municipalities to start off with an election like this after they’ve made changes so it can give them a sense of where there might be some flaws and gives them an opportunity to fix them before they’ve got a groundswell of additional voters,” Rottinghaus said.

Dr. Benjamin Bannon, Manager of Training for Harris County Elections Administration, who prepares the presiding judges’ working polling locations, has been in close contact with the county to ensure that the changes implemented are processed and understood by the judges.

“We are given updates and information and what we do is make sure the training that we are delivering is accurate and communicated to everyone,” Bannon said.

He conducts four-hour long classes making sure the judges carry out procedures correctly, and also trains them to handle and interact with voters at the polls.

“We model training as to how we would like to operate at a voting center with accuracy and precision,” Bannon said. “We tell the judges that they are going to be met with individuals who know what they are doing and those who may need a few questions answered.”

Although these judges will not be traveling to a central location this time around, no other changes to how they are supposed to operate were made. The county usually updates their training curriculum ahead of every midterm election.

For small-scale elections like this one, Bannon trains around 2,000 judges, compared to larger ones, where he will train around 6,000.

I mostly note this because of the news that the Elections Office has implemented a trouble-tracking system, which had been notably absent before now and was a reason cited in the office’s post-election assessment as to why the facts were not fully established regarding the paper shortages. Both that story and this one from last November note that other large counties had implemented such systems years ago; the latter story says Dallas has had such a system in place since 2012. I note this because, of course, Stan Stanart was still running elections in Harris County in 2012. Indeed, he had another six years of running them before finally being voted out. So when certain people complain about how elections have been run in Harris County, it’s worth noting that elections were run in Harris County before 2020 as well. Maybe it’s taking awhile for the Elections office to get things all cleaned up, but there was a much longer period before that, which is what necessitated the cleanup in the first place.

UPDATE: I drafted this over the weekend, before the Senate passed bills to force Harris County to return election administration to the County Clerk and Tax Assessor and allow the SOS to order a new election in Harris County if more than two percent of voting locations run out of paper. (Which will get sued if it passes.) The weird and probably unhealthy thing is that I actually expected worse. Going back to the old two-office election management process is inefficient and just dumb, but we have a good County Clerk who used to run the elections herself, so it’ll be fine. And if there’s one thing I feel confident we’ll fix after the 2022 saga, it’s never underestimating the amount of paper ballots needed again. If this is all they do, all I can say is it could have been worse. Again, a screwed up way of thinking about it, but this is the kind of trauma that the Lege is inflicting these days.

Lege targets Harris County election administrator

We knew something like this was coming.

House and Senate bills filed by Republican lawmakers in response to Harris County’s mismanagement of its recent elections could give the Texas secretary of state the authority to step in, suspend county election administrators when a complaint is filed and appoint a replacement administrator.

Election administration experts told Votebeat the legislation was an overreaction to the desire to hold Harris County accountable for years of election mismanagement, and would disrupt the state’s ability to help county election offices improve and address systemic problems.

If passed, the secretary of state’s office would change from being a guide and resource for election workers to being an auditor that can investigate and fire them. Some election officials are concerned this change could prevent local election workers from asking questions or seeking help from the office for fear of being reprimanded.

“Currently we work hand-in-hand. [The secretary of state’s staff] are our No. 1 resource, and that benefits all voters,” said Jennifer Doinoff, Hays County elections administrator. “Putting them in the position of oversight would definitely change the dynamic.”

Authored by state Rep. Tom Oliverson and state Sen. Paul Bettencourt, both Harris County Republicans, the bills are among several already filed this legislative session in reaction to the long lines, late openings and reports of shortages of ballot paper on Election Day in Harris County. More than 20 lawsuits from losing Republican candidates have also been filed against the county, citing those problems and seeking a redo of the election. Harris County Elections Administrator Cliff Tatum did not respond to Votebeat’s request for his comment about the legislation.

House Bill 2020 and Senate Bill 823 would allow the secretary of state’s office to take action in a county if a complaint is filed by one of several officials and organizations involved in elections, and if there’s “good cause to believe that a recurring pattern of problems with election administration exists.”

The bills list five causes for suspension of an elections administrator:

Currently, any problems that arise in an election or with an elections administrator are handled by the county’s election commission. Those commissions are made up of the county judge, the tax assessor-collector, the county clerk and the chairs of local political parties. The commission’s oversight powers allow it to appoint, terminate or accept the resignation of the county’s election administrator.

Some Texas voting rights groups worry the Legislature will use the problems in Harris and those lawsuits as “an excuse” to advance bills such as these. The League of Women Voters of Texas in a statement last week said such legislation, if passed, “is fraught for potential abuse, infringes on the rights of county governments to select their own elections administrator, and demeans the meaning of local governance.”

Slightly more than half of Texas counties appoint nonpartisan election administrators to run their elections. This legislation would apply only in those counties and not in the 122 that elect county clerks or tax assessors tasked with running elections and handling voter registration.

“We are subject to the authorities of those that appointed us,” said Remi Garza, Cameron County elections administrator and the Texas Association of Elections Administrators legislative committee co-chair. “It does cause concern that somebody from outside that jurisdiction would be able to usurp the authority of the elections commission in dealing with their elections administrator.”

There’s more, but I don’t have the mental energy to continue, so go read the rest for yourself. This story came out the same day that a Senate committee approved a bill making “illegal” voting a felony with even harsher punishments and lower standards for “illegality” than before. So, you know, a banner Monday.

My first thought is that I’m not really clear what these guys are aiming at. I mean, Harris County could in effect call their bluff, restore election administration to the County Clerk, have Cliff Tatum move over and be the chief of elections under Teneshia Hudspeth, and this bill would no longer apply to us. Democrats would still be running the elections. Maybe they actually think Stan Stanart can win that ridiculous election contest, I don’t know. At this level, this is just weird.

Second, these bills – I assume they’re identical in each chamber – are just a mess. The story goes into detail about how absurdly vague the provisions are, which could put a whole lot of election administrators in solidly red counties in danger if something goes wrong, as things sometimes do. I obviously wouldn’t expect the Secretary of State to crack down on, say, Bell County as they’re slavering to do to Harris, but it could be that the first example to be made is in a red place. This is what happens when you let your rage control you.

(Of course, if we had managed to pass a federal voting rights law over the past two years, we wouldn’t be talking about any of this now. But hey, Joe Manchin and Kyrsten Sinema preserved the filibuster, so.)

Third, I kind of suspect that in the same way that the TEA probably doesn’t actually want to take over HISD, the SOS probably wants no part of administering Harris County elections. It’s big, it’s hard to do, and most importantly now everything that goes wrong is your fault. Who wants that? But the Republicans in the Lege don’t care about that. Slapping around Harris County is the point. If there’s collateral damage, so be it.

And finally, with a less-predatory state government, we could have a reasoned discussion and admit there are problems that could be fixed with some help from that state government and Lege find ways to do elections better that aren’t predicated on punishment and the exercise of raw power. And if I flap my arms and think happy thoughts, I could fly.

I’ve made the decision to pay less attention to the Lege than I have in the past because I don’t need the mental torment. The Republicans are gonna do what they’re gonna do, and we can’t stop them. One fine day we’ll win enough elections to make it stop, but until then this is what we’re gonna get. I don’t know what else to say.

You can help Democrats being sued by election losers

Below is a list of the judges and electeds being sued by the Republicans. These are nuisance suits but the Judges and Lina have had to hire attorneys to represent them against the claims. Marilyn and Tenesha have pro bono attorneys but the others are not allowed to be represented pro bono due to conflicts of interest. The judge hearing the case is in San Antonio which complicates matters re time to get there and back for hearings. The travel time alone for the attorneys will be in the thousands when ZOOM meetings are not allowed! The average attorney charges $500 per hour. The fee can’t be lowered due to “appearance of impropriety” issues. The judges listed as well as Lina have little in their campaign coffers. That’s how it is for the judges. One judge whose race is being challenged, David Fleisher, lives in 133. This is the state house district in which I ran back in 2018 and 2020.

I was on several endorsements interviews with some of these judges through a different organization. This is how I learned how little was in their campaign accounts. The Republicans picked the judges with some of the smallest accounts.

It is believed that the purpose of these suits is to drag out the cases, have judges dip into personal resources, and be exhausted financially and emotionally by the time of their next race.

The Harris County Democratic Party is NOT doing anything to assist the 22 electeds. If even one is bounced, Abbott could appoint a replacement for those in the criminal courts. Judges are being sued “in their individual capacity.” That is why each person named in a suit has to retain their own attorney.

CLUBS IN ACTION is trying to raise 95K to donate to them. The maximum that a judge can receive from a PAC is $5000, so that is the goal for each judge and for Lina. We all know that Lina received very little in campaign contributions, especially compared to Mealer.

During the election CIA knocked on 300,000 doors. WHD knocked on about 1500. We worked hard to make this happen. No one wants all this hard work to go to waste. So, if you are willing to make a donation to CIA that would be great.

I included Mealer and Cagle for post-election inclusion mostly out of curiosity. Jack Morman did not have a report filed or I’d have included him as well. Cagle’s July report showed over a million bucks on hand. Life comes at you fast. (Except for Steve Radack, who still has a nice chunk of change in his account.) On the other side of that, you can see that Judge Hidalgo left it all on the field. She’ll have plenty of time to build that treasury back up; she did a pretty good job of that this cycle, so I’d expect to see her total tick up in short order. I didn’t look closely at new Commissioner Briones’ report, but I’d bet a nice lunch that a substantial chunk of her cash arrived after the election. It’s good to be a Commissioner.

I don’t think I’ve seen reports for District Attorney on the county election site before. DA is technically a state office – for smaller counties, the DA can cover several of them at once – so I’d normally expect to see them on the Texas Ethics Commission site. Not that I’m complaining. I figure it’s just a matter of time before incumbent DA draws a primary challenger or two, so we’ll want to keep an eye on her fundraising totals. Nothing else of great interest in this group – I’d expect both Ed Gonzalez and Christian Menefee to start posting bigger numbers soon. As for Joe Danna, is there ever a time when he isn’t running for Sheriff?

I don’t know if we will get Constable/JP redistricting, but there are always some interesting primary contests here, and even with the same maps we could have interesting November races in Precincts 4 and 5. Along those lines, I note two potential future Constable candidates: Don Dinh, a Deputy Constable in Precinct 1 since 2020 who was for 24 years before that a sergeant in the Fort Bend County Precinct 2 Constable’s office, filed a designation of treasurer to run for Constable in Precinct 5. I’m going to guess he’d run as a Democrat, but I can’t say for sure at this time. A William Wagner, about whom I could find nothing, filed the same for Constable in Precinct 7. He would almost surely run as a Dem in this heavily Democratic precinct.

Oh, and the second place where there might be a Democratic primary fight worth watching is in Precinct 1. Alan Rosen had his eye on the Sheriff’s office back when Ed Gonzalez was a nominee for head of ICE, but that’s off the table now. He may or may not seek to run for something else – do remember that the minute he says something to that effect he’ll have to resign, so all we would have before then is speculation – but either way I won’t be surprised to see some competition for the Precinct 1 slot. One of his top staffers ran against Judge Hidalgo in the 2022 Dem primary, and I imagine there will be some kind of response to that. That would not be a cheap race as things stand now, as you can see.

Not much else to say at this time for 2024, but I will note that at least some of the Democratic judges whose election is being challenged by a sore loser are raising funds for their legal defense. If you have a favorite or two among them and a few bucks to spare, I’m sure they’d appreciate a contribution.

Precinct analysis: Inside and out of the city

Most years we don’t get the data to differentiate between votes cast by residents of Houston and votes cast by Harris County non-Houston residents. There needs to be a citywide referendum of the ballot in order to get at this data. Fortunately, we had that this year, so we can take a look at how the races of interest shaped up. The usual caveat applies here, which is that this data is not exact. There are multiple precincts that are partially in Houston and partially not in Houston. Many of them have a tiny number of Houston-specific votes in them, with a much larger contingent of non-Houston votes. Counting these as Houston precincts means you wind up with a lot more total votes in Houston than were cast in the referenda elections, and gives you a distorted picture of the candidate percentages. I filter out precincts with ten or fewer votes cast in the Houston proposition elections, which is arbitrary and still yields more total votes than in the prop races themselves, but it’s close enough for these purposes. So with all that preamble, here’s the data:

To be clear about what this data shows, Beto won the city of Houston by a margin of 317,736 to 175,533, or 63.43% to 35.04%, while Greg Abbott carried the non-Houston parts of the county 314,728 to 277,917. This is about 493K ballots cast for those two candidates, which doesn’t count third party and write-in candidates or undervotes; I didn’t tally them all up but we’d be at around 510K total ballots defined as being “Houston”. In actuality, there were 486K total ballots cast, including undervotes, in the city prop races. Like I said, this is plenty good enough for these purposes.

As noted, I don’t have a whole lot of data for this from previous elections, but what I do have can be found in these posts:

There were city propositions in 2010, for red light cameras and ReNew Houston, but I didn’t do the same city-versus-not-city comparisons that year, almost certainly because 2010 was such a miserable year and I just didn’t want to spend any more time thinking about it than I had to.

Looking back at those earlier years, Beto fell short of the top performers in Houston, which in 2008 and 2012 was Adrian Garcia and which in 2018 was himself, but he did better in non-Houston Harris County. That’s consistent with what I’ve said before about how Democrats have overall grown their vote in the former strong Republican areas, while falling short on turnout – this year, at least – in the strong Democratic areas. Note how even the lowest scorers this year exceeded Obama’s performance in non-Houston by three or four points in 2008 and four or five points in 2012, while doing about as well in Houston. As I’ve said, Harris County is more Democratic now. This is another way of illustrating that.

No third party candidates here, just a write-in who got a handful of votes for County Judge, so the percentages mostly add up to 100. More or less the same story here, with the distinction between Houston and not-Houston being smaller than in prior years. There won’t be any citywide propositions in 2024, not if we have them this coming November, but I’ll try to use the precinct data I have here to analyze that election. In what should be a stronger Democratic year, I’ll be very interested to see how things change. As always, let me know if you have any questions.

County races appear towards the bottom of the ballot, after all of the federal and state races. With the exception of County Judge, which is the first county office to appear, the other county races come after any county judicial elections, which we know in a non-presidential year is another two dozen, on top of all of the state judicial races you’ve just slogged through. In addition, unlike Presidential years when higher profile county offices like Sheriff and County Attorney and Tax Assessor appear (District Attorney is a state office), the ones on this ballot are low profile and mostly clerical in nature. You’d think this would be a recipe for a lot of indifference, but you’d be wrong.

Despite appearing so much lower on the ballot, the per-district vote totals in these races are about the same for the two major parties. They’re lower overall because there are no third party candidates in these races, and that lack of mostly Libertarians does seem to be better for the Republicans than the Democrats. Not enough to swing any individual district – only the two swing Commissioners Court precincts are that close to begin with, and the Dems prevailed in all three races here anyway.

The simple fact is that despite the lack of straight-ticket voting, and the often-complained-about length of the ballot, people voted to the bottom of it anyway. There were more people who skipped these races than did so for Railroad Commissioner, the last of the statewide executive offices, but not that much more. About 40K people on average skipped these three races, compared with a bit less than 23K for RRC. That looks like a significant difference, but it’s still less than four percent of the total turnout. Putting it another way, more than 96% of the people who cast a ballot in November of 2022 cast a ballot in these three races.

That is slightly less than it was in 2018, the last year of straight ticket voting, when nearly 97% of the people who voted cast ballots in these races, plus the two countywide HCDE races; to put it another way, the undervote rate in these races was generally between 2.5 and 3 percent. Some people will skip races that are not of interest to them, I will absolutely stipulate to that. I’m just saying it’s not as much as you might think.

Two more things: One is that the undervote rate was higher in judicial races. I’ll go into more detail on those in subsequent posts, but even there it topped out at about five percent. I’m here to tell you, because I’ve looked at this before, the undervote rate in City Council races is much higher than that, and that’s a much shorter ballot. The other thing, and this may be my favorite bit of data from this election, is that there were about 800 more votes in the Treasurer race than there were in the County Clerk race, which was immediately before the Treasurer’s race on the ballot. Carla Wyatt, the Treasurer-elect, won more than 60% of those 800+ extra votes. Why did those eight hundred and some people vote in the Treasurer’s race but not the County Clerk’s race? I have no idea. But they did, and finding little oddities like that always delights me. I hope it at least amuses you. Let me know if you have any questions.

Endorsement watch: I had totally forgotten who her opponent is

The Chron endorses Teneshia Hudspeth for a full term as Harris County Clerk.

As the parent of a young child, Teneshia Hudspeth is familiar with the back-to-school rush for documents, including birth certificates. For families without reliable internet access, that might be more of a challenge than usual. And a trip to the county clerk’s office often means taking off work. So, as Harris County Clerk, Hudspeth helped launch an event in 2021 that let parents and guardians come in on a Saturday to get birth certificates at select offices.

“There were hundreds and hundreds of families who needed this service,” she told the editorial board.

She’s continued the event this year, partnering with local organizations that helped cover the costs of the documents for families that needed it and supplied backpacks. Her office added a service that allows people to order a birth certificate online.

These are the small things that a county clerk’s office can do to improve life and ensure that people are getting their needs met by an office that few residents likely understand well.

With a full term, Hudspeth will be able to seamlessly continue her efforts to make the office more responsive and accessible to all of Harris County.

Under her watch, the office has digitized thousands of marriage license records, prepared an estate-planning virtual series launching this month, added digital monitors in the courts with information in Spanish and English and overseen upgrades to the annex offices, some of which were begun before her tenure.

Among future plans: an e-certification program, an update to marriage license that will allow couples to add their photographs, and more outreach efforts.

In between is a discussion of the former role that the County Clerk played in running elections. That includes a mention of Stan Stanart, the deservedly former Clerk who is running for his old job and wants to do the election-running thing again. However you judge Stanart as the elected official in charge of elections, know that it was Teneshia Hudspeth doing the real work behind the scenes while he was spending a bunch of money on iPads he never deployed. As the headline indicates, the fact that Stanart is on the ballot just doesn’t stick in my mind – I confront that fact when I do campaign finance roundups, and now as I read this endorsement piece, and in an hour or so it will have flitted right back out of my memory again. This is a happy place for me to be. Please don’t ruin it. Vote for Teneshia Hudspeth, for the betterment of the Clerk’s office and my peace of mind.

On the B-side, the Chron endorsed their first Republican of the cycle, giving the nod to Morgan Luttrell in CD08, a district that unlike some others can reasonably be described as “bright red”. As noted, it is somewhat less crimson now than it was before redistricting, but the voters to shore up Dan Crenshaw and Mike McCaul have to come from somewhere and it’s those “bright red” districts like CD08 that are the obvious source. A longtime employee of the Clerk’s office before winning a special election in 2020 to finish out the term after Diane Trautman stepped down, Hudspeth is now one of five members of the Harris County Elections Commission, with oversight over the office of the Elections Administrator. We obviously talked about that, and about all of the things she is doing with the non-elections parts of the Clerk’s office, which is a quite a lot. July 2022 campaign finance reports: Harris County

Happy Mid-Year Campaign Finance Reporting Day to all who celebrate. Today we’ll be looking at the races of interest in Harris County, which thankfully for me has a lot fewer candidates to review than the last time we did this in January, before the primaries. I also did this roundup in July 2021 if you want to go that far back. You know the drill here, so let’s get to it.

With the much-smaller field of candidates now that we are fully past the primaries, everyone who is on the November ballot in these races has a current finance report online. Note that for some candidates, the report covers the period from February 20 through June 30 – these are the candidates who won their March primaries outright – and for some it covers the period from May 15 through June 30. These are the candidates who had to win in their runoff, a list that includes Alexandra Mealer, Jack Morman, and Lesley Briones. Mealer’s amount raised total is a lot more competitive with Judge Lina Hidalgo’s given the smaller amount of time that her report covers, but as John Coby points out, she got more than half of that total from four donors who each gave her $100K.

It’s interesting to me that Morman, who was a County Commissioner for eight years before Commissioner Garcia nipped him in 2018, has had such anemic fundraising. I’m not sure what that says, other than maybe not enough people think he can win. Lesley Briones still has a significant cash deficit against Commissioner Jack Cagle, but she’s been considerably more proficient at fundraising. She is unlikely to catch up to him in that department, but she’ll be more competitive.

Not much else to say, as the other offices tend to have little fundraising capacity, and these reports present no surprises. Eric Dick also filed a report for his current office of HCDE Trustee, in which he again reported zeroes across the board. Given Dick’s past propensities, I wouldn’t take any of that as gospel, but it is what he reported.

We have a new Election Administrator

Harris County’s election commission today named Clifford D. Tatum the county’s next Elections Administrator. He is scheduled to take over from interim EA, Beth Stevens.

Mr. Tatum is the chief information security officer for the DC Board of Elections in Washington, D.C. He brings 16 years of election experience to the EA position.

He holds a bachelor’s degree in Administration of Justice from Guilford College and a Juris Doctorate from Western Michigan University’s Thomas M. Cooley Law School in Lansing.

In response to the selection, Harris County Democratic Party Chair Odus Evbagharu issued the following statement:

“Following a nationwide search, the election commission is thrilled to select Clifford D. Tatum as the county’s new elections administrator.

“The commission worked well together to reach our decision, and Mr. Tatum was unanimously selected in a 5-0 vote.

“Mr. Tatum has an impressive background in leading elections — currently with the DC Board of Elections and prior to that as general counsel for the U.S. Election Assistance Commission. We are excited to bring him on board.

“Mr. Tatum’s elections experience — combined with a background in information security and elections law — make him perfectly suited for the Elections Administrator position, and we look forward to welcoming him to Harris County.”

As of 5:30 PM when I draft this, I’ve not seen a news story yet, though there’s this tweet from Judge Hidalgo saying that his hiring was unanimous. I’m sure there will be some coverage shortly. In the meantime, the Google machine found this biography for Cliff Tatum from the US Election Assistance Commission, and this WaPo story from 2011 about Tatum taking over as the head of the DC Board of Elections. He sounds like a solid hire, and he certainly has the background and experience you’d want for the person taking this job, especially with the next election looming. I’m sure we’ll learn more about him soon. In the meantime, welcome to Houston, Clifford Tatum.

UPDATE: And here’s the Chron story, which doesn’t have much in the way of new information but which does remind us that “Tatum’s appointment will be confirmed in a vote at a later meeting pending a background check and after he meets a residency requirement to become a voter under the Texas Election Code”.

Still no new Election Administrator

C’mon, y’all.

Harris County officials canceled an election commission meeting for the second time this week, again citing a lack of quorum because only two members were able to attend in person. The rescheduled meeting now is set for Tuesday.

Harris County Judge Lina Hidalgo, one of five members of the commission, announced Sunday evening that she had tested positive for COVID-19.

When they meet, members of the county’s election commission are expected to pick a new official to run elections, as outgoing Harris County Elections Administrator Isabel Longoria’s resignation went into effect Friday.

At their most recent meeting on June 15, members of the commission narrowed their search to two finalists. Both candidates live outside Texas and have previous election experience, according to Hidalgo.

Again, I would like to know who (besides the presumably still-testing-positive Judge Hidalgo) was unable to attend and why, and I would like to know when we might reasonably expect the next meeting to occur. We may be at risk of losing out on one or both of these candidates if we don’t move forward, and that would be a catastrophe. I want to see this done by the end of next week. Please!

No new election admin yet

Hope this delay is brief.

Harris County’s top election position remains unfilled, after a Monday meeting of the county’s election commission to select a candidate was canceled due to a lack of quorum. Their final pick will face a narrowing time frame to prepare for his or her first test: Early voting for the November election begins Oct. 24, less than three months after the new administrator’s likely start date.

The tight schedule adds to an already daunting job in a sprawling county with more than 2.5 million voters, an adversarial political climate with frequent election lawsuits, and a startlingly high rejection rate of nearly one out of five mail ballots in this year’s March primaries under the state’s new voting laws.

Only two of the five members of the commission were able to attend the Monday meeting in person, a day after County Judge Lina Hidalgo announced she had tested positive for COVID-19. The commission has not yet rescheduled the meeting.

With outgoing Harris County Elections Administrator Isabel Longoria’s resignation going into effect Friday, Beth Stevens, chief director of voting for the county, will become the interim administrator until the new hire begins, which Harris County Judge Lina Hidalgo said is likely to be Aug. 1. The new administrator’s appointment will be voted on at a later meeting after the selected candidate meets a residency requirement to become a voter under the Texas Election Code.

The commission was slated to hold a closed-door executive session to interview two finalists for the position and take “possible action” to name the administrator at Monday’s meeting. Both finalists have prior experience running elections and are located out of state, according to Hidalgo.

See here for some background. I agree with Campos, it would have been nice to know who besides Judge Hidalgo (who had a perfectly good excuse) didn’t show up and why. May have been valid reasons, but the clock is ticking and we deserve to know. I get the impression that there’s no real dissension on the committee, they just need to finish the job.

The target date to have the new admin in place is still August 1. That’s a brief time to get up and running, but if they are hiring an experienced person and the operational staff is in place – and hopefully we have a way forward on the ballot collection question for Election Day – then I think we’ll be fine. So with that in mind, let me comment on this:

At the commission’s most recent meeting on June 15, Rob Icsezen, deputy chair of the Harris County Democratic Party’s primary committee, presented a letter to the commission signed by around 100 members of the public, many of them current or former Democratic election workers, asking that Longoria be reinstated as elections administrator. One of the reasons they cited was the time frame left until the November election.

“Any new elections administrator would have the same challenges as Ms. Longoria, without the benefit of a year and a half of hands-on experience,” the letter stated. “In short, they would be starting from scratch. November is rapidly approaching. The voters of Harris County do not have time for this.”

This will not be the first time an administrator has overseen a major Harris County election on relatively short notice. In June 2020, Chris Hollins took over as county clerk shortly before the November election, after outgoing clerk Diane Trautman resigned her position, citing health concerns during the pandemic.

“On my first day as County Clerk in 2020, we had just four months to figure out how to administer an election in pandemic conditions for the first time in Texas history,” Hollins said in a statement. “That included acquiring the necessary protective equipment, recruiting the election workers we needed, and creating and training our team on new safety procedures.”

Hollins benefited from an unprecedented budget to administer the 2020 election, after Commissioners Court approved $27 million — much of that coming from federal CARES Act dollars — to fund his plan, which included additional polling locations, up to 12,000 election workers and an extra week of early voting.

“Many core planning items (e.g., number and location of voting centers) should be well under way by August, but the new EA will need to ensure that solutions are in place for issues that have arisen in recent elections, as well as problems created by the recent voter suppression law,” Hollins said. “These include record rejection rates for mail ballots, which we saw in March, and intentional disruption by partisan poll watchers, which will be something we face for the first time in November.”

I was contacted by Icsezen and a couple of other folks, all people I respect, with this pitch. I did not join them. I like Isabel Longoria and I totally get where Icsezen and the others are coming from, but I just think that ship has sailed. It didn’t work out. That’s unfortunate, but it is what it is. Let’s get the new person in there, give that person all of the support and financing they will need to run a successful election, and do everything we can to help. At least COVID ought to be a much smaller issue this time around. We can do this.

We have finalists for the Election Administrator job

Good.

The director of voting for Harris County will become the interim elections administrator, officials said Wednesday as the county elections commission narrowed its search for the permanent job to two candidates.

Following a closed-door executive session of the Harris County Elections Commission, County Judge Lina Hidalgo said both candidates live outside Texas and have previous election experience. The commission will schedule another meeting to make its choice to replace Isabel Longoria, the outgoing elections administrator whose resignation takes effect July 1.

In the meantime, Beth Stevens, chief director of voting for the county, will become the interim elections administrator until the new hire begins, which Hidalgo said is likely to be on Aug. 1.

That will give Longoria’s replacement less than three months to prepare for his or her first test: early voting for the November election begins Oct. 24. The fall ballot will include several high-profile state and local races, including those for governor, attorney general and Harris County judge.

It would have been nice for this person to have a longer runway, or a lower-profile election in which to get themselves acclimated, but this is the hand we’re playing. I certainly hope that whoever these folks are, they have a lot of experience doing this job. They’re going to need to change the narrative about how elections are run in Harris County, sort out the best way to collect and transport election night returns (at last report, the Supreme Court has still not issued any ruling on that writ of mandamus the local Republicans filed), and probably deal with a slavering horde of Republican poll-watchers in November. Godspeed and keep a stiff upper lip, whoever you are.

Actually, May Election Day vote reporting was basically fine

This headline is correct, but it leaves out some relevant details.

Even with help from constable’s offices, Harris County again was the last of the state’s largest counties to finish counting Saturday’s election results, turning its final tally to the Texas Secretary of State’s office after 9:30 Sunday morning.

In a move touted by the Harris County Elections Administrator’s Office, constable deputies picked up ballot boxes from the 465 polling locations on Election Day and delivered them to the county’s central counting station. Typically, that responsibility has fallen to election judges, the final task at the end of their 15-hour day. Even with deputies taking over delivery duties, results from Harris County slowly trickled in hours after other big Texas counties had reported their tallies.

Dallas County and Tarrant County sent complete results to the state shortly after midnight, while Harris County’s results came in around 9:37 am on Sunday, according to the Texas Secretary of State’s office. With hundreds of polling locations spread out over 1,700 square miles, the state’s most populous county has a history of delayed election returns.

Outgoing Elections Administrator Isabel Longoria announced her resignation following a botched March primary election. The county took 30 hours to finish counting and then two days later announced it found 10,000 ballots that had not been included in its final vote count. Longoria took the blame for the miscues and resigned days later. Her resignation takes effect July 1.

The Harris County Election Board — consisting of Harris County Judge Lina Hidalgo, District Clerk Marilyn Burgess, Tax Assessor-Collector Ann Harris Bennett and the heads of the county Democratic and Republican parties — voted last month to hire a national search firm to find Longoria’s replacement.

Deputy constables have picked up and delivered ballot boxes during early voting in previous elections, but this time they delivered ballot boxes on Election Day, as well. Nadia Hakim, a spokesperson for the Elections Administrator’s Office, said the constables also will assist with the primary runoff election set for May 24.

The county’s elections office boosted its staff on Election Day by bringing in employees from most constable’s offices, along with Harris County employees across several divisions who were available to help, Hakim said. The process, she said, went smoothly.

Asked why the county was the last to report results, Hakim noted Harris County still was within the 24-hour deadline for reporting results to the state, and said there was no issue. Harris County is the third largest county in the country, she added.

Here’s the thing: The Elections Office was updating its results every hour on the hour Saturday night. I know this because I get an email from that office every time there are new results, and I have an email from them with those updated results every hour from 7 PM when the EV totals were posted up until 3 AM, when 95% of the results were in. Maybe that’s slower than you want – as of the midnight report, only about a third of the votes had been counted – but as someone who has spent many an hour by the computer hitting Refresh on the browser, it’s the lack of updates, and the unpredictability of when the next one will arrive, that truly drives us up the wall. This might have felt drawn out, but at least you knew when to check again.

Can we do better than this? I think we can certainly try, and I would hope that whoever the Election Board hires in July will have some solid ideas for how to achieve that. Until then, getting updates on a regular schedule will help most of us keep our blood pressure under control.

The Harris County Election Board on Tuesday voted to accept Elections Administrator Isabel Longoria’s resignation and hire a national search firm to find a replacement, two weeks after the five-member panel could only agree to adjourn without taking any action.

Harris County Judge Lina Hidalgo, who chairs the election board, said the county would post the job Tuesday, as well as review applications submitted when the elections administrator job was created in 2020. Before then, elections in Harris County were managed by the county clerk’s office, while the tax assessor-collector’s office handled voter registration and maintained the voter rolls.

“I think it bodes well that the body has worked well together,” Hidalgo said afterward.

The board, which at times sparred over election procedures and replacing Longoria, approved the county administration’s preferred search firm and settled on the job description the firm will circulate and the timeline to have a new elections chief in place by July.

The steps taken were the first since an April 6 meeting ended with nothing achieved after members balked at proceeding with a a search before they formally had accepted Longoria’s resignation. Though she announced her intent to resign after the botched March primary, the election board had — until Tuesday morning — never accepted it.

Hidalgo had defended leaving Longoria in place through the upcoming election, saying officials needed to efficiently find a permanent replacement by mid-year and not try to transition to an interim leader and then into a second permanent person.

“I am afraid if we have another transition it will complicate things,” she said.

As a compromise, the board agreed to a change in its timeline by [Republican Party Chair Cindy] Siegel to meet by June 30 to appoint a permanent administrator or an interim replacement, assuring Longoria would not last into July.

“I just want to make sure we are not artificially boxing ourselves in,” Siegel said.

I think it’s fine to not want to have an interim administrator in place for the May elections, and it’s also fine to want to ensure that we have closed the books on Longoria’s term by July 1. It would be nice to have the next administrator in place by then, but I’d rather we get it right than we get it done quickly. There’s plenty to learn from the last couple of years’ experience, and I hope that whoever comes in fully avails themselves of that opportunity.

If you don’t see a linked report for someone, it’s because there wasn’t one I could find on the harrisvotes.com page. The information I have here is current as of last night. It’s possible someone could still file a report, these things do happen, but I wouldn’t expect much from anyone who hasn’t by now.

There are items of greater substance to discuss, but I can’t help myself: Naoufal Houjami was a candidate for Mayor in 2019 – if you don’t remember him, it’s probably because he got a total of 565 votes, for 0.2%, finishing last in the field. He has filed a finance report as a candidate for Harris County Judge, but he is not listed as a candidate for either primary, according to the Secretary of State’s Qualified Candidates page. (The Harris County GOP candidates page doesn’t have him, either.) The first two pictures I saw on his webpage were one with him and Greg Abbott, and one with him and Sheila Jackson Lee. Go figure. He is fully supporting his friend George P. Bush for Attorney General, so you make the call. This is way more than you ever needed to know about Naoufal Houjami.

Anyway. Barring an unlikely late and lucrative report from Georgia Provost, who wasn’t much of a fundraiser as a City Council candidate, incumbent Judge Lina Hidalgo outraised all of the other candidates for that position combined. Erica Davis claimed $70K raised on the summary page of her report but just $50K on the subtotals page – I suspect the $70K number was a typo. She had six total donors listed, two of whom gave $25K each, one who gave $196, and the others gave $19.12 apiece. Vidal Martinez was the other big fundraiser, though as John Coby notes, almost 70% of his donations came from 14 people who each ponied up at least $10K. For sure, it’s all green, but that’s not exactly grassroots support. As for Alexandra Mealer, I’d been wondering about her because I’ve seen multiple signs for her in my very Democratic neighborhood. Turns out she’s also my neighbor, now living in one of the historic houses. That explains a lot.

I included the two Commissioners who are not on the ballot just as a point of comparison. Adrian Garcia is obviously well-equipped for battle. George Risner presumably had a few bucks in his account from his time as a Justice of the Peace, but his candidacy for Commissioner does not seem to have drawn much support so far. Jack Morman also had some coin still in his bank and drew more support on his attempt to come back, but he’s nowhere close to Garcia. For Precinct 4, Jack Cagle raised a reasonable amount, though as you can see not an earth-shaking total, with Lesley Briones coming close to him. He has a tidy sum in his treasury, but it’s less than what he had in July thanks to how much he spent. Gina Calanni didn’t raise much – to be fair, there isn’t that much time between the filing deadline and the finance reporting deadline – but her report showed $40K in pledges, which are noted as transfers from her State House campaign account.

None of the other offices tend to raise much. Chris Daniel has a personal report as well as the SPAC report. The non-SPAC account reported no money raised and $1,151 in expenditures.

Finally, someone named Stephen Kusner filed a finance report for Treasurer in July but is not on either ballot and has no report for January. I’m just making a note of that here in case anyone who looked at my July summary is wondering what happened to him.

The filings I’m still looking for

Today is Filing Deadline Day. By the end of today, we’ll know who is and isn’t running for what. While we wait for that, let’s review the filings that have not yet happened, to see what mysteries may remain.

Congress: Most of the potentially competitive districts have Democratic candidates in them. The ones that remain are CDs 22, 26, 31, and 38, though I have been told there is a candidate lined up for that latter slot. Of the rest, CD22 would be the biggest miss if no one files. I have to think someone will, but we’ll know soon enough.

For open seats, CD15 has five candidates so far, none of whom are familiar to me. CD30 has six candidates, with State Rep. Jasmine Crockett receiving the endorsement of outgoing Rep. Eddie Bernice Johnson. CD34 has six, with current CD15 Rep. Vicente Gonzalez the presumed favorite. CD35 has three serious contenders – Austin City Council member Greg Casar, former San Antonio City Council Member Rebecca Viagran, and State Rep. Eddie Rodrigues – and one person you’ve not heard of. CD37 has Rep. Lloyd Doggett and former CD31 candidate Donna Imam, in addition to a couple of low-profile hopefuls, but it will not have former CD25 candidate Julie Oliver, who has said she will not run.

Democratic incumbents who have primary challengers include Rep. Lizzie Fletcher in CD07 (I’m still waiting to see if Centrell Reed makes some kind of announcement); Rep. Veronica Escobar in CD16 (I don’t get the sense her challenger is a serious one); and Rep. Henry Cuellar in CD28, who gets a rematch with Jessica Cisneros, who came close to beating him last year. The Svitek spreadsheet lists some dude as a potential challenger in CD18 against Rep. Sheila Jackson Lee, but so far no filing. Reps. Al Green, Joaquin Castro, Sylvia Garcia, Colin Allred, and Marc Veasey do not appear to have any challengers as of this morning.

Statewide: Pretty much everyone who has said they are a candidate has filed. Frequent candidate Michael Cooper and someone named Innocencio Barrientez have filed for Governor, making it a four-candidate field. Two Harris County district court judges, Julia Maldonado and Robert Johnson, have filed for slots on the Supreme Court and CCA, respectively. The Svitek spreadsheet lists potential but not yet filed contenders for two other Supreme Court positions but has no listings for CCA. The one potential candidate who has not yet taken action is Carla Brailey, who may or may not file for Lt. Governor.

SBOE: As this is a post-redistricting year, all SBOE seats are on the ballot, as are all State Senate seats. Dems have four reasonable challenge opportunities: Michelle Palmer is running again in SBOE6, Jonathan Cocks switched from the Land Commissioner race to file in SBOE8, Alex Cornwallis is in SBOE12, and then there’s whatever is happening in SBOE11. The good news is that DC Caldwell has company in the primary, if he is actually allowed to run in it, as Luis Sifuentes is also running. I would advise voting for Sifuentes.

There are two open Democratic seats, plus one that I’m not sure about. Ruben Cortez in SBOE2 and Lawrence Allen in SBOE4 are running for HDs 37 and 26, respectively. There are two candidates in 2 and three candidates in 4, so far. Georgina Perez is the incumbent in SBOE1 but as yet has not filed. If she has announced that she’s not running, I have not seen it. There is a candidate named Melissa Ortega in the race.

In SBOE5, the district that was flipped by Rebecca Bell-Metereau in 2020 and was subsequently made more Democratic in redistricting, we have the one primary challenge to an incumbent so far, as a candidate named Juan Juarez has filed against Bell-Metereau. I’m old enough to remember Marisa Perez coming out of nowhere to oust Michael Soto in 2012, so anything can happen here. The aforementioned Perez (now Marisa Perez-Diaz) and Aicha Davis are unopposed so far.

Senate: Nothing much here that you don’t already know. Every incumbent except Eddie Lucio has filed for re-election, and none of them have primary opponents so far. Lucio’s SD27 has the three challengers we knew about, Sara Stapleton-Barrera, State Rep. Alex Dominguez, and Morgan LaMantia. A candidate named Misty Bishop had filed for SD07, was rejected, and has since re-filed for SD04; I’m going to guess that residency issues were at play. There are Dem challengers in SD09 (Gwenn Burud, who has run for this office before) and SD17 (Miguel Gonzalez), but no one yet for SDs 07 or 08.

House: Here’s the list of potentially competitive districts, for some value of the word “competitive”. Now here’s a list of districts on that list that do not yet have a filed candidate:

I’m told there’s someone lined up for HD133. We’ll see about the rest.

All of the open seats have at least one candidate in them so far except for HD22, the seat now held by Joe Deshotel. There’s a name listed on the Svitek spreadsheet, so I assume that will be sorted by the end of the day.

Reps. Ron Reynolds (HD27), Ana-Maria Ramos (HD102), and Carl Sherman (HD109) are incumbents who have not yet filed. No one else has filed yet in those districts as well. Svitek has a note saying that Rep. Ramos has confirmed she will file; there are no notes for the other two. There is the possibility of a last-minute retirement, with a possibly preferred successor coming in at the same time.

Here is a complete list of Democratic House incumbents who face a primary challenge: Rep. Richard Raymond (HD42) and Rep. Alma Allen (HD131). Both have faced and turned away such opponents in the past. If there was supposed to be a wave of primary opponents to incumbents who came back early from Washington, they have not shown up yet.

Rep. James Talarico has moved from HD52 to the open HD50 after HD52 was made into a lean-Republican district. Rep. Claudia Ordaz-Perez, the incumbent in HD76, will run in HD79 against Rep. Art Fierro after HD76 was relocated from El Paso to Fort Bend.

Harris County: Again, nothing new here. Erica Davis has not yet filed for County Judge. County Clerk Teneshia Hudpseth is the only non-judicial incumbent without a primary opponent so far.

Far as I can tell, all of the county judicial slots have at least one filing in them, except for a couple of Justice of the Peace positions. George Risner, the JP in Precinct 2, Place 2 (all JP Place 2 slots are on the ballot this year) has not yet filed, amid rumors that he is mulling a challenge to Commissioner Adrian Garcia. Incumbent Angela Rodriguez in JP precinct 6 has not yet filed. No Dem challengers yet in precincts 4 or 8.

Other judicial races: Sorry, I don’t have the bandwidth for this right now. I’ll review it after today.

July 2021 campaign finance reports: Harris County

PREVIOUSLY: Congress

There will be plenty of crucial races in Harris County in 2022. Because of the Democratic sweep in 2018, all of the countywide offices are held by Dems, meaning this is the first non-Presidential year in which Democrats will be running for re-election. That also includes two of the three Democratic members of Commissioners Court, which obviously has played a huge role in Harris County politics these past two-plus years.

It’s early in the cycle, but that doesn’t mean that no one has an announced opponent. There are a few names out there that I hadn’t heard before I went looking. That’s another reason why these July-the-year-before rituals are worth doing – you never know what you’ll find. With that, let’s get started.

Probably a few names on there that you don’t recognize as well. Let’s take it from the top.

The big question surrounding County Judge Lina Hidalgo, now that she has officially announced her re-election bid, is whether she would draw a primary challenger. As we’ve discussed before, there are many reasons why someone might challenge Judge Hidalgo in the primary, none of which are directly related to the job she has done. One thing that may scare off potential rivals is a show of force in the fundraising department, which I’d say we have here. Hidalgo was not a big fundraiser in 2018, which is no surprise given she was running against a well-established incumbent and was a first-time candidate that was widely underestimated. She has stepped things up in the last year – as of July 2020, she had $371K on hand, after having raised $173K in that filing period. She wasn’t on the ballot, and surely didn’t want to compete with Dems who were, but still. She’s showing she can raise money with anyone, and she would start out in a primary with a big cash advantage. Maybe that scares off competitors and maybe it doesn’t, but it definitely sends a message.

I should note that if you search for campaign finance reports on the HarrisVotes website, and you sort by Office, you will see that there is another person listed for County Judge, Juanita Jackson. My first thought was that she is challenging Hidalgo next year, but I needed to double check that, because we have seen people whose intended office is actually one of the County Court benches be listed like this before. Indeed, it appears that Jackson is really running for Harris County Criminal Court #10 – the picture there matches the one on her Facebook page, and it appears she may have run for a similar position in 2010. I feel pretty confident she is not challenging Judge Hidalgo but the incumbent judge on that bench, Lee Harper Wilson.

Both of Hidalgo’s colleagues on Commissioners Court who are up in 2022 do appear to have opponents, though both are November challengers. Running against Commissioner Adrian Garcia in Precinct 2 is John Manlove, a former Mayor of Pasadena and a two-time Congressional candidate. He previously ran for CD22 in 2008 – he finished third, behind Shelley Sekula Gibbs and eventual winner Pete Olson – and for CD36 in 2014, following Steve Stockman’s switch to the Senate race – he finished third again, though this time much farther out of the money. Of his modest total, all but one donation was for at least $1,000, so this is not what you might call a grassroots movement. His report lists a $10,000 contribution to himself, and also a $10K loan – it’s on the Subtotals page, not the topline summary. I don’t know if the is an error is in how he filled out the form or if he double-counted that $10K. Not that big a deal, and he may file a corrected report, we’ll see. Garcia’s total speaks for itself and it’s what you’d expect from someone in his position.

The same can be said for Jack Cagle, who has been a Commissioner for longer than Garcia but who is (for now, at least) in a less competitive district. Remember, Commissioners Court will be redistricted as well, and we have no idea yet what that map will look like. Clarence Miller has been running for this position for awhile – I know I have spoken to him, maybe in early 2020, it must have been in person because I can’t find a written message. He doesn’t have a lot of cash to show for it yet, but he’s there and he’ll have an easier time of things when in person events begin happening with frequency again.

Teneshia Hudspeth was on the ballot in 2020 to complete the unexpired term of office that had been vacated when Diane Trautman resigned. She is now running for a full term and has no opponents as yet. Generally speaking, County Clerk is not a big fundraising office, so her totals here are perfectly normal.

The other two incumbents, both in their first terms, appear to have opponents. Desiree Broadnax looks like a primary opponent for District Clerk Marilyn Burgess, and according to her personal Facebook page, she works at the Harris County District Attorney’s office. I didn’t find anything for “Stephen Kusner” at first, until I made the obvious decision to look for Steve Kusner, and there I found the announcement of his candidacy. While I infer that Desiree Broadnax is a Democrat, it’s quite obvious that Steve Kusner will be running as a Republican. As with County Clerk, neither of these races draws much in the way of campaign contributions. Everyone will rise or fall more or less on the topline partisan vote in the county.

Finally, while I didn’t include them in the table above, there are two other reports of interest. As you know, I’ve been checking in on the finances of the late El Franco Lee, since there was over $3 million in his account at the time of his death. While there was a report in 2019 that “all campaign funds have been allocated for the El Franco Lee campaign account in accordance with the guidelines from the Texas Ethics Commission”, there still remains $900K in his account, with expenditures of just $1,000 over the past six months. The deadline for disposing of the rest of that is 2022.

The other report belongs to the now-retired Steve Radack, who remains with $1.1 million on hand. As with Lee, he can give it to other candidates or campaigns, the state or county Republican Party, the state treasury, a tax-exempt charity, a school or university for a scholarship program or as a refund to donors who gave in the final two years the candidate accepted contributions. He has a deadline of 2026 to do something with the funds.

So that’s what’s going on at the county level. I’ll take a look at the city of Houston – yes, I know, there are no municipal elections, but they can fundraise now and I like to check in – and HISD/HCC next. Let me know what you think.

We weren’t supposed to have a County Clerk race on the ballot in 2020, but we did following the health-related resignation of Diane Trautman in May. That gave us a battle of Stan Stanart, former County Clerk whom Trautman had deposed in 2018, and Teneshia Hudspeth, former chief elections person under Stanart. Hudspeth won easily, and though her 835K total votes were on the lower end for Democratic countywide candidates, her 53.76% of the vote was pretty close to Trautman’s 54.60% from two years before. The 2018 election was a non-Presidential year, with record turnout for such a contest, and the 2018 Clerk race also featured a Libertarian candidate, so comparisons are a bit tricky. My advice is to look at Hudspeth’s percentages compared to Trautman’s. Here’s the 2020 race:

I included undervotes in the county candidates’ analyses in 2018 because I was trying to analyze the effects of straight ticket voting as well. As I said, if you compare just the Democratic candidates’ percentages, you see that Hudspeth and Trautman had fairly similar performances, with the drops we have noted before in some of the Latino districts. Trautman knocked it out of the park in HD134, which was more Republican in 2018. Hudspeth had among the higher scores this year in HDs 131 and 141. I fully expect she’ll build on her performance in 2022, when she will be the incumbent running for re-election, though as always the first question is what will the national atmosphere look like.

Commissioners Court rejects Paxton allegation about Elections Administrator

The Democrats on Harris County Commissioners Court on Tuesday rejected an opinion from Texas Attorney General Ken Paxton in which he said they illegally created an independent elections office and hired an administrator.

The move invites a potential lawsuit from the attorney general, which Precinct 1 Commissioner Rodney Ellis said he was confident the county would win.

“This is another example of (Attorney) General Paxton using his office to attack the voting rights of Texans,” Ellis said.

He noted that Paxton sued to prevent counties from installing more than one drop box for mail-in ballots during this fall’s general election. The attorney general also convinced the Texas Supreme Court to block Harris County’s plan to send mail ballot applications to all 2.5 million registered voters. Paxton also had issued an opinion suggesting the county’s drive-thru voting arrangements violated the state election code.

In a written response to Paxton Tuesday, [County Attorney Vince] Ryan acknowledged that Harris County had not promptly informed the state of those actions. He said, however, that Texas law says the delays do not change their validity.

Harris County joined more than 100 other Texas counties in creating an independent elections office, which combines the election management role of the county clerk with the voter registration duties of the tax assessor-collector.

The three Democrats on Commissioners Court voted in favor of the change, arguing it is more efficient. The two Republicans were opposed, saying it created an administrator who is unaccountable to voters.

The court was similarly divided in Tuesday afternoon’s discussion. Democratic County Judge Lina Hidalgo dismissed Paxton’s threat as a distraction and said Longoria must be able to do her job.

Precinct 4 Commissioner Jack Cagle, a Republican, said Ellis’s criticism of Paxton was unfounded. The attorney general has a duty to ensure the law is followed, he said.

“When Paxton says we didn’t follow the rules, I don’t think there is some evil intent,” Cagle said.

See here for the background, and let’s put aside for the moment the laughable idea that Ken Paxton has any moral authority when it comes to telling people to obey the rules. I dismissed Paxton’s threats as mere bluster, but I’m an Internet smartass. There are no real consequences when I’m wrong about something. I certainly hope Vince Ryan is right about this – and as a side matter, I hope incoming County Attorney Christian Menefee was consulted and is on board with this, because it will be his mess to clean up if Ryan and the rest of us are wrong. I guess we’ll find out soon enough if we’re about to be dragged into a prolonged court battle, or if this was indeed just hot air. The Texas Signal and the Chron’s Erica Greider have more.

Paxton has a tantrum about the Harris County Election Administrator

Someone is going to have to help me understand this, because I’m clearly missing something.

Harris County failed to follow the Texas Election Code when it created an independent election administration office, rendering the office and the appointment of Isabel Longoria as administrator null and void, according to Attorney General Ken Paxton.

In a Nov. 25 letter to the county attorney’s office, Paxton said Harris County did not inform the secretary of state in a timely fashion, as required by law, when it created the new office in July and when an administrator was selected in October to run it.

“As a result, neither the Commissioners Court’s July 14, 2020 order nor the Election Commission’s October 30, 2020 appointment of (Isabel) Longoria to the position holds any legal weight,” Paxton wrote. “In short, the Harris County Office of Election Administrator does not exist.”

Longoria’s appointment should be rescinded, the attorney general said.

County Clerk Teneshia Hudspeth referred questions to County Judge Lina Hidalgo, who deferred to the County Attorney’s office. First Assistant County Attorney Robert Soard said all required documentation regarding the election administration office has been sent to the secretary of state.

“We feel confident that, after they review this, all misunderstandings will be cleared up,” Soard said.

Longoria said in a statement that the county attorney had advised her there were no procedural issues with the creation of her office; she will continue working.

The Election Code requires counties to inform the secretary of state within three days of creating an elections administration office. Within six days, it must inform the state of the appointment of an administrator.

Paxton said Harris County waited two weeks to inform the secretary of state it had created the elections administration office and three weeks to formally disclose the hiring of Longoria as administrator, a senior aide in the County Clerk’s Office.

Harris County must take “corrective action” within 14 days, the attorney general said, or the state may take the issue to court. Paxton did not respond to a question asking why his office did not address Harris County’s error in July.

County Attorney Vince Ryan placed an item on Tuesday’s Commissioners Court agenda to discuss the matter.

Here’s the relevant statutes relating to an Elections Administrator:

Sec. 31.031. CREATION OF POSITION. (a) The commissioners court by written order may create the position of county elections administrator for the county.

(b) The order must state the date the creation of the position of administrator is effective. The effective date may not be later than 12 months after the date the order is adopted.

(c) To facilitate the orderly transfer of duties on the effective date, the order may authorize the commissioners court to employ the administrator-designate not earlier than the 90th day before the effective date of the creation of the position, at a salary not to exceed that to be paid to the administrator.

(d) Not later than the third day after the date the order is adopted, the county clerk shall deliver a certified copy of the order to:

(1) the secretary of state; and

(2) each member of the county election commission.

Sec. 31.032. APPOINTMENT OF ADMINISTRATOR; COUNTY ELECTION COMMISSION. (a) The position of county elections administrator is filled by appointment of the county election commission, which consists of:

(1) the county judge, as chair;

(2) the county clerk, as vice chair;

(3) the county tax assessor-collector, as secretary; and

(4) the county chair of each political party that made nominations by primary election for the last general election for state and county officers preceding the date of the meeting at which the appointment is made.

(b) The affirmative vote of a majority of the commission’s membership is necessary for the appointment of an administrator.

(c) Each appointment must be evidenced by a written resolution or order signed by the number of commission members necessary to make the appointment. Not later than the third day after the date an administrator is appointed, the officer who presided at the meeting shall file a signed copy of the resolution or order with the county clerk. Not later than the third day after the date the copy is filed, the county clerk shall deliver a certified copy of the resolution or order to the secretary of state.

(d) The initial appointment may be made at any time after the adoption of the order creating the position.

The relevant sections relating to timing are highlighted in bold. As was noted in the comments to the Chron story, there’s nothing in the laws to say what happens if a county, for whatever the reason, fails to do the paperwork in a timely fashion. Saying that the appointment is null and void for being a few days late is to be the equivalent of saying that because there were a couple of precincts in Wayne County that didn’t exactly balance we need to throw out every vote in the county. I may not be a lawyer, but I can tell when the remedy doesn’t fit the alleged infraction. And if we’re going to be super-technical about it, then let Commissioners Court rescind and re-appoint Longoria today, and notify the Secretary of State later in the day via email, fax, Fed Ex, town crier, and unfurling a giant poster with Isabel Longoria’s picture on it outside the SOS office tomorrow morning. Will that suffice?

This part puzzles me even more:

Republican State Sen. Paul Bettencourt, R-Houston, a frequent critic of local Democrats, urged Commissioners Court to revoke Longoria’s appointment.

“Appointing an administrator of elections in the nation’s third largest county should have been made by following the prescribed legal process to the letter,” Bettencourt said in a statement. “The attorney general’s letter is specific that the duties of that office should be returned to the elected county clerk and tax assessor-collector.”

The dispute is the latest in a series of disagreements between Texas leaders and Harris County officials over how the state’s largest county runs its elections. Paxton and state Elections Director Keith Ingram see their actions as reigning in rogue local leaders; Hidalgo and county officials view them as unnecessary micromanagement.

I mean, we’re aware that all of the election innovation that made Ken Paxton and Paul Bettencourt SO MAD last month was done by the County Clerk, right? Not a non-partisan official whose bosses include the Chair of the Harris County GOP? I’m trying real hard here, but I fail to see what they think they’d be gaining by putting Teneshia Hudspeth in charge of running elections. Do they think she wouldn’t keep doing what she did while Chris Hollins and Diane Trautman were in charge? Have they forgotten that she’s an elected Democrat? Seriously, what is their angle here? I mean, other than being little pettifoggers with a grievance. Like I said up front, someone help me understand this one.

Endorsement watch: Well, he does have a big Twitter following

I’m honestly not surprised that the Chron endorsed Dan Crenshaw for re-election. I just wonder if the editorial board ever reads what they write when they come up with this stuff.

Sima Ladjevardian

U.S. Rep. Dan Crenshaw has 1 million Twitter followers. His fundraising power puts him within shouting distance of high-ranking members such as Steve Scalise, R-La., and House Speaker Nancy Pelosi. A former Navy SEAL, he has managed to appear both loyal and critical of President Trump, and was the only Texan elected official with a major speaking role at the Republican National Convention.

There’s no question of Crenshaw’s outsized national standing as a freshman congressman, but now his fate is in the hands of Houstonians in the 2nd Congressional District, which makes a wiggly westward arc from Kingwood to neighborhoods near Rice University.

Turn the stage lights off, though, and his race against Democrat Sima Ladjevardian, 54, looks rather conventional.

First, let’s consider what is unusual. Crenshaw, 36, has shown a penchant for standing up to party and president. He wrote a letter of support for the inclusion of Log Cabin Republicans, who represent LGBT conservatives, at the Republican Party of Texas’s state convention. He’s called for Republicans to take climate change seriously. When Trump criticized Sen. John McCain months after his death and when Trump told the liberal congresswomen in “the Squad” to “go back,” Crenshaw tweeted at the president to quit. When Trump withdrew troops from Syria, Crenshaw released a nearly 12-minute video that respectfully but emphatically rejects the president’s rationale.

We applaud Crenshaw for using his platform to take these stands. At other times, he has left us both troubled and disappointed. Like many others early in the pandemic, Crenshaw argued that masks weren’t effective against the coronavirus. While he changed his mind as evidence showed otherwise — even purchasing and then donating 50,000 masks — he continued to push misrepresentations, as he did in his more recent videos defending Trump’s coronavirus response. He was wrong to call Harris County Judge Lina Hidalgo’s mask order “draconian” and was wrong to remove his mask for long enough while at a crowded fundraising party to be photographed without it.

We’re also concerned that his positions on key issues for Houston, including how to confront climate change, aren’t far-seeing enough. He’s called renewable energy “silly” and has not embraced a carbon tax, something even many major oil companies are willing to accept. His positions on the border and on prescription drugs also disappoint.

And yet, it’s impossible to ignore Crenshaw’s star power and his potential to shape the future of the Republican Party around respect, ideas and principles.

In addition, if he retains his seat, Crenshaw is likely to wield the kind of power that matters on delivering funding for dredging, roads and floodgates. We believe voters should return him to Congress.

There are two obvious problems with this. One is that in every way that the Chron cites to support the notion that Crenshaw is some kind of independent-thinking maverick it’s all talk and no action on Crenshaw’s part. Can the Chron name one bill of significance where Crenshaw is teaming up with a Democrat, or one vote he has taken where he opposed the party line? To be fair, even tweeting a mild rebuke at Trump makes him stand apart from the Louie Gohmerts, but surely the bar can be set a little higher than that. To put this another way, what exactly has he done for the greater Houston area and its residents that a replacement level member of Congress couldn’t have done?

Which gets to the second point, the belief that Crenshaw will someday be a force for getting big things for Houston. Which, sure, could happen, but for at least the foreseeable future he’s going to be in the minority, where there’s much less power to be wielded. Compare Crenshaw’s record of accomplishment to Lizzie Fletcher’s to see what I mean. Yes, Congressional majorities are fleeting, and the whole idea of getting anything done is meaningless as long as the Republicans control the Senate, but this puts an awful lot of faith into a guy who’s so far been a total show horse. Remember when the Chron endorsed Ted Cruz in 2012 with the hope that some day he’d grow up to be like Kay Bailey Hutchison? This gives me a similar vibe.

I agree that Crenshaw is a rising star in the GOP, and that the exodus of experienced (mostly Republican) members of Congress from Texas has left the state with less clout than it once had. If one believes that Crenshaw is going places, then there’s reason to hitch a wagon to him and hope that he’ll eventually use his powers for good. Alternately, you could sign on with the candidate who actually agrees with the things you say you value. Maybe Sima Ladjevardian doesn’t quite have Crenshaw’s star power, but I’d put more money on her actually doing the work to get stuff done.

In other Congressional endorsements, the Chron also recommended Rep. Al Green, and Rep. Brian Babin. They also endorsed in the other two countywide races of note. For Tax Assessor, they went with Chrin Daniel, former District Clerk, over incumbent Ann Harris Bennett. I don’t have any issues with Chris Daniel. He was perfectly competent as District Clerk. I also think Ann Harris Bennett has been fine as Tax Assessor, and think she will continue to be fine. (I’ve had this overview story of the Tax Assessor’s race on one of my tabs for a couple of weeks now because I haven’t been able to think of anything more original than that to say.) But look, in the year 2020 if you are on the same ballot as Donald Trump as a Republican, that’s an indelible mark against you. There may come a time when that isn’t the case, but that time is not today. Also, until we get some Democratic power at the statewide level and in the Legislature, we really need a unified county government, because the Republicans who wield power in this state are coming for us, and we need everyone pulling in the same direction to protect our interests as a county. and an independent entity of government As someone once said, it is what it is.

Finally, they endorsed Teneshia Hudspeth for County Clerk.

Teneshia Hudspeth

Hudspeth, 39, is the Democratic candidate running against Republican Stan Stanart, who was the clerk until 2018, when he was unseated by Diane Trautman. With Trautman resigning over health concerns earlier this year, the winner will fulfill the remainder of her term.

Usually, Stanart’s experience would give him the edge, but Hudspeth is no stranger to the clerk’s office, having worked her way up over a 15-year career from an administrative assistant in public affairs to the chief deputy position. Her climb through the ranks has given her a ground-level view of many of the office’s responsibilities, she said, from voter outreach to records preservation and archiving.

That will come in handy as she continues the office’s modernization by upgrading technology and enhancing online services to reduce wait times and improve efficiency. She also wants to make some of the clerk’s services more widely available outside the office by partnering with community centers.

While the clerk will no longer be a direct elections administrator, the position comes with a seat on the county election commission, a role where Hudspeth’s experience will also be important.

“I will be able to sit on that commission and hold the elections administrator accountable,” she said.

While Stanart is as affable as ever, it was time for new blood in the clerk’s office when we endorsed his opponent in 2018 — his pledge to “stop socialist Democrats” didn’t boost our confidence in his judgment — and that need for change continues.

At least this time, they understood who the candidates were. Good call.

How many undervotes would it take?

This story about the race for County Clerk has broken me.

Teneshia Hudspeth

[Stan] Stanart has finished in line with the Republican straight-ticket vote in each of his three elections, winning the clerk seat in 2010 with 53 percent of the vote when Republicans won 54 percent of the countywide straight-ticket vote. In 2014, Stanart won with 54 percent, matching the Republican straight ticket. When Stanart lost his seat in 2018, he received 43 percent, running about a point below the Republican straight ticket.

This year, straight ticket voting has been eliminated statewide, adding a layer of uncertainty to what otherwise would be an all-but-impossible uphill climb for Stanart, Houston political analyst Nancy Sims said.

“We don’t really have any ability to predict voting behavior without straight-ticket voting,” Sims said. “I do think both candidates who are deeper in the ballot are going to face more challenges because people are less likely to know them. And I think none of the county races are a shoo-in with the lack of straight-ticket voting.”

Maybe I’ve obsessed too much over the straight ticket voting effect and what not having it may mean this year, but can we please at least try to think about this in terms of the actual numbers? I will once again use the judicial races as my proxy for partisan preferences. In 2016, the typical judicial race was roughly a 52-48 win for the Democratic candidate; there was some variation in there, from about 51-49 to 53.5-46.5, but 52-48 was close to the mark for the average. If we assume that the Clerk candidates would perform at basically the average partisan level of the county, then if every Republican voter goes all the way down the ballot, you will need more than seven percent of Democratic voters to stop voting before they got to this race for it to tip from Teneshia Hudspeth to Stan Stanart. If five percent of Republicans failed to vote in this race, you would need over twelve percent of Democrats to do likewise. If ten percent of Republicans undervoted for Clerk, seventeen percent of Democrats would have to do the same.

It’s even starker if we’re talking about a 2018 partisan context. In 2018, the average judicial race was 55-45 for the Democrat. Under those conditions, if every Republican votes in every race, more than eighteen percent of Democrats would have to miss this one to affect the outcome. If five percent of Republicans skip this race, 23% of Dems would have to do likewise. If it’s ten percent of Republicans undervoting, you’d need more than 26% of Dems to do the same. That’s the level of undervoting you get in Houston City Council At Large races, where nobody knows who most of the candidates are.

Is this plausible, or even possible? I don’t know. We’ve never had an election with no straight ticket voting before, so nobody knows what is possible or plausible or likely. I spilled many electrons following the 2018 campaign shooting down bad arguments about straight ticket voting, all of which are underpinned by the assumption that if Democrats couldn’t vote that way they would be at a big disadvantage because they’re so much more likely to not vote the full ballot. If you want to make that argument, then by all means, go ahead and make it. You may be right! I have no idea. But let’s be clear about what you are arguing, rather than vaguely waving in the direction of “well, not having straight ticket voting could be bad for Dems”.

One more thing: What is clear is that not having straight ticket voting will make it take longer to vote (even if those effects may be overstated), and that in turn may cause longer lines at polling places, which as we all know is a thing that disproportionately affects voters of color, who are the Democratic base. This effect is most closely felt in Harris County, which has so damn many judicial candidates on the ballot. Harris County, and County Clerk Chris Hollins, have taken a lot of steps to minimize this effect, with more mail voting, more voting locations, longer early voting hours, and so forth. (We have also seen how resilient Harris County voters have been, though they should never be put in that position.) We have no way of knowing what the longer-time-to-vote effect of not having the straight ticket option will be, but we do know that Chris Hollins and the Democrats on Commissioners Court have done their best to minimize it. To tie this back to the Clerk’s race, which is where this post started, it’s impossible to imagine Stan Stanart doing all this work to make it easier to vote in Harris County. Even with the move to an appointed elections administrator, that in itself would be enough to not vote for Stan Stanart.

And the nominees are…

Teneshia Hudspeth

Yesterday was the Harris County Democratic Party CEC meeting, at which the nominees for the two positions that needed them were filled. The easy one was the second one, where Teneshia Hudspeth was unanimously selected. The way this process works is that any potential candidates have to be nominated by one of the precinct chairs. (You could nominate yourself, if you are a precinct chair yourself – Nat West did this in 2016 for the Commissioners Court Precinct 1 nomination – but that did not apply here.) Gayle Mitchell had previously announced her intent to seek this nomination, but as far as I could tell, she was not on the Zoom call, and no one spoke to nominate her. I was one of three people to speak in favor of Hudspeth’s nomination – as I said on the call, I’ve known Teneshia Hudspeth for years via correspondence with the County Clerk’s office, and I have a high degree of confidence in her abilities. She now gets to beat Stan Stanart in November, and who doesn’t look forward to voting against Stan Stanart again? She will have a unique set of challenges, which look to include oversight of the new Elections Administrator’s office. We talked about that and more in this interview I did with her. The other position to fill was the nominee for HCDE Position 7, At Large. Andrea Duhon won the primary for that spot in March, but she had been appointed to fill the Position 4, Precinct 3 position in January following the resignation of Josh Flynn, who unsuccessfully sought the nomination in HD138. Three candidates were nominated for this position: David Brown, Obes Nwabara, and Jose Rivera, as was expected. Brown led the voting with 38%, followed by Nwabara with 35% and Rivera with 27%. The rules say that a majority is needed, so we went to a runoff, and there Brown prevailed with a 53-47 vote. The closeness of the vote was appropriate for a tough choice, as all three candidates were excellent and well-qualified. Brown, whose Q&A with me is here, now has the important job of knocking the ridiculous and execrable Don Sumners off the Board. Erica Davis is the nominee for Position 5, At Large, which is an open seat after fellow unqualified yahoo/all-around embarrassment Michael Wolfe decided to tun again for Justice of the Peace. Dems already have a majority on the HCDE Board now thanks to the appointment of Duhon, but this is a chance to take full control, and just make two huge upgrades in quality. Congratulations to David Brown, and I look forward to voting for you in November as well.

Interview with Teneshia Hudspeth

As you know, HCDP precinct chairs will be picking a nominee for Harris County Clerk, to run for Diane Trautman’s unexpired term. The leading candidate for this is Teneshia Hudspeth, who has worked in the Clerk’s office for fifteen years and has been a top lieutenant in the elections division. I’ve interacted with Teneshia multiple times over the years, and I plan to vote for her in my role as precinct chair. With the selection process coming up on August 15, I wanted to take the opportunity to interview her, so my fellow precinct chairs and everyone who’ll get to vote for her in November can get to know her a little better. The job of County Clerk will be different when she takes office thanks to the adoption of an elections administrator by Commissioners Court, and that made this interview a little weird for both of us, since my questions to Clerk candidates have usually been about election matters, and right now we don’t know exactly what that will mean going forward. But we persevered, and you can hear the result here:

The county races in which the precinct chairs get to pick the nominees

There are two Harris County races on the ballot this year – one that was always going to be there, and one that was unexpected – in which Democratic precinct chairs will have the task of picking the nominees. As you know, that group includes me, and we’ll be doing it on August 15, shortly before the deadline to finalize the ballot. Let me tell you what I now know about the people who have expressed interest in these races.

Teneshia Hudspeth

First up is Harris County Clerk, the race we didn’t expect to have on our ballot this year. As you know, Diane Trautman resigned in May for health reasons, and Chris Hollins was sworn in as an interim Clerk after being appointed by Commissioners Court. Trautman’s term ends in 2022, however, so someone will have to run in November to complete her term, and Hollins will not be running for the job. Two people so far have emerged for the position. One is Gayle Mitchell, who lost in the 2014 primary to Ann Harris Bennett for the County Clerk nomination. I saw her post about this on Facebook, but can’t find that post any more. She’s a nice lady – you can listen to the interview I did with her here – but I don’t have much more to say about her. I’ve not seen or heard anything from her since the 2014 primary.

On Monday this week, Jasper Scherer wrote on Twitter that Teneshia Hudspeth, the current chief deputy clerk, has announced her intention to run for the position; Marc Campos had previously noted that she had filed a designation of Treasurer. You can see her press release, sent on Tuesday, here. Hudspeth immediately drew support from Sen. Borris Miles, Council Member Tiffany Thomas, and apparently former Clerk Trautman, if I’m reading her press release correctly. I can imagine one or two people who could jump into this race that I’d have to seriously consider, but barring that possibility I fully expect to support Teneshia’s nomination. She’ll do a great job.

(UPDATE: Trautman has since sent out an email, which I received, endorsing Teneshia Hudpseth’s candidacy.)

The other race is for HCDE Trustee At Large, Position 7, the one where Andrea Duhon, who was appointed to fill out Josh Flynn’s term in Position 4 but was already on the ballot there, won outright in March. Despite my belief that she could not withdraw from the November race, apparently she could because here we are picking a replacement nominee. (See, this is why I always remind you that I Am Not A Lawyer.) I am aware of four people competing for this slot:

David Brown and Obes Nwabara, who also ran in the March primary and finished behind Duhon.

Sonja Marrett, whose candidacy was noted to me by Andrea Duhon, who has endorsed her.

Jose Rivera, husband of former Justice of the Peace candidate Tanya Makany-Rivera, about whom Stace wrote on Monday.

I had a chance to talk to Rivera over the weekend. I’m pretty sure I had a brief conversation with David Brown during the primary campaign, but that was eight million years ago, so who can remember. I do not believe I have spoken to Nwabara yet, and I do know that I have not spoken to Marrett. I do not at this time have a preferred candidate for this position. Honestly, they all look well-qualified.

I will probably do an interview with Teneshia Hudspeth after the runoff. I don’t know that I’ll have time to talk to the four HCDE candidates, but I may write up a Q&A for them. If you have any insight as to these folks, I’ll be glad to hear it. And now you know everything I know about these two races.

Have you missed having Stan Stanart to kick around?

Well then, I have good news for you.

Former Harris County Clerk Stan Stanart will run again for his old job, he confirmed Wednesday, joining two other Republicans seeking their party’s nomination for the November special election.

Incumbent clerk Diane Trautman, who defeated Stanart in 2018, announced she would resign May 31 because of undisclosed health concerns.

The Democratic and Republican parties must nominate candidates to fill the remaining two years of her term.

“I’ve got eight years’ experience, and the name ID necessary to win in November,” Stanart said in a phone call. “I’m calling precinct chairs and doing very well asking for their endorsement.”

Stanart’s announcement Wednesday was the result of a mix-up; he said he thought he was talking to a Harris County Republican Party precinct chair when a Houston Chronicle reporter called him. He said he had planned to go public with his candidacy next week.

The other Republican candidates to date are former Houston city councilman Bert Keller and former Harris County judicial candidate Michelle Fraga.

Emphasis mine. We’ve all missed that Stan Stanart touch around here, haven’t we? Not to mention the glorious headshot. I feel like he missed his calling as a spokesman for BrylCreem, but we must look forward from here.

Anyway. As the story notes, no Dems have publicly announced their interest in the nomination as yet. I expect Teneshia Hudspeth to throw her hat in the ring, but as yet I’ve heard nothing. I presume we’ll know more by the time of the next CEC meeting.

Meet your new County Clerk

Harris County Commissioners Court on Tuesday appointed an attorney and Texas Democratic Party official as interim county clerk.

Christopher Hollins, vice finance chairman for the state party, will serve until a new clerk can be elected in November. Incumbent Diane Trautman, who was elected in 2018, announced May 9 she would step down because of health issues.

The court voted 3-2 along party lines to approve Hollins. Five public speakers urged court members to choose Teneshia Hudspeth, Trautman’s chief deputy. County Judge Lina Hidalgo and Precinct 1 Commissioner Rodney Ellis said Hollins’ pledge to serve only on an interim basis factored in their decision.

Hollins was selected after 10 p.m., more than 12 hours after Commissioners Court convened, and was unavailable for comment.

He previously worked as a senior manager at the consulting firm McKinsey & Company and intern at Goldman Sachs and the White House Office of Presidential Personnel during the Obama administration, according to his personal website. He has never held elected office.

From skimming Facebook, the folks I read seem to be positive about him and his appointment. Clearly, the Commissioners wanted the Clerk to focus entirely on running the election and not running for their own election. That is certainly a reasonable position to take, and it means that we precinct chairs will get to pick a candidate of our choice. Fine by me.

Also mentioned in the story was Commissioner Ellis’ proposal about an appointed elections administrator, which was discussed but no action was taken. I saw somewhere that the Harris County Republican Party Chair was opposed to the idea, which is his right. My guess is that this is the end of it, but you never know.
